J-Fed Comments on the 4-2

From one of his two blogs that we don't link to, J-Fed posts this late yesterday:
  • I apologize for not commenting on recent posts. I was preparing for the budget hearing, which thanks to many people, went very well. However, I have received many inquiries into the work schedule. I remain committed to providing the officers of this Department with the best possible schedule. Any published reports of this being a done deal are inaccurate, as we remain in good faith negotiation on this matter. You have to understand that I am limited in what I can say due to the requirements of confidentiality of the ongoing negotiations. Because the work schedules are subject to mandatory bargaining, I cannot act unilaterally. All officers, sergeants, lieutenants and captains are represented by a collective bargaining agent. You need to bring your concerns to your union so that they can negotiate on your behalf. For my part, I will continue to work toward reaching an agreement that will best serve you and the residents of this City.
In other words, Shortshanks told him, "Not yet."

And it seems that all our information regarding the hiccups in implementation was, once again, 100% correct despite what the FOP, Department talking heads, and numerous commentators claimed. You're welcome.

The FOP has put a "tentative schedule" on their website with all the various permutations of schedules currently in operation. We wouldn't doubt that an order will come down shortly for everyone to bid furloughs under their current schedule, then sometime in the next month or so some massive schedule change will be implemented just in time to fuck up everybody's vacations.

Plans for Northerly Island: A bird sanctuary is likely, because the lakeshore is a favorite resting and dining space as the animals move north and south, with walking and exercise paths nearby so that city dwellers and tourists alike could take in. Are you kidding me? Ask anyone in 023 about the bird sanctuary at Montrose Harbor. Nothing but "Alternative" lifestyle people in there doing the nasty! The Brass needs the know the potential numbers of retirees and the actual number of retirees. Based on manpower with no hiring expected for all of 2010 they will slowly impliment 4-2 first in patrol and then slowly in units.
Expect manpower to be between 7500 and 8000 by Jan 2011 with special employment overtime initiatives in the districts and units.

Don't know where the rumors that the 4-2 are off. It's not on the FOP website. I spoke to FOP today and was told that the 4-2 is still in the works and no way off the table. Who keeps starting the rumors? Accept change you just might like it.

J-Pud is afraid that you may retire after the contract is signed. Shortshanks states you don’t have enough brains to leave. Who is right. In some aspects they both are it is just in the timing. Many coppers will not leave until they get their retro checks. For those who are max’d they are almost working for nothing! Others are afraid that Daley may push they into Obama Care regardless.

1. Your BFD’s and P-Day’s are not subject to re negotiation every four years why would you health care be? Could it be that we would rather believe a rumor than fact. He just can not take your health care away after THEY ask for this change

2, There will be no unpaid BFD’s. In fact while Shortshanks is telling the press that we are not helping out the city his lawyers are in Federal Court fighting FLSA stating that the city cannot man the necessary cars if we get all the time off we want. Why would Shortshanks do that? To influence the court of public opinion. PS. THEY ask for arbitration not us.

( HAVE YOU HEARD ONE WORD FROM ANY ALDERMAN SINCE THE PETITION DRIVE STARTED?)

3. We are two thousand short according to Fran from the Sun-times. Pay the fee to do research at Lexis Nexis. You will find out that she printed almost the same article word for word four years ago for the city. Make no mistake about it she is the city’s mouth piece.

4. NYPD just got 20% for four years. Yes that does help us some but not all that much. Their cost of living is much higher than us too. Gas, heating gas, electric are all much lower now that last year. Property taxes are up slightly. We will get more than the city offered and less than we asked for. The big question will be how it is divided over 4-5 years.

5. The City and FOP are still meeting and the arbitrator is fully involved. Things are actually going faster than expected. This is the one thing that I take with a grain of salt but I know a unit rep that is not part of the FOP inner club. His old partner is part of the negotiation team and most things are falling into place so the arbitrator will not have to decide that many issues. The Capts and Lt’s assc’s screwed us some by signing off on disciplinary changes we would never have agreed too.

6. Residency is not even on the table until the State law is changed and hell will freeze first.

If you want to retire after the retro check next year you need to put your PAR forms in now if you are under 60. Otherwise you will have to stay till 2011. Take 13th period furlough. (Sorry youngsters they old guys need to cover their bases here) Retire before 29 Nov 2010 and get your first C.O.L.A. 01 Dec 10 and another one on 01 Jan 11. Wait til Jan 20011 to retire and lose 3% for the rest of your life.

That’s what Daley wants you to do.

The question is HE smarter than YOU are?

I CAN't AFFORD a vacation let alone my mortgage in the CITY and the update of kids clothes, BILLS I accrued over the last 5 years due to increases of prices/taxes etc.

Officer Pedro Medina assigned to the 014th District was deployed to Afghanistan. Officer Medina was inside of a building and seriously injured when a helicopter crashed into the building causing it to collapse. Pete is now at a Veteran's Hospital in Tampa, FL. He was initially admitted as a paraplegic. He is now undergoing extensive physical therapy six days a week where he is making progress. He is now able to walk slowly with the help of a cane.

To the poster who asked about taking a holiday off: A slip for DOH is by seniority. It does not matter if you put it in four weeks ahead of time, or the day before the holiday. The most senior people get the day off first. Your watch commander CAN'T say a holiday is closed to any more people. If you have more seniority than people with slips already in, then you trump them. I know because they tried to pull this on me a couple years ago. Holiday time off is by seniority per the contract.

Am I missing something? Didn't the city and fop agree to the pilot programs to see which one the rank and file liked the best and would work out better for the majority? Weren't we supposed to give input on which one we prefer? Would it be put to a vote with our unit reps asking our opinions? Was this a ploy by "management", just to get us to go along with what the little prick wants? Who started the blitz on this blog to get the 4-2? was it the city or some people with side jobs that fit with their schedules? What is wrong with the other work schedules? Did anyone discuss them?

I just spoke with Officer Pedro Medina. He is in good spirits, he is using a cane and wheel cahir. He is getting stronger day by day. He express his thanks for all the support and he hopes to be in Chicago in the spring 2010.

Get some time on the job and take a 13B or put in a P-Day a few months before Christmas. Otherwise, go to work like the rest of us have/had to do and hope you have decent bosses who allow you to get home to family before they're asleep. The shit part of this job is you miss holidays like Thanksgiving and Christmas. Then when you get enough time to get those days off the kids are grown. I feel your pain, but we've all had our turn in the barrel.

Let's travel back to yesteryear. The old-timers/retirees all know that our beloved Mike Lucas is a living legend.

When you worked that 3rd watch chasing felonious mutts through Cabrini-Green, the West and the South Sides, da job was a real pressure cooker. Come midnight or later, it was time to commiserate with your buddies over a few cold ones and maybe hook up with one (or two) of that bevy of beautiful groupies at the most legendary of all "cop bars": MIKE'S.

Thank God that the hallowed walls of that venerable saloon on Webster had neither eyes nor ears.

Our dear friend, Mike Lucas, will be released from the hospital later this week. I visited him today. He has been undergoing treatment for prostate cancer. Same old upbeat, lovable Mike minus a few pounds. We shared some memories and had a few great laughs. If everything goes as planned, come Thursday or Friday, you can drop Mike a get-well card at home c/o the bar:

Mike closed his tavern a while back. The neighborhood has since undergone dramatic gentrification.

If I ever wrote a book about da job (with names changed to protect the guilty), even several chapters could never capture the laughs, good times and fond memories of MIKE's.

Let's also pray for his full recovery. In the jargon of the CPD, Mike is THE Prince among princes--a first-class gentleman and a dear friend to so many of us.

It is at the discretion of the Watch Commander. There is nothing in writing to the contrary. If anyone thinks there is, then go and find it and post it. Seniority rules in use of P-Days but not on a holiday, you cannot take a P-Day on a holiday, it is DOH or nothing. At the discretion of the watch commander.

Matter of fact, negotiations are over, only the issues officially on the table at the time negotiation ceases are allowed to be ruled on by the arbiter... so once again, this ain't no contract issue. We won't get it because Daley is attempting to make it appear that it's a contract issue that we didn't agree to.

Here's a little something


Section 23.7 — Holiday Assignment.
When operational considerations require that some officers
of a unit work on a holiday, as defined in Section
11.1 of this Agreement, the most senior officers will be
given the option to work, provided that the holiday is not
an officer’s regular day off or a part of an officer’s approved
furlough extension and that the officer possesses
the necessary skill or special qualifications to perform
the duties required.

In summary: If the most senior officer is given the 1st opportunity to work, then they are also given the 1st opportunity to NOT work, ie DOH. Most W/C's will ask that anyone interested in taking DOH, that they get it in by a certain date so they can figure out the sheets and who's going to be granted DOH.

A lot of watch secretaries and watch commanders don't know this, but that don't make them right. A watch commander can say only a certain number of people can be off on a holiday because of manpower. However, it's still by seniority regarding that fixed number. Let's say a guy with four years puts in for Thanksgiving on Nov 1st. A guy with six years puts in for DOH two days before Thanksgiving. The guy with six years gets the day off before the guy with four years. When it comes to holidays it does not matter how many days before the holiday you requested the day off, it's by seniority! People saying it is not by seniority have probably been denied a holiday off in the past, and were incorrectly told they got their slips in to late. They got screwed by an incompetent watch secretary or W/C. Call the union if you don't believe me. I went through this a few years ago myself. I'm telling you it's by seniority.

year you need to put your PAR forms in now if you are under 60. Otherwise you will have to stay till 2011. Take 13th period furlough. (Sorry youngsters they old guys need to cover their bases here) Retire before 29 Nov 2010 and get your first C.O.L.A. 01 Dec 10 and another one on 01 Jan 11. Wait til Jan 20011 to retire and lose 3% for the rest of your life.

Not correct. If you retire 29 November 2010, you will get your first COLA increase on 30 December 2011, and the second on 30 January 2012. You must be retired 1 year to get the COLA increase, and pension checka are issued on the 30th of each month for that month (30 December is for December). Under your scenario you will get 2 in a row, but only after 1 year.

Read the letter from the Mayor in today's paper. He comes right out and states that they are looking at "pension reform" and the police and fire departments making sacrifices , " we will ask our police....to agree to steps that will reduce our personnel cousts". Now what do you suppose that means? If you have a two teir pension system, that is all new hires are not in the pension system, eventually the money in the fund will dry up and not be there for the last ones in the fund. Interesting times.

Please quote the chapter and verse that gives the right of DOH by seniority. You will not be able to do it because t isn't there. I mean really, quote the exact section or article in the contract that gives PO's that right. Not anonymous opinions on the blog, cite contract or order. Settle it then. And not "a guy talked to a guy who heard from some guy he knows at FOP." Cite the rule, article, order etc.

In summary: If the most senior officer is given the 1st opportunity to work, then they are also given the 1st opportunity to NOT work, ie DOH. Most W/C's will ask that anyone interested in taking DOH, that they get it in by a certain date so they can figure out the sheets and who's going to be granted DOH."

Note the word "some" officers work a holiday.

This deals with non-essential personnel only and units that do not have to be operational on a holiday, people who can be told they must take the day off.

If you are on a watch in a district and you are in a day off group and you are scheduled to work a holiday then you work it. Period. The above cited example is not for watch personnel, it is non-essential people only.

And, it does NOT state that DOH is by seniority, you cannot assume the opposite but unstated reverse is true unless it is spelled out in writing.

It is at the discretion of the Watch Commander. There is nothing in writing to the contrary. If anyone thinks there is, then go and find it and post it. Seniority rules in use of P-Days but not on a holiday, you cannot take a P-Day on a holiday, it is DOH or nothing. At the discretion of the watch commander.

Health care is not in the contract and never was. That is the huge blunder made with the very first contract. Not a word about health care is in the contract. That is why the City can do what they want, they don''t have to negotiate shit with regards to health care, it is not a contract issue.

All the stuff about Korshak decision etc. came out of a lawsuit. The city wanted and still wants to get out of the health care business entirely.

Why do you think you can't use a Personal Day or Comp Time on a holiday? Because it's by seniority. Seniority is the tie breaker. If it wasn't you would be allowed to use P Days or Comp Time.

Not correct. If you retire 29 November 2010, you will get your first COLA increase on 30 December 2011, and the second on 30 January 2012. You must be retired 1 year to get the COLA increase, and pension checka are issued on the 30th of each month for that month (30 December is for December). Under your scenario you will get 2 in a row, but only after 1 year.
