A Slow Start

  • Leaders of the rank-and-file Chicago Police officers’ union on Friday slammed the city’s police oversight agency, demanding a “clarification” on use-of-force policies a day after Officer [...] 2015 shooting of Quintonio LeGrier and Bettie Jones was ruled unjustified.

    “If an offender is wielding a bat against an officer, must he or she wait until they are actually struck before they can defend themselves?” union officials wrote in a statement.

    “Must they wait until they see a muzzle flash of a gun before any attempts to protect their lives and those of the public would be deemed reasonable? How far can the weapon be found from an offender before an officer’s use of force is deemed legitimate? Six feet? Ten feet? Fifteen?”
The standard (for much of our careers) has been the "21 foot rule" where someone with a knife inside of a 21-foot distance, was able to close the gap and inflict damage before an officer could draw and fire. If we aren't mistaken, at one point the TASER cartridges came with a 21 foot wire specifically to address this situation (but ignore the reality that at 21 feet, the TASER prongs were too far apart to make meaningful contact with a subject.) A bat (with an assailant reaching his arms) extends the effective range of the weapon four to six feet. We won't even bother to cite numerous publications by the FBI that show people are beaten to death far more often than they are killed by rifles.

The FOP is completely correct to put this pile of shit into COPA's lap. Make them define exactly what they are basing their judgements on, then show that the Department has failed every officer in training personnel up to COPA standards - the officer will instantly win his lawsuit against the Department's inadequate training. We'd bet that upwards of 75% of the Department was trained under the "21 foot rule," and to date, we haven't heard of it being tossed. We'll even ask to have the names of the gym instructors posted in the comment section - most of them are still alive and would probably love to come in to explain the training.

Fellow officers, I am writing this to you all to let you know that the moment has come in whether we show solidarity with each other or turn our backs on each other and cower away! No one wants to be that person called upon to go against the tide. Most of us want to live our lives as simple as we can and do what’s best for ourselves and our loved ones. But on Friday 29 Dec 2017, the city showed its intent when it comes to us, that is to persecute us! It has unleashed a beast that will not stop until it has made a name for itself as a persecutor of “bad cops”. Most officers have taken the fetal mentality. Has much as I hate that way of policing it has become an appropriate method in order to avoid this beast called COPA.

The problem is that being fetal will not ensure your safety when it comes to complaints, persecution, and termination. You still have a job to do and by policy and law you must respond to your calls accordingly. This officer did just that when he responded to a mental/domestic call. He took appropriate action that was well within policy and the law! Yet, here we are two years later and this officer may now face termination and possibly being charged! So, how long until you’re the next officer being called to COPA to answer for your actions? How long until your face is plastered all over Chicago media and your home address is shared live on TV? This is not about salary, healthcare, pension, or whatever! It’s about the quality of life, our dignity, and honor! We cannot rely on the FOP or anyone else! We must rely on each other! Regardless of your skin color, gender, religion, and sexuality, we all are blue! We are blue when we put on that uniform and star!

So, I am asking all of you who are reading this, if things continue to decline then it will be time to show a sign of solidarity. We will show solidarity by applying the blue flu method! Or any other method deemed appropriate. Right now would not be the right moment. But I say let us choose Memorial Day weekend 2018! Whether you’re a PPO or about to retire Veteran, we must stick together! We can make a difference if we stick together! This department had a legendary reputation, but we are now the laughing stock of the nation! Enough with the petty bitterness that divides us and let us come together! I am a blue shirt in a management spot, and I am more than willing to do what it takes to defend my brothers and sisters in blue. Pass the word!

them with FBI stats, FBI training standards towards
varoius weapons, throw in some SS findings, training,
split-second decisions on lethal use of force.
Throw in kill zones for all lethal weapons, including

stars. Get some James Bond shit and make them
memorize feet/second, muzzle velocity, feet to yards
conversion. A little pharmacology would bitch slap them
sober: angel dust, PCP, ecstasy, cocaine, methamphetamine.
Show them clinical cases about these drugs ability to increase
endurance and dull pain in these actors. Finally, ask the COPA
assholes where they went to medical school and if they are
currently allowed to practice and weigh in as experts.

Back when I was at the academy COPA came and talked to us to tell us all about how COPA was there to help us. Male white COPA investigator introduced himself, said ok you guys I talk fast and loud and swear so just let me know if that's a problem. he proceeded to remove his blazer. He started into his story about when he was a homicide officer down south while rolling up his light blue shirt sleeves, exposing tattoos. He threw in how if your not getting CRs then your a lazy dog. Not to lie and tell the truth. In closing he gave a story about hitting an offender with some object, but that it was ok because of use of force model. Come on really the removal of his jacket and wearing dark blue slacks and a light blue shirt, He must have rehearsed this a bunch and has the outfit ready a week ahead. Probably wears it when dealing with POs so they feel that he is one of them.

This definition needs to be clarified by COPA and the State of Illinois. This is the issue that needs to be pushed to the fullest. Forget the no confidence vote it means nothing but assign one of our VP exclusively on this task. Every day on the news, waiting at the mayors office, waiting at COPA to get this definition. This is the key to the fair of JVD and many other P.O. that need to know where their risk of life lies. I wouldn’t give up on the search for the defined answer. Let the mayor and everyone else tell us the limit. That being said every P.O. and instructor would be on the witness list to testify to their training. Man had a knife, man was in the act of a violent act, man was fleeing a crimson act and is now dead becaus he caused fear for an officers life. Oh yah and was on pcp, ward of the state with no parents and a taser which would be banned today wasn’t available. Forget the no confidence vote and pound this issue until we get an answer. I don’t know who wrote the letter at the FOP but great job in doing so.

A simple solution here is that officers should not or will not respond to any in progress calls until COPA and CPD brass clarify the Use of Force policy down to the exact inch, exact second, exact words to use, exact speed, exact body movements, exact facial expression and exact weapon to use for every single exact situation that an officer might encounter. The current version of the policy is just to fucking vague. A new revised one to include all of the above might need more than one brightly colored graph on a single sheet of paper and take years to write and read but at least we’ll know how to react. I know until this happens I’m taking my sweet time to roll on in progress calls. Can’t have your cake and eat it too.

SCC, AN IMPORTANT CLARIFICATION!

Too many people in both LEO and non-LEO circles have needlessly gotten themselves killed or injured because they mistakenly believed the Tueller Drill (a.k.a., "the 21-Foot Drill") is somehow a "rule." It is NOT a rule of any kind. It is ONLY a drill.

To quickly clarify, in March 1983, SWAT Magazine published an article by then-Salt Lake City (UT) Police Sergeant Dennis Tueller entitled How Close is Too Close? The article revealed that the average individual closed a gap of 21-feet in 1.5 seconds. Some younger and healthier individuals closed that gap faster; some older and less-healthy individuals closed that gap slower. But the AVERAGE individual closed it in just 1.5 seconds.

It also noted that the average trained individual requires 1.5 seconds to draw, present, and fire a holstered handgun. Again, some trained individuals do it faster, others slower. But the AVERAGE trained individual does it in 1.5 seconds.

There is NO rule or law or policy that precludes a LEO or non-LEO who is in reasonable fear of death or serious bodily injury to him or herself or others from drawing and firing at an assailant positioned more than 21-feet away. Indeed, the point of the article is that if you have waited until the assailant is at, much less within 21-feet you have likely waited too long to draw and fire your weapon -- so you had damn well better have other skill sets to protect your life and the lives of those around you.

As in the children's game "Telegraph," over time this simple fact has often been misunderstood as being some make-believe "21-foot rule." NO SUCH RULE EXISTS!

In the 35 years since Sgt. Tueller's article first appeared, countless techniques have been developed by LEO and non-LEO self-defense trainers to both get the GG off the X in order to give him or herself more time and distance to react to an attack with a contact weapon, as well as giving the GG more skills with which to react.

By the way, every day the FOP should be pounding this information into the collective heads of Rahm, Eddie, COPA, and the media.

Finally, as 2017 draws to a close, I'd like to say to all active duty and retired LEOs reading this, on behalf of all non-LEOs in Chicago like myself, THANK YOU for your service and for your families' sacrifices. Both are more widely understood and more deeply appreciated than you can ever possibly know.

My opinion: This is Rahm's fault. He is responsible for training police. He handcuffed the police, didn't hire enough police, now is attacking the police for doing our jobs in the Quintonio LeGrier matter.

LeGrier is the crazy guy whose parents called the police because he was violently out-of-control, and then when they got there he attacked them with a bat. Thank goodness our officers didn't end up like Gregory Hauser and Raymond Kilroy.

Bruises on the hands of Chicago Police Officers Raymond Kilroy and Gregory Hauser indicate that they scuffled with Roman Chavez in his grandmother`s Northwest Side garage in an identical situation when she called for the same reason before he seized Hauser`s gun and shot the officers, investigators said Tuesday.

A pair of handcuffs was found on the floor of the garage at 2158 N. Nordica Ave., suggesting that the officers had attempted to subdue Chavez before he emptied the gun into them, investigators said.

I seriously doubt that the civilian investigating agency would put themselves in a box and respond to the FOP's questions. It used to be what a " reasonable man" would do and was judged in that mode along with a use of force model. But, I am guessing that is out the window now. Tough times are coming. I hear what everyone is saying, but what exactly does their decision mean in the real world. Can you be fired, suspended, indicted, can their decision be used in a civil case against an officer? Who over sees COPA, or are they just a lose cannon of the Mayor, doing his bidding for his political survival? What real authority does this agency have? It would be interesting to see if they report directly to the ACLU or use them for advise in their decisions. If I'm not mistaken, isn't COPA a direct result of Obama's DOJ? Presently, we have the Trump's DOJ and why in god's name is 9-1/2 following any of the recommendations of Obama's administration, but for purely political reasons. To all the new police, don't engage COPA for any reason, unless you ordered to do so, don't talk to them. The new rule should be, just like talking to the FBI, only with an attorney at your side; that advice now applies to COPA. Just my two cents, this is confusing and a concern to all of us.

What we need is federal standardization of use of force. All use of force training in the US should be the same as the feds and the use of force standards should be consistent across federal, state and local agencies. And training should be monitored for consistency. This would force the city to raise our standards of training. The department has known for a long time before JVD that our training is shit but they will do nothing about it unless they are spanked. Thirty rounds once a year is bullshit and they know it. It’s not training, it’s only a minimal skill qualification and a poor one at that. In the mean time limit your contact as much as possible and only perform stops when you are 100 percent certain that you are justified. Do not risk contact that may escalate unless the initial reason for the stop involves a serious threat to safety. Smile and wave.

How about you start slowly. First step is a vote of no confidence in mayor and aldermen. They follow-up with a no confidence vote Kim and Twinkeltoes. Finally a no confidence againt judges and Dart. Each tome would create opportunity to have press question why. Find an articulate spokesperson to present your point of view. This is an election year and bad press will be something to be avoided. Name names and site examples of why no confidence. You need to work with all first responders groups to show unity. Be sure to site SCC so more citizens are aware of what is really happening behind the scenes. Put the administration on the defense instead of the offense. Buy an ad in newspapers naming bad judges and aldermen, unless you tell the story the voters are clueless. Organize and protest this will get press. Picket in front of Sun Times this will get Tribune to cover story. Picket asking for truth be told about Exam cheating. Then move to Tribe this will get times involved, against for truth about when Rahm saw tape. Remember it's an election year.

The ambiguity is intentional so they can distance themselves from a politically inconvenient use of force incident; even if it is legally justified. Vague guidelines also push the liability onto the officer. The new taser order is a good example of this.

Loved attending it when done on the north side.How about if the FOP applies for a permit for SOUTH Michigan Ave and have it circle the City Hall before disbanding. Looking to FOP is useless. They have shown in past that pact the will to really get involved. You all are the FOP go to meetings and force them to do their job. Start a recall vote to get new leadership. Change requires activities if you really want change you have to work hard and force the issue. With over 7000 members $100@ will build a war chest of $700,000 nice start, once the ball is rolling you should be able to attract outside help once they see your serious in fighting city hall. Get some other Cook County forces to join your efforts as they too are being negatively effected by the war on the justice system. The police have more leverage than you realize, but it will take some effort to get everyone going in same direction. If you don't do something other then bitch and moan it will only get MUCH WORSE. Once they know they have you on defensive they know they have one and you become their little bitches. Is that what you want, to be someone's little bitches? Start by calling a special FOP meeting to get ball rolling. You need some new leaders that have some brass balls find them and support them.

The Union is such a joke, yes they will sometimes represent you if you get in a jam .When they tell you, your case has been denied, you better appeal. The decision...you should appeal(they will deny you based on expenses), if not, you are fool. Don't expect your Union Attorney or Union Rep. to go above and beyond for you, you have to do your own homework and investigation to get any satisfaction. My Attorney for FOP failed to consider rule 14 violations, Civil Right Violations, and hold those responsible for testilying under OATH. The Attorney said, the Arbitrator, hired by the City Of Chicago, has no choice but to appease the City to get hired again. Its a no win situation.

Officers, perhaps I missed it but I saw NO comment as to the way you (any Officer) make a statement to a Detective or ANYONE ELSE when you have been involved in a traumatic situation and a suspect or bystander is injured or killed (shooting, violent assault, bad car wreck in which you were driving, etc.)
Your COPA fixates on the "inconsistency" of Officer Rialmo's statements. When faced with a situation you should NEVER speak to an investigator or even another Officer immediately after the situation. I speak from 37+ years on the Nashville Tn. PD including 28 on Patrol and 9 as a plainclothes Detective. We had the FOP as our representative most of that time and we had attorneys on call that would come to the scene to speak with the Officer. You can make a short statement to let the investigators know the basics but you NEVER make a formal statement (on the scene or otherwise) without an attorney present. Things happen too fast, time slows or seems to speed up, you have NO idea of how long things took or even how many shots were fired until you can sit and decompress and THINK about it. It may take days but you have a constitutional right to (A). Have an attorney present and (B). Not make a statement if you don't feel right about it. Your brass may not like it (I'll guarantee that) but you have that RIGHT.
Once you make the formal statement then you are one and done. Second statements and "followups" do nothing but generate inconsistencies that can be used to hammer you.
First thing on the scene of another Officer's situation is to make sure that he/she does not develop diarrhea of the mouth and tell them to SHUT UP and make sure an attorney is called. No lawyer, no statement. You give that consideration to the worst of them, now afford it to yourself and your partners. You want to explain yourself and you feel the need to fill silence with your comments as to how your actions were correct and all you do is walk into the same trap that your "clients" do every day.
I read all of the COPA report and have to say a lot of this would not be an issue had the two Officers availed themselves of this opportunity to take a breath and speak with a person that is paid to LOOK OUT FOR THEIR INTERESTS.

Very good points, the confusion is only beginning. For us that have time on the job, we will do what is best for our own safety. The new babies are another story, they're going to get themselves killed or another. That's the immediate problem I see.

I don't know why you would ever talking to COPA or BIA/IAD without an attorney present. Never waive council. This must be some real new shit because I only have 15 years on. Oh yeah.... phones are for ordering pizzas, not talking to COPA.
COPA cannot order you to do anything, only a CPD supervisor can.

I foresee quite a few lawsuits Vs COPA and their slew of pencil neck beards and functionally literate Hatorade swillers.
