Someone Explain Please
This is ridiculous if true:
- great pinch by the 014 burglary team, who grab 2 subjects for breaking into a yuppie house in bucktown. offenders waited until the maale resident left the house, then put on rubber gloves and kick in the door, enter the house, only to find the wife and daughter watching tv. the terrified wife calls 911, and the offenders flee. the a/o's gave chase on the tracks on bloomingdale and catch the offenders.
here's the kicker- the 3rd watch lt refuses to approve the arrest reports because the charge was attempt burglary. she YELLED AND SCREAMED her head off like she always does, and said there's no way we're going to sandbag these 2 guys with attempt burglary charges because there's no act of furtherance on the part of the offenders. good victims, shithead offenders, and a terrible lt- the only thing to come out of it was criminal trespass. i guess putting on rubber gloves, kicking in a door, and actually entering the residence wasn't enough. it's no wonder why burglaries are thru the roof in that neighborhood.
to be fair, i shouldn't have made a big point of the fact that Lt. H yelled and screamed her head off and berated the a/o's and inv. dicks. that's her normal tone for regular conversation. i'd hate to see her pissed. people skills and ability to lead are definitely not her strong suit.

That would work if no one were home and it wasn't a residence but when you have 2 people in the house and the offenders have gloves on and such I think the "intent" to commit a theft or other felony is met. But I only make D2A pay. Put it on the ASA and see what they approve.
These cases are always funny. You could shoot and kill the shitheads coming through the door no questions asked, you were in fear of your life. But can't even get a felony charge approved if you don't kill them!? What a system.
you have to know how to deal with her. yes she is crazy, has her own opinions, doesnt know the law but that is a quarter of the Lt. and above on this job. i dont know the incident in question but maybe the paper writing is to blame? it is 014 remind you.

I don't believe this. No lt could be that dumb. You don't need an act of futherance. All you need to have upon entry is the intent to commit a felony or theft. Its not an Attempt Burglary. Its straight up a Res Burglary given the facts. Intent should have been easy enough to show. Rubber gloves and there was probably more given the prescence of witnesses. I dont know this lt but there must be more to the story. Seriously.
Let's hope the same occurs at her home. Wanna bet they get charged properly ??

I was there. Read the reports. The door was unlocked and they fled immediately after opening it. Nothing was kicked in and nobody was wearing gloves. Also, the offenders were 13 with no record.
Burglary is entering into a building with the intent to commit therein a theft or felony. Did the two shitheads confess they were going in to steal something or commit some other felony? Before encountering the residents, did they stuff something in their pockets? I think your Lt. understands the law, and while it may seem preposterous, she made the right call.

i don't know much about the incident, but i know they were juvies (closer to 16 i think) and they did have on latex gloves.
the Lt is absolutely out her mind. she has serious control issues (among a bunch of other issues). i've heard her screaming at officers on several occasions. it's completely unprofessional. i avoid making arrests on nights she's working for the simple fact that i am not walking into her office for anything.

But as far as I understand, the only people allowed off that day are the ones on furlo or RDO. And as far as the furlo reason is given, it can't be an extension.....it must be within the furlo segment.

Lets see... you catch these guys and are going to charge them with Attempt Burglary(probably Home Invasion?). Anyway, you call Dicks and they are on board. They do investigation and contact States Attorney. ASA reviews case and approves charges? If so, NOW you bring your arrest report to the Watch Commander for final approval. This is the order in which it should happen. Did these officers ask her first if they could pursue the Att. Burg.? If so shame on them. Now, if she refused to approve the arrest after an ASA approved charges that would be a story worth telling!

Actually, the Lt. may be right. It sounds more like a "home invasion" to me. If they didn't steal anything, how do you know that their intent was to commit a burglary or theft therein. The offenders apparently didn't damage any property or sexually assault anyone so you don't have a sex crime. . . what they do you have? And doesn't home invasion required an intent to commit a theft or felony therein? All this being the case, you can't prove what the intent was upon entering the premises - you can only assume that it was to commit a theft. Assumed intent will not be sufficient for a conviction without the act in furtherance. OTOH, as a Lt/WC, I would probably have approved the charges and left the question of conviction to the SAO and let these morons sit in jail for awhile. Maybe that's the part the your Lt. doesn't understand but then she's a lawyer isn't she?

I have been waiting for this headline for about 10 months. We did a search warrant, and had a female, LT. H. was all stressed out about her going to 011 not 25 cause the warrant took place in area 4. Good ole LT. mother*uck me up and down, and said "get the *uck, out of my office". at that time the capt. on 3rd watch rolled her eyes 4 days later after she apologized. Thanks to "clout" she is where she is at. Lt. H. has been dupmed out of every district she has work.

Ummmm, I think that is the province of the Watch Commander, not the Dicks.
Did she refuse to approve the charges or perhaps did she just reject the report for revisions because it was badly written and failed to contain the elements of the crime? Her problem is she treats people so badly that by the time you are done with a conversation ( that is if she will shut up long enough for you to speak)all you want to do is walk away and never return.
Seen her act for many years from P.O. in 023 up and through Lt. Loves to berate people and stir up a shitstorm and she is vindictive as hell and proud of it.

the order for which you described the process of arrest, detectives investigation ad so on is wrong...you obviously don't make felony arrests outside of PCS.
its home invasion plain and simple.
She sounds a lot like a F/4 Lt in 010 on 2nd Watch.
This is what is flawed in our promotion testing process....I'm sure she scored real high on the LT test, and probably the SGT test too. Unfortunately, the three components to a good supervisor that they don't test for are decision making skills, leadership and interpersonal (people) skills. You could be the smartest person on the job, pass all the tests and still not be a good Sgt LT Etc because you don't possess those three skills/traits. They are critical to the morale and direction of this department. And until they start recognizing those skill sets as critical components to effective supervision, then there will continue to be nothing but problems.
If the offenders were charged with attempt, then the charges must have been approved by an ASA. If the W/C refused to sign the arrest slip then a release form should have been prepared and given to her. If she signed it let the offenders go, fuck it. Just make sure you keep copies.
As for the person who chided the detectives for not requesting an override, how can an override be requested when charges have already been approved.?
And if charges had been denied then it is the W/C's responsibility to request the override. Sound like a Catch 22.
For you guys wondering how some people got off the 14th. In our district we were allowed to use the provision of switching days off with another P.O. About five people got the day off that way.

You're certainly being diplomatic. Sounds like a flat-out mental. Nobody sane yells and screams constantly in the course of the normal daily performance of their duties. AMEN! this is my point exactly. Stop trying to dump your arrest off on other people and this wont happen. Do an investigation and call the dics/ASA. Have the victims/witnesses all in one place so the detective doesnt have to track them all down. get it felony approved and tell the WC, "hey, guess what? I have this sweet burglary arrest thats been approved and is awaiting your review."
Actually they should've been charged with home invasion not attempt burglary.

Need more for Home Invasion. It has to be more than just the residence being occupied. An act of force or violence is required I believe. Without the 720 in froont of me the exact wording eludes.

Actually, offenders would have to remain once they discovered people were home for Home Invasion.

Your RDO was cancelled??? Why is my RDO not cancelled any anybody else in my district? Maybe some of us would like the extra cash!!!!

Also, no mention of an ET being ordered so I'd say the door wasn't kicked it. Also, nothing about the offenders wearing gloves. What gives?
that Lt H is a lunatic....she called me from check off in 012 while I was at the hospital with a victim taking a report and screamed at me. I hung up, and she called me back to scream at me more...then I refused to put her on the report as being on scene, and she yelled at me more. Psycho!!!!!!
I commented previously on this thread because like many others I think this Lt. is a raving lunatic. However after thinking about it she really doesn't deserve a whole thread dedicated to badmouthing her. There are many other bosses male and female who are just as goofy in their own way, and there are always three sides to every story. Yours, theirs and the truth.
She borrowed $5 dollars from me while we were in the academy and didn't pay me back!!!
