What Are You Thinking?

The First Amendment to the United States Constitution begins as follows:
  • Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;
Article VI, Paragraph 2 (The Supremacy Clause) states the following:
  • This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
In plain language, "It provides that state courts are bound by, and state constitutions subordinate to, the supreme law." There is ample case law regarding this.

Meet Exhibit A in an upcoming Federal Lawsuit (sorry about the double pic - it was sent to us like this):


  • Following through with Mayor Lori Lightfoot’s promise to take action against churches that violate social distancing rules, the Chicago Police Department issued $500 fines to three separate houses of worship that held services over the weekend, city officials said.

    Police cited Elim Romanian Pentecostal Church, Philadelphia Romanian Church of God and Metro Praise International for their services.
Willie Wilson is said to be paying all the fines at this point in time - $1,500 for hundreds of thousands in free publicity.

Executive Orders are not laws. Even Putzger knows this as evidenced by his attempt to get more power this week in Springfield (which he withdrew - see post a few below this one) and previous legal briefs written by (can you believe this?) Lisa Madigan.

Ticket issued by Unit 215, Star 70. That's a Captain's star, isn't it? So the Federal Lawsuit is going to read:
  • Defendants: City of Chicago; Mayor Lori Lightfoot; Superintendent David Brown; Captain Whoever; et al
Better start making a mental list of all of your assets Captain - property, salary, vehicles, deferred comp, pension. We recall those days...and not in a good way.

Rumor is Commander Jimmy Sanchez elevated to Deputy Chief of OCD and Narcotics will be disbanded today and some sort of combination unit of 189/193 will exist. I’m just lost that he wrote D.C. The Supreme Court has already said that our peace can’t be breached. So without an actual Complainant, and the city doesn’t count, and it can’t be the P.O... How can this even be issued? The fact that church was held, “alarmed and disturbed” someone...? This guy is going to get hammered at the Dirksen... I tell Recruits all the time on FTO... The ridiculous things that bosses want done, regardless if it’s legal or constitutional, and idiots just go along with it. I hope this ballless person gets sued. The Supreme Court made it clear that an officers peace cannot be disturbed so who was the complainant? Surely not the 26 people in church.

The city deserves every lawsuit it gets from this. And so does the department. This is a slam dunk federal lawsuit. The city has many of those against them that will be filed. Embarrassing. Again, I’m happy to see that almost all of CPD is refusing these illegal orders (even if you hear these covid dispersals, I guarantee they’re driving by and waiving and pulling a number for it, no one is actually doing it). Like commander dickhead Spencer’s orders to check identification to enter certain blocks, coppers just sit there and play on their phone. So the overall boots on the ground haven’t really enforced any of this (I’m sure someone can name some occasion, but overall it’s been good). The leadership of the department has been horrible though, seemingly just as eager to act as a dictator as our little Nazi mayor. Because of it, when this is all over, this is going to hurt our reputation further, but this time with folks on the right side of the isle, as they sat and watched CPD enthusiastically trample rights of churches. Now we all know it’s the bosses, but it will be reported “CPD tickets churches”. This was a great time in history to show our respect for the law and people’s rights, but too many merit bosses are worried about their next promotion.

In this particular instance, I’d say the captain knowingly handed the win to the Plaintiff based on what he wrote in the narrative of the citation. He most likely didn’t agree with what was being done to these people and gave them the ammo to fight it at a later date.

That's the most creative use of the charge, disorderly conduct that I have seen in quite some time. I would have gone with Gang Loitering, and asked for a dispersal number.
If some pays the fine, the respondent will have to admit guilt. That will negate the lawsuit a little, wont it?
I would personally frame the ANOV and hang it next to a picture of the check the city is going to write.
I'm sure the Deputy Chief is politically connected enough to know he will be indemnified by the city.

Whoever this Captain is, he/she is a true leader. The good captain wrote this tag him/herself and put themselves, not some lowly officer/sergeant on front street. The Captain got an order and dropped the hammer him/herself.

Did the church refuse to comply, offered an opportunity to disassemble the peaceful religious observances once the peace officer, traffic control aide, fire department official or other official who has identified himself as such, gave the order to disperse?
Did the congregation fully understand, given notice the demand of dispersal?
Was the citation issued after the peaceful observances?
Is there actual evidence of the assembly, like were there any infections present, were swabs taken, collected from a peaceful congregation or surfaces?
Why didn’t the pastor just run away?
Ain’t no Lt gonna foot chase ...that’s against generals orders.
Good thing the church probably won’t go beyond a civil remedy and follow thru with a punitive assessment.

Ok, case law study:
Give me another example of “public health, safety or welfare” that wasn’t or has never been enforced. CTA, airport and Lower Wacker Dr. piss bums don’t count. (Knowingly be affected with but not limited to any influenza, herpes or conjunctivitis, with the intention of spreading contaminating or discharging said infectious spores by public contact.)
This will be another costly settlement for the city.

Elections have consequences, let’s hope the church community is taking notice of the Democrats in November.

And only 26 people attended - leaving more than enough room for adequate distancing if such a requirement exists. Full text of the First Amendment:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

This is relevant because it wouldn't be terribly hard for the city to argue that they're not prohibiting religious choice (i.e. you can still be a whatever-ist in your own home and not get arrested for it) and that's the intent of the first portion of the amendment. They are, however, taking a dump on the assembly clause and coming dangerously close to shutting down dissent. And of course the whole limited duration of emergency powers thing.

At some point everyone is going to have to choose between the citizens and the state apparatus. It's clear that the various mayors and governors telling people to stay home are not going to give up their power voluntarily, so it's just a matter of what happens when honest people start to get desperate enough to not do what the local authorities are telling them to do.

First of all, I don’t know this captain and I don’t know what he is like. We all have been in Chicago long enough to know how District Commander’s and exempt rank are achieved. He made a decision to follow the mayor’s “rules” . He did not ask the subordinates to do it he did it. Give him credit for this. Seeing what’s going on in the city these days I would say “ it’s a rare example of leadership”.

A good thing to litigate on. The city would have to show it was "reasonable to believe that the order is necessary to allow public safety officials to address a situation that threatens the public health, safety, or welfare".

Going to be pretty tough to get a judge to buy into that idea.

Also note that the citation claims the notice was delivered by "the city of chicago" and is not specific as to an official that has to deliver the warning.

it is pretty clear the requirements to violate the ordinance were not met on several points.

If Captain Whoever (or Deputy Chief) mistakenly believes that he can successfully hide his assets by transferring them to parties that will help him do so, he should talk with an attorney that will tell him how experienced attorneys who represent plaintiffs will still be able to go after his assets and the assets of those who help him.

As Sheriff, I feel that my own 1st amendment constitutional right to free speech has been completely trampled on by a governor who has threatened my Offices’ reimbursement and grant funds as a tool to force me not to speak. I just can’t do this any more. I stand with our citizens and businesses of DuPage County who have offered no trouble or no resistance to any rule we put upon them, no matter how strange. In fact they have communally helped to support us during this pandemic with resources and physical help. We are not experiencing the same problems as Cook County. We can re-open responsibly and with proper care. As our local restaurants continue to dissolve into oblivion, the reliance on food will cause more people to flock to the few that are open, causing very high potential virus transfer, food shortages and a potential collapse of our economy. If other businesses were opened responsibly, wouldn’t that take away from congregation at the only few places left open? This is what purely scientific minds have asked me. I’m just having difficulty with what looks like politics pitting everyone against each other and then wanting the police to arrest everyone who disagrees. We are not stormtroopers. We are peacekeepers. All these years, you have told us that you want law enforcement that thinks before arresting, doesn’t violate your rights and treats their citizens with decency. Now you have that and are asking us to regress into what you didn’t want and didn’t deserve. Please let us be the law enforcement you always asked us to be. Non oppressive. We are dealing with a serious rise in crime, new challenges in our correctional facility and a massive upsurge in our courthouse when everything opens back up. We will rise to the challenge. So far it seems government has only been able to determine that Christian churches where worshippers are mostly white are at risk. I'm the one kicking back your reports, Joey. Your inability to read and understand simple concepts, like those in the Constitution, doesn't make you right. A governor's "order" does not trump civil rights. Selectively enforcing an order, that is unconstitutional on its face, against people of one race, to suppress their religious rights, right to peaceably assemble, etc., is illegal. If the governor says you can't say mean things about him, and then you get arrested for saying mean things about him, that's fine, right? His word is law in your mind, even when it directly contradicts our most basic, guaranteed rights. You aren't as smart as you think you are. Go read more and try to impress us again. The police have no duty to enforce an order that deprives people of their civil rights, no matter who gives the order.
