Who Approves This? (UPDATE)

We asked rhetorically the other day about who approves the Taser General Order without assessing the practical applications and consequences of such a misguided piece-of-crap order.

We got an answer....in more detail than we thought possible:
  • ....the way the order is currently written, a PO is forced into an “outcome-based” situation…if the taser deployment is deemed “good”, the PO is ok. However, if the taser based deployment is viewed by COPA as having a “less than desirable outcome”, the PO is screwed because of the wording of the order.

    ANY AND ALL CPD POLICY REGARDING USE OF FORCE STARTS AND STOPS AT WALTER KATZ

    Katz was hand picked by 9.5 and ONLY KATZ has the final word regarding CPD use of force policy; if Katz can’t be convinced it’s a good idea, it will never be implemented. I can’t tell you the number of hours that gets spent trying to explain things to this guy. His agenda is NOT the police; it is PUBLIC PERCEPTION and covering the Mayor’s ass. His claim to fame is that he wrote the Use of Force Police for the Los Angeles County Sheriff’s Department. Everything that we try to implement on the CPD is compared by Katz to that policy.
We must admit that we had never heard of this guy. Here's some helpful links to bring people up to speed on who is playing tiddlywinks with your career, reputation and freedom:
Suffice it to say, a lot of the contradictions in the Taser Order were understandable after the above explanation and reading up on this guy. He's cut from the same cloth as those ACLU pukes who dictated the "consent decree."

You want to see the face of "de-policing"? Obama at the top of the list, followed by Holder and Lynch. Then Rahm and others like him, desperate to hold onto their power by hiding videos and covering for the clouted. And finally, there are the foot soldiers like the ACLU's Gupta and this guy, put in place to wreak havoc for their masters, writing policy that is so convoluted, cops would rather sit back than put themselves in the trick-bag for an administration that will fuck them at the drop of a hat.

For some reason, following the posting by this insignificant blog, the Twitter account is now "locked down," meaning no one can view it unless they're a subscriber. It's almost like he's ashamed of all his "tweeting" as it reveals to much of his progressive agenda. Funny how the progs scurry for cover when the lights come on.

I would hate to be 5 years on or 10 years.. with a wife, kids, baby andva mortgage and and car note that is equivalent for o a mortgage--/ and have to put my lively hood on the line for using a taser. That's were we are boys, girls and transgenders-- enjoy!😁

I don't get it. Who benefits from all of this? Sure the obvious answer looks like Foxx's family and friends from the projects but if anything they're the losers and they're losing more everyday. No, it's not them. Is it Toni Preckwinkle, and her lackey Kim Foxx, or Lori Lightfoot? Some would say Rahm is to benefit but not likely. He seems to be a willing pawn being used by Toni so as to make good on his escape from this city.

Chicago seems to be a litmus test for something very bad. Chicago is, by no means alone. One look east and there we have Detroit, Baltimore, and Philadelphia all failing and getting worse. I thought I'd never leave this city but my entire family has not only moved out of Chicago but Illinois over the last 10 years. Even my wife's family has moved out of this state. I just don't get it. How does educated tax payers leaving Chicago let alone Illinois benefit Illinois politicians?

What they fail to see is the broader picture. The more that the department caters to a democratic leftist liberal snowflake rhetoric the more they put the city as well as the officers in a liable situation. As they rewrite policies and add words like "objectionably reasonable", "when practical", and even "could" that brings a vagueness to the orders that is open to interpretation to a situation that occurs in a couple seconds. What is objectionably reasonable to people that are trained as law enforcement officers and who have years of experience dealing with chaotic situations at the peril of life or limb may not be objectionably reasonable to the aforementioned groups. We need clear and indisputable policies that say "bad guy does this.... you can do this ... and whatever happens to him that was unintended (tased and dies or more seriously injured by a fall etc) is his own fault". Catering to these groups makes it easier to file lawsuits and punish officers so they can claim that copa was even necessary. This also removes personal liability for an offenders own actions.

You cant paint officers into corners by expecting them to analyze a situation that unfolds in seconds. It is not only unfair, but also makes it impossible to get it right all the time. Cops are human, they will make mistakes. When you add more and more things for them to try to figure out in those seconds, it adds an unnecessary burden and adds more risk to their lives as they might not react in time to save themselves or others because there is too much to contemplate including being held criminally liable for reacting to a criminals actions.

The Chicago Police Department will never be what is once was ...adapt , overcome and get out ASAP. Laws, as written by our political class, are not designed to be complied with; they are designed to be impossible to be certain of precisely what does and does not define compliment. As in, what comply meant. As in, did I or did I not comply.

It must be admitted that it takes a certain talent to compose, even in legalese, a law which meets the standard of flexibility equaling or exceeding ambiguity.

It appears that Wally here has such a talent, albeit he lacks the attractive appearance required to be sold to even the most ignorant voters as a candidate for elective office.

Not that this absence of attractive appearance has kept Wally from garnering a position to impose his whimsy upon others. Perhaps this is fortuitous, as thinking of Wally having the authority to impose taxes, create ever more ambiguous law and generally screw the pooches of others lends a single positive note to his existence.

The obvious factual reality of, if ya don't want none, don't start none, eludes the talented thinking's of Wally, as it does so many.

Human society is, as a default, difficult enough, without the effective enforcing of the basic, essential natural laws.

Ya know, like.....do not kill your neighbor, if the asshole doesn't fuck himself by forcing you to.....do not take/steal from your neighbor, no matter how much you covet his stuff......do not break/damage your neighbor's stuff, nor your neighbor's flesh, not even if you find yourself in the mood to fuck up somebody's shit, motherfuckers!!!!!......etc......

So, Wally, enjoy your being so talented at mish mash, gobbledygook bullshit. While you pat yourself on the ass for the spiffy job you've done, your neighbors will continue to enjoy the absence of any effective preventative actions being taken to reduce their being subjected to being, in no particular order of likelihood: robbed, mugged, raped, battered, ripped off, carjacked, murdered, maimed, burglarized, bitch slapped, pick pocketed, pissed and shit upon, and, in general, made to regret they were ever born into a society of humans.

Rahm is not from Chicago, and many of those moving into the new construction in the South Loop and North side are also from somewhere else, so they fail to acknowledge or realize that the Chicago Police Department is going through Major "Change", with regard to management, Mission and most of all perception. We are living in an age of soundbites and Perception, rather than substance. Rahm was all about Perception when he worked for both Clinton and "Obongo". And the Department has been since Rahm took over consistently run by attorneys who are not from here. Before Rahm, attorneys in the Police Department were often former cops themselves, or related to cops; not anymore. Have a buddy who retired recently from LA County. He said if a Deputy assigned to courtroom security went to a loud, obnoxious person in a courtroom, put a hand on his shoulder and said "Hey pal, can you keep it down?" Policy required that he had to notify a supervisor that he used physical force (touching) and a use of force report had to be submitted.

Imagine a bar fight?

Taser now called axon is backing away from liability now by saying to all the master instructors at the recent conference in New York that the officer is to now follow and refer to agency policy and protocol when using a ECW. So the weight in now on the agency and the officer regarding the proper or improper use of a taser. The new order follows taser new updated policies and leaves it up to the agency to say what’s good or bad. A lot of the complaints are from user error such as closing distance and not achieving NMI with the proper spread of probes. So axon leaves it up to the agency to carry the weight now.

"he directed the independent oversight of police misconduct investigations" - I was not a member of the SJPD but I think this is incorrect. SJPD is responsible for all IA investigations - Criminal Investigations are conducted by the SJPD and the District Attorney's office, which is mostly staffed with retired SJPD detectives and brass.

The oversight office reviews completed cases and makes an annual report to the city council. He didn't write policy for the SJPD, and I doubt the LASO.

The head of the office is a retired black female homosexual Superior Court Judge. Doesn't have much use for the police; her outreach consists of giving classes to high school kids explaining why they don't have to cooperate with the police and ensure they know to lawyer. up when confronted.

San Jose is not Chicago. bh

ASA's, upper brass, city hall - they all have to make it look good.
This city is so messed up compared to early 1990's.
Our actions are being looked at every time force is used. We are under the spot light - and the offenders actions are secondhand because he/she has been held down in life and they are incapable of knowing better.

Looking at his profiles, he was born and raised in Chicago. Now he is back to put the appease the citizens (not tax payers), and give payback for his early life, all while lining his pockets. You have, impressively, missed most all of the actual intention here.

1. There are plenty of citizens with a brain here; they avoid contact with the brainless, and the politicians, who are not brainless but bent beyond recovery, and go about the business of living in spite of the policies of said politicians.

2. The truly brainless, those embracing being relegated to effective plantation servitude, with the benefits, to them, of being free enough to rape, rob, pillage and murder, mostly their own, are not fit to be trusted to conduct the politician's orchestrations of their favorite variations on the theme of The Great Grift. So, those brainless you refer to are, indeed, present here, just not qualified to do anything other than what they are used as pawns to do.

3. Thus, the importation of not from around here but still useful kindred spirits, useful, by being clueless, pity party promoters, and the like, for the purpose of managing the strategies of the grifter masters.

THE QUESTION

Q. One of the big issues you’ve addressed is the use of deadly force, the latitude given cops to kill by Graham v. Connor. Can that be fixed internally, by policies limiting the use of force, the rules of engagement? Can anything overcome the First Rule of Policing, to make it home for dinner? Has your exposure to the police perspective made the problem of crafting policies to preserve everyone’s life harder? Are cop too quick to scare, too quick to kill preemptively? Does the law need to change to end cops’ killing in anticipation of a potential threat?

HIS RESPONSE

A. This question could fill a whole volume. I have written about independent investigations of officer-related deaths elsewhere and I am a big believer that such investigations need to be more transparent. Over the years I have been to dozens of scenes where an officer or deputy used deadly force. Some of those incidents were obviously well-justified and, conversely, a few were real head-scratchers – I am being as circumspect as I can be here – for why deadly force was found to be reasonable.

Three situations are the most troubling to me: (1) where the individual is not armed with a firearm and in an acute state of mental illness; (2) where an officer shoots at a vehicle because he thinks it is being used as a weapon; and (3) the largely unexplored phenomenon where a foot pursuit ends with a deadly use of force where the individual is right at what I call “the point of escape,” and for an unfathomable reason allegedly slows or turns and reaches for his waistband — even when unarmed!

All police-related deaths demand the closest scrutiny, but those are three areas where deaths are too frequent and the justification cannot simply be chalked up to, “well the officer feared for his life, so let’s move on.” It is absolutely necessary to ask the next natural question, “was it reasonable that he feared for his life.” Until recently, I did not see prosecutors or law enforcement executives really diving into that second question too deeply because, I believe, it could frequently lead to uncomfortable answers. This is why video is so critical.

In 2015, I believe that six officers across the nation were criminally charged for their conduct during an officer-involved shooting. All six of those incidents were captured, at least in part, on video. That is why we need both body camera video and in-car video made as available as possible to all police departments. The challenge is dealing with the massive recurring costs involved in licensing and data storage that the body camera companies are charging.

As for the Graham standard… I am torn. The necessity requirement for deadly force in Article 2 of the European Convention on Human Rights (ECHR) is very attractive, but in the United States, we have the reality of 300 million firearms in circulation. Policing is dangerous work and I don’t have a lot of patience for those who trot out statistics that policing is safer than it has ever been. There are too many variables such as improved body armor, trauma care, communications, and tactics to make a simple comparison. I urge those who are critical of police conduct (and I am a critic) to do plenty of ride-alongs to get a feel for what a traffic stop really feels like when you have no idea who may be inside that car, or to respond to a volatile domestic violence incident in a confined space.

Having said that, I am very uncomfortable with pre-emptive deadly force. There are certain trainers out there who preach the warrior cop, “going home tonight is the only thing that matters” mentality. Officer safety is critical, but calibrating force standards to respect human life and safety is a real challenge because we are in a country that has such a propensity for violence.

The officers told me that they were speeding for no particular reason and confessed that to the WC who promptly wrote them up. Their response was they could not lie about this. Needless to say, I was shocked. No one hurt, no damage, just going through an alley a little fast which really is a subjective opinion. But they caught hell for this and they did admit it. This is where the CPD is going. If they said not where they lying or where they just not convinced they were going too fast at the time?
