COPA: Not Qualified

The Illinois Law Enforcement Training and Standards Board came up with a blockbuster ruling - COPA investigators are NOT to be lead investigators on police involved shootings:
  • The Executive Director of the Illinois Law Enforcement Training and Standards Board (ILETSB) has asserted in a recent letter that Chicago’s police oversight body is not legally qualified to investigate police-related homicides.

    In an October 28 letter, Brent Fischer, Executive Director of the ILETSB, asserted that Chicago’s Civilian Office of Police Accountability (COPA) is, in his opinion, without statutory authority to investigate police-related shootings. Fischer’s position, outlined in his letter to FOP President Kevin Graham, reinforces the identical position taken by the Fraternal Order of Police.
This throws a largish wrench in Rahm's and Lisa Madigan's "consent" decree:
  • The letter also poses grave questions for the proposed consent decree over the Chicago Police Department currently being pursued by the city and AG Madigan. The consent decree would allow COPA to continue with these investigations. Other complicating factors are several scandals currently taking shape in COPA and its predecessor, IPRA.

    Former Chicago Police Commander Glenn Evans claims IPRA investigators ginned up false allegations that led to his criminal indictment. Evans was acquitted of every charge. Another lawsuit from a former IPRA employee claims he was told to change his findings in a police-involved shooting to make the shooting unjustified. In yet another case, FOP discovered that COPA withheld the existence and the findings of outside investigators in an investigation of a police-involved shooting.
It certainly looks like this is going to drag out far past the election.

That's why COPA's clueless investigators aren't the lead investigators on police shootings. They're just there to have their hands held while they try to figure out a way to find some sort of wrongdoing by the officers.

During my Police Board Case , the IPRA Investigator Galindo failed to provide a key To/From which Deptuy Chief Dugan issued a “NOT SUSTAINED” finding on my CR during the discovery phase. I was only informed of it after being found guilty by the Police Board and was not allowed to use this in my defense. In this To/From Dugan also said that the investigation was “ sinister” and that the IPRA Investigator has committed a Rule 14 Violation in her conclusions. If I had been provided this or known of its existence then we would have subpoenaed Investigator Galindo and would have IMPEACHAHED her before the Police Board. Anyways after a modest suspension that was half served up until the Board hearing it went to termination upon the boards findings. Since I had never had a SUSTAINED CR the Board determined there was no way to go forward with TERMINATION, however I was given a very very lengthily Suspension. I appealed and the Judge overturned everything and basically found the City/ Department guilty of what they had accused me of and ultimately the Department/City accepted the Judges findings which were scathing to the City. This entire process took over 8 years, I would not wish it on my worst enemy.

training board lacks the legal authority to tell the City who has to investigate police shooting; no where in police training act is the board granted this authority. The same board still allows the city to grant police powers to private security guards without requiring said guards to complete full-time or part-time certification, so the city should tell the board to pound sand. Having said that, copa is full of fools that will only be stopped by civil rights lawsuits against city and copa employees in their official and individual capacities.

Will never happen. No small municipalities will ever investigate the CPD. If they were ever found liable in a lawsuit the financial burden would wipe them out. The only agency that makes any sense is the State Police or a Multi-Agency Task Force made up of experienced homicide investigators.

Pcria doesn't say the investigators need to be certified police officers. Standards board has no power of enforcement, neither does copa. At the most copa makes recommendations to the states attorneys office. This won't change anything except the possibility of the SA office swearing them in or some other state entity. The public hates the police and they will find a way. Worst case is copa gets replaced with an even more liberal bunch. Not all of the people at copa are anti police but there are enough to push the agenda. You dont want to alienate the good ones.

They have the designation, but they don't actually do any of the real investigation. Street deputy runs the show, detectives and forensics personnel collect all the evidence, witnesses, etc., and COPA gets walked through everything by the street deputy. The investigation of a police shooting needs to be done by actual law enforcement personnel. COPA doesn't have the training, skills, knowledge, or ability to conduct an actual criminal investigation. They just take whatever is given to them by the actual police conducting the actual investigation, and then try to figure out if the police did anything wrong so they can hang them. COPA "investigators" are generally clueless and confused. They are unqualified and unable to do the job they've been assigned to do. Their position was created to appease people who believe there's some huge conspiracy in our department to cover up every police shooting, because every police shooting involves some wrongdoing by the involved officers. The state police should be investigating our shootings, but they don't have the desire or the personnel to deal with it. So we get a bunch of civilians with an agenda, not an impartial investigation.

PCRIA doesn’t say investigators need to be certified police officers . PCRIA Does say that to investigate a police involved shooting at least one of the investigators must be certified as a lead homicide investigator by the police training standard board. Our former commander in A/N, argued that the city was knowingly violating state law by allowing COPA to be the investigators on use of force. He continuously went to the former chief of detectives (Roy) and said as much. I believe that he also met with Kwame (author of the law) and Lisa (I didn't see nothing that my daddy didn't see) and asked for an investigation, stating that the ISP should be the only outside agency investigating CPD shootings but he was consistently told "It'll be fine - don't worry about it"! Guess he was right after all.

During my Police Board Case , the IPRA Investigator Galindo failed to provide a key To/From which Deptuy Chief Dugan issued a “NOT SUSTAINED” finding on my CR during the discovery phase. I was only informed of it after being found guilty by the Police Board and was not allowed to use this in my defense. In this To/From Dugan also said that the investigation was “ sinister” and that the IPRA Investigator has committed a Rule 14 Violation in her conclusions. If I had been provided this or known of its existence then we would have subpoenaed Investigator Galindo and would have IMPEACHAHED her before the Police Board. Anyways after a modest suspension that was half served up until the Board hearing it went to termination upon the boards findings. Since I had never had a SUSTAINED CR the Board determined there was no way to go forward with TERMINATION, however I was given a very very lengthily Suspension. I appealed and the Judge overturned everything and basically found the City/ Department guilty of what they had accused me of and ultimately the Department/City accepted the Judges findings which were scathing to the City. This entire process took over 8 years, I would not wish it on my worst enemy.

Pcria doesn't say the investigators need to be certified police officers. Standards board has no power of enforcement, neither does copa. At the most copa makes recommendations to the states attorneys office. This won't change anything except the possibility of the SA office swearing them in or some other state entity. The public hates the police and they will find a way. Worst case is copa gets replaced with an even more liberal bunch. Not all of the people at copa are anti police but there are enough to push the agenda. You dont want to alienate the good ones.

training board lacks the legal authority to tell the City who has to investigate police shooting; no where in police training act is the board granted this authority. The same board still allows the city to grant police powers to private security guards without requiring said guards to complete full-time or part-time certification, so the city should tell the board to pound sand. Having said that, copa is full of fools that will only be stopped by civil rights lawsuits against city and copa employees in their official and individual capacities.

You would think the FOP lodge offices, either state and national would demand an top bottom of every sustained IPRA/COPA investigation, and seek the firing of any IPRA/COPA investigation found to have engaged in misconduct , gross incompetence, or criminal action in the performance of their duties.
IPRA is reopening old CR numbers that were not sustained? Why can't the same process be done for sustained investigations?
You know, like Kimm Foxx is doing for the Ron Watts arrestees?
Does the union representing IPRA/COPA employees and the FOP have some sort of one way gentleman's agreement not to pursue IPRA COPA investigators jobs?
I would think that an IPRA investigator who was
arrested multiple times
sued twice by a police officer for battery
attacked fellow employees, both sworn and civilian,
committed perjury and presented false official reports to IPRA and numerous courts,
misused city of Chicago equipment while breaking the law and violating policies
( and that's the tip of the iceberg)
would warrant a union demand to fire him or her ( M. Campbell) and seek charges and damages.
But again this ain't the real world, it's Chicago.

I don't think the City does it anymore. At one time it was pretty common for private guards to get some kind of municipal police department badge. In the burbs they sometimes called them reserve marshals. But the state has restricted that practice pretty seriously.

But as far as I know, the city still has "special" police that have some limited police powers that are basically security guards for certain city facilities. IIRC, the police superintendent can issue that kind of police commission to anyone he wants to with no training required. How common it is these days is hard to say. I bet it has not completely gone away though.
