New Jersey Bans Cops Carrying

  • A new gun law went into effect in New Jersey that makes it illegal for law enforcement to carry duty weapons off-duty.

    Trenton, NJ – The new law that limits gun magazines to 10 rounds went into effect on Dec. 10 without the legislature taking up the amendment to create an exception for law enforcement officers.

    Modern firearms issued to patrol officers generally hold 12 or more rounds of ammunition.

    That means that just about all law enforcement officers in New Jersey will be breaking the law if they carry their assigned duty weapons while off duty, including just being home with them, unless they live outside of the state or leave their magazines behind at work, rendering the weapons near-useless.
New Jersey is certainly the San Francisco of the east coast.

Serves us right since we are so anti 2nd amendment anyway. How many CPD officers would arrest a valid out of state concealed carry person in Chicago? The answer is a bunch would make that arrest. There is zero reason to mess with valid CCL holders, especially if they’ve done nothing else wrong, aside from carrying their gun. Uphold the 2nd amendment rights of people, and tell the politicians we aren’t enforcing their unconstitutional laws.

Isn’t that the reason the Law Enforcement Officers Safety act was put into place? It’s Federal law and says any law enforcement officer can carry their weapon in any jurisdiction. Wouldn’t that count for an officers “home” jurisdiction?

-The House of Representatives also defeated, and the Senate refused to consider, proposed amendments aimed at preserving local law enforcement agencies' discretion to regulate "the conditions under which their officers may carry firearms." Thus, both the words of LEOSA and its legislative intent clearly establish that LEOSA applies nationwide, including the home state of the individual.

L/E in AZ & other states when traveling 2 California Buy these 10rd magazines 2 comply with these dumb ass laws , & guess what the 10rd magazines cost more than the 15 or 17 rd magazines . The magazine restrictions were an oversight by the legislature. It has been corrected.

And those eastern states like New Jersey will still funky with you even with a HR218 card. While you can carry a gun you are still subject to local magazine and ammo ordinances.

Unfortunately, nationwide reciprocity is dead. Since the communist democrats took over Congress it is dead.

Those who choose to exercise their LEOSA rights to 50 state carry should make sure to learn what is allowed. When out of your jurisdiction and state, you are considered a citizen with CC privileges and must follow state and local laws. HR does not exempt you from bans limiting you to 10rd mags but as of 2013, you are exempt from bans like NJ hollow point ban:
"qualified active and retired law enforcement officers may carry ammunition in States which may have prohibited the possession of certain ammunition by persons not actively serving in law enforcement within that State."

Make sure you are familiar with what is and isn't allowed...

That is, hopefully firearm ignorance *IS* the reason for this fucked-up Law, and not just rabid hatred of cops -- 'Why do cops need more than 10 bullets? Just to kill more Black Men?!!? -- and this Law is a big FUCK YOU to police officers in the state.

The ironic thing is that New Jersey isn't the first state to do something this f--king dumb. Shortly after the Sandy Hook Elem School shooting, in 2013 New York State passed a Gun Control Law called iirc, the 'Safe Act'. It limited magazine capacity for Semi-Auto Firearms to.. ya better sit down ... Seven Rounds! (not kidding). And initially it didn't exclude police firearms either. Luckily, they corrected the Law for police officers BEFORE the law went into effect.

This screw-up by New York State was HUGE national news, so it's surprising that nobody in New Jersey remembered this before they wrote, passed, and enacted this STOO-PID law.

Hawaii one ups NJ by also limiting out of state active and retired to only 10rds but also requiring you to register your firearm if staying for more than 5 days with the local county Chief of Police.

It's obvious to many, when making up gun laws, law enforcement needs are never even considered. They want a police force liken to England. Don't be stupid, join the NRA. If you have a problem with the NRA, join the Illinois Rifle Association. Help you relatives, friends and others get into the shooting sports. Encourage them to go to gun safety classes, we are in deep shit my friends.

Also, by Illinois statute, LEOSA holders are not subject to the Illinois "Gun Free Zone" signs....Although they may be asked to leave...they can not be charged with it's violation....

NYS also has a problem with high capacity magazines. Be polite and ask for consideration when stopped by NYS Troopers, no reason to get jammed up when passing through another state. They are just doing their job and just like us have discretion to what laws they enforce.

Before LE could carry in all 50 States, Chicago Police Officers would get locked up for carrying their weapons in WISCONSIN and TENNESSEE. I’m sure their were others. Indiana would let LE carry back than no matter where they were from.

Had many interactions with TN L.E. They are golden men of the law. Right wingers and they hate the same as we do. They don't play with any shit bag criminals. Always carry a CPD patch and give it to a TN copper. You will never ever have a problem in TN. The copper' there will give you their home phone or vell numbers.. They are truly the real police.
WI, I hated LE there for 40 years. They would trick bag CPD guys all the time , mostly their state police.
We got even. They drove milk trucks in Chicago and IL years ago. Automatic stop. We played nice and they admitted they had a pistol in their car. They hit the shitter and their gun was history. Always missed the first court fate to make them travel. The judges in Cook county back when also hated the WI state police. They locked up 3 sitting old time judges from cook.
They pled out and not knowing their gun was c and d ed. Also they took a 30 day suspension. I was in the old gang crimes and a Major called my cmdr beefing. I heard the call and my cmdr mother fucked him I bet he was crying. My cmdr ordered all WI plates take a stop. We had fun messing with their citizens and they always were cited after a simple traffic violation and check the box must appear. I would not take a crap in that inbreeding state of WI. IN guys are golden too from what I hear now.

I'm sorry, but that's not entirely correct. If you fall under LEOSA carry, you are required to follow Federal law in that regard. You ARE NOT considered a citizen of that state with CC privileges! But, if that individual state has a Gun Free Zone, then you are required to follow that state law unless you are on active duty or posses a state CC permit.

You should also know that NJ does not allow retired officers to carry without a NJ carry permit. NJ politicians do not believe LEOSA covers its retired officers. Butt-heads!

NJ and New York City have long given out of state or retired police officers problems with regards to carrying concealed, LEOSA, or not. I have heard that they took the stance that LEOSA is an affirmative defense that you can use in court during your trial. I am not sure what is going on at present, but I would not test it. The carrying of hollow point bullets is another issue where you could be charged. NJ is a stgate, a very high tax state, run by gun grabbers of all sorts and now it seems, anti-police types as well. There was a civilian who had a declared handgun in his luggage who had no intention of stopping off in NJ. His flight was diverted because of weather. When he went to recheck his bag he was arrested, convicted and sentenced to 3 years in prison. He did serve some time. It is a crazy state and avoid it if you have any guns with you.

Yes, you are correct, but that does not mean you won't be arrested. In some jurisdictions LEOSA is considered " an affirmative defense" that you can bring up during your trial. You will be found not guilty, most likely, but it will cost you. So much for sensible and " common sense" gun laws.Only disarming the entire population will satisfy the liberal left and put a real dent in gun crime. They know it and you should know it. The left lies all of the time.Obama lied, Hillary lied. Now we have Pritzker who is the most anti-gun of all. Look for a slew of gun grabbing legislation coming in 2019.

Although LEOSA preempts state and local laws, there are two notable exceptions: "the laws of any State that (1) permit private persons or entities to prohibit or restrict the possession of concealed firearms on their property" (such as a bars, private clubs, amusement parks, etc.), or "(2) prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park"[1][10][11][12] Additionally, LEOSA does not override the federal Gun-Free School Zone Act (GFSZA) which prohibits carrying a firearm within 1,000 feet of elementary or secondary schools. About the Illinois Retired Officer Concealed Carry (IROCC)

On July 22, 2004, Congress passed, and the President signed, the Law Enforcement Officers Safety Act of 2004 (the “Act”), Public Law Number 108-277, 118 Statute 865 (2004), codified as 18 U.S.C. §§ 926B and 926C.

With certain limitations and conditions, the Act exempts active and retired “qualified law enforcement officers” from state laws and local ordinances prohibiting the carrying of concealed firearms. In accordance with the Federal Act, Illinois passed Public Act 94-103 (2005) that provides for the annual firearm qualification of qualified retired law enforcement officers required under this federal law.

Appears you are allowed to carry. Doubt they want to violate federal law when confronted

Please take a moment to consider what is happening here. The left has passed a law that makes a criminal out of law abiding citizens and Police Officers who own name brand unaltered semi automatic pistols. Whats next. Orders to turn in our semi automatic pistols or they will issue warrants and search our homes and confiscate our NOW illegal guns because they have 11, 12, 13, 14, or 15 round magazines. Or the next time you fire at a range or if you a retired Police Officer qualifying yearly will they have "range Agents" to arrest us and confiscate our semi automatics. Think it can't happen. It's already started in New Jersey. Of course they don't want to put real criminals in jail. but gun owners they apparently will.

Negative kid, My vehicle has no identifiers of any kind on it. Not even a dealer license plate frame. Windows are tinted dark so even a kid like you cant see in my vehicle when it is parked. It is a model that is not used by any Police agency anywhere. So when you are driving home in your jeep unlimited wrangler with all kinds of lights and Police plates on it, you be careful kid.
