Emergency Powers Deadline?

We were doing some light reading the other night and found this:
  • (20 ILCS 3305/7) (from Ch. 127, par. 1057)

    Sec. 7. Emergency Powers of the Governor. In the event of a disaster, as defined in Section 4, the Governor may, by proclamation declare that a disaster exists. Upon such proclamation, the Governor shall have and may exercise for a period not to exceed 30 days the following emergency powers; provided, however, that the lapse of the emergency powers shall not, as regards any act or acts occurring or committed within the 30-day period, deprive any person, firm, corporation, political subdivision, or body politic of any right or rights to compensation or reimbursement which he, she, it, or they may have under the provisions of this Act
The Illinois State of Emergency was declared on 09 March, s0 thirty days expired about ten days ago. Did the legislature gavel itself into session and meet to grant additional dictatorial powers to the governor? We may have missed it. We can't seem to find any headlines or media articles about it. But we were sleepy and we needed a quick post to put up and this seemed like a good way to get readers to participate.

UPDATE: Lightfoot is following the proper route trying to extend her emergency powers via the City Council:
  • Mayor Lori Lightfoot will ask aldermen next week to retroactively bless her executive order that gives her additional power to spend city money and make changes to the 2020 budget to deal with the COVID-19 crisis.

    The mayor issued the order on March 17, creating a new section in the city’s budget to consolidate coronavirus expenses and giving her the ability to move money around to cover the costs that are piling up as the city tries to cope with the pandemic.

    The order also allows the city’s procurement department to “negotiate and execute contracts for emergency supplies and services” up to $1 million, up from the $500,000 cap on such emergency contracts that’s usually in place.

    With aldermen grumbling about the move, Lightfoot will introduce an ordinance directly to the Budget Committee on Tuesday, asking for the City Council’s approval of the additional powers. In a bid to quell dissent, Lightfoot also has agreed that her administration will give weekly updates to aldermen on the virus spending.
As usual this article came out at 1653 hours on a Friday, meaning no one saw it....including us.

It is difficult to read the Illinois Emergency Management Act and not come to the conclusion that Pritzker has gone far beyond his lawful powers during the COVID-19 crisis. He needs to seek legislative approval for his actions since thirty days have lapsed.

Seriously, where in the hell has the Illinois General Assembly been during all of this crisis? Are the legislators being paid and, if so, what for? The legislature has not convened in over a month and keeps canceling its session days. The US Congress has managed to convene and conduct legislative business during the same time frame that the Illinois General Assembly has been out of action.

What would happen if you kept canceling your scheduled work days? Would you be paid?

Can anyone in the Pritzker Administration count or check a calendar? Are we governed by laws or has the Illinois Governor become a dictator or an absolute monarch?

He of course extended his powers of taking away our rights on April 1st through an executive order. I am no professor of law but this does not seem constitutional. But of course a comment like that will be shot down because he is doing this in the name of public health...

SCC, the date of the emergency declaration might be off.
Lookng at the Executive Order 2020-10, it's dated March 20th, 2020, which means his powers expired yesterday.
To make it more confused, Pritzker issued a second order extending the first, on April 1st, 2020, Executive Order 2020-18.
So, evidently he extended his emergency powers himself.
I could see that heading into a cloud of lawyers and judges.

Shelter in place has saved thousands of lives in Illinois and tens of thousands across America. I am a constitutionalist but in extreme emergencies extreme measures need to be taken. While our rights have been restricted under the bill of rights, no ones rights have been taken away. The basic premise of the Constitution is that the federal Government’s primary duty is to protect its citizens. Saying I should have a choice in this doesn’t work as those who feel they are immune and this is just the flu can and will contaminate those of us who don’t want the virus. We still need to go to the store once in a while. We may need to take the dog to the vet or go b out for some reason.

There is no case law on the Emergency Management Act's section governing the time limit, so no court has ever ruled on the topic. However, there also is no language in the IEMA denying the Governor the power to issue new orders to start a new 30 day period. Nor is there any language as to the authority of the Legislature to rescind a Governor's orders. In fact, there is no language requiring the Governor to convene the Legislature to pass any type of enabling legislation allowing said Governor to issue orders outside the 30 day period. Remembering that the law was passed in Illinois, it is not surprising the law is badly drafted that it lacks some or all of these key point.

Well Lightfoot is in a position that she isn't qualified for or competent in. She a hypocrite who is convicted she is the smartest person in the room, however shouldn't be allowed to oversee the finances of a Girl Scout troops cookie sales, let alone that of a major metropolis. Sounds familiar, sounds a lot like our Departments merit bosses. Lightfoot has become our Merit Mayor.

I’m sure that in about 5 years, invoices will appear showing that the city paid out ‘millions’ for service rendered by do-nothing hacks. Look over here while the Mayor does this...

Section 12 of the Disaster Proclamation Tubby-no-Toilets signed states 'shall be in effect immediately and remain in effect for 30 days'. The order went into affect on 9 March and would have expired on 8 April. But, EXECUTIVE ORDER IN RESPONSE TO COVID-19
(COVID-19 EXECUTIVE ORDER NO. 23) signed 1 April re - declares a disaster and extends another 30 days. The question is the statute clearly states 30 day max, no exceptions or extentions. So if if this is the same 'Emergency' as stated by Governor Trust Fund, the order would be in violation of the statute. If only we had a group of civil liberty types to sue...wait this guy's got a D behind his name so it's disregard.

Do you know how many media outlets are covering this story? You guessed it... Zero. It's 6pm,and I still haven't seen a single story on this. So sad how the local news media continue to suppress information or when it's to their liking embellish it. They are seriously one of the major factors for the overreaction, false information being distributed, and fear being caused by this pandemic. Unscrupulous people driven by their own agendas.

Your wrong on every thing here. There’s no way in hell your a constitutionalist. This Covid is a flu strain. It is an upper respiratory infection that wreaks havoc on those with compromised immune systems and pre existing health problems. Shelter in place does not, does not, does not kill the virus it only delays getting it thus alleviating the strain on hospitals which was the reason for shelter/stay at home orders. Stanford PhD released study over weekend that based on testing numbers that this virus is far more contagious than thought. Based on their testing it’s possible 50-80 million American citizens have already had it. Therefore the mortality rate is more like 1 per thousand, similar to the flu. Quit spreading fear and panic. We are gonna have to live with this just like we live with the flu and other viruses. If we keep the economy closed any longer you will lose your home, lose your pension and the money you have won’t be worth anything.

But that doesn’t make you right.

You say no ones rights have been taken away- maybe you should listen to zone 10 every single night.
Do you know what a “COVID DISPERSAL” is? It’s peoples rights being taken away. A clear violation of your constitutionally guaranteed rights.

If I own a business, it should be up to me if I want to open or not.
No one is forcing you to patronize it.
In fact, those who want to continue to shelter in place are free to do so.
If you want to go out, go out. If you want to stay home, stay home.

There has never been another situation in which the entire population is quarantined, whether healthy or sick.

Quarantine the elderly, quarantine the sick and people with pre existing conditions, but let the rest of the world get back to their lives.

I’m not big into conspiracy theories by any means, but this is starting to stink like it being politically motivated to cause disruption on several levels- the least of which is a genuine and bonafide concern for public safety.

To the constitutionists out there that claim the lockdown is legal I say, Wake Up You Fools. There is nowhere in the constitution that says “the following rights can be suspended under order of the government.” The rights are God given by the fact of our humanity.
