Retiree News (not good)

We don't understand all of it, but here is the letter from Krislov late last week just before the holiday:
  • Dear Participants,

    I am truly sorry and disappointed to report that the Illinois Supreme Court has denied our petition challenging the lower courts’ rulings on our complaint.

    While this might be viewed as only a ruling at the early stage of the case, it will certainly be treated by Judge Cohen as a vindication of his and Justice Simon’s declaration that the only protectable interest is what is stated in the statute.

    If that’s so, then the statute still requires the Funds trustees to provide a plan, and subsidize it; albeit at the 1983 and 1985 statutory levels.

    Since none of the Funds are “providing” a plan, it may be that Judge Cohen will now require them to do that. However, there is a fair likelihood that Judge Cohen will instead now back off that, to rule that the only obligation is for the Funds to subsidize your premiums for the $55/$21 (Police and Fire NonMedicare/Medicare)and $25 (municipal and laborers) monthly subsidy amounts for life, for everyone who was hired by mid-2003.

    I share our great disappointment at the Court’s not even bothering to give us a hearing on the City’s broken promises. I guess the message is you cannot rely on anything the City promises unless there is a statute requiring it.

    Since the court has not ruled on the related petition (dealing with the lower court’s refusal to certify the case to proceed for the class), there may be a basis to seek reconsideration of the denial of the petition. I don’t think that’s likely to be successful.

    At this point, we will be back before Judge Cohen on November 29th, asking him to order the Funds to actually do their jobs and provide you a plan (indeed, the County’s UHC retiree healthcare plan is much cheaper than the Blue Cross Plan being offered you, even for their Choice-Plus PPO), and subsidize it at least at the statutory rates. We’ll see how this all plays out, and we invite your comments and suggestions.

    We’ve devoted ourselves to this effort for you, and share your diminished confidence in the system’s fairness. And while many of you contributed to this effort, and the FOP and Retired Chicago Policemens Association contributed significantly, feel free to contact any of the rest of your unions to thank them for their lack of any help for us at all, especially the Firemen.

    And you might give your Funds’ trustees a call and a special remembrance for their switching sides and supporting the City in this battle.

    I am and will always be proud of our fight for you. I’m sorry we haven’t been more successful for you. But we will continue fighting to get the maximum benefits and subsidy for all of you.

    We sincerely wish you a happy thanksgiving with your families. Sorry we don’t have more to be thankful for at the moment.

Krislov says right out that the Fund Trustees switched sides and supported the city in this lawsuit. That should certainly be an issue going forward from this point. Also, that the city pretty much kicked police widows/widowers right in the gut, reneging on years of promises.

Indeed. Sounds like forensic accounting could put
this case (and the side switching) into perspective
and establish a timeline of events, account balances,
actions taken. We need a side-by-side flow chart
comparing Police vs. Fire contracts, dates of
promises (implied contracts), fund balances, dates
promises were broken (or just left on the vine to
die from willful neglect).
This could be the result of funds invested improperly,
based on prevailing market levels and conditions at
the time.
There's more here than meets the eye, but more often
than not a simple reason will be found as the motivator
or cause. Following the money in an apples to apples
comparison should be very revealing.

Horrible news for those that gave a significant amount of their lives to this shithole city.

I'm sure the 2% isn't gonna stay 2%. I'd be happy forking over 4-5% for healthcare when it's time to pull the pin in a few short years... IF IT WERE ACTUALLY GUARANTEED. Too bad nothing is ironclad when dealing with this fucking establishment. There's a special place in Hell for all the cocksuckers that had a hand in orchestrating this travesty.

Healthcare and pension benefits are the ONLY things that really matter. Discipline is a close third. Forget residency. Forget piddly increases for uniform and duty availability. And for fucks sake, forget bargaining for vehicles or other shit that should have never been introduced during CBA negotiations. Are you paying attention Kevin Graham and Contract Negotiating Committee?

Il Supreme Court (ISC) won't hear the case? Nice!! I remember back when Rahm wanted to run for mayor and the circuit court said No, he was not considered a Chicago resident because he took a job in DC and resided their with his family for several years, but within 2 fuck'n weeks the ISC dropped everything to hear that Mutts petition and over-turned the lower courts ruling. And it was widely known that the ISC does not usually like to get involved with matters when it involves residency. And Burkes wife is one of the Justices... Oh, It's All Legit!

I don’t understand the switch by our elected members either. I’m guessing that they might be trying to save money by excluding the additional costs of insurance. If our fund is slowly growing broke without the insurance payment, it would crash and burn sooner with the payment. Also, I totally doubt if the four members appointed by the mayor would ever support this issue. As I recall, a 4-4 deadlock means the motion is defeated. Anyways, its all just a guess on my part.

I hope this motivates the younger officers to intensify their deferred compensation contributions. Insurance costs are skyrocketing and any serious illness has the potential to financially devastate your family. Retiring closer to 63 is another option.

The trustee's at the Funds did no such thing as switch sides. They followed the law. Krislaw attempted to twist the law to his advantage. The courts saw through his scam. The Funds attorney called Krislaw out on this years ago. Krislaw stated he had nothing to lose. The Fund has always been paying to the city the sup for retiree's.
It's been said Krislaw's wheeling and dealing used all who gave him money were foolish.

I came on this job in 1970. At the time we did not even think about our retirement. Retirement was for old people. Not us... we were going to work this fantastic job forever.

I remember our homeroom teacher saying that "in order to fire you it would take an act of God." That is how safe your job is. (of course you could be fired but it was hard to do.)

We were also told we would be getting paid health insurance for the rest of your life. That, as you can see, did not happen. The city (Rahm) found a better use for our money. Putting in to the pension fund, as Illinois Law said should be done, did not happen. Rham took great pleasure in taking away our health insurance and was caught on tape bragging about it.

Happy cops.... who needs them, health insurance.... who cares. The City don't care.

I give up. "They" won. I stand defeated by the system and our FOP. You know the people we elected to look after our interests. They failed us.

That's my time.....

When Shields was FOP President he always spoke about in great detail pensions issues in the newsletter. Since he left never are pension issues a topic in the Newsletter. It is as if Angelo and Graham purposedly stay off the whole topic of pensions because they know they are only puppets to the city. That whole situation with Lappe on the pension board was a dog and pony show for the city. Lappe a puppet. All these so called trustees and FOP folks are pawns.

Does this come as a surprise to anyone. The Illinois Supreme court is made of almost all Democratics. I hope everyone of those union officials who sided with the city has a special place in hell for them. And for the union members who keep on voting for the same officials every year you got what you deserve. Found better and cheaper health care on the open market. Medicare eligible mrs and I paying less than $250.00 a month for both of us, total. No deductibles, no out of pocket. Mail in drugs, $0. With the former city plan $600 a month, $300 deductible each for medical, $100 each for prescriprions. I'd never go back. Aetna of Illinois ( not the fop Aetna) Humana drug plan. Check out your options you may learn how we were getting screwed by the city and now getting screwed by fop.

So the Illinois Supreme Court rules 6 to 1 in favor of the states employees retiree health insurance and said it is protected, but in our case won’t hear the case. Our case mirrors the state case and is also the exact case and arguments.

We CPD retires carried this suit on our shoulders, the punks in the funds and the do nothing fire union didn't contribute a dime in this effort. Someone said on another thread, they knew this was not going to fly. I say bullshit, if all of the funds, including the fire union were involved, just the numbers alone would have worked in our favor.

I don’t know why the elected trustees failed to support the insurance issue. My best guess is that our fund is slowly going broke without paying added insurance benefits to the retirees. Adding increased costs to the pension fund will only make it crash and burn faster. Also, I don’t ever think that the appointed trustees who do Rahm’s bidding would ever vote yes to the insurance issue. I think that in 4-4 ties, the motion would fail. Need a majority vote for passage.

0507 We were in federal court they ruled against us when the city played the game take it out of circuit court, then to federal court and back. Federal judge ruled against us. Your so smart tell us how it should be done. Its difficult when your opponent, the city, has unlimited funds to play games in all courts (using the tax payer funds), to screw us further. On May 31, the General Assembly passed a bill (SB 777) that changes the City's contribution to the Chicago Police Pension Fund. The bill is now being held by Senate President John Cullerton. This bill, that was NOT supported by the PB&PA organizations, was to be part of a greater plan to solidify our pension fund. The legislative efforts to stabilize the fund was explained at a May 20 meeting of the Chicago Public Safety Coalition (FOP Lodge 7, IAFF Local 2, and the three PB&PA Units). The plan called for legislation that would grant the City of Chicago their own casino where the profits of this casino would be contributed to the police and fire pension funds. This commitment was estimated to be in the area of 350-500M per year until the respective pension funds reached a 90% funding level. The trade-off for the city's dedication of casino revenue funding the pensions was that the public safety unions support a re-amortization and ramp bill that turned out to be SB 777. On May 21, the CPSA Board of Directors agreed to support the casino bill for the dedicated revenue stream to fund our pensions. The re-amortization bill would only be supported contingent upon the casino bill being passed. We felt that we could not support that legislation without the dedicated funding source already being in place. Without the support of the PB&PA unions, SB 777 was introduced last Friday and passed on Sunday. As the bill is being held by President Cullerton, this gives our legislative liaison and lobbyists time to raise our concerns and suggest solutions to some of the troublesome language contained in SB 777. With the General Assembly still in session, anything can happen.
Below are some of the changes as compiled by the Center for Tax and Budget Accountability:

In analyzing the changes that SB 777 makes, it is important to remember what the bill does not do:
· The bill DOES NOT reduce any pension benefits either currently earned or in the future.
· The bill DOES NOT change the total amount the City owes to the Chicago Police Pension Fund.
· The bill DOES NOT change the employee contribution to the Fund.
SB 777 makes three major changes to the payments the City is required to make to the Chicago Police Pension Fund. As noted above, the total liability of the fund is unchanged by SB 777. However, the bill does extend the time that the Fund will be severely underfunded. The legislation specifically does the following:
· Delays determining the City’s annual contribution based on benefits earned and unfunded liabilities from tax year 2015 to tax year 2019. The City’s contributions for tax years 2015-2019 are specified in SB 777 and are NOT determined by actuaries each year;
· Extends the time to reach 90% funding from 2040 to 2055; and
· Provides the Chicago Police Pension Fund the right to sue the City if it fails to make the contributions required under the bill.

Also get in touch with the assholes in the union at the CFD. I can't believe those little assholes left their own out on the limb. I do have a qustion. Can we move the fund alway from the curent holders since they dont care about us?

Didn't this case get started around 1987? How much of our taxpayer money did the City piss away on fighting this? Could this be the longest running case in history? What did they accomplish in 30 years that they couldn't do in one? It would be interesting to see how much of our money the City spent to screw us.

Way back when we first got unions health care was free and they then wanted to start us paying. At next contract talks both fop and fire union promised to stand together against this. City then threatened fire to go on 8hr shifts and they then stuck in our ass and gave in. Then another time they came out with bumper stickers saying "we fight fires not people" a slur against us. Screw them, they are always for themselves afraid of going on 8hr shifts.

Was around in 1980 and the firemen didn’t get us anything. Byrne hired the “scabs” as you call them who later went to become some of the CFD brass. That was 37 years ago Byrne gave the big raises because she loved the CPD, not the fire strike
Firemen thought they could go on strike and couldn’t be replaced. She did replace them withe “scabs.

Not sure about the appeal. From the beginning I think all sides agreed that the case would ultimately be decided by the Illinois Supreme cour and all the other courts were just a step to get to the Illinois Supreme Court remember the court has a democratic majority and who is the Chief Justice. Can’t believe they ruled in favor of state employees but against city employees in basically the same case. Politics?

Here’s what it means because it happened to me
Retired after 55 and received free health care for my wife and I when I turned 65 the stopped paying anything for healthcare because I was eligible for Medicare. So I went from free healthcare to paying around $125 a month for each of us for Medicare and $300 to $350 a month depending on which plan you selected (city BC/BC or FOP Aetna plan
So don’t think when you retire at 55 plus city pays health insurance for life. At 65 you and your wife will be paying at current rates approximately $900.00 to $1000.00 a month healthcare and more if you are not Medicare eligible or if your wife is younger and isn’t eligible when you are

Great you are younger and take next to no medication. I’m 78 and my 1 drug is $6500 a month. I had my financial planner look for drug coverage on the open market and my drug was not covered. The AETNA plan cost me $85 for a 90 day Supply. So i don’t know how i am getting screwed. A group plan is better than any individual plan. How you stay young and healthy, because you will want to be on the Fop plan when that day comes. By the way the Fop plan save me $1200 a year under the city bcbs plan and other than Premium and drug copay i don’t come out of pocket a penny. I’m thankful Kevin Graham and Fop have this option for me.

The attorney Krizlov made millions the last time this was litigated. He was the one that agreed to the expiration of the subsidy. It was a 10 yr agreement extended another 10 and then another 2 and then the final phase out of 3 yrs. you would have to live under a rock to think this was going to be forever. I have 9 yrs left on the job and as much as i want healthcare to be around i don’t expect it. This is the main reason why our raises are very important this contract. We all have to prepare for retirement. Pension, deferred comp and healthcare. Krizlov will still fight to get his legal fees covered by someone and has taken donations from Fop and retired police in excess of $200k plus individual donations. What kind of lawyer takes donations? If he wins his fees are we getting the money back? Not a chance.

Old timer here. We tried that a few years ago. Guys wanted the teamsters years ago to represent us and they campaigned and spent a lot of money to try and replace our union. Rank and file members voted in favor of keeping our union

Sounds like the best plan out there. $250.00 a month for a couple and no deductibles or out of pocket expenses
Please post the name of the company as Medicare enrollment isn’t over yet and I will have time to switch. I was going to stay with Aetna but this is so much better

The Circuit Court AND the Appellate Court of Cook County (state courts, not federal courts) have ruled on this. All that Krislov is saying is that the Illinois Supreme Court denied our petition to challenge the ruling of the Illinois Appellate Court.

I am trying to boil this down, but I do not want to bog you down with details.

There are 5 statutes involved here, the original 1983 and 1985 statutes state, (more or less) the city will pay PART OF retired cops healthcare. (how much? well,it changes in the following amendments to the statute, going up to a max, I believe, of 55%). In 1987 the city simply wants out of paying retiree healthcare COMPLETELY. You are on your own says the city. In 1989 this was codified into law. In 1997, the city amended. All these amendments are doing is extending the time the city will (partially) fund retired cop's healthcare. The 1997 amendment extended the city paying until 2002. I know, this is getting too complex already. So we have 1983, 1985, 1989, and 1997 laws on the books. Now, in 2003 the city amends again. This covered until 2013 (another 10 years). In 2013 the city kind of made the final statement - they said we will pay so much (I think it was 55%) until the absolute final date of January 1st, 2017. We all know what happened on January 1, 2017. ALL CITY PAYMENTS CEASED. End of story. The original 1987 statement by the city saying "we ain't paying" - culminated - 30 years later.

Here's a little more absolutely necessary detail: The 1983 and 1985 amendments to the pension code have been ruled to have been constitutionally protected. (Remember the Kanerva case which recently stated healthcare benefits are constitutionally protected?) But the 1989, 1997, and 2003 amendments had language that "these are not pension benefits for constitutional purposes," AND those amendments had time limits.



So the 1983 and 1985 statues are IN PLAY. Judge Cohen, of the Cook County Circuit Court, will rule on them (remanded by the Appellate Court I believe).

So it seems like guys hired after 1985 are fucked, right? Wrong.

What is interesting is that the Illinois Appellate Court said that those that were hired before 2003 (and were thus paying into the system by the time of the 2003 amendment) ARE INCLUDED, and are tied into these 1983 and 1985 amendments. What is that going to amount to - benefit-wise? No idea. The 1983 amendment has language like "$55 paid by the board," not language like 55%. 55% is good, $55 is bad. It's nothing. (And it is bizarre that the statutory language went from $ to % at different times). But then it has language which says the "tax levy" will pay the rest. So does that mean the 1983 statute covers 100%? I can't make heads or tails of that.

I liked Krislov's comment that hopefully, at the very least, Judge Cohen may require the Funds to provide a health care plan, which they have not done.

When looking at Medicare Supplements please look at whether or not you or your wife is tied to a network. The extra money spent for a supplement that pays all doctors is life saving if you need it. My wife came down with cancer 2 1/2 years ago, our primary physician broke the news and then wanted to know our supplemental as he wanted to refer her to out of network plastic surgeon and oncologist. I had paid the extra $$ monthly for our supplemental and told him that. My wife is fine now, the plastic surgeon and oncologist are great. I will state that we live in Arizona so take that into consideration. The other item to watch is the Part D for medication. Many of the plans are 30 -40 dollars a month for each person. Because my wife is the only person needing one pill daily ( anti-estrogen) , I went for the cheapest which was Humana for 17 dollars a month. The amusing thing is, the oncologist told the wife to go to Costco for the medicine, it is cheaper there for a 6 month supply than the co-pay. Told neighbors about it and many have saved some money by going to Costco.

If you are that worried about it retire now at 56 and get it.If you don't have enough time on to retire,lots of luck.

Contract negotiations are going to determine what happens to all of you still on the job. Right now, you can retire at 55 years old and pay 2 percent of your annuity (pension) each month for health insurance thru the city. However, that agreement ends when the current contract ends. The city can do whatever they want. They might say no health insurance for any of you ever again when you retire - go find your own. They might say let's go back to the old agreement of retiring at age 60 with free health insurance up until you turn 65 years old and you have to go on medicare.

To give you an approximate idea of what some of us are paying for health insurance. Those of us who are retired and are under age 65 - A single person with the best BCBS plan in Illinois cost $1300 per month. A couple with families, you will definitely double that. Every state is different, some states are more expensive than others, so it depends on where you live. The plans are different too, meaning each state will have different deductibles and medical procedures that are covered and co pays and pharmaceutical coverage and such.

It is a huge pain in the ass researching all of the plans available, and reading the small print, and learning the terminology. Every retiree is fkd. Good luck to the rest of you still on the job.

I have no idea or info as to if the Police retirement/ heathcare is similar to other City employees, but as a retired member of the Laborers'Pension Board here's the scoop : You will get healthcare, but the cost of it will come 100% out of your pension check.
The plan you choose will determine the cost...and even if you qualify for medicare , it's still budget- breaking. $ 850. a month for my wife and I ( same coverage was $ 421. two years ago.... we get the 3% cost of living ( that had to go to the Illinois Supreme Court to beat Rahm )...but that gets eaten up by increased healthcare cost.Your " fixed income" is chiseled away little by little and when you add the taxes for the privilege of living here ( property and sales , etc, etc) the " chisel gets slammed into you with a sledge hammer.
I wish I could just leave like some of the retired guys who post here recommend...but God it's tough to leave two daughters behind ...it's hard enough to worry about the street crime and carjackings without being 500 miles away. Every time the phone rang , I'd shiver.
Love you guys, always have my respect ...was an MP and many friends were cops.

When looking at Medicare Supplements please look at whether or not you or your wife is tied to a network. The extra money spent for a supplement that pays all doctors is life saving if you need it. My wife came down with cancer 2 1/2 years ago, our primary physician broke the news and then wanted to know our supplemental as he wanted to refer her to out of network plastic surgeon and oncologist. I had paid the extra $$ monthly for our supplemental and told him that. My wife is fine now, the plastic surgeon and oncologist are great. I will state that we live in Arizona so take that into consideration. The other item to watch is the Part D for medication. Many of the plans are 30 -40 dollars a month for each person. Because my wife is the only person needing one pill daily ( anti-estrogen) , I went for the cheapest which was Humana for 17 dollars a month. The amusing thing is, the oncologist told the wife to go to Costco for the medicine, it is cheaper there for a 6 month supply than the co-pay. Told neighbors about it and many have saved some money by going to Costco.

City and FOP didn’t offer a supplemental plan. Both city and FOP plans are advantage plans. Big difference.

Found better and cheaper health care on the open market. Medicare eligible mrs and I paying less than $250.00 a month for both of us, total. No deductibles, no out of pocket. Mail in drugs, $0. With the former city plan $600 a month, $300 deductible each for medical, $100 each for prescriprions. I'd never go back. Aetna of Illinois ( not the fop Aetna) Humana drug plan. Check out your options you may learn how we were getting screwed by the city and now getting screwed by fop.


Sounds like the best plan out there. $250.00 a month for a couple and no deductibles or out of pocket expenses
Please post the name of the company as Medicare enrollment isn’t over yet and I will have time to switch. I was going to stay with Aetna but this is so much better

Mr.Krislov came to Local 2 (CFD) and asked for "donation" to the cause. When he had won the previous ruling he went after the city for court costs and won 1-2 million dollars (unsure of amount - would be in public records) and reimbursed the unions ZERO . So he was paid twice.
Local 2 cffu wanted an agreement that if this was to happen again that there would be reimbursements to "all" unions" involved. Krislov would not agree to this so he was told to go pound sand. For him to say that 50,000-75,000 $ would have been a difference in this case ( which was going to be a longshot at best) is laughable. But he got the reaction he wanted and is now deflecting any blame in the case away from him. Divide and confuse.

Fat head Bella said at the union meeting last week the SC was going announce that they would hear the case last Wednesday> the City would have 35 days to respond and we would have 35 after that to respond with a hearing date in Feb.

I personally could care less if Krislov gets paid thice,thrice or whatever.If your local gave shit and didn't want Krislov's help they could have found another,better attorney.Do you expect the guy to work on a case against the city for free?
