No More Mugshots? (UPDATE)
- Since the Southwest Chicago Post was founded in early 2012, we have brought news of crime--large and small--to the people of the Southwest Side.
That's important, we know you agree, because folks want to know what's going on. Where the garage break-ins are occurring. Where the home and business burglaries are happening. Details about robberies, batteries and assaults.
Folks also want to know about people charged with crimes--who they are, where they're from and what they look like. That last bit of detail--what they look like--requires a mugshot.
Guess what they aren't finding any more?
- You see, the Chicago Police Department has decided to no longer post mugshots of people they arrest for misdemeanor crimes--in other words, for the vast majority of arrests they make. And when we say "misdemeanor," please don't think we're talking about a guy who steals a pack of gum from a store.
These days, "misdemeanor" often includes burglary, robbery, assault, battery and domestic battery, weapons violations, you name it. People often charged with violent crimes.
The Department has (through spokesweasels) refused to provide the media with a satisfactory answer as to why information is not being disseminated. We know that the Department regularly distributes full descriptions of suspects to the media....who then refuse to publish the actual facts. Perhaps the Department is merely bowing to the prevailing leftist group-think and no one is actually committing crimes - property just goes missing, bullets just fall out of the sky, and two-year-old children just chop themselves into pieces and throw themselves into lagoons.
UPDATE: Comments are saying this is a change in State Law. Because a misdemeanor theft offender has never turned into a home invader. Or an opportunistic rapist. Or a murderer.
So while police are forced to be "more transparent," the justice system becomes more opaque and the sheeple are kept in the dark.

5 ILCS 140/2.15 – Arrest Reports and Criminal History Records. (Public Act 100-0927)
New language in section 2.15(e) of the Freedom of Information Act provides that notwithstanding the requirements of subsection (a), a law enforcement agency may not publish booking photographs, commonly known as "mugshots", on its social media website in connection with civil offenses, petty offenses, business offenses, Class C misdemeanors, and Class B misdemeanors unless the booking photograph is posted to social media to assist in the search for a missing person or to assist in the search for a fugitive, person of interest, or individual wanted in relation to a crime other than a petty offense, business offense, Class C misdemeanor, or Class B misdemeanor.
If the Southwest Chicago Post paid attention they would know a new restorative justice law was passed that prohibited the posting of misdemeanor booking photos in the State of Illinois. Illinois misdemeanor booking photos can be disseminated for certain non-criminal purposes, such as missing person who was previously arrested.
Thanks for protecting the criminals and not us.

As I understand it, this is actually due to a change in state law that took effect at the beginning of the year:
"Provides that booking photographs, commonly known as "mugshots", shall not be made available on a law enforcement agency's website or social media page unless the chief law enforcement officer of the agency deems that there is an imminent threat to public or personal safety and the publishing of the photograph would assist in addressing the imminent threat to public safety."

So the press would have to FOIA request the photos, which would take forever, vs. just copying them from the arrest website.
I think this one of the new laws passed by state legislators for 2019. Misdemeanor arrests can no longer have the mugshots released.

Theres a state law that forbids sharing mug shot photos as of January 1st. This is just another "criminal justice reform" that makes criminals more victims, then offenders. Once again, everything in Cook County/Chicago is viewed through the prism of Race and Politics. The Media and Elected Officials do not want to create an impression, that any Specific Race, commits a disproportionate number of crimes. 2019 Illinois passes new law to further crack down on public mugshot extortion. The bill would also ban local police departments from posting mugshots of low-level offenders on their websites or social media pages. However, there's an exception for active investigations where publishing a photo would help police. The Illinois State Police is exempt from this, as are news media outlets.
It's too embarrassing for the politicians to release photos because so many of those photos reveal the "usual" suspects when the public is being fed the race neutral criminal idea. Checking out the CWB CHICAGO web site it is revealing indeed with about 90% of arrests being the "usual" suspects.

Story: An armed group of six people has been luring males to meet up through dating websites before robbing them over the past three months in the Lawndale and West Garfield Park neighborhoods.

But instead, four males and two females were waiting to rob him at gunpoint of his belongings and, sometimes, his vehicle, police said. At least two of the males were armed with handguns.

Thank the private mugshot websites that mine the mugshots, post to the websites, and then charge a shit ton of money to have them taken down. Im sure the judges and politicians didn't like their kids pics being posted when they were out buying heroin in the ghetto.
That's a very well-written and well-reasoned opinion piece. Every single mayoral candidate should answer to it and citizens can do their part. Go to a campaign event and ask for yourself, before or after the speech if necessary. MAKE THEM LOOK YOU IN THE EYE AND ANSWER. Don't wait for the media to do it for you.

I did background investigations for Homeland Security for years. Chicago has always refused to cooperate in any routine background investigation unless prints were used. They refused to do a routine name check or to provide a list of " calls for police service" to the address of the person under investigation.

You can still post mugshots for Class A and Felony charges. You can also post mugshots for anybody wanted on a warrant, either original warrant or BFW.

That only affects *social media* it does NOT affect or limit distribution on the department's official web page, as has been done for years.
Further, you are overlooking (a) as cited in your excerpt. Police agencies are STILL required to release mugshots for ALL arrestees within 72 hours of arrest:
“(a) Arrest reports. Your link goes to the legislation *as introduced,* not as PASSED. There were significant changes and there is much misinformation (possibly disinformation, too) regarding the final bill. Police agencies are REQUIRED to disseminate mugshots for all arrests to media upon request. What's new in this regard is that agencies are BARRED from posting certain misdemeanor mugshots to *social media* but NOT barred from posting to their official web pages.

If a FOIA Request has to be filed, it's pretty simple - file a blanket FOIA request on 1/1/xxxx for ALL mugshots, for ALL crimes, for ALL arrestees for the year.
Let the LE Agency send the information within 7 days of it being captured - publish it on your own website - for the public good/education.
IF the Agency complains the request is too expansive, start filing FOIA's every day for the information captured during the prior day. Again, it's exempted from the "Recurrent Requester" status because it's going to be published for the public good/education.
Once the Agencies have to start hiring extra staff to handle all the FOIA requests EVERY DAY, this nonsensical law will get reversed.
See, just one more of the benefits of voting for our communist/socialist democrats.

O.T.- I toured a college campus with my son today. Carthage in Kenosha, WI. Could not help but to notice a sign on an office door of assistant professor of chemistry Walter Smith. Sign read: that every 28 hours a black man, woman or child is killed by a police officer. I told my son on the way back home and we both agreed that Carthage was not for us.
How about the hearing on the two asshole judges that just got reinstated. Judge Clapps and Judge Hooks. Nice transparency there boys. Maybe Cabrini Kim or Lisa the Skank could ask someone who is a real lawyer how to sue and “ pierce the robes of secrecy”. And find out how these two jagoffs were reinstated.
Proceedings were private. Do judges have a code of silence? Did the crime lab do all it could to identify the gun Clapps dropped? Was there a cover up? Was there a conspiracy? Did the sheriff testify that he say a gun?
Looks to me like a code of silence between everyone assigned to the courthouse. Judges, States Attorney, Sheriff’s office, police department, state crime lab.
