Day One into Day Two

No one landed any significant body shots.

The prosecution showed that they are going to make this all about race. How that plays to a jury that has a lone black woman on it is anyone's guess.

The defense had a few hiccups, but no major errors. They even extracted a major concession from a prosecution witness regarding what we think of as "fish eye" lenses distorting distance and exaggerating movement.

Before the trial opened, the prosecution dropped four of the Murder counts, pretty much validating the common thought that this was overcharged for political reasons, but you'll never hear that from the courtroom or the media.

Protestors were minimal, running from under ten to almost twenty-five at one point.

On a completely unrelated note, does anyone remember what years and what superintendents L. Flores served as lieutenant and commander? Asking for a friend.

L.Flores made Lt in 2007 and promoted to commander shortly after in 2008 by Jody Weis. After that she was made XO of Special Functions by Uncle Garry in 2012.

Another officer who testified Monday, Joseph McElligott, said he had come within 15 feet (4.5 meters) of McDonald, the same distance Van Dyke was when he later shot the teen. He said McDonald had stabbed the tire of the squad car his partner was driving and struck the window with the knife. But he said he didn't think his partner was in danger. He said they were waiting for an officer to arrive with a Taser to use on McDonald.

What does it take to be in danger my god what if Laqaun broke the window and stabbed you?

Flores made Lieutenant sometime in late 2008, early 2009. She went to 011 as LT from R&D as a Sergeant. She was on 1st watch for awhile then I think she went to afternoons or the CAPS office until she went to 014 as a Commander. At the time, Weis was the boss.

I was thinking the same thing. What kinda partner is that? Would u actually need to get stabbed before he feels you’re in danger? Ahhh, try this one....the City wants to go back to 8hr 6-2. The old way. More manpower on the street. You will actually work 2080hrs in a year. With this schedule you actually work less, I know Daley went nuts when he was told that but he signed off on it anyway.

The prosecutor held the knife daintily like it was a nail file. Actually used 2 fingers. The 9-11 hijackers practically decapitated some of the victims with box cutters. The lock blade knife that LM was armed with was a very sturdy and lethal weapon. I was disgusted at the display out on by this supposed law enfircement official. Nauseated actually.

With the current racial make up of the jury, if the prosecution's strategy is to play the race card it will backfire on them.

It all boils down to reasonable use of force, was it reasonable being in the position that JVD to use the force that he did that night? It's very difficult for a civilian to put themselves in his shoes, and it could be hard for a cop as well who hasn't had to fire a gun while on duty.

No way does first degree murder apply here, there was no premeditation or planning. I could perhaps see a verdict of voluntary or involuntary manslaughter, however if those charges are not an option for the jury then I think he is innocent of murder charges.

The aggravated battery charges could stick, maybe not all 16 counts but a significant number of them.

It was circa 2008 when I had my first encounter with (Ret) Chicago Police 014 District Commander Linda Flores.

I remember I was standing on a crime scene at Jackson/Sacramento and a then lieutenant Linda Flores was just a midnight lieutenant in the 011 district. She was a talkative thing... Full of conversation, she would asked why we only had yellow tape up and not any additional “red” tape etc... SHE even struck up a conversation about some of her police knowledge and experience had come from listening to her boyfriend Judge Vincent Gaughan tell her how crime scenes should look.

I forgot Linda and the judge live together.

Actually a number of charges/counts are dropped in cases prior to the start of trial. Media and run of the mill cases, from dope to murder. However, the charging itself was political and defense started in that direction near the end of opening but quickly backed off. He should've made that the highlight of his opening and put the blame squarely on the city.

Funny how the same media won't mention race when giving a description for an offender who is on the lamb or describing anything when race is important.

I remember seeing this before I became the police and thought it was just me. Now my 20 year career is over and it's just sickening how the media is (now that I am in the know lol).

OT from JVD: I just don't get it. I just don't understand why the media refuses to give out race descriptions when it is imperative. Why doesn't the CPD and all police just omit race from the reports then?

I finished up at 311 due to an injury. I'll never forget one of my last calls. "Hello I wanted to report a theft on Michigan Ave." I replied "Ok, what happened?" Caller said "Two guys walked into our store and ran out with $1,00 worth of clothing." I replied let me give you a report. I asked the usuals and then said "Ok so you said it was two male blacks. Can you tell me their apx height and weight?" The clerk replied "I never said they were black." I said "My mistake (lol) what did you say their race was?" He replied "They were black." I said "I thought you said they weren't black? I'm confused." (lol) He says "They were black but I never said they were black." I said "Wait. They were black but you never said they were black but now you are saying they are black? I don't understand where you are going with this (lol)."

Needless to say it was a liberal store owner who I hung up on, lol. Remember folks BLM.

If you think someone is taking their own life because of rumor of RDO cancellation you are wrong. The last Officer to commit suicide worked the 10.5 hour day. Using your argument those 4 day weekends should have been her salvation. Stop making pithy comments about a subject this serious.

I just listened to the defense opening statement. He made some very good points along with the fact that this should not have been tried as murder. Fingers crossed that this will be the reason he is found not guilty.

Regarding 12 hour shifts:

Not CPD, but when our west coast agency went to 12 hour days for one its low security facilities (back in the day when you went to jail for a year for not paying your child support - you did two week in the main jail to get a taste of jail (most didn't like it) a month at min security out in the country and then off to work furlough were you worked in the day (and paid your child support and room and board).) . We couldn't get people to out in this facility, so we sent to 12s. Two hours of OT built is to the schedule each week. The Camp became the most sought after assignment.

In the 1980s we expanded it to the entire officer (Detectives worked ten hour days - no one would volunteer, despite the 7% and the car, to be a detective so they put them n 10s.)

The office was organized into four teams. The way it works is each team works FRI-SAT-SUN of one week and then has FRI-SAT-SUN off the next. The built in OT is nice.

Before most other agencies went to 12s, we had great cops with tens years on quitting their department to come work for us.

So if you can get it, you should. Gives you a normal life. Home every day - two on, two off, three on, two off, two on, three off. In some ways the 12 hour shift is almost as good as the Fire Departments schedule.

0600-1800 are the normal shits.

I read this BLOG only to vicariously experience how bad the democrats can screw up a city. You folks have the hardest police job in the country.

Good luck to you, and if you can get 12s believe me your home life will improve. Maybe it will help address the mental health issue that SCC talks about.

Whole case is garbage. IL use of force statutes allow deadly force in this incident. He tried to stab a victim with a deadly weapon and then used it against officers in their squad. He then tried to escape while still armed with the deadly weapon. All of the above allows an officer to shoot and kill him legally.

Worked with this goof in 007, not the brightest of the bunch and always telling war stories to the new PPO'S. That being said, totally agree with above comments. In the state of mind that "future DOCTOR" was in that night stabbing or slashing tires, then he took a shot at the window of the squad car "in his state of mind" the window was open and tried to murder a fellow LEO. As far as I'm concerned, that is justified force to liquidate said scholar. Case closed.

Several years back me and my partner saved a 300 pound F/1 from becoming a permanent addition to Davey Jones locker in 35' of water a mile and a half out on Lake Michigan. The amazing feat of saving this whale of a woman was witnessed by a boatload of passengers on the Seadog and 2 other vessels who didn't know what to do in 4' to 6' waves. Unknown to us, we were put in for a lifesaving award which was kicked back by Flores. The irony is everytime you see all the whiteshirts in their dress uniforms , they love parading around with all the medals on their uniforms like Russian generals. Most probably unearned or received on someone elses coat tails. Signed, disgusted and can't wait to leave this shitshow of a dept !

A few years ago I attended a presentation of an officer (another state) who told his story of having had a line of duty shooting.

What he said stood out.

He said he couldn't visibly tell that shots had made contact with the person's body, or that he had killed the guy (still moving). I can't recall the number of bullets, maybe he said 5-10 did and that he didn't know until official reports came out.

In the movies we see the blood and gore of a gun shot wound but that's not the reality from the account of this officer's story. I feel like this would not be common knowledge to the general public. Maybe the jury needs to see the movie version and the reality to desensitize the number 16.

If one is trained to eliminate the threat, and perceives a threat, AND it's not so visibly apparent that a shot has hit or deterred a human body, I can see how reaching the number 16 is feasible. Perception is subjective.

Plus Laquan was a felon making his escape while armed with a deadly weapon which allows use of deadly force by the same statute. I believe it was a mistake to go with a jury. Whole case is garbage. IL use of force statutes allow deadly force in this incident. He tried to stab a victim with a deadly weapon and then used it against officers in their squad. He then tried to escape while still armed with the deadly weapon. All of the above allows an officer to shoot and kill him

Not sure the years L Flores worked within different units in the Dept but when she worked at the Academy as a Sgt she would tell anyone who would listen how smart she was and how she “wrote 90% of the General Orders when she was at R&D. As a retired sergeant and firearms instructor I would like to make a point.
We taught officers to fire until the threat is stopped. No specific number of rounds, just until the threat is stopped.
What may have been a justifiable use of deadly force, gets muddled by the number of rounds fired. If the guy is on the ground with a gun...and still poses a threat, it’s not a problem.
A person armed with a knife down on the ground poses the question, is he still a threat?
I don’t like second guessing any officer. I don’t know what this officer heard over the radio enroute to the call or what he perceived.
If anyone disagrees with me take note of any news report about this shooting and find me even one that does not contain the word sixteen.

Linda, has been dating Judge G for years. Her brother is or was a CPS principle. I have seen the request of a signature to go to court on a yellow OT slip cause her to be overwhelmed, not an exaggeration. She was on scene for a unruly prisoner and stuck her nose too close to the vehicle window where he was sitting. He kicked the window out with some of the glass hitting her face, no real injury. She insisted on felony charges. Judgey got involved and bail was set for $500K to the best of my knowledge. I don't know if she was merit or not, but I honestly think she couldn't handle the stress of sitting for a long promotional exam unless she knew the answers.

When cross on the officer about stabbing the windshield or squad tires..the question should be what was his intent...were they in fear of their lives...how about this simple question asked ..officer throughout your career ..how many citizens have attacked your veficke with a deadly weapon. This defense attorney again should have done simple homework and kept repeating ..so he attacked your squad car ..so in affect he would have attacked you or anyone else ...just can't believe this attorney is that bad!

Defense asked that exact question..judge shut it down.

I am not sure there has ever been a class like 85-4A and 4B, they had more promotions than ever, ever, ever. It was a very small group, maybe 70, had more Commanders, Captains, Sgts. Flores was in that group. Amazing little class. Hell of a group, still a few commanders left. Check it out!

They showed an enhanced video today. It's much clearer that McDonald swings the knife wildly at one point as he's moving. And it appeared that he turned his head and torso toward Van Dyke just before the shots were fired. That in combination of the "stare with the focus beyond". I believe it was totally justified. As far as the following shots, the expert witness psychologist can explain that, but anyone who's been in a shit-your-pants shooting, gets it!

The officer is allowed to provide his opinion based on what he was confronted with and his law enforcement experience. This occurs every day in court so Im not sure where you got your information.

If the prosecution is making the case that this shoooting was all about race can't the defense argue that JVD has made x amt of arrests of male blacks with weapons (guns/knives) and didn't shoot those offenders? Why not? Because they followed direction/orders.
