What's Missing Here?
A Rogers Park man whose wife was hit and killed by a driver fleeing police in December filed a wrongful death lawsuit today against the driver and owner of the vehicle.
[...] Eubanks, who was driving away from police at 70 to 80 mph at the time, did not stop or slow down, leaving the mother and 6-year-old child lying in the road, according to Cook County prosecutors.
[...] According to the lawsuit filed Monday in Cook County Circuit Court, Eubanks "carelessly and negligently" operated the 1998 Gran Prix and failed to yield the right-of-way to the pedestrians who were crossing the street at the time.
The suit also names the car's owner, Dennis Jeter, as a defendant, stating that he gave "explicit permission" to Eubanks to use his car.
That might not seem like a big deal, but it is. Hopefully, it keeps on being true.

I am so happy that someone actually gets it and blames the responsible party. No further comment is necessary.
I'm sure they will change their minds and go after the police.
Big big deal. Too soon to say one tide may be turning. Would need to see more of the same.
Plaintiff must have found out that the defendant owner has pretty good insurance and he doesn't have to sue deep pockets of the city.
While I applaud pursuing those directly responsible for this tragedy, the plaintiff's attorney will surely modify and re-file this suit after Mr. Eubanks and Mr. Jeter are ordered to declare their collective assets.
I'd surmise that a combined net worth of somewhere in the $10,000.00 range is a GENEROUS estimate. I can see an itemized list of assets now:
- Liquid cash available: $317.81
- Three (3) flat screen HD televisions of various size
- Two (2) X-Box gaming systems
- Eighty-Nine (89) X-Box games
- One (1) set of 20-inch Vogue tires mounted on
"Assassin" chrome rims
- Various gold and precious stone jewelry items,
(subject to appraisal by certified gemologist)
- One (1) 1998 Pontiac Grand Prix vehicle (totaled),
KBB value: $473.25
- Nine (9) Pitbull canines of varying ages and sexes
There will be no settlement from some AAA-rated insurer, as Mr. Jeter didn't deem Personal Injury coverage as feasible or necessary. There will be no freezing of equity in either defendant's residence, as both are Section 8 recipients. There will be no wage garnishment of defendants, as neither ever worked a day in their lives.
And as soon as Mr. Plaintiff's attorney puts all these puzzle pieces together, it'll be the City of Chicago, the CPD, individual officers and their supervisors, the call-takers, dispatchers...maybe even Streets and Sanitation (they didn't salt the street where the victims were crushed, after all)...et al, being named as defendants on the amended filing.
The road to Hell is paved with good intentions...
Good intentions, however, don't pay the bills.
It happens once in a blue moon that someone cares more about the right thing than they care about money. They're out there.

Wait until the defendant adds the city and the police to this suit for their "contributory negligence."
The law is a funny thing. The truth is that the truth has nothing to do with the law.
THE CITY WILL BE ADDED LATER TO THIS SUITE, BUT IF A JUDGEMENT IS ENTERED AGAINST THE OWNER AND DRIVER. THEY CAN NEVER CLAIM THEIR GHETTO LOTTERY WITHOUT THIS GUY BEING PAID FIRST.
Looks like he and his lawyer were smart enough to know that the city is broke and he was more likely to actually collect from an insurance company. Hey, it's still a win...

Power is Joseph Power and Smith is Todd Smith, formerly of Corboy & Demetrio. They don't take cases to go after deadbeat shitheads with no insurance.
There has to be a very good chance of recovery for these guys to take a case on spec. They are among the very highest of high powered personal injury law firms.
If I had to go after someone, I mean really go after them, for severe personal injury or wrongful death, this is the law firm I would pick. These are not the shiny pants cigar chomping ambulance chasing type of lawyers.
They are plane crash chasing lawyers.
Todd Smith worked for a long time on the American Airlines Flight 191 case and used to have a model of an American Airlines DC-10 in his office.
They know something and have more cards in their hand than what they are showing in the initial filing, that is for certain.
Mr, Worthton (husband and father of the victims) has excellent representation.
Good Luck on getting anything from the person is question Dennis Jeter, this is an un-educated male who who really has no purpose in life, he has several children that he does absolutely nothing for. He lives with his baby mama who holds a section 8 voucher and has defrauded the HUD system out of over $50,000, this person has no regards for life both living and dead, why would you think he would care about giving his keys to a convicted felon high on marijuana and ectasy. I wish this never happened may she rest in peace. May Justice Be Served For All.
