Pension Bill Highlights (UPDATED)

From a Mike Shields e-mail:
  • Here is a well written e-mail by one of the lobbyists explaining the bill.

    The benefit changes will only impact police & fire employees that are newly hired into positions covered by the pension code on or after January 1, 2011. Current employee’s benefits will not be affected by this legislation.

    The highlights of the bill include the following elements which are standardized retirement benefits for all new public safety employees who enter the Articles 3 (downstate police), 4 (downstate fire), 5 (Chicago police), 6 (Chicago fire), and/or 7 (IMRF-SLEP) on or after 1/1/2011.

    1. No change in employee contributions.

    2. Maximum benefit will be 75% of final average salary* at 30 years of service and 55 years of age.

    3. Final average salary* is defined as “the average monthly salary obtained by dividing the total salary of the police officer during the 96consecutive months of service within the last 120 months of service in which the total salary was the highest by the number of months of service in that period.” (ie - best 8 of last 10 years)

    4. Maximum salary for pension purposes is capped at $106,800 for 2011. The cap will be increased each year thereafter by 3% or ½ of CPI-U whichever is less.

    5. Survivors annuity benefits will be 66 2/3 of the deceased employee’s salary at time of death.

    6. COLAs – Both retirees and survivors will receive COLAs equal to 3% or ½ of CPI-U the year after their 60th birthday.

    The bill contains authorization for future pension fund studies.

    It also includes some very important and momentous funding compliance language that is designed to insure that our funds remain stable and solvent for all current and future public safety retirees and employees.

    While the coalition was opposed to some of the benefit reductions for new employees we were successful in maintaining current employees’ benefits, all contribution levels, minimizing benefit reductions for new employees, and much to the disappointment of municipal employers - securing meaningful funding compliance language for all of the funds. We will continue to work with the Senate leadership to minimize any additional adverse impact for new employees.

    The legislation is now in the Senate for concurrence. We anticipate that the Senate will act on this bill in the next 24 to 48 hours.

The rest of us should contact our elected representatives and voice our disapproval of this bullshit. If you don't call, you deserve what they do to you!

This last election should have shown them that the people will hold them accountable. They better reduce THEIR pension benefits before they touch OURS!

Do we need any more proof that the city is going to let the fund collapse? Mathematically, the fund MUST have the proper contributions in order to generate enough interest $$ to pay out to retirees in the future. As the time period without contributions increases the future income stream source dries up faster and faster, toward the end, depleting exponentially. It will be a mathematical impossibility to fix this if we don’t act now. We had better start making some noise. The city is relying on our usual complacency. Fuck the math. Let’s have fun while my kid is still asleep. A satirical analogy:
A ship, the S.S. PENSION FUND, (not a temporary lifeboat but one your children must live on also) has a leak. You begin bailing it out and no one is all that worried. This goes on a long time and projections by the damage control team are that the ship will be watertight long enough for those over the age of about 50 to die of old age above water. “What about the rest of us and our children,” wonder the soot covered crew in engineering?

A few whiners onboard keep saying we should fix the leak instead of just barely keeping up with the flooding. Most think, “why bother when everything is fine, as long as you keep bailing out water? “ Fred O. Plenary, the ship’s Bursar/Entertainment Director says, through a mouthful of steak, that he agrees something should be done but it is not a contract issue. Also not a contract issue was the recent proposal to rename the ship the “S.S. Fuck this Crew,“ but F.O. Plenary fought against that so why can‘t he fight for something much more important? The crew suspects this is bullshit and that the real reason is that he has been sleeping with the Captain in exchange for special duty assignments and extra rations while they survive on a meager diet of hardtack and jerky. The source of the leak widens and it takes more effort to control but the crew can barely bail because they are sick or dying. Captain Flowerpot, who has always hated his crew and barely makes a secret of it, chooses that time to make the already ailing Ship’s Surgeon walk the plank where he is, of course, eaten by the Aldercreatures of the deep, a species that swims in “councils“ and exists in secrecy at 20,000 fathoms. The crew knew this was coming but hoped F.O. Plenary would protect the Surgeon and thus their medical needs AT THE LAST FUCKING MINUTE. Captain Flowerpot knows there is enough room in the lifeboat for him and his handpicked few, so fuck the crew. The crew has always wondered why they are the only ship in the sea who has a lifeboat for the Captain and Officers that is actually LARGER and more SEAWORTHY than the ship itself and why they are constantly ordered to move food and medical supplies to it in the dark of night. I love how the FOP guys claim that Shields has rants on his facebook about the benefits for officers being too extreme. Try another strategy guys. Probably the same guy that said Shields is the nephew of the mayor or nephew of an indicted judge. FOP feels threatened by somebody that actually does his job.

It's nice to see that at least one of our elected trustees is disseminating pertinent information regarding this most pressing matter.

Where are our other elected memebers that sit on the board??? (crickets chirping)...And I won't even get started on the BOUGHT AND PAID FOR, SOLD-THEIR-SOULS TO THE DEVIL DALEY-APPOINTED PENSION BOARD MEMBERS...THEY SHOULD BE TARRED AND FEATHERED ALONGSIDE DALEY AND THE 50 ALDERCREATURES.

Mike truly has our best interests in mind, and it's obvious he has the tenacity and gumption to make waves and get the job done, even though it may appear to be slow-going at this juncture. We know these things don't happen overnight, Mike, but allow me to thank you for a job well done so far. Keep up the good work...we need you to make a run for FOP President now. And if that is your intention, please do a total house cleaning on your ballot...we need fresh blood and fresh ideas to bring this organization out of the rut that we currently occupy, and the stagnation in the current FLOP just won't cut it.

What coalition is Shields talking about? As a pension trustee I don't think he belongs to any coalition pushing pension legislation in Springfield. Prolly b/c the letter you are attributing to him isn't his. It's just 1. copy 2. paste 3. take credit - for our man Mike Shields.

Isn't #5 written incorrectly?

Unless something has changed, the survivor(s) of a non-retired, active-service employee that dies under other than line of duty or performance of duty circumstances, would receive a refund of the deceased employee's contributions. The survivor(s) would not receive an annuity, as the employee was not retired at the time of death nor killed in the line of duty nor died while in the performance of duty.

However, the survivor(s) of a deceased retiree would receive a survivor's annuity.

#5 should be written:

5. The survivor's annuity benefit will be calculated at 66 2/3 % of the deceased RETIREE'S monthly annuity in effect at the time of the retiree's death.

No?

Unrelated, but while sitting in branch 43-2 this morning I was able to observe exactly what is wrong with our legal system. Officers were sitting in court by 8:45AM...the arrogant Judge David A Skryd would arrive in court 45 min later. No apology given, not an acknowledgment of any kind to excuse his inconsideration of the ASA's or Police Officers. Funny enough that the 3rd case that was called, the ASA read from a note that was given to him by the court Sgt..."The Ofc is running late your honor... (judge) WHAT? (asa) The officer is running late Judge, I was handed a note from the court Sgt stating that the officer is OTW. (judge) YOU WANT ME TO WAIT FOR OFC ------?!?!? YOU WANT ME TO WAIT FOR AN OFC???? The way that Judge David A Skryd said it made my stomach turn! Yes you pompous FUCK!!! Yes, we waited why cant you?!?! THIS COCK SUCKING ARROGANT PRICK SHOWS UP 30 MIN LATE TO HIS 3 HOUR A DAY JOB AND WANTS TO TALK SHIT??? Best part about the whole thing is 15 min later court was in recess! I've had Judge David A Skryd in branch 44 also, and he was a prick there too. Sorry, had to share my morning with you guys.

Finally, someone addresses those money thieves called " investment advisors". I do not know who initiated the move but it is a very good start. The next step would be to get the " trustees" on board. I know when Mike ran for the pension board he seemed like he would be a breath of fresh air. He promised to increase the funding. It was on his campaign material. The funding has gone down in his two year term. He has not accomplished anything at the board.

This bill seems like a big mistake. Although the money is now "guaranteed", what is to say that a future administration won't strike the guarantees? Who will fight for us? The next generation of our brothers in blue that we sold out on a two tier system? Fat chance on that. These negotiations should take place at contract negotiations. But we have an FOP that settles for less money than was origionally offered at contract time.

The city is strongly objecting to this stating that it would unfairly burden the taxpayers. To that I say STFU! The city is who has underfunded our pension and aided and abetted as our pension fund began its decade long decline. They caused these problems and now don't like the fact that the legislature wants them to pony up and play fair. All of these rotten politicians ought to be ashamed of themselves.

That fucking jag off is always late! I thght it was a one time deal but i have heard from several officers that he has come as late as 10:00. Yet if a PO are late u get a spar. Us against them. This whole county is a fucking sham.

If you were born before 1955 yes you have the COLA and if you were born after 1955 if should be taken care of the Jan. session.

Too bad Mike is reporting this. WE needed HIM down there last month when this bill was being written not being a reporter. But Mike Madigan just ignores him. I am a 40 year friend of McCarthy of Orland. His father was CPD and his older brother is a retired suburban copper.

Daley is going nuts because they will be forced to fund at 100% level by 2015 if not the state controller will with hold the tax money from the city and send it the pension board. Why is Daley going nuts? He will not be the mayor? He must still have plans to have his greasy fingers in our pockets somehow!

Not in Illinois. Less than a dozen State Rep and Sentate seats changed hands. NOTHING CHANGED. City Worker heavy wards all voted overwhelmingly for more of the same.

This bill seems like a big mistake. Although the money is now "guaranteed", what is to say that a future administration won't strike the guarantees? Who will fight for us? Everyone except the current police officers and firefighters realize and acknowledge that in order to save the pension funds the benefits of current employees will have to be reduced. They are openly talking about it and I believe it is coming next year or the year after. The accountants do not believe the funds can survive unless this happens. It is not possible to raise enough tax money to save the funds . So, just keep fooling yourselves into believing that this current bill which is on Quinn's desk for signature is the final word. And, if the alderman, legislators and judges do not take the same hit, what are you really going to do about it? In reality, nothing. It is a very bad scene coming straight at us.

Well Mike Shields I may not vote for you but at minimum thanks for shaking up the apple cart at the stale FOP. It is obvious they are running scared. In my humble opinion Shields has done a great job at the pension board. However, that does not translate into the makings of an effective FOP President. Plenty of smarts and balls. The negative issues for Shields are: he is too young, unproven and lacks experience. The current FOP made a critical mistake when they chose Bella over Dougherty for President. Dougherty is a bright guy and a hard worker. By all accounts very knowledgeable about Union issues. I think he would have made a good President. Conversely, I and almost everybody I talk to have little to no faith in Mr. Bella. It's an important election and hope to hear from other candidates as well. I hope other officers will keep an open mind to the ideas of the candidates as opposed to 8th grade girl sniping.

Two tier is for new hires, NEW HIRES, I knew this was happening, anyone who has gone to FOP meetings over the past year or read the FOP newsletter regularly knew this.

The only question was how would it affect current employees.

We got the answer: No affect for current employees and a mandated funding mechanism.

Good for us. Under the circumstances the best we could have hoped for.

Think about this, currently we get 75% after 29 and a day, that's 30 pension years.

New hires get 75% after 30 years, 29 and a day. We thought it would go down to 72%, it didn't.

Instead of highest 4 out of 10 they get highest 8 out of 10.

Instead of getting out at 50 it is now 55. It was like that during the career of many current old timers.

In a difficult time we did OK.

I have just finished reading all of the comments on this "Pension Bill Highlights (UPDATED)" post. I know. I DO have a lot of time on my hands, but that's the beauty of being a retiree.

It's amazing how every time Mike Shields name gets mentioned on SCC, how much anger and vitriol gets spewed on here right afterwards. And it's not like we can't figure it out. We're coppers, guys! We can follow how these comments are posted one after another. They are timestamped and say the same thing with slight changes in the wording! You FOP guys must just sit at your laptops trying to assassinate Mike and share your comments with each other so it looks like we all dislike him. Why? Because he's not part of your ole boy network.

You must think we're all stupid if you think we don't see right through this bullshit! In all the years that I was on the job and during the several years that I've been retired, I can honestly say that NO ONE, including FOP, has represented our interests in our pension fund more vocally than Mike Shields has. I don't know him nor have I ever met him, but I'm comfortable with the fact that he's got my back regarding my pension.

My concern is who will be watching the pension after he leaves there to become FOP president. I know that the chain of past FOP "leaders", from Dineen, to Nolan and through Donahue have a been way too cozy with the Daley Crime Family and Daley has benefited from those warm relationships. It is DAMN time for a change over there!

I received Mike's email and he cites the well written summary of the bill by a lobbyist. This is not the time for political infighting. Instead we should band together and make sure Governor Quinn doesn't veto this bill. I believe Quinn will veto this bill on orders from Daley and all those damn aldermen who held their press conference condeming this legislation. Aldermen are vested after 10yrs with 80%. A few weeks ago FOP reps came to our roll call and flaunted that they will shoot down the two tier system and said that the last thing they want us to worry about is the pension as we hit the streets.

Really? That's funny but when they came out to 024 about 1 month ago they told us just the exact opposite. They told us that the 2 tier pension was coming but shot down the rumor that the new hires would have a 401 instead of a reduced pension package.

Simply put:

This Pension Bill = increase in property taxes (Yes, there is a pension, but at what cost?).

Northerly Island renovation = less police, fire, and essential city services & increase in property taxes (No doubt).

Less police = more officer's killed in the line of duty (Keep the honor guard at the ready).

More smoke & mirrors = crime continues to go down, folks (I don't feel too safe. How about you?).

Separate is not equal = take police from slow districts and put them in fast districts where nobody pays property taxes (Hmmm, sounds like reallocation to me?).

WAKE UP PEOPLE!!!!!!!!

The Kicker (This one hurts bad):

6 officers killed so far this year = let's raise property taxes and beautify a park (Hire more police? What? Huh? Crime is down. The Mayor and Supt. said so. There having a test anyway. 200 more police are on the way, but more importantly, look at this pretty park we have! Isn't the Mayor just grand!?!).

If the department hired the number of officers that are currently needed - with all them making contributions to the pension fund it certainly would be in less dire shape right?

Instead the tax revenue has been spent on no-bid contracts to politically connected friends.

You're not going to get any pension funding out of the money spent over at United Road Towing or the new company that took over the parking meter's or any other company that has been privatized right?

This privatization under the guise of saving taxpayer money is costing us our pensions like the off-shoring of jobs by corporations is costing the shortfall in social security funding and the shortfall in tax revenue to pay for those new officers.

Yeah, it's the trickle down economy at work.

Stop the corporate off-shoring and more tax revenue comes in to enable the hiring of more officers. Hiring more officers means more people throwing dollars into the pension pool pot...etc.

I'll tell you what's most likely going to happen. They will eliminate the pensions entirely and offer you a 401K plan telling you how it gives you more control over your money to invest in the stock market and people will cheer. Who would refuse more control over their money right?

Then when the market doesn't perform and people end up in poverty in their retirement, the city can place the blame on you for not making the right choices in their investments.

The system is broken. The city that works sure ain't working for many of us I can tell you that much. We need to get these career politicians out!

It was obvious to anyone with a pulse who kept up on this that there was going to be a two tiered pension plan in Illinois. The exact shape was to be determined.

All in all, we came out of it very well.

Hear this and read carefully:

OUR ("our" means current sworn employees) will NOT have any of our benefits promised to us reduced in any way.

Got that? Read again if confused.

And the future funding will be guaranteed. The City of Chicago has until 2015 to come up with adequate ways of funding their contractual promises to us.

The City must fund up to what the actuarials say is needed, like they should have been doing for many years. If they had, it wouldn't be so painful now.

By 2015 the City must bargain for increases in our contribution or get a casino going or tap some other sources of revenue but they must properly fund the pension.

The "two tiered" part is for employees hired after Jan 1, 2011.

Even that is not as bad as feared. The minimum age was raised to 55. it was 55 in 1968 and crept down to 50 over the years. Now it is back up there. That's life.

The max is still 75% only it is based on the highest 8 years instead of the highest 4 years.

We did better than expected under the circumstances and we won't have to deal with daley any more about this.

A new administration will have to find new funding sources.

It worked out much better than I expected.

As I read it, our benefits do not change one bit. Only new hires after Jan 1, 2011 go into the second tier pension plan. Not current sworn. Still, that is not as bad as it could have been, still much better than private industry.

Been retired for a little over two years because I couldn't put up with the BS anymore. Went out at age 53 with 26 years. Don't get my insurance paid and because I was born after Jan 1, 1955 now I don't get a cost of living adjustment either. Sounds like this is affecting current members and not just new hires. I'll be retired 7 years before I see a cost of living raise at age 60. How is that fair?

As an officer and a taxpayer I really am not looking forward to higher property taxes. I am, however, looking forward to having a solvent pension fund in a few years when I pull the plug. If higher property taxes are what it takes then so be it.
The majority of the public will be pissed at cops and firemen but that is misplaced anger. Their anger should be directed at Shortshanks and his alderthieves. It's their political malfeasance that caused our pension fund to deteriorate into the piss poor state that it's currently in.
So when Shanks is ranting and raving about this legislation perhaps he should look in the mirror. There he'd see the true cause of this mess.

That would make Mike Shields about equal to the happy smiling lunk Ken Hauser, who has been warming a seat there and little else since 1993.

Ask Hauser about China. I hear he's an expert. Ken Hauser also voted for giving millions $$ of pension funds to Vanecko and Davis and still claims he didn't know that Vanecko was related to the Mayor.

In my humble opinion Shields has done a great job at the pension board. However, that does not translate into the makings of an effective FOP President.

The first part is horseshit. what exactly has shields done? He promised to secure better funding. He's done N-O-T-H-I-N-G on that front. Not even tried anything! However, I do agree with the second part.

First off if you are going to use my excellent prose, please use all of it. What has Mike Shields done?

1. When Ron Huberman went to increase his pension contribution based on his CTA salary it was Mike Shields who showed up with a video camera to film the proceeding. Hubermans demand would have allowed him to collect a huge pension.

2. It was Mike Shields who exposed the significant amount of money used to pay the law school tuition for the President's of the funds secretary.

3. It was Mike Shields who went to town against Mayor Daley's nephew getting approval to invest our pension funds. Not a public word came from any other member probably because many of them voted for it. By the way never a word from FOP either.

4. It was Mike Shields who asked that Jody, Brust and Masters be removed from our pension fund. They were subsequently removed because none of them were hired as patrolmen as required by pension by-laws. If Masters sticks around 10-years he can draw a nice chunk of change or if they can manage law enforcement time elsewhere they can potentially buy back years in the CPD pension.

5. It was Mike Shields that really made people aware of the huge underfunding of the pension fund, not FOP. In fact FOP forgave the city for 20 million in contributions.

6. Lastly ask anyone Patrolman that had a true injury and sought disability, Mike has been fantanstic in getting benefits approved. In all fairness to the FOP Dougherty has been terrific also.

My advice to current regime is to sound off your accomplishments like the heart bill, 4-day work week, etc. At roll call tell me what you have done for our union not your petty worries about some 30 something year old kid. You have some great accomplishments to run on. Conversely you sound very worried about Shields. As I said don't know who I am voting for but you guys sound petrified of him. If he has done nothing on the Board why do you hit the blog and trash the crap out of him? One last thing please tell be the read head is heading the ticket and not Bella.

If it wasn't for the disability commitee, there would not be 75% for the total & permanently disabled, disabled officers would still have to live in the city until they retire, there would not be stars and ID cards for the disabled. The warrant card would still have to be signed monthly for duty disabled officers. A duty disabled officer can work and make as much money as he/she wants because of the disability committee.

The committe has helped many disabled officers, they just don't go running around bragging about it.

Just for the record who do YOU actaully think got the 75% for the total & permanently disabled officers, because if any one is telling you the FOP & disability committee did not get this or any of the above listed benefits for the disabled officers, that officer is a LIE, and you are drinking too much KOOL-AID.

If it wasn't for the disability commitee, there would not be 75% for the total & permanently disabled, disabled officers would still have to live in the city until they retire, there would not be stars and ID cards for the disabled. The warrant card would still have to be signed monthly for duty disabled officers. A duty disabled officer can work and make as much money as he/she wants because of the disability committee.

The committe has helped many disabled officers, they just don't go running around bragging about it.

Since I am long retired, let me stick my two cents in. THERE WAS NO DISABILITY COMMITTEE AT THE TIME 75% DUTY DISABILITY, CHILD ANNUNITY, NO MORE WARRENT CARDS OR CAN WORK ANOTHER JOB. That useless committe is just postering and grandstanding for Donahue to make it appear FOP is doing something for their injured officers. If you youngsdters out there believe all this, then you are naive!

You are wrong, and it's obvious you don't understand the difference between total and permenent disability and duty disability.

Oh and by the way, the disability committee was originally formed when Nolan was in office.

Its pathetic that some of the members blogging here chose to try to disparage Mike for trying to inform us on the state of our pension while completely ignoring the fact that our union thus far has completely failed to inform its members of those who stands with us and those who stand against us, the aldermens, state rep, state senators & etc.

They seem more concern about protecting their current job then doing the job they were elected to do. THE BASIC FUNCTION OF ANY UNION IS TO EMPOWER ITS MEMBERS BY (1) INFORMING THEM OF THE ISSUES (RING THE ALARM) AND (2) ADVANCING POLITICAL STRATEGIES TO INFLUENCE LEGISLATION IN OUR FAVOR (NOT JUST HANDLE CONTRACTUAL BEEFS WITH THE BRASS)

Thanks Mike for at least attempting to ring the alarm while they were asleep at the wheel.
