Fourteen Year Old Shooter

  • A judge allowed a 14-year-old boy to go home and come back Monday after he was accused of opening fire at the CTA’s Argyle station in Uptown this week.

    “Over our objections, the minor was released to the custody of a parent,” Cook County state’s attorney’s office spokeswoman Tandra Simonton said in an emailed statement.

    The boy, who appeared in juvenile court before Judge Linda Pauel on Friday, is charged with two counts of attempted first-degree murder and aggravated battery with a gun.
And it's the police's fault!
  • Prosecutors requested that the boy be held in custody, but the judge found that under the law he must be released because he was held in custody for 42 hours by the police and was not brought before a judicial office within 24 hours, Simonton said.
An error? Or an overabundance of caution?
  • Chicago police said they were worried for the safety of the boy, especially in light of the fact that his picture, taken by CTA surveillance cameras, has been posted in multiple news reports.

    Prosecutors also asked for electronic monitoring, but that was denied as well, Simonton said.

SCC, unfortunately 90% of the Department has no idea what you mean by "Yummy Sandifer." More importantly,they dont realize that we are now an agency without a real mission. DON'T enforce drug laws but learn to give narcotic antagonists to save a junkie. Law enforcement is siMply over in Chicago.

Two men, 34 and 41, were wounded. The 34-year-old was hit in the back, abdomen, buttocks and groin and was taken to Presence St. Francis Hospital in Evanston in critical condition, while the other victim refused medical treatment for a graze wound, police said.

During a Monday news conference near the scene, police said both victims were targeted by the shooter.

I Think that the problem with the cook county justice system is that the only party held liable is the police.

He is charged with attempted murder and docent even have to wear a tracker. Docent the judge realize that would help finding the body? Its hard to decide if I want him to make it through the weekend or not. If he makes it it will just be postponing the ineffable with the chance he would kill some innocent persons before he meets justice.

So many coppers and supervisors believe the custody clock begins when the arrestee arrives in the station. It actually begins when the person is no longer free to go, i.e. the street.

Also, the 24, or 48 hour rule requires the arrestee to appear before a Judge within 24 or 48 hours...not to have changes approved within that time frame

You actually get a lot less than 24 or 48 hours

No its not a law-its a City General Order. When dealing with juvie offenders, you must have your case put together as much as you can before arresting him because you have to have charges approved and the paperwork before a judge within 24 hours. I don't know the circumstances that took place to detain this kid over 24 hours. But be aware of this: this is NOT a law. This is the guidelines that the city has placed upon us (Chicago PD). The Supreme Court has determined "a reasonable amount of time". Many of our suburban police departments still use 72 hours as the time in which to charge adult offenders. We used to have 72 hours for adult offenders and then the City made it 48 hours and then they made it 48 hours to have the paperwork before a judge. Therefore, if there are reasonable circumstances that led to detention for over 24 hour hours regarding this juvie offender then all is good. The issue we have is that the Juvie Court judges are extremely liberal. Thus the judge let the kid out but the case is still pending.

Not sure about the 24 hour rule for juveniles.

But as for the 48 hour rule for adults that is a CPD policy.

Genrrally a person arrested must be processrd and made ready for bail within a reasonable amount of time. Usually held by courts to be 72 hours. Chicago took it on itself to go with the 48 hour time limit.

He was in city custody a lot less than 24 hours. The county failed to get him in front of a judge on time. So many coppers and supervisors believe they are experts when they don’t have a clue what they are talking about.

I can actually see the logic of this decision. After all, white 14-year-olds are released to the custody of their parents - you have to treat black 14-year-olds the same way. It's called equal rights under the law. As far as what the 14-year-olds have actually done, well, no one forces you to even think about that - it's not something you focus on - it's too inconvenient.

Years back a Hispanic judge in Juvie ct let a hispanic youth charged with murder released to his parents stating that it was proper as it was only his first murder. Forward a couple of weeks and bingo,#2 was notched up by the minor respondent,as they say in court. No comment from the judge. And so it goes officers. Get out there and get'um. 19-P

A 14 year old with 16 arrests shoots two people and goes home with mommy. Almost 30 years in law enforcement, most of that pushing a beat car, and it's one of the goofiest things I have seen on this job.

You know, this kind of news make me really angry. I have two boys myself and despite being a single mother I always know where they are, what they do and that they never are" on the loose ".
They are being provided with love and care.With everything they need at age 12 and 8. I wouldn't call myself a good mom if I let them out of sight even for a moment. Of course, they are being given a certain amount of freedom but it is a parent's responsibility to make sure the child is safe and do not get into trouble.
I am amazed with hundreds of teens in this City going free anywhere they want and doing anything they want. Acting like animals without respect for people or property. Or both.
The parents only show up when something happens and they blame POLICE?!
Unbelievable!!
I am very sorry, Officers, you have to deal with all this.
I am teaching my kids respects to law and people who enforce it. Without the law there is only chaos and death.
It is time for Chicago to realize it.
