Abbate to Plea?
A lawyer for police officer Anthony Abbate — videotaped beating up a female bartender — signaled today his client might plead guilty.
Abbate’s lawyer Peter Hickey requested a “402 conference,” in which prosecutors, defense counsel and a judge discuss a possible plea deal.
Here's what we'll guess at:
- misdemeanor plea
- no jail time or minimal (under 180 days?)
- heavy community service - over 200 hours?
- resignation as part of the deal
Why? Again, we'll guess that Hickey and his client can see the writing on the wall. This is a heater case, a loser in the hands of a jury and even worse in the Cook County Courts where the Machine holds sway. It's also a loser in front of the Police Board where the mayor calls all the shots and since this is the very case that drove Daley to pick an outsider, J-Fed isn't going to play any games with this one. The civil suit will bankrupt Abbate anyway and the City will be out of it completely as he was off duty and not acting in any official capacity.
Avoiding prison is the only issue here.

As much as I hate the thought of this asshole NOT going to prison, I keep wondering..... What would I have done if Abbate was just the local bar drunk from the "Cheers" crowd who got pissed about not getting the last beer before closing time. Let's say I was working the desk the day after it happened and the bartender had come into the station to make a report. Not a mark or bruise on her and she says he used no object or weapon, just socked her and threw a few kicks at her, mostly which missed.
Everyone I've talked to has said they'd make it a "Battery/Simple, 0460." No broken bones, no disfigurement, no permanent scars or marks.
Of course you would. It doesn't fit the requirements for an Aggravated Battery.
I hate the thought that this cocksucker ever passed the psych or background test. Yet, I'm angered that he was DENIED due process by being charged with something he DID NOT do. Ugly video? Yes. Does he deserve to have the bartenders dad and brothers give him an old-fashioned asswhooping? Certainly. Time in the joint and 23 hours in a cell with a guy named "Faheem?" No way.
Fire him, talk bad about his Mama and make him stick his tongue to a metal pole when it's cold out but remember: the next time someone gets charged with a felony to further someone's political agenda or it's a family member that the news media wants to see railraoded, it might be YOU!
IAD and OPS/IPRA love to chant "offenders have rights, too!" but we apparently don't.

Plea...yes in Branch 29 on 13 Feb 08 there was a case. A plea agreement was tendered. The plea was disregarded and the case went to trial..the complainant kept interrupting the States Attorney AND the Judge. He even shouted while the judge was making his decision.

First off, what he did was inexcusable. It was a black eye on the whole Dept. The man was charged with Felony Agg. Battery. Why? Because he was a Policeman, and he was in a public place upon the public way. Another case where the States Attorney's Office picks and chooses who they charge with Felony Agg. Battery. Did she suffer great bodily harm? No. Did he use a weapon? No. Any simple battery that occurs on a public way can be charged as an Agg. Battery. It is the ASA's who pick and choose who gets charged with that due to political reasons. When is the last time you tried to get Agg. Battery charges approved thinking you had a legitimate chance of getting them, only to be told Misd. Simple Battery? It is a little used subsection in the Agg. Battery statute when an ASA really wants to stick it to someone for political reasons.
NO TRIAL.....same scenario as Sgt. john "nightstick" herman: guy is a goof, not a criminal, fire and take pension...not prison...but isn't Hickey the same legal eagle that took a bench trial and now herman, thanks to jo jo claps, is going to the JOINT?
If Sgt. J.H got 25 years for having sex with some crack head whore. Why should this guy walk away with paper. This video was shown around the world. If I were Abbatte, if they offered me a deal, I would take it and run. Supposedly Herman was offered a deal but he turned it down. Look where he is now.
opened the trib today and abbate has 15 felony indictments against him. not defending the guy, he made a terrible mistake, but 15 indictments for a simple battery. i hope the state's attorney shows such bravo the next time one of us goes down at the hands of a real felon who is trying to avoid going back to the penitentiary for the "fourth of fifth" time.
There will be no plea deal without jail time.

Witness intimidation is a crime, no less of a crime when you do it in your official capacity as a police officer. He needs to be somebody's wife in prison.

I still believe the bartender shorted him on his change and that he was going to the cash register, when she hit him first. Why did she wait 3 days to even make a report?Yes, he was wrong, but not jail wrong. Remember, they kept showing only the part of the tape that showed only his ridiculous behaviour.
Abbatte is a miserable, ignorant mutt who makes us all look bad. His crime, had it been committed by anyone else whould probably have been charged as simple battery. But the CCSAO does sometimes use the "agg batt - public way" language in the statute to upgrade. Factors that might lead to the upgrade could be politics (some might say that is what happened to Abbatte), the existence of the video (which makes the case a slam-dunk winner, something the CCSAO likes to have), or the relative size/strength of the victim & offender. If I were going to predict the outcome of a plea I would say less than one year in jail (not prison, IDOC, but jail, CCDOC)combined with probation and community service and, possibly resignation just to avoid the media circus of a police board hearing.

Truth is, had there been no video, he'd have taken 30 days on an excessive force beef and kept his job.
I'm not excusing his conduct, and it sucks to be him, but he made his own bed and has to sleep in it.
It was bullshit to charge him with a felony. The qualifying element of the offense was not the harm done to the victim, but that she was in a public place. That means every bar fight is a felony.
He should and will probably plead to a misdemeanor and quit. He'll cash in his pension to pay his bills and if he's lucky, find a half way decent job sometime in the future.
