The Reality of Complaints

The Lieutenant makes sense. Too bad she works in Aurora:
  • When I was a patrol officer, a citizen filed a formal complaint against me, claiming that while arresting her, I picked her up and threw her against the transport van. I remember receiving the official notification of the allegation and feeling the blood drain from my face when I read that an investigation was being launched and that a guilty finding may result in my termination.

    Not only was I not guilty of the infraction, but, ironically, I'm so much smaller than the person who filed the complaint that it would have made it nearly impossible for me to lift her, let alone throw her, as she claimed. One of the sergeants for whom I worked even gave me the humorous nickname "Crusher" based on the sheer irony of my predicament. Eventually, justice prevailed and the complaint was ruled "unfounded" after several of the citizen's own family members gave statements that exonerated me. Despite being found not guilty, that allegation sits in my personnel file to this day.

Go read the whole thing. J-Fed might take some lessons from this Lieutenant Kristen Ziman. Yes, we are aware he was backed into a corner by the Federal judge - it was all for show anyway. But he's more than capable of revamping the entire Complaint process and maybe doing something simple? Unfounded complaints should be purged upon going through the review process. Not Sustained cases shouldn't be kept around for seven years. How about a few prosecutions for false affidavits to restore trust?

Of course, capable doesn't mean willing. We won't hold our breath.

wahh wahh we can't prosecute false complaints... that would deter people from filing them.
there has been cases where Defamation of character, etc have been filed and have been successful,but by private attorneys, not the city. I.E. Paul Gieger (ask the F.O.P.)

my fellow officers in blue-- we are under siege. sit on your hands and do nothing but respond to your jobs and back each other up. do not give these cocksuckers at iad or ipra the opportunity to invite you down for an interview with your attorney. they will believe the shitbird before they believe you and YOU will be brought to task. you don't believe me-- take a ride down to 2111 w lexington and talk to a few of the stripped guys and ask them how they are being treated by the dept. remember, we are all human and make mistakes. remember, j-fed has your back 200 percent.

Can't blame Jody or the Dept for the 7 year rule. Come on SCC read the contract! We and the FOP have been selling ourselves out for years. I think in the Sgt's contract it is only 5 years for the CR's to be kept. You act and talk like this is Jody's fault how about we put the blame where it belongs, on us the po's who allow this shit and the jerks from the FOP who unlike a real union do not have the balls to ever go after the city to change this in the contract! Years ago while going through a federal trial as defendants, for violation of civil rights, the plaintiff got the federal judge to get IAD to release our CR files. Well let me tell you IAD had more than 7 years worth and none of them were sustained and the FOP never did anything to stop it. Also had CR files released one time during a criminal trial involving an off duty po and the media, the bosses (Hillard) turned it into a "racial" incident. Once again the FOP wouldn't help and never filed a grievance or tried to help stop it with a law suit. So all you people knock off the bullshit this is our own fault not Jody's for allowing the FOP and the Dept to screw us contract after contract. Watch the next contract the same old shit will be included in it. If you ever want to see a real union that actually fights for and tries to protect it's members then I suggest you talk to Chicago Firefighters. At least their Local 2 actually files good grievances and has actually sued the City and won over contractual violations. They have been beating the city for years unlike us who sit and let the city screw us. Be honest with yourself SCC actually sit down and compare the Firefighters contract and the results they have achieved compared to the bullshit we always settle for. I'll start off with they have always known the rank listing and meritorious picks on all their promotion lists not to mention that by their contract any firefighter "passed over" on a list will always be promoted before a new list is posted. Shit that right there is more than anything we ever got from FOP bargaining for us. We did this to ourselves nobody to blame but us. Now ask yourself why should any CR file that has been investigated and ruled "Not Sustained" "Unfounded" or "Exonerated" ever be allowed to be kept after the investigation is completed? What purpose does it serve to keep those files? And believe me try to look at your CR file sometime down at IAD and see what happens. Shit you can't even get Sgt R.G. at Personnel to let you see your own personnel file and read the contract that is your right to do anytime during normal business hours. Now I dare you go down to 35th St and see if Sgt R.G. lets you see your whole Personnel file and if he doesn't good luck getting FOP to sue the jerk or fight for your contractual rights. I personally have been the victim of and know others who have also been the victim's of open and intentional contract violations and have never had the FOP help. For all you "experts" out there who say sue or notify the "G" yeah right good luck been there tried that. Lawyers don't want these contract violations unless you can come up with cash up front and Fitzgerald and his band of goofs are full of shit because they pick and choose and only do what they are told. So SCC and all my fellow coppers next time you are passing the blame around for the shit that happens to us, take a good long hard look in the mirror at yourselves for there lies the real problem.

The dept. Is under a (standing) federal court order to not destroy CR files. Even though the dept. can't by labor agreement use files older than 5 (or is it 7 now?) Years, the physical files are stored off-site seemingly forever. This is for use in litigation. No Supt. can change that, it's been tried. It sucks to be us.

My last brutality beef was the biggest joke, up until that point I had ever seen.
The complaint was my partner and I were accused of manhandling to females up north on two streets I had never heard of, the description of the offenders were two m/2's, 40-50, 510 160 and 508 220, one with grey hair and other with black hair. Well it was close, we work far south, I was 6-03 275, 25yrs old and my partner was 507 140, 24yrs old. we walked into OPS and the investigator looked at us and said, this obviously isn't you, so we said goodbye. The investigator stopped us and told us we had to give a statement before we left. Both of us were like, WTF!!! We called our old school Captain, who told the investigator a few choice words, and we were excused and we got the results and it was unfounded. There are plenty of cases that don't end up this well, but if you just look at the complaint we are two guys who threw around a couple of females.
Oh yeah, the actual officers turned out to be impersonators, with stolen M plates with plate number being written down incorrectly by the original person at OPS taking the complaint.

I'm a retired suburban officer. We had a new Chief arrive one day, ironically he was a retired Chicago Officer. One of his first acts when he arrived was to go through all the personnel files of the police department employees and he removed and destroyed all the cleared AID files from everyones file and they started fresh. J-Fed has the power to do the same thing, but unfortunately he not only doesn't have the balls, he doesn't have the power as he is nothing but a puppet on a string for King Richard and can not act on his own.

I don't understand how lifting the residency NOW will help Chicago police officers. The housing market is crap, no one is going to buy our houses especially in this crappy city. There is nothing that would make me happier than to be able to move out of this city, however this would be the worst time to lift the residency requirement. Now a couple of years ago it would have been great.

Could you tell her if she must insist on picking up her kids for school to STOP DOUBLE PARKING ON THE STREET WHILE SHE WAITS FOR THEM? Because one of these days someone is going to fly around the corner and smash right into her (or me for having to go around her). Then she's going to have to tell her boss why she wasn't where he thinks she was.

"In a move of defiance against a court order that released the names of officers accused of multiple allegations, Mayor Daley instructed the Superintendent of police to form a unit of detectives that would solely be assigned to investigate perjury cases in which citizens have lied after signing a sworn affidavit alleging police misconduct where evidence supports that these allegations were false. Superintendent Weis says he is looking forward to cooperation from the States Attorneys Office, who have also stated they would assign multiple assistant states attorneys to prosecute these offenders. FOP President Mark Donahue applauds the initiative, but stopped short of giving it his full support saying "these laws have been on the books for years. I have to question why only now has the Mayor decided it is time to prosecute these offenders. We will hopefully know more in the days and weeks to follow." Several west and south side community groups have come out against this action, stating that every citizen "has a right to question the police, and their methods of policing". Reverend Clasp of the new anglican west side missionar baptist church said that he encourages his parishoners to make allegations against the police to "keep the police on their toes" and admitted that his parishoners sometimes exaggerate the details of their complaints, but that is not concerning to him because it is the "idea that matters, not the details". Reverned Clasp stated that this new policy will allow the police to continue harrassing and tormenting the people, and will only deepen the gap between police and the community. An anonymous source reported that Rev Clasps congregation are solely responsible for over 200 complaints of police misconduct over the past six months, a majority of those complaints coming in the hours following an arrest of gang members and drug dealers, many of whom are family members of Clasps parishoners."

Two parts here SCC, so a little long, sorry....

1) Copper on 2nd watch in my district met with Corp counsel Friday (the 13th.) Seems copper and partner had a lawsuit filed against them. Corp. counsel says: "We can settle this out of court for $600,000 AND are going to make you and your partner pay $11,000 in punitive damages."
If you want to go to court, and they award punitive damages, it will probably be a lot more; there is your choice officers; take it or leave it. So, now the city is deciding how much punitive damages you will pay, even without a trial
Supposedly FlOP is looking into group umbrella policies if this happens.....The city's got your back..

2) Has anyone looked at the latest FlOP newsletter regarding the 2009 legislative session? 8 of the 15 bills they are following (although beneficial to some) will be taking even MORE money out of our 48% funded pension fund. Only 1 bill has anything to do with putting more in the fund, and that bill is about raising the city's multiplier from 2.0 to 3.0. Now, like I said, I'm not against people getting their fair share, but I'd like something to be left for me and those that came behind me when we retire.

if our pension fund is not being funded as required by the statute, then the pension board needs to sue the city. The Village of Calumet Park was sued by their police pension board for years of under funding their pension. Their pension board hired an attorney (Rick Reimer)who filed all of the paperwork and low and behold, they won. The Village is bound by the court order to continue the proper funding each year. In our pension law, which is slightly different than theirs, under subsection (G) the city is obligated to deposit with the city treasurer before March 1st of each year an amount that is not less than the amount of city contributions for that year as certified by the board to the city council.
If they are not doing this, then the pension board should hire a lawyer and have a judge make them do it. contempt of court is a bitch, as Weis knows so well.

The rest of us understand it isn't about today, or now, or even 'me'. It's about the bigger picture and it's about the long haul.

Sorry you only want residency repealed on YOUR schedule. The rest of us would just like it repealed, any time, any way it can be made to happen.

I know I could get to work in 025 a hell of a lot faster if I lived in Oak Park, than if I lived INSIDE the city at 111th and Western. The rule is stupid and outdated and only exists to maintain the tax base for the City.

Calm down!! I'm not a cop, I'm a wife!! I agree that the rule only exists to maintain a tax base for the city and should be lifted. I was just stating a fact that this would be the worse time to lift residency because of the loss everyone would take on their homes. However, if you think living in Oak Park would be a good thing it is pointless to talk reason with you!!
