Arguments of Venue Change

  • Chicago police Officer Jason Van Dyke cannot get a fair jury trial in Cook County because of highly prejudicial and extensive news coverage, a consultant hired by the defense has concluded, saying the officer’s fatal shooting of Laquan McDonald “remains seared in the public’s consciousness.”

    “Neither the size of Cook County nor the passage of time have ameliorated the prejudicial impact of pervasive media coverage surrounding the McDonald shooting on the jury pool,” Bryan Edelman was quoted as saying in a newly filed memo seeking to move the upcoming trial from Chicago. “As prospective jurors reported, the defendant would have a difficult time convincing them that he is not guilty of murder.”

    The long-awaited report by the California-based trial consultant was not made public, but references to his findings were included in a memo filed Tuesday...
When you hear the word "murderer" chanted at you a couple times a week, and dozens of stories about similar incidents, you can bet that the jury pool has been irrevocably tainted.

Change of venue will cost Rham votes... Rham, Dart, and Preckwinkle say “stay put and get some JVD, you ain’t going no where” we already know this case stays in CC. I doubt you couldn’t get this transferred to Dupage, Kane or Lake county— those counties don’t want anything to do with that case

He should get a change of venue to as far from Cook Co. as it is possible to get and still be within the state. That would happen in a just world.

Van Dyke did nothing wrong Laquan was high on PCP refused to drop the knife. Why don't they bring in the Woman Officer who had her had bashed into the pavement repeatedly by someone high on PCP testify in his defense?

Richard Speck had his trial moved to down town Peoria in 1967. Why not JVD?

He should not only have a change of venue we should have a change of country. There is no where that this case can go where the jurors can honestly say they don’t know about this case. This officer was railroaded from the start, he was the ultimate political pawn don’t forget the exempts signed off on this from the beginning, then the nasty world of politics raise that’s ugly head and then they change their opinions. Look up quickly the boss is retired the boss is involved with this quickly left they skipped out on any more interest in this case. They know it was wrong God willing Jason‘s lawyer will bring Every last one of them to testify in this trial, this could’ve happened to any police officer don’t say I would never do that because things happen in an instant as we all know you will never know what you will do in a situation until you were there and involved in it and if you are scared of your life you’ll do things that you can’t imagine in your head.

The judge may ignore it and proceed with the case in Cook County, but yet again (for what seems like the tenth time already) there will be another grounds for appeal. It'd almost be better for JVD to have a jury trial. The results are immediately tainted

In a just world he wouldn't have shot 17 times thats what has him jammed up. It just dosen't look or sound good and thats what matters in todays world, not the right or wrong of it.

They need to have it change to Pope or Hardin Counry. They need to rent office space and a hotel room for a few weeks but the venue will be better and the facts will actually get heard, one way or another.

He should axe for a bench trial. Law is clear that he was justified by shooting. Well connected attorneys have stated that it's impossible to determine which shot killed LM. If the first shot or 2 killed him, which may be the case, the rest of the shots fired are irrelevant. I would think a directed verdict of not guilty is in order.

Heard rumors that it will be announced at next hearing date, that the trial is being moved to Alexander County. It will be moved there so a non biased jury pool can be chosen. This location is not accessible via the CTA.

"Prejudicial news coverage" is not why he can't get a fair trial. The reason is the trial is politically and racially motivated, and within Chicago, politics and race are paramount, and may impact the verdict.

There should be no doubt that Officer Van Dyke should get a change of venue, even if he opts for a bench trial.

The problem is that from a lot of news articles it appears that even the Cook County Judges are now Social Justice Warriors, ignoring laws on sentencing minimums and rules / regulations on Bail, bending over backwards for 'People of Color' long 'oppressed' by 'the man'.

Ergo, a White Police Officer accused of killing a black person who posed no direct threat -- and not only killing him but Over Killing by firing 17 rounds -- is screwed before the first gavel falls.

IMHO, the only way Van Dyke will get a truly fair trial, is if the entire case is moved to another state, as far away as possible from democratic party influence of jurors, democrat prosecutors, and democrat judges -- a state like Kansas, Idaho, Wyoming, or Montana. Though this could never happen due to Jurisdiction.

Just to think how far this nonsense has gone is disgusting,rahm handing out tens of millions to thugs and their families,the exempt ranks and other bosses signing off as justified,then rahm steps in,tells the "I didn't see no tape" and his dirty politics enter the scene and bam paperwork is changed and jvd is charged with a top crime!

The bigger question is will the happily,fat and taking undeserved amounts of pension,bosses be dragged back in and made to testify as they all should be?

Unfortunately this case was never meant to be handled in a court. It is and always was, politically motivated. No charges would have been brought if Alvarez was not up for reelection and if Rham didn't sit in the video.

One would think the state might want a change of venue to forestall any claims of an unfair trial after a verdict comes in.

The video is going to make it very hard for a jury anywhere to come back with a not guilty verdict, so might as well get rid of something that might kink up the works down the road.

the riots are not going to be prevented by moving the trial so I don't see any downside to the state in going along with a change of venue request.

Speck a mass-murderer got venue changed to Peoria: Guilty verdict. This Van Dyke case should be venue changed as well. Will result in bench trial acquittal. However political correctness aka the new McCarthyism will determine. Nothing is sane anymore. The Cook County Crooked Machine fix is in.

If Rahm had any wishes to have this case over with by the time the election rolls around, it ain't gonna happen.

If there is a venue change it will be at least another 6 months until a site is found and the county agrees to take it. Sounds like the case will be an election issue.

You must be absolutely fucking stupid to think the judges in this County don't owe a favor to someone above them. Felon, had a deadly weapon, didn't drop his weapon, was shot as a result until he was no longer a threat. If that were my son? Well, it wasn't. Move the trial to Lake County, not guilty. Du Page, not guilty, Kane, not guilty. Cook County, well we can all agree with that jury selection (fuck them).

It's a judgement call.

Historically even with incontrovertible evidence it is very hard to get a conviction against a LE officer by either a jury or a judge. both tend to give extreme deference to police.

In this case however, the video is so damning that it will be hard for a jury to get past it.

A judge might well be a better choice. A judge in another county even better.

I have a feeling this is going to end up in the US Supreme Court? Don't take a plea deal Van Dyke your life is already ruined fight it all the way until the end don't give in to the insanity you did nothing wrong! Laquan's family didn't care about him until he was shot they just wanted the big payday if he got a hold of the those women Officers who stayed in their vehicle their heads would have been getting bashed into the pavement.

A simple look at the Tueller Drill would tell you he was justified. Not to mention McDonald was not walking away like the media states he was. He was looking for his angle of attack.
