COPA has Confidential Informants?

And their trolling your social media, copying inordinate amounts of files and failing to sign affidavits in violation of state law:
  • During a recent FOIA request, COPA informed a requestor that there is information that could not be released due to it compromising the identity of their confidential source. So apparently COPA gets to now have “CI’s” and run covert investigations.

    One minute they’re getting Search Warrants for Officers property, the next they’re working with Confidential Informants.

    This same FOIA request also revealed that the same “confidential source” went back as far as 2013 to report a social media post that was made by an Officers family member. Yes, they are now not only spying on us, but our family members, as well and have every intention of holding us accountable for what others post to social media.
Here's the relevant portion of the reply to the FOIA request (click for larger version):

Sounds like former alderasshole Arena's little helper Leslie Perkins was busy downloading a lot of social media postings. By the way, those 12 CD's would hold roughly 8.4 GIGAbytes of information - about 4.2 million pages of printed material, which works out to 840 boxes of paper (10 paper reams of 500, 5000 pages per box). That a lot of information for a so-called "oversight" agency. It certainly sounds like a lot of government overreach, too.

Considering you would have no reason to request anything from a public facing facebook page, as anyone could access it and record what is needed... Am I correct in understanding that COPA is somehow attempting to get information in private messages or other non-public facing portions of officer's facebook data? So they're attempting to penalize private conversation?

We are unwittingly voting our Rights away. FOIA requests can be denied if overburdensome. Who determines that? What is the criteria for determining overburdensome? The appeal process is a joke. If this OP doesn’t get cops to get off of Facebook, Twitter, etc, etc, etc then they got holes in their head. It only takes ONE INCIDENT on the job or off whether you’re a hard charger or not......... The fact that your accounts are being surveilled (spied on) tells you how laser focused the powers that be (SJW) to nail your ass.

Strong source tells me a former police officer from the detail unit who was caught trying to shake down an illegal worker at his friends resturant for $2500 but not charged criminally and was fired,then retired but I dont know if they allowed it is working with COPA and engages coppers at Functions who have open CR's with small talk and tries to extract info to use against them. Poor guy is desperate, house is in foreclosure, owes everyone big time. RM is his initials.be careful.

Funny how the attempted carjacking/robbery of a COPA employee arriving for work in the wee hours a few weeks ago got absolutely no media coverage. I am on furlough with no access to department computers, but do a location history/check of 1615 W. Chicago Avenue on (IIRC) 04 or 05 December, 0500-0730 hours. Karma is a bitch. Apparently Ms. Petersen does know how to redact confidential information/names from a FOIA request. I hope the requester asks for a review by the AG's PAC, although the Democrat AG will probably quash the request. If that doesn't work, I hope the requester seeks relief in the courts.

What is this world/city coming too. Maybe someone needs to remind these incompetent employees that they are part of a government agency and as government employee, they must operate within the provisions of the constitution.

The fix for COPA is civil rights lawsuits. Bunches of them. under 28 USC 1981, 1983, and 1985.

Also start filing complaints with USDOJ that a non-law-enforcement agency is filing false search warrant applications (because COPA has no legal authority to apply for, or execute search warrants under Federal or Illinois law or the COPA Ordinance). In addition, if any City lawyers are seeking OR approving such warrant applications, file complaints on their law licenses with the Illinois Attorney Registration and Disciplinary Commission for committing the crime of Official Misconduct as City employees, because they should know COPA cannot apply for or execute search warrants.

NOTE: COPA can subpoena witnesses, documents, and other items under the COPA Ordinance, Section 2-78-125.

What Is Traversing a Warrant (a Franks Motion)?
Suppose your home or office was subject to a police raid using a search warrant. You knew you had nothing illegal inside, so you were not alarmed, but you were still annoyed at the disruption. However, police emerged from the search with two kilograms of methamphetamine, a large sum of cash, several firearms and a few hundred rounds of ammunition. You were certain it was planted and therefore the affidavit supporting the search warrant must have been falsified.

What can you do to have the evidence suppressed? One option it to traverse the warrant. What does this mean?

Traversing a warrant means challenging the affidavit and the information therein as false. Franks v. Delaware (1978) 438 U.S. 154, 155, 98 S. Ct. 2674. This is a limited right and must be based on reasonable information or else such challenges can undermine the prosecution of the case, as well as other cases. People v. Panah (2005) 35 Cal.4th 395, 456, People v. Lewis (2006) 39 Cal.4th 970, 988.

As the reader of this article may be well aware, a search supported by a warrant is presumptively reasonable, so overcoming this presumption can be a tough argument. Moreover, even an insufficient affidavit does not require suppression of the evidence obtained if the police acted in a good faith belief that the warrant was valid. U. S. v. Leon (1984) 468 U.S. 897, 104 S. Ct. 3405.

This “good faith” exception is unavailable, however, in four limited circumstances outline in Leon at 923; see also People v. Camarella (1991) 54 Cal.3d 592, 596. They are: 1) when the issuing magistrate was misled by information that the affiant officer knew or should have known was false; 2) the magistrate wholly abandoned the judicial role of neutrality and disinterest; 3) the affidavit was so lacking in indications of probable cause that it would be entirely unreasonable for an officer to believe probable cause existed; and 4) the warrant was so facially deficient in failing to particularize the place to be searched or things to be seized that the executing officers could not reasonably presume it to have been valid.

Just because you post something that is open source doesn't mean it isn't protected speech. If the government monitors your social media without a predicate such as an RD# then it is a 4th amendment violation. Even if the branch of government isn't the police department, lawmakers should fall under that umbrella as well.

Part I:

If they're claiming that burning 12 CD's is too burdensome for a single request, then they're counting on the requester complaining to the AG PAC and that'll take time. Take note of the fact that the pricks didn't say there weren't any records - there are some. They just don't want to provide them all at once.

So fine, do this:

Give them 12 requests for the information, each request asking for a particular CD in the sequence (1...12). File each request separately over a period of 16 days. File the first 6 requests the first week, the remaining the next week. Net result is that they get to produce the same friggin information, but it's technically different requests.

At that point you can count on the pricks claiming you're a "Recurrent Requester" and demanding to take additional time, but it doesn't qualify as a "Recurrent Request[er]" the way it's being submitted (5 ILCS 140/2(g)).

There are exemptions to the "Recurrent Requester" time extension, here's the text of 5 ILCS 140/2(g):

"(g) "Recurrent requester", as used in Section 3.2 of this Act, means a person that, in the 12 months immediately preceding the request, has submitted to the same public body (i) a minimum of 50 requests for records, (ii) a minimum of 15 requests for records within a 30-day period, or (iii) a minimum of 7 requests for records within a 7-day period. For purposes of this definition, requests made by news media and non-profit, scientific, or academic organizations shall not be considered in calculating the number of requests made in the time periods in this definition when the principal purpose of the requests is (i) to access and disseminate information concerning news and current or passing events, (ii) for articles of opinion or features of interest to the public, or (iii) for the purpose of academic, scientific, or public research or education.
For the purposes of this subsection (g), "request" means a written document (or oral request, if the public body chooses to honor oral requests) that is submitted to a public body via personal delivery, mail, telefax, electronic mail, or other means available to the public body and that identifies the particular public record the requester seeks. One request may identify multiple records to be inspected or copied."


Expecting the arrogant fools at COPS to claim you're a "Recurrent Requester" or subject to some kind of fees, claim one of the exemptions to that in your requests by including this language in EACH REQUEST (or if you really want to make them insane, in one request):

"I would like to request a waiver of all fees under 5 ILCS 140/6(c) because a principal purpose of the request is to access and disseminate information regarding the health, safety and welfare or the legal rights of the general public and is not for the principal purpose of personal or commercial benefit. Further, that that pursuant to 5 ILCS 140/2(g) a principal purpose of the requests is (i) to access and disseminate information concerning news and current or passing events, (ii) for articles of opinion or features of interest to the public, or (iii) for the purpose of academic, scientific, or public research or education. This request is made by the >insert whatever name you want< Educational Foundation for Better Government."

Part II:

Note that the ">whatever name< Educational Foundation for Better Government" doesn't have to be any 'official' entity whatsoever, not even a filed DBA. "Academic, scientific, or public research or education" was never defined in the FOI Act, so it can be whatever you want it to be. If COPA responds that they want documentation of the official filing of the entity, respond that you don't have to provide it to them. Then file a complaint with the IL AG PAC because they've unlawfully delayed or denied your lawful request.

Finally, entities subject to FOIA are required to keep particular records that can be very revealing. Try this request:

"Dear Mr. >records officer<:

This is a FOIA request for the following information:

* Pursuant to 5 ILCS 140/4(a) - a brief description of Citizens Oversight Police Authority (COPA), including a short summary of purpose, a block diagram giving functional subdivisions, the total amount of the COPA operating budget, the number and location of all of its separate offices, the approximate number of full and part‑time employees, and the identification and membership of any board, commission, committee, or council which operates in an advisory capacity relative to the operation of the public body, or which exercises control over its policies or procedures, or to which the public body is required to report and be answerable for its operations.

* Pursuant to 5 ILCS 140/4(b) A brief description of the methods whereby the public may request information and public records, a directory designating the Freedom of Information officer or officers, the address where requests for public records should be directed, and any fees allowable under Section 6 of this Act.

* Pursuant to 5 ILCS 140/5 a reasonably current list of all types or categories of records under the control of COPA. Please also detail the dates this list was first created and last updated.

* Pursuant to 5 ILCS 140/6(b) detail the actual costs of reproducing public records. Provide copies of paid vendor invoices as necessary in support of this claim. Scope: Years 2017 to Present.

* Pursuant to 5 ILCS 140/6(c) provide a list of all requests for fee waivers of approved FOIA requests which were denied. I want to know how many fee waivers were requested, which were subsequently denied by COPA. Scope: Years 2017 to Present.

* Pursuant to 5 ILCS 140/9(b) provide a copy of the single central file containing copies of all notices of denial, and its required index. Scope: Entire contents of file.

* Provide details of the number of times that COPA has been a party to a lawsuit for injunctive or declaratory relief due to denial of access to inspect or copy any public record.


Please provide these records in Adobe PDF format, via email to my address. If this is not possible, please provide the records on CD-ROM or DVD-ROM. In the event they are not available electronically, I request copies of them on 8.5" x 11" white paper, and I would like to request a waiver of all fees under 5 ILCS 140/6(c) because the principal purpose of the request is to access and disseminate information regarding the health, safety and welfare or the legal rights of the general public and is not for the principal purpose of personal or commercial benefit. Further, that pursuant to 5 ILCS 140/2(g) a principal purpose of the requests is (i) to access and disseminate information concerning news and current or passing events, (ii) for articles of opinion or features of interest to the public, or (iii) for the purpose of academic, scientific, or public research or education. For what it's worth.. the person looking for these records is a nut job. Stop posting on social media, stop generating RD numbers for your fellow detectives to investigate. No ASA is going to touch an alderman/former alderman.

COPA also is keeping their own files on POs containing COPAs finding on complaints they investigated on POs EVEN THOUGH THE CITY HASNT AGREED WITH THEIR FINDINGS sustaining the complaint. So when the shit head and his shit head lawyer tell the ASA that his client filed a complaint against the PO for the case they are on, the ASA requests the info from COPA who then sends the ASA their file on the Officer NOT the offical file with the findings from the city which are what the Officers jacket contains. Total BS they are keeping their secret files on POs. The union is useless on the matter too.

And their trolling your social media, copying inordinate amounts of files and failing to sign affidavits in violation of state law:
During a recent FOIA request, COPA informed a requestor that there is information that could not be released due to it compromising the identity of their confidential source. So apparently COPA gets to now have “CI’s” and run covert investigations.

One minute they’re getting Search Warrants for Officers property, the next they’re working with Confidential Informants.

OPS, IPRA, COPA and IGO have ALWAYS run confidential investigations. Why would you think they didnt? They are/were investigative agencies. CCSA, FBI County Sheriffs office does it too. Arrest of a CPD member is a feather in all their caps

A COPA lackey reading a post a couple of weeks ago babbled about COPA getting increased funding, incrased hiring, blah blah, blah...
What this inept asshole didn't post was
COPA is going to be under intensified watch. The Public Safety IG and the Chicago OIG will be breathing down their necks to oversee any inept or corrupt investigations. That means these two IG agencies will have their work cut out for them.

If you think COPA is breaking the law, or personnel policy while investigating you, file a complaint against those assholes. If one of their legal staff is misbehaving file a IARDC complaint him or her.
And FOIA their investigations.
