"Unusual Step"

  • In a highly unorthodox move, the Illinois attorney general’s office is “reviewing” former Chicago police Officer Jason Van Dyke’s relatively lenient prison sentence, a spokeswoman for the office said Thursday.

    “We are going to do a careful review of the record and the law and make a determination based on our review,” spokeswoman Maura Possley said in an email.

    Possley declined to elaborate on what exactly the office is examining, but legal experts told the Tribune the attorney general might be considering whether to petition the Illinois Supreme Court to order the trial judge to sentence Van Dyke again — only under tougher guidelines this time.
The defense team had agreed to forgo an appeal based on the length of sentence - which is exactly in line with hundreds of other sentences handed down by the courts for similar convictions for similar charges with similar backgrounds. But the opportunity to waste taxpayer money for political purposes may prove to be too big a draw for the assorted bad actors currently occupying political office.

Kwame brings an entirely new level of incompetence to at AG Office. With Kwame and Lil’ Kim, you can expect the very worst. By the way, as I was typing “Kwame”, the autocorrect kept changing it to “Jeanne”, and then “Keanu”. He’s so irrelevant that autocorrect doesn’t even know.

Make a determination of what exactly? It’s Cook County. Sentences are light - if you stick around on electronic monitoring long enough to be sentenced at all.

How about malfeasance for a SA who makes her own rules against prosecuting cases for distinct violations of illinois statutes: i.e., murder by accountability, felony theft for those that qualify as a felony based on the value of the item stolen, and a host of other statutes that she selectively chooses not to prosecute because she doesn't believe the law is just. Didn't she take an oath of office? Isn't she supposed to uphold the constitution and laws of the land? Maybe Kwame should look at our SA.

That was immediately after the sentencing. The political winds started to blow right after with some calling for an investigation later that night. The "community" is not happy, the mayoral candidates are not happy. Expect it to happen

If anyone was listening on election night Kwame basically said he was going to do what he is doing now. It was obvious to me as a listener that he intended to right the wrongs of the past. I’d expect that this is just the start. Just as Rauner had a crusade against unions I feel Kwame will be obsessed with righting everything he thinks is unfair.

On one hand, we have set a precedent in this county/state of being lenient in sentencing for murder. One the other hand, we also have what I will call the Cozzi double "jeopardy" standard for LEO's. When the community is not satisfied with justice, they refer to anyone else who doesn't have the Balls to make a stand for what is the right thing to do. I still cringe when they call LQM a victim in the news. I call him a named offender in a case report.

I sincerely pray for JVD and his family to put this Media Circus Nightmare behind them in the near future.

Unfortunately it doesn’t work that way. She was elected as the ASA and has the discretion as to what cases to prosecute and which ones not to. Also, she decides if there is enough evidence to charge. Wish it wasn’t that way

IF the AG can allege some kind of wrong doing on the part of the Judge - then FILE CHARGES against the Judge. File a complaint with the Licensing Board for Judges.

But the Prosecutors and the Defense negotiated something in good faith, the Judge signed off on what they negotiated - just like 100000 other plea agreements have done, and that's that.

They don't like it now? Fuck them. Welcome to that little thing called the CONSTITUTION where they don't get to try someone twice for the same crime. Double Jeopardy and all that...

But then again, this is IL, Crook County, and Chiraq so those pesky constitutional things don't mean shit to liberals....

How long until we can bring back tarring and feathering? Or the gallows on the public square for corrupt politicians?

You’re lucky he took the 60 days just to get it over with. Otherwise he would have been found not guilty. It was a shit case and would never have been charged otherwise
