Abbate Guilty

  • A Cook County judge today found Chicago Police officer Anthony Abbate guilty of aggravated battery for his 2007 attack on a female bartender, saying that even if the woman pushed and shoved Abbate to get him to leave a restricted area, "that did not justify his actions afterward, which were completely out of proportion."

    Earlier in the day, Judge John J. Fleming, presiding over the bench trial, acquitted Abbate of two lesser charges of official misconduct.
Thank goodness we've now seen the last of that video! It was getting tedious.

Same judge who let some shithead go from a pistol case because he said he was going to attend college in the fall. Guess what? Shithead still not in college but that stern speech fleming gave to that jagoff must've really worked since the next time I grabbed him, he only had dope on him but no gun. Was Abatte guilty? YES. Should he spend the next 364 days in jail? YES. Was it aggravated battery? NO. If he wasn't a cop, would any of us gotten charges approved? NOT A CHANCE IN HELL. Let us all hope that they, the MSM, will now focus on the health of Officer DC from 22, and the pending funeral of Officer AV.

These fine two police officers are a much better representation of what a true, CPD, Officer is all about.

It is not some fat slob who was only on the job because of clout, or a drunk from Bridgeport who also had clout, or even a commanders kid who likes to drink and drive but also has clout.

These 2 brave officers far and away out weigh any of the misdeeds by the other, clouted, three disgraces to the CPD.

I am now going to call the asa for every battery case where a weapon is used. A barstool, stick or whatever. I had cases where peoples heads were split open and the dics wouldn't even come out. This girl had no injury she was walking around without any sign of injury right after the attack and even worked the next day. How the fuck is that not a simple battery? Bitch is just looking to get paid. I can't blame her because the city will just give her a few hundred thousand to settle and everyone knows this.

Im quite sure we havent seen the last of that video. EVERY time a copper fucks up we will see it again. Now a dead woman turns up in oak forest and her ex husband is the suspect. Prblem is he was CPD but fired in 1997 for shoting her in the hand. YEP FIRED IN 1997 and still mentioned in the story that he was a chicago police officer.

You should really read the CCSAO's arguments concering Abbate's official misconduct charge. Thank G-D the judge didn't buy their political bullshit.

Prosecutors argued that police are held to a "higher standard so when they commit crimes they are automatically guilty of official misconduct."

This is a really sad attempt by the State's Attorneys Office. In making this argument they are confirming what all police officers in Cook County know, ASA's are bottom 1/3 of their law school class, political hack lawyers who obviously have a hard time reading and understanding the ILCS.

Would somebody please let these poor excuses for lawyers that the Illinois Constitution and the US Constitution doesn't say that just because you are a police officer you are held to a different criminal standard.

Good thing Judge Fleming saw right through the feeble minded prosecutors' argument. By the way, anybody could have tried and convicted Abbatte on the battery charge so don't pat yourself on the back too much.

I wouldn't make any arrests anymore and hopefully the lack of work will bring about a cut in the CCSAOs workforce and we will actually get some intelligent attorneys who will adequately represent the citizens of Cook County.

Abatte got screwed because he was a police officer.

But, Abatte did so much damage to this department I could care less. Abatte set the stage for the SOS over-reaction by the State's Attorney and the media. It set the stage for wrongful charges against the PO's at Jefferson Tap. It set the stage for the comming of Weis and the piss-poor managment creation that followed.

All these problems started with Abatte. Now this deparment is damaged beyond repair. Abatte let ever police hater and social malcontent point to that damn video and say, "See. All Chicago Police are like that."

All by himself, this usless excuse for a police officer changed this job forever.

I hope he rots downstate on the trumped up charges that put him there.

As a Police Officer, he should be held to a higher standard, and he was. He will loose his job and his pension and start his life over as the penniless drunken slob that he is. If he were a doctor, plumber or Indian Chief I doubt he would have been charged with anything more than the misdemeanor. Trust us, no one is happier than the real Police Officers in Chicago that he is off the job.

We are not sticking up for him when we say the agg battery charge is over the top. It cheapens the charge to call it agg batt when the bartender wasn't hurt. We see incidents every day where people are severaly injured and the offenders are not charged with aggravated battery.

I hope the citizens understansd this when we say this is out of line, but we are happy he was convicted.

Whatever F*cktard posted this has no idea why we are posting what we are, so here's a road map. The ONLY reason Abatte was charged with a felony is because he was the police. Most of his drunken haymakers missed, and this woman had no sign of injury much less great bodily harm. On the flip side, I had a woman who was not the police plow a steak knife through another woman's cheek, and no felony charges were approved. So in summary: Police-felony for a few punches, shithead-misdemeanor for a stab wound that required surgery and caused a massive facial scar. Get a clue pal.

Regarding Dugans controversial order of last week where he cut the desk crews city wide and also kicked out some C.A.P.S. and Commanders people I see Gene Roy is not wasting any time going back to his old ways. A.B.,one of his dollies who was tossed out onto the mean streets, was assigned to bt.934 today but lo and behold she was held down on reports for the entire tour per Cmdr Gene Roy.
Every sworn P.O. was trained to be a police officer if they can't handle that then they should resign. Poor little Aura has had her cozy little world shook up by being tossed out onto the street. No more 4 hour days or wearing blue jeans whenever she wants...the audacity of Dugan!
She's paid her dues.. I think she might have 5 years on and at least 3 of that has been inside.

My family history is rich with police officers and therefore, I've always felt a special affinity for the men and women in blue. I also understand that while I hold no animosity toward the police, the same can't be said toward me: an ASA. That's fine. I get it. Some cops have had bad experiences with ASA's - Lord KNOWS that even *I* have had bad experiences with ASA's myself. So usually, I ignore comments like the above, but something has to be said: to consistently paint ALL ASA's as "law school hacks" is, to borrow a word from SCC, "tedious" at best, and idiotic at worst. Just like the vast majority of ASA's do not believe ALL cops are pieces of shit, e.g., Abbatte, I'd hope that most cops don't view us ALL as your enemy. Do you have dogasses amongst your ranks? Do you have lazy POS's getting promoted for political reasons? Guess what? So do we!

I'm not suggesting we get together and sing kumba-fucking-ya anytime soon, but for me, personally speaking, I will go to bat for a cop any time. I will continue to work hard to work WITH you to see that justice is done. Anything less just wouldn't be acceptable in my family. You're all entitled to your opinion, of course, but maybe next time before spouting nonsense re: the intellectual acumen of most ASA's, stop and think; realize that our orders come from the top - like yours. We have shit personnel - like you. We're not that different. My naive hope is that we can work together - especially to crush those two jagoffs who took one of your own so tragically.

Here is some additional background about this case. The Polish bartender is alleging that she told the two responding P.O.'s (J.K. & P.M. of beat 2514) that Abatte was a cop. BULLSHIT. J.K. and P.M. did the paper and wrote down all of the facts. I work in 025 and these two guys are honest and good P.O.'s. No fucking way would they "cover up" an incident like this.

This woman/bartender is lying in order to extort money out of the city. Does she have a conscience? Poor P.M. and J.K. are going through a lot of stress and mental anguish. J-Fed considered firing them but the worse case scenario is 60 days with no pay!

Once again to Ms. illegal Polish "immigrant" bartender, do you have a conscience?

The day you walked into the academy, no matter how long ago it was, everyone told you that there was a double standard when it comes to being the police. If you didn't get that speech you obviously missed alot of class and therefore don't belong being a cop in the first place. If you fuck up and you are on the job you are going to be crucified! So please stop already with the whining about a double standard. I have been on the job the better part of 18 years and it was that way when I came on. If you are afraid of it then you should go do something else and leave it to the real police to do the job. The simplest way to avoid getting in a situation like Abatte did is to use common sense, don't over indulge and if you realize you have a problem seek help. Often they do, leave quietly, and come back in the door the next day with A. an apology to the employee and B. a "set 'em up." Was having a bad day, you know? Life goes on.

Go off on the bartender like that, not surprisingly there'll be worse trouble.

That's interesting because I was talking to a buddy of mine who told me that the ASA who showed up for a job he was on would not accept the witness statements that he put together because she told him, "everybody knows police lie", so they would not stand up in court. She told him that she would interview the witnesses and write her own witness statements.

Abatte got screwed because he was a police officer.

But, Abatte did so much damage to this department I could care less. Abatte set the stage for the SOS over-reaction by the State's Attorney and the media. It set the stage for wrongful charges against the PO's at Jefferson Tap. It set the stage for the comming of Weis and the piss-poor managment creation that followed.

All these problems started with Abatte. Now this deparment is damaged beyond repair. Abatte let ever police hater and social malcontent point to that damn video and say, "See. All Chicago Police are like that."

All by himself, this usless excuse for a police officer changed this job forever.

I hope he rots downstate on the trumped up charges that put him there.

This state is most accurate post, tells it the way it reallt is.

I also understand that while I hold no animosity toward the police, the same can't be said toward me: an ASA. That's fine. I get it. Some cops have had bad experiences with ASA's - Lord KNOWS that even *I* have had bad experiences.............

Yes, I would have something to say. You betcha!

First, I would be shocked if my mother or sister or daughter were stupid enough to put themselves in harms way like the bartender in this incident. She had access to a telephone before placing her hands on Abatte and should have called 911 instead of trying to woman-handle a drunk. To me, it was like being dead-right in a traffic accident. You have the right-of-way, but get killed by the guy blowing the red light. On its face, she was not incorrect in trying to keep a drunk non-employee from getting behind the bar, but she was stupid, very stupid, for not sizing up the situation and foolishly attempting to physically keep him from doing so.

Second, watch the video with a discerning eye. You said, "A grown man beating the tar out of a little woman." Hardly. Does Abatte ever connect? Does the bartender suffer any injuries? Did she have any wounds? A concussion? Was she mamed, lacerated or permanently disfigured? Did she sustain a hearing loss? Or suffer double vision? The answer is no to all of the questions. She alleges she lost some hair, but it must not have been permanent because her head of hair looks to be fine. She now says she is afraid of Abatte. Look at the video. She tried to push him around and did not look afraid in the least.

And the kicker. When did she seek medical attention for her contrived, mythical and non-life-threatening injuries? The answer: the next day, after she saw, not stars, but the dollar signs.

Say what you want about Abatte, I do not even know the guy, but look at this whole thing objectively, not hysterically, with a discerning eye, and it is a travesty that he was found guilty of aggravated battery. It is a simple battery at best. Public opinion and hysteria stuck it to Abatte. I predict his conviction will be over turned on appeal.

For a police officer to get aggravated battery approved, he would have to be missing a limb, and even then it is a toss up if Felony Review will approve an aggravated battery charge. The charge of Aggravated Battery in the Abatte incident is simply ridiculous.

I don't think you can blame Abbate for the problems.

If that situation had been handled better, it would not have been such a huge issue.

City government is a cesspool of corruption and the police department is at least in part a reflection of that government.

You can't really reform the PD in Chicago, or do much to improve its sorry image without first dealing with King Daley's crime syndicate.

Regarding Dugans controversial order of last week where he cut the desk crews city wide and also kicked out some C.A.P.S. and Commanders people I see Gene Roy is not wasting any time going back to his old ways. A.B.,one of his dollies who was tossed out onto the mean streets, was assigned to bt.934 today but lo and behold she was held down on reports for the entire tour per Cmdr Gene Roy.
Every sworn P.O. was trained to be a police officer if they can't handle that then they should resign. Poor little Aura has had her cozy little world shook up by being tossed out onto the street. No more 4 hour days or wearing blue jeans whenever she wants...the audacity of Dugan!
She's paid her dues.. I think she might have 5 years on and at least 3 of that has been inside.

Let me explain to you what happened. Since I work in 025 and was there and read the paper that 2514 did.

Beat 2514 P.O. J.K. and P.M. are at a local store and Belmont and Long. A citizen approaches them and tells them that "a big guy is beating up the bartender at Jesse's Short Stop Inn". The bar is a half a block away from Belmont and Long.

So the two officers respond and they also get the job over the air. When they arrive, Abbate is gone. So 2514 writes up a report and even sends out a flash message. Other responding units are touring the area looking for this shithead.

Now after a few hours, some of Abatte's friends visit the bar and demand the video tape/disc from the owner and demand that the bartender does not press charges. Or else they would get the bar owner and the bartender in deep trouble. At this time, Karolina the Polish illegal bartender finds out Tony Abbate is the police. JACKPOT.

Thus now she makes up the story that she told beat 2514 that she recognized him as an off duty police officer. And 2514 didn't write this fact down in their paper.

That is total bullshit. P.O. J.K. & P.M. did what they were supposed to do. There is no way these two fine gentleman would stick up for a piece of shit like Anthony Abbate.

Now this woman is suing the department and CPD alleging that 2514 tried to cover up for Abbate. And these two fine officers might be given 60 days suspension.

As for the bartender, if she is truly illegal, what gall is it of her to get her ghetto lottery. Another illegal feasting off the American tit. Bruising at best....were there any ET photos taken right after the incident? NOT. Whatever happened to her reported "domestic" that happened shortly after the bar incident? Any taxes taken out?

I hope every dic calls felony review for agg battery on any type of bar brawl and demand that felony charges be approved. We should post on this forum all calls to felony review for agg batt charges and get the name of the felony review asa who disapproves. Be sure to indicate the injury on the victim.

Where do you find anyone carrying water for him? We all think he should be fired. We all think he is guilty and should go to jail. The only problem we have is that when we call felony review for a crime that is 10 times as bad as what he did we never get felony charges. The double standard because he is a cop is amazing and he was not on duty or in uniform. Trust me, we see a lot worse than that everyday but since the participants are not the Police no charges. Only when the ASA can get face time on TV are charges approved.

On 21 March 2007, a complaint was registered with the Independent Police Review Authority (IPRA, formerly known as the Office of Professional Standards), regarding an incident that occurred in the 25th District, in which four (4) Chicago Police Officers responding to the scene of a battery, allegedly failed to report the misconduct of a fellow department member. Based on video footage and on corroborating witness statements, IPRA recommended to “SUSTAIN” multiple allegations that the accused members failed to report the misconduct of a fellow department member, were inattentive to duty, disobeyed a written/oral direct order, and made a false report. IPRA recommended a sixty (60) day suspension for each of these accused members. As to the other two (2) accused members, IPRA recommended that the allegations that they failed to report the misconduct of a fellow department member, were inattentive to duty, disobeyed a written/oral direct order, and made a false report be “UNFOUNDED” because evidence indicated that the other two (2) accused members did not receive information relating to the misconduct of the fellow department member.
