Cautiously Optimistic for Mette

  • An Iowa appeals court panel in the case of Chicago cop Michael Mette on Thursday gave his family and some 30 Chicago police officers who came here for the proceedings a reason to smile. It was perhaps the best day they've had in years.

    Mette is the fellow I've been writing about who was unjustly sentenced in 2007 to 5 years in prison for throwing one punch in self defense against a drunk who attacked him in Dubuque.

    During an hourlong hearing Thursday, Appeals Court Judge Terry Huitink suggested it would have been "impossible" for Mette to reasonably flee his drunken attacker rather than defend himself, which was a key argument of the prosecution.

    "It appears to me that the folks were in such close contact that it would have been impossible to escape," Huitink said. Inside the crowded courtroom, Mette's father, Bob, his wife, Pat, and the officers there to support the family were heartened by the exchange.
Hopefully, the Iowa court issues an expedited ruling and either drops charges, goes the misdemeanor route or frees Mette with time served. Anything to get Mike out of Iowa.

I was one of the Supv at the latest meeting with Supt Weis. During the meeting he was asked point blank if Mette would be welcomed back to the police department. His answer was "as long as he doesnt have a felony conviction, I would welcome him back with open arms" The Supe went on to say that Mike made some "bonehead" statements in his testimony but nothing that should have landed him in jail for 5 yrs.
He went on to say that Gov of Iowa said he would look at the case "after the appeal"
Hopefully they either go the misd route and time served or toss it out alltogether.

I have had some serious CASES in court in my day. Even some BULLSHIT ONES and I just cringe at HOW SEVERE this thing is for being a BULLSHIT CASE from the word GO!

JESUS CHRIST, YOU WOULD THINK MIKE MURDERED OR ATTEMPTED TO MURDER SOMEONE THE WAY THIS IS GOING...........

My heart goes out to Mike and his family for every one being raked over the coals by our CRIMINAL JUSTICE SYSTEM (that seems to only work against public officials and the police and not the serious heinous offenders life has to offer)

I was at the Iowa Court of Appeals yesterday and after hearing some of the questions that the judges asked, I would be shocked if Mette wasn't released from prison as soon as the court issues its ruling. The arguments made by the state's attorney asking the judges to deny a new trial were SOOOO TERRIBLE that I honestly believe that even the State's Attorney thought that Mette should be released and was purposely making VERY WEAK arguments, solely because it was her job, and in actuality she wanted the case dismissed as well.

She actually argued that while Mette was not the aggressor, he could have done more to avoid a fight by trying to talk his way out of it, by hiding in a house or a car, or at least he could have pushed the aggressor instead of striking him. This is all the while admitting that the alleged "victim" was the aggressor, was larger than Mette(her exact words were "Slenderer" than the other jackass who was 6'8'' and 245lbs) and that the alleged "victim" had a blood-alcohol content of .27.

The body language and questions from all 3 judges seemed to indicate that at the very least they will grant Mette a new trial if not dismissing the whole case.

Yesterday was a good day for justice in Iowa!

I saw it on TV wish Ive could have been there. Saw some faces i know I hold them in high esteem along with mouse Mette I hope Mike gets released soon!!! I wish I could have gone I'M rpoud to be CPD!! I'm sorry I could not make it but I've tried to help in other ways. If there is another hearing which there should not be I'll be one of the 30!

Four people were shot early Friday morning in West Humboldt Park neighborhood on Chicago's West Side.

Three of the victims were taken to Stroger Hospital and a fourth was taken to St. Mary of Nazareth Hospital, said Chicago Fire Department spokesman Kevin MacGregor.

He did not know their conditions, but Chicago police said at least three of the victims were thought to have suffered non-life-threatening wounds.

The shooting happened about 12:40 a.m. in the 4200 block of West Potomac Avenue.

Can you do a thread on "Officer Safety?" Yesterday, I was at A/3 and every dic, except one, had a pancake holster on. This is not exclusive to dic's, I see tac/gang and other CD units wearing them all the time. Get yourself a Level 2 or 3 holster! Blackhawk makes a nice one. Too many guys out there think they are Shane or Macky and want to look cool instead of being safe. Buckle up and wear your vest.

UPDATE ON PLEWA- I heard that the ASA has a cell phone records of Plewa showing he contacted the co-conspirator over 40 times and had extensive conversations with him. The ASA also has witnesses and video tapes from a bar/restaurant showing Plewa met the CI/co-conspirator several times. Plewa, why did you lie in court? All you had to do is tell the truth. I am not holier than thou, but you brought this all on yourself.

At the Sox game last night and was glad to see that the police helicopter that we have that I have noticed on numerous times on the zone and citywide get denied for use becasue they werento available circle comickey two times for no reason what so ever.

Excellent use of police resources. And it had nothing to do with the ann. of 9-11 because it occurrred during the 3rd innning

i wouldn't read too much into it. appeals courts rarely look into facts as determined by a lower court. only points of law that might have been screwed up.

look at how hard is is to get people DNA has proven to be innocent out of jail. mette is not anywhere near that innocent. its clear he did strike the guy and did cause the guy some injuries.

i am not sure that an iowa appeals court has any authority to reduce charges at all, as one poster suggested. I think about all they can do is order a new trial. if they do, look for a plea and time served.

Can't blame all of Iowa for this travesty. To blame is a prosecutor and a couple of coppers who are friendly with the Goddard Family. A judge friendly with the Goddard family. The glass jaw punk who cannot handle his beer and apparently never could. Don't forget his cowardly 6-8 basketball friend.

It is the Great State of Iowa that hopefully will do the right thing by Mike Mette.

Remember we are in Cook County who don'thave a clue what justice means. Also in the Northern District of Illinois who, a few years ago, railroaded a Chicago City Treasurer who stood up for out pension, denied Daley the opportunity of stealing money from it and a sniviling rat U.S. Attorney put her in jail because Daley thought she might run for mayor. Yet we keep electing Daley, Stroger and Blago no matter how much they steal.

I don't know much about this story, but I find it nearly impossible that some cop is being held for throwing a punch in self defense. What does the plaintiff think he should have done..turn the other cheek?! I'm guessing if he was in dubuque, then he was off-duty..IE: he's a citizen just like everyone else. If someone threw a punch at me when drunk, I'd be damned if I was running away! So he slugged him, big deal. Battery at the very most, but if the other guy started it, how can there even be charges filed?

I would personally discourage Charter One. That bank and TCF make up the vast majority of the walk-in fraud cases for bank type fraud cases at the desk in 022.
I have heard good things about Park City 112 & Kedzie, Founders at 3030 W 111th St (although very low interest rates, and really starting to get pimpy with fees), and the Archer Bank at 111 and Homan (just a little west of the Post Office---again, don't bank there, but heard good things).

I know this sounds harsh,but the new breed of police officer could care less about someone they don't know.People won't even back each other up in most places unless they are verbally ordered to a scene by a dispatcher.Our fellow "brothers" will sit and read a newspaper or continue bullshitting instead of assisting another.This is UNACCEPTABLE,our 'D' units are for the most part, only concerned if it's their pager or supervisor sending them somewhere and even thern they are obnoxious and disinterested pricks..We have hit a new low as far as I am concerned and it's getting worse.NO wonder the city doesn't take us serious!

How about the detectives up there who only carry a snub nose in a small easily defeated holster. I have even seen detectives who carry the snub with the belt hook just stuck in their waist band. This is ON duty. Tragedy waiting to happen.

Speaking officer safety.

I too see it all to often officers wearing a pancake out on the street when really they shouldn't. Also see idiots walking around with their vest half fastened. Also see tons of po's wearing a vest that's not fitted correctly and exposes what is supposed to be covered.

Although comfortable, body armor isn't supposed to be worn in an outer carrier. It's designed to be worn under our uniform shirts. Wearing it outside shirt causes it to bunch up at the bottom one move too much.

Also, don't be cheap when buying new armor. Pinnacle and us armor are good reputable manufacturers. You'll spend $700 minimum, but its worth it. And just cuz something has the NIJ certfications, doesn't mean it's good stuff . Those NIJ standards are kinda low

Make sure your armor is fitted right. It should touch the top of your collar bone and go down to about 2in above your duty belt while standing.

First, Mike's attorney at the appeals court hearing DID appeal the conviction on TWO points of law.

The first point of law is that the Iowa statute on self defense does not require a person facing an immenent threat of violence to do anything other than defend one's self - even if there are other options available. Period. It didn't matter if there was a chance to run, talk the other person out of it, exit the scene or any other nonviolent option.
The original court testimony established that the person and another large drunken individual ran out of their house after Mike and his friends, using profanity and making threats. The person approached Mike and pushed him hard in the chest at least three times. This happened in the space of seconds. Mike punched back. That's all that happened. He didn't wade in after the person was on the ground and continue to strike him. His punch wasn't some fancy funky kung fu move.

The second point of law argued by Mike's lawyer was that the alleged victim received "serious bodily harm." Mike's attorney stated that this charge was "not based in reality." The original judge based her sentence on the fact that the victim COULD have received some serious injuries when he fell down and hit his head on the sidewalk after he was punched. But Mike's attorney insisted that the court had to take into consideration what did happen, not what might have happened. The victim originally did not want to go in the ambulance. He fought with the EMTs. He was so drunk that the attending ER doctor thought that the victim might have suffered brain injuries; but a subsequent exam at a different hospital only hours later by a neurologist showed that the victim was only very drunk, not suffering from any injury to the brain. (By the way, I'm using the word victim in lieu of calling Mike's assailant a jag off.") So much for decorum.

But I couldn't disagree with this writer more heartily. Officer Mette is totally and clearly THAT innocent. He was fucked.

Anyway - I was also present and was very proud to be among such caring people. It reminded me of the old days. There were 30+ bodies present, but also thousands of hearts and good wishes. Our group behaved impeccably; we were treated, I think, respectfully by the staff at the Iowa courthouse. We did have enough people to fill up the courtroom, and as such, made a good impression. At the very least, the Mette family was encouraged by our presence. Besides, too many people from CPD might have looked like an intimidating mob to those with small minds in the Iowa court system.

Kudos to the on duty sergeant who showed up by the bus before we left and donated snacks for the trip. A shout out to the FOP for the nice motor coach - first time in my life I've ever been in a Mercedes Benz.

Too bad the city and the administration have to be such micro-managing, backstabbing, ballbusting hypocrites; we can be an amazing group of people when given half a chance.

Finally, thanks SCC for all you do. Your blog is a gift to all of us - because you never know when one of us might be in a position to need some support from you.

Can you post a link to the George Will column from 12 SEP 08 regarding the looming pension crisis.

This is the first time I've heard of any city (Vallejo CA)
being allowed to file bankruptcy and then the courts say that unions will have to make "a plan of adjustments". He ain't kidding when he says other cities are watching to see how this plays out.

Last year ol Larry's son, Larry Jr got locked up by UICPD for something like 60-70 counts of I.D. theft. He worked at their hospital and was using the I.D.'s of elderly patients who died while under his care. Nice huh? Guess what he got? A few years felony probation...nah it's all legit right??

I was that guy from Mettes class. I had hoped that at least 1/2 of the class would show up. I took the time, and paid the babysitter for my kids and went. Mike is a friend, Mike is a fellow brother in Blue. I hope that people would do the same for anyone else in that predicament. I guess I learned a little more in the Marines about comradery than people did while they were in College. I noticed that 2 guys he worked with showed up as well. I was happy to see and proud of the people that did show up for Mike.

Can you do a thread on "Officer Safety?" Yesterday, I was at A/3 and every dic, except one, had a pancake holster on. This is not exclusive to dic's, I see tac/gang and other CD units wearing them all the time. Get yourself a Level 2 or 3 holster! Blackhawk makes a nice one. Too many guys out there think they are Shane or Macky and want to look cool instead of being safe. Buckle up and wear your vest.

Thank you John Ryan for representing our NYPD brothers and sisters in the Mette case in DesMoines on 9/11.

We will never forget the NYPD, FDNY and PAPD who made the ultimate sacrifice at the World Trade Center on that same date in 2001.

If they can do that to a cop what chance do I have if I have to defend myself??

I hate to point one thing out here, but I hope you coppers have seen what I have seen for years on this job.

If you think that your so-called drinking buddies and fellow officers come close to really giving a flying fuck about what happens to you...remember that your family, your blood, are the the only people that will be there for you 100% percent.

Only about 20-30 coppers took the time to show up for a railroaded officer. How many Fillmore Rangers are there in 011? A whole lot more than that I'm sure. 011th District coppers should have filled MANY buses. What? All them young single coppers have better things to do? One night of shit sleep too much strain? Court? OT?

Remember the possible consequences and the support you can expect if you step on your dick...especially all you hard chargers that think there is nothing holier than a 143a or dope pinch.

Many people might show up to party for your benefit, but after time you will be a faint memory.

Your family will NEVER forget you.

To the old veteran who is happy with his old holster, look on the wall when you go to headquarters. Remember how many died from old worn out or outdated holsters. I would prefer not to be shot with your gun when it gets taken away from you. My wife and kids would too. Spend some of that uniform allowance on some new equipment please. Maybe the bosses should step up to the plate on this too.

There's nothing wrong with wearing a pancake holster while on-duty if you're a detective. They're weraing suits, so they need something concealable and close to their body. You don't expect them to wear a duty belt under their blazer? That's ridiculous. But if you want to feel safer you can purchase a Serpa holster made by blackhawk which they make in level 2 and 3. Second, how about we stop wearing those silly vest covers over our uniform. They look like shit after a while. Some have black others blue, others in leather, others with a hundred pockets on them for their gadgets. No uniformity. Some are too lazy to wear it correctly. How about wearing your vest under your uniform shirt where it's going to be most effective and save your life some day. One more thing, lets get rid of those silly light blue shirts and go with navy blue. It'll be much easier to keep clean.

The US constitution grants congress the power to set uniform laws of bankruptcy. That means for the most part the bankruptcy system will determine how this plays out.

The Courts and most Government Officials don't view the police as just citizens. We are always held to a much higher standard. We also can never be considered as just a victim of any crime. I've seen it time and time again. I was a victim of an agg assult and the judge found the offenders not guilty. He used their drinking as an excuse by saying "They were just drunk and acting stupid and you were able to get away." Everyone was more concerned as to whether I drew my weapon in defense of safety. How that for being a victim!
