- Cook County States Attorney Dick Devine says "there certainly are some issues” with the case against the 26-year-old man charged with the murder of police detective Robert Soto and his female companion, Kathryn Romberg, last month on the West Side.
Devine says there are a lot of cases that have issues, and he won't characterize this case one way or another. But Devine says anyone who has been following the case knows that there are issues and that he will be reviewing the case this afternoon.
Jason Austin is due in court tomorrow. Austins's lawyer says the alleged getaway car was in the shop at the time of the murders. The lawyer’s best hope is that the case will be dismissed outright. The accused’s relatives have asked all along that the public not “rush to judgment.”
If the getaway car is the hangup, lose the theory and work it from another angle. The entire case shouldn't hinge on the car.

A Pod Video isn't going to solve this case and may end up torpedoing a large portion of it. You know what''s going to solve it? The current news reporters and investigators are a prime example of what you are speaking of SCC.
In the years gone by, reporters had confidential sources that gave them scoops about the inside happenings of City Hall and other news of importance.
Today the reporters all sit behind the Internet either repeating what officals say as gospel or at best making a few cell phone calls.
The gumshoe reporters of the past actually dug up the truths. dug up the dirt on elected officials. Now most reporters are nothing more than copywrite employees.
The sad thing is the police dept. followed these footsteps of the reporters. Thinking I-Clear, a camera POD, DNA that may or may not exist that takes weeks or months to be analysis is going to solve the case.
Police work still needs gumshoes. You be surprised to learn that an elderly neighbor actually saw or even knew an offender of burglary. But this witness isn't going to come to you.
It appears most professions have gotten lazy. Depending on high tech to "feed" them what they need to know instead of the old fashion way of talking to people in person.
This is the new department they want. Bosses are calling, you must clear the case. Who cares if it is the right guy or not. Don't work overtime but only hold a guy 48 hours. Don't manhandle witnesses make everything voluntarily. Oh no downtown is calling... we have to tell them something!
Now I am uninformed if this guy is or is not the killer but the sad news about any crime where the wrong guy is pinched, is that the right guy is walking free.
One of fellow officers was killed, a woman was also blown away. When I came on this job, everyone involved would of been arrested. There was no unsolved police killings. But look at today, two suburban officers killed, the young CPD officer killed in 011th off-duty and they are UNSOLVED.
You tell me if these new P.C. policies are helping to solve crimes!

The detectives who work the case only know the strenghths and weaknesses of it. The press only knows what will sell more newspapers and airtime.

If the state wants to let hood rat "witnesses" & illegal alien mechanics slip & slide, there is nothing we can do about that. You don't have a clue about this investigation. Stick to gazing longingly at your furlough sheet and telling the hair gel boys how you've seen it all. If you got a problem with that, stop by the second floor at 3151 W. I spent 11 years in A/2 working cases this way. It works to work.
Here's another problem... The state hinged a portion of its case on the POD video, but now, depending on the testimiony (or bald-faced lies) from the witnesses, that very video could serve the defense more than the prosecution. They put the video out there too soon, and didn't do all their homework, and what began as evidence for the prosecution now could be used as reasonable doubt by the defense.
Maybe someone could check the financial accounts of the mechanic. Could he possibly have received a monetary payment to give a false statement???? I don't think it is too hard to take a car out of a mechanic shop, say for an hour or two, cruise around the west side, find a couple of targets, commit a couple of murders, drive the car back to the lot and nobody the wiser that the car was not there for a short period of time...Not saying this is true but rumor has it this guy is in financial straits, possibly losing his business. I also liked the previous poster, who pointed out locking up all the witnesses who recanted their statements....isn't this some kind of obstruction of justice? Just curious

I'm always leery about any arrests in high profile cases. Too much pressure MAY lead to too quick arrests. I have zero idea whether this guy is guilty or not and will make no comment on the quality of the detective work or the prosecutors.
I do know that bad arrests and convictions happen. Check this site out for the name "Mette".
There is little justice in this life, but you keep working and hoping that sometimes justice occurs. Hopefully the right people will be arrested and convicted in this case. If not hopefully they will die in a shootout with fellow criminals, where fortunately there are no survivors.
It's virtually impossible to have a witness flip if they're on video. Most other major departments are doing it. Why not CPD?

This seems like a case where someone came up with a theory on hwo the crime was done, and then the investigation went down the path of proving that theory rather than finding out what really happened. That approach often works OK, but it seems like in this case, it may have some issues.

Looks like my ex partner Proud Fillmo Trooper was right after all. He told me that he had heard the case was not that airtight and that folks need to put down the hangmans noose. Looks like we have to get back to work and do the investigation correctly. Maybe its time for A4VC to step aside and let the Federal Bureau of Investigation or ATF handle the case. Unfortunatelty CPD officers are starting to lose a lot of credibility in the eyes of the public with this years multiple arrests of coppers. Heck CPD will no longer conduct bank robbery investigations because it seems like only the FBI can do them correctly in Chicago. It s not that way in New York or Los Angeles. If the witnesses all shit on the offender at the beginning ... there is NOTHING you can do to make them repeat that story in court. THAT's the weakness (I'm just guessing here - I'm not involved w/ the case).
Even if those witnesses were locked in at grand jury, you STILL can't charge them with perjury, you can ONLY use their grand jury statements to impeach their lies at trial.

You sir need to wake up and join the 21st century. In this century we need hard evidence to charge and convict. Evidence like;
1.DNA
2.Video
3.Other physical evidence like a weapon, or finger prints, clothing, an automobile, etc.
Eye witness and circumstantial witness might be great in a low crime district where your witnesses are real citizens without rap sheets. If you try and put together a case with ONLY statements and no other evidence you may as well forget it when it comes trial time.
With witnesses recanting on a daily or weekly basis at 26th st AND the fact that people watch too much tv and want you to have the above hard evidence that i mentioned along with a few statements from witnesses you are not going to be able to charge and or convict.
You much utilize all available tools that the department has, such as I-Clear and PoD's etc. Why? Because the defense knows we have that and if you dont check it and use it they will be asking you why and they will want that data anyway.
This is the 21st century, now a days, you cannot just rely on talking to people. Do a google search and see how unreliable witness testimony is at court. Now look up and compare that to how many cases are won with DNA, Video, finger prints, fibers, etc.
On a hot case like this you get DNA back in 24-48 hours or less. You can pick up the POD info almost immidiately.
A hooker that got murdered and left in an alley might take you months on the DNA.
I do agree with you on your assessment of the reports and how they obtain their info these days.

I saw Fox 32 this afternoon and wanted to give kudos to Patrick Elwood. When the reporter on the scene was done telling the story, He asked a question that in essence was, is Austin "free and clear" now that he is being released or will he still be under investigation as a suspect? The street reporter said that she believes that he will still be under investigation as a suspect. That was fantastic. That made things a lot clearer than just announcing that this POS was being released.
Patrick Elwood is one of those in the media that seems to understand. I remember the time they had moprah on for an interview aboiut some other police matter and Elwood ripped her a new one on that show.

I'm taking it that when it was reported that the car was "in the shop", it was really in the shop, either inside the building itself or behind the locked gate. Just how secure was the vehicle in the shop or in the yard?
If it was picked up the day after the murders, then the work was probably already done. What better way to alibi yourself and your car than to have it "in the shop", when in fact you picked it up for a couple hours early that morning to go out and committ a few robberies, then returned it shortly thereafter.
Don't discount the car being used just yet. At the same time, don't discount other hypotheses either. When you get focused in on only one element, you tend to get tunnel vision.
Start throwing some shit at the walls, see what sticks.
It wasn't too long ago that if you fucked up a police murder this bad, heads would be rolling.

How gullible are we these days? "CPD blew it" sells newspapers. "Witnesses who swore they saw it or said they were there when it happened, now recant" doesn't sell newspapers. Hmm, what do you think the newspapers will print? Duh.
Area Four did not blow it. The dicks had the guy, had witnesses, had the car that fit the description. Unless YOU can prove the car wasn't out of that 'shop', unless you believe a bust-out mechanic who has EVERY reason to lie to protect his sorry ass, unless YOU have suddenly become the pollyanna 'nobody would ever lie to us' police, then re-examine your knee-jerk reaction to the newspaper reports.
The State was AFRAID to prosecute because the witnesses changed their stories. Maybe for money. Maybe for safety of their loved ones. Maybe because they came down off their high and realized their lives weren't worth a penny if they testified for the prosecution.
I once had an outstanding boss who said, 'if we miss 'em this time, we'll see 'em again'. Unfortunately, in this case, someone will have to be hurt or killed again before we put this slime away.
I have been on the job over 25 years. And tho I never worked A4, I know that there is too much talent and pride there to allow this case to screwed into the ground by them.
Hopefully the case holes will be filled in.
When they say the car was in the shop: What was it in for? Was it a disabling repair? Or just getting a boomer box installed? Was the car at the garage secured? Maybe jamoke put the car "in the shop" as an alibi and using a second key kept his work car rolling. Those video off those POD's are so bad as to be useless. Color under those yellow streetlights are way off.
If the case was that weak, why did the ASA approve charges at all in the first place? SAO always skates away from tough questions.

To Sgt 006 District, Chicago Police Detectives still do investigate EVERY bank robbery, or attempt, committed in the city of Chicago. A CPD Detective is assigned to EVERY CASE, (Check the CHRIS SYSTEM or Data Warehouse) This has not changed. Detectives detailed to the FBI Violent Crimes Task Force have always handled the bank robbery cases. All that has changed is that the area's dont send a detective to the scene to duplicate the investigation that the Task Force Detective that is assigned will conduct, thereby freeing the Area Detective to handle their own workloads or respond to District cases. Please be more informed when u post a comment, as a supervisor you should know what you are commenting on before you post.

I saw Fox 32 this afternoon and wanted to give kudos to Patrick Elwood. When the reporter on the scene was done telling the story, He asked a question that in essence was, is Austin "free and clear" now that he is being released or will he still be under investigation as a suspect? The street reporter said that she believes that he will still be under investigation as a suspect. That was fantastic. That made things a lot clearer than just announcing that this POS was being released.
Patrick Elwood is one of those in the media that seems to understand. I remember the time they had moprah on for an interview aboiut some other police matter and Elwood ripped her a new one on that show.

what was this repair to the auto that only took a few hours to repair ( tune-up) he still could of gone to the shop and drove the car away and brought it back. there is no fence surrounding the property to keep vehicles locked in, " that are there for repairs".
I suspect there are a couple of things going on here. Some or all of the witnesses are not exactly model citizens and those that are want to remain alive.
What good does it do a witness to testify if he is going to get offed for it? In this insane state, law abiding citizens have no means by which they can lawfully protect themselves. they are thus forced to not get involved since police can't/won't/don't protect them.

This old ship is in full need of COMING IN for repairs(if it can make it of course) and or assistance while afloat in the heated battles we are still fighting while out at SEA.

The problem is that the Cook County States Attorney's Office wants to present a 2008 trial that meets all the expectations of people who watch CSI and Law and Order. They want DNA, fingerprints, a smoking gun, a motive, and an answer for every lying alibi witness in every single case from murder to garage burglary. They want to present cases beyond a resonable doubt to the point of absolutely no doubt. They want to do all of this with 1970 police tactics and resources and an undermaned detective division.
They basically want police to force witness cooperation. We can't do that anymore and the CCSAO has no intention of forcing future voters to cooperate with law enforcement. So, they let murderers go.
This will all continue until this city is so overcome with violent crime that it literally collapses into rubble.

While the ASA was asking questions of the victim and his witness the both implicated the offender. However, when the victim and witness tesified in court separately they said that the offender could have not shot at them because he was standing next to the victim and witness. My point is these lying asses will lie under oath in a court of law. Boy was the judge pissed because he went through the trouble of paneling a jury. The judge dismissed the jury. Something swayed these two to change their testimony!

Looks like my ex partner Proud Fillmo Trooper was right after all. He told me that he had heard the case was not that airtight and that folks need to put down the hangmans noose. Looks like we have to get back to work and do the investigation correctly. Maybe its time for A4VC to step aside and let the Federal Bureau of Investigation or ATF handle the case. Unfortunatelty CPD officers are starting to lose a lot of credibility in the eyes of the public with this years multiple arrests of coppers. Heck CPD will no longer conduct bank robbery investigations because it seems like only the FBI can do them correctly in Chicago. It s not that way in New York or Los Angeles. I would never put my real name down on SCC. Too many higher ups read this blog. If the intent of the officer from 006 was to get noticed by his Sgt., then I would say "buckle up Junior, you're in for a rough ride."
Sgts in 006, especially M 1 Sgts, will find every opportunity to crush the working M 2 po. He is good as done. I actually feel sorry for the po now...somebody should have informed the po about how things work in 006.
I'll say this much, that Tully on Days is one crazy cracker! He need to have good medical insurance! Shit, the guy has been hurt alot since coming to the watch. I gives him credit though. He get hurt and show up for more the very next day. He don't take no medical. Can't say that for most po's. He do backup very well too. He a good guy in my book.

We all need to keep in mind that in this anonymous blog environment anyone can post anything about anyone using any name or identity they wish. To compound the problem, as we all know sworn officers are not the only people reading and posting messages here. Civilian department members, city workers, pro-police and anti-police citizens, politicians, media, gangbangers, mischievous high school students….they’re all here along with countless others reading and/or posting messages.
NO ONE should be attaching their name to any legitimate messages they post on the blog regardless of whether they’re favorable or not. All you’re doing is broadcasting your identity to all of the previously mentioned blog readers. A signed message should be treated as a fabrication and nothing more. If it is a fabrication then the innocent person assigned the blame for it can catch a whole lot of heat over something they had no participation in or knowledge of whatsoever. All that causes is dissention – something our department has too much of already.

The good Sgt is correct. In 006, there are not a lot of M 2 po's to begin with. He has every right to judge them harshly. I believe the M 2 coppers in 006 on afternoons especially are the ones the Sgt must question. He is right about his comment. Unless you work in 006, then you have no reason to question the Sgt.
