It sure looks like if you do DUI's, you will be targeted for lawsuits, publicity and all sorts of innuendo. This is like the third or fourth DUI writer facing all sorts of accusations.
Have they done anything wrong? There's a process for determining allegations of misconduct and the process should move forward.

What is also funny is the main part of the lawsuit against him was that he was targeting gays. That is like a po working on the west or south side areas that are 98% black are targeting them becasue the are black. Hell no, that is the population of the area you are working. My last DUI was over two years ago. I will not do another. Same with movers and arrests, in extreme cases only. I also have gotten into my last argument with a citizen over a parking ticket. The blinders are on to stay. Fuck this shit.

These people can bitch all they want, but when something bad happens....023 cops are on it, and I mean quick ! I live there, Im straight, blue collar, joe 6-pack and I get excellent police service in my area. Some ass-clown fired 6 shots, late on a hot july night and we had 2-3 marked cars and 1 unmarked on scene in 60 seconds. Try getting that level of service in other areas.
The only time I will ever do a 501 is when the person crashes into someone or something and there is open containers of beer in the front seat of the car. I never have to worry about probable cause and everytime I've gone to court, I've never had to testify because they plea out due to the mountain of evidence against them.
I just act like an ASA reviewing a felony and do slam dunk DUI's, nothing more.

Im no fan of RF but please point out what he does wrong. The offender stumbles prior to walking , then misses his nose every time with his left hand. The officer's directions are clear and at times, stern. But he did a more thorough job than most would have with the field tests. His paperwork is what gets him killed in court. As a supervisor in 023 , its between him and a tact officer whose narratives (spelling,grammar)resemble my 6 yr olds diary.
I don't think that the fictional skill known as "gaydar" extends to traffic stops. How does anyone know the sexual preferences of a bad driver until they tell you? These lawsuits are crap.
Without discussing the merits of this law suit and only commenting on what I saw on the video, the driver did not seem to be intoxicated and performed the field tests well. I really do not know if he blew the box or anything else about this, only my observations on the video.

That being said in a few other cases some Chicago cops or former Chicago cops have clearly cut corners regarding charging DUI.

I know one or perhaps even two cops reading this hate video cameras. Like it or not video is here to stay and in cases like this should make for better policing. If a cop knows he's being taped the idea of skipping the approved procedure may seem less appealing.
Plus, a tape showing a clearly drunken driver stumbling around could also be useful.

The truth is the Chicago Police Department does not properly train officers in processing a DUI arrest.
This is something that is always skipped over in the academy.
It is a very complicated arrest, with many possible things that take place.To wit: Injuries, Blood Tests, Breath Tests, Field Tests, Court.
To train properly a officer has to actually do six or more with a experienced officer, also watch case in court. Problem is most FTO's won't do one, and really are unsure how.

How is the lawsuit not appropriate? I cant speak for the other defendants, but looking at this particular video, it certainly is not consistent with the report. If you're dumb enough to lie while being videotaped, you deserve the karma you have coming. Also, in response to the first post, the officer has repeatedly been accused of using homophobic slurs. So yes, while its expected if he works that neighborhood he will likely encounter a large gay contingent, it sounds to me like he has larger personal issues he needs to work out in the confines of a therapists office.

This guy is a real tool. His paperwork is shit. He tries to act like he knows what he is doing, but he can't spell and his sentences are like a third graders. Some of the stuff he puts in arrest reports is so bizarre you know it is bullshit. People tried to tell him 10 years ago that he was doing things wrong and he wouldn't listen to anyone. In my fucken experience, the biggest jagoffs in the station were the ones who wrote all those pimpy DUI's and it WAS for the money. Just like the scared to death cops that just do TVB's, to avoid dealing with real criminals and situations. Holding themselves down all fuckin night for shit. Sandbagging is the order of the day for these people and everybody knew it. Waiting outside a mexican bar does not a policemen make. Daley's Hiring Regulator Needs To Be More Aggressive In Clean Up, Shakman Says
Mayor Richard Daley’s hiring regulator needs to show more independence from City Hall and conduct more rigorous analysis of alleged hiring abuses, the attorney at the center of a decades-long court battle argued in a new legal filing.
Michael Shakman, who has fought against political hiring and promotions, said today that the mayor’s Office of Compliance seems to be acting as “an advocate for the city as opposed to a neutral fact finder.”
In a federal court filing Tuesday, Shakman took aim at what he saw were a series of glowing but vague progress reports filed with the court by the mayor’s Office of Compliance.

Field sobriety tests are a joke. The USA is one of the last industrialized countries in the world to use this tactic to determine alcohol impairment. Change whatever statues that need to be changed and simply breath test the suspect. The officer already had the guy on weed possession so just write the ticket, breath test and have a good night.
I am getting so sick of these same shyster lawyers making up shit about officers. I've worked with that cop and he knows his stuff.
There are plenty of things that can't be observed on the video that shows this guy is impaired. He did it for the overtime? Really? I have a hard time believing he would ruin a persons life for a little overtime. There are a hundred other drunks out there.
The lawyers are reaching but it doesn't matter in the end. The criminal case will never go to trial because ASA will "nollie" it. The civil case will just be settled by the city for a few million to the "twelve" others he claims are his clients.
As for the officer, the department will probably take him off the street, treat him like shit (oh wait, 23rd District already does that), and pretend they have his back.
I have had people perform the FST perfectly and blow almost 3 times the limit. This DUI enforcment thing should be re-studied. Illinois does not even follow the advice of the people who invented the breathalizer at Indiana University. I'm not saying that driving drunk is right, i just think it's become more and more political in nature. Stay away from it whenever possible.

Cops are human beings and subject to doing the same kinds of stupid things human beings are known for.
I knew a guy who got fired for using his work computer for personal business. Guy was given multiple warnings and knew his computer usage was heavily monitored yet kept on using his company computer for personal business.

In the late 90's. I had a 5'2, 100 pound female DUI that passed all the FST's without a problem and she did it in stiletto spike high heels. She declined to do the tests without the high heels because she was never without her heels. I sized her up as a .10 max. Later, she blew a .27 and a .26 to the surprise of everyone near the machine! FST's are of no help when you have a "professional" drinker.
