Lefkow Overturned

It's good to see that someone realizes the Constitution is there for a reason:
  • A two-year legal battle to open up disciplinary records of Chicago police officers suffered a setback today when a panel of federal judges decided to keep the files secret -- denying an attempt by a journalist and 28 aldermen to open thousands of documents to public scrutiny.

    The fight over the files has unfolded amid a broader public debate about police oversight in the city, with some critics suggesting the files would reveal evidence of police department leaders ignoring rogue cops for years.

    But the 7th Circuit Court of Appeals decision came down to a simpler legal matter.
    The files had been exchanged as discovery evidence between parties in a federal misconduct lawsuit against eight police officers.

    But the files had never been formally placed in the case file. The three-judge panel ruled that legal precedents favoring public disclosure of court records do not apply to records not in the case file.
Of course, the lib-tards are screaming over this one. If they come here and expect to see their rant, they will be sorely disappointed. This is our echo chamber and as such, we decide what goes up. You can go over to the BreakingNews website and post your bullshit there. Ain't happening here. This was a good call by the Appeals Court.

Liberal OR Conservative, it was simply the correct thing to do. In either a civil case or a criminal case, the defendant has rights. The Plaintiff had no legal grounds to look at the files. It is nice to see that sometimes the Federal Appellate Panel reads and interprets the laws in a manner reflecting their alleged mastery of jurisprudence.

I agree with the comment about the 017 dist tact teams. As a resident of 017, gangs/burglaries are on the rise. Tagging is more evident but police precense is practically invisible. I know that most districts are short staffed but I always see plenty of po's at : 1)7-11pulaski/addison 2)Gas station at avondale/addison 3)shopping at the home depot on addison.

I realize that we don't have a contract right now, but not all of us live in 016(the motherland).

It seems to be a good call based on the law.

As for a policy so many complaints are pure bullshit that I don't think opening them up to the public is a good call.

That being said there are still guys on this job who I wouldn't trust to open an envelope.

Now for the minority of the non envelope fookers who are excessively brutal or thieves there are methods of dealing with them.

In the late 90's there were a group of veteran PO's shaking down and flat out stealing from immigrant Polish drivers on the NW side. Then Superintendent Hilliard brought in Polish speaking Feds and voila......no more shakedowns.

Complaints should be kept in house and patterns should be looked for. If a cop has 25 complaints and they are mostly of a different nature it's likely they are bullshit.

If he has 25 complaints and 20 are for the same thing then he needs to be investigated. If the complaints turn out to have a basis in fact then the cop either needs to be forced to get help or be forced out. Worse case prosecuted.

The internal affairs function in a Police Department is a nasty but absolutely necessary function. The main problem with it in this department, I know you're all curious as to what I'm going to say, is CLOUT.

Just like every other problem in the department. I know that surprises most of you reading this who believe all is on the up and up in the magnificent CPD.

I think the court got it right. Not because the records in question should remain secret, thats a different issue. Its all about how this kind of information is handled pre-trial.

To have decided this any other way would have made a mess of a lot of other cases, most being mundane civil cases.

Last week, a Detective on the Police Department brought to my attention that Mike Masters was participating in our Policemen's Annuity and Benefit Fund of Chicago. As an appointed member of the exempt ranks, Masters has a salary of $155,000+. I then decided to investigate further with other exempt member. Weis, Brust, Daly and Klimas were all former FBI agents appointed to exempt ranks. They too are participating.

This is not simply a matter of sworn vs non-sworn members of the exempt rank. The fact that these member never participated to our fund prior to their exempt appointment eliminates them.

Here is the law: The Illinois Pension Code that governs our fund includes persons of exempt rank in our fund only if they meet the following criteria under Sec 5-109.

"Policeman" : (b) An employee as defined in sub-paragraph (a) immediately above who is serving in the regularly constituted police department of a city in a rank or position which is exempt from civil service and who, immediately prior to the time he began such service, was a participant in the Policemen's Annuity and Benefit Fund Act

The five exempt members have a salary ranging from $140,000 to $310,000. This is a lot of money to expose our pension fund to the risk of these members obtaining a pension. If these members were to be participants in our fund for 3 Years, they can take advantage of our loopholes in the pension code. If they get another "safety or investigative" job after the 3 years on our department, in either the County, the State, the City, the Federal Government, or become a police Chief outside of the city, they can continue to participate in our fund.

Here is the law: Sec 5-414 Credit For Service

Any participant in this fund (other than a member of the fire department of the city) who has rendered service as a member of the police department of the city for a period of 3 years or more is entitled to credit for the various purposes of this article for service rendered prior to becoming a member or subsequent thereto for the following periods:

(c) While performing safety or investigative work for the county in which such city is principally located or for the State of Illinois or for the federal government, on leave of absence from the department of police, or while performing investigative work for the department as a civilian employee of the department.
(d) While on leave of absence from the police department of the city and serving as the chief of police of a police department outside the city.

Not only does our Board need to remove them from this fund, we also need to explore how it is that these members were invited in to our fund in the first place. Who let them in? As we all take a closer look at this pension system, we realize that it is far too often that the chosen ones benefit from this fund, not the hard working men and women of this department. It takes a village to raise a child. In our case, it takes an entire police department to police our pension fund.

Mike what do we do to help you ensure they are NOT ALLOWED in our pension!! I had heard if they (FBI exempts) are in the pension for 3 years they get full retirement pension or something like that, is this true as well? Then that's why JFed MADE SURE he had a 3 year contract and immediately had his FBI buddies join our ranks so they can have full pension after 3 years. As soon as he is gone they know that they will also be "asked" to leave. What do we do about this?

If some investors bought the parking meters let them pay for it all. What a great investment idea. I buy the meters and you pay for all the work to make my investment profitable.

If that's the way it works its a really sweet deal. Wish i could have put some money in that pot.

Hey back in the DAY that team used to ROCK! Excellent pinches and we kicked ass with search warrnats..we had a great leader then and we were the best 017 had til they took our team apart!

Put the band back together and we will take care of it again!

crybaby copper who likes to complain about cars sitting around at the 7-11 and gas station or home depot in 017--- crime is up everywhere because the economy is bad--- where you work i'm sure that nobody hangs around anywhere as you are all getting paid by the mile-- 017 tac is a head unit as are all tac teams now-- quantity over quality has been preached for years so don't blame the tac team, they are just doing what they are told--

This decision is merely a stall used by the court to "not decide" and issue and send it back to the district court for reconsideration. You can expect that the Plaintiff will motion for the files to become part of the official record, that Lefkow will admit them pro forma and the case will go back up for consideration.
