City Pushing Too Hard?
Christopher Ries thought he’d finally won.
A jury awarded him $4 million for neck and back injuries he suffered after he was hit by a stolen Chicago Police squad car in 2002. Jurors faulted the police for leaving the suspect alone in the back of the squad with the keys in the ignition — and for then chasing the suspect.
But the city appealed, claiming the officers should receive immunity. And last month, the city won in the Illinois Supreme Court, canceling out Ries’ award.
Chicago is getting more aggressive in fighting lawsuits against police officers — a strategy that’s winning approval from the rank-and-file who believe the city settled too easily in the past.
But some plaintiffs and their attorneys complain the city is going too far.

There is no such thing as "going to far" in the law. If an attorney aggressively defends his client at trial or through appeal he is doing exactly what he is supposed to do. Bravo
The city isn't going far enough, they should represent the rank and file in counter suits against the frivolous plaintiffs for the distress and slander.
Does anybody know if the city is getting legal fees from the losers
Lawyers, the Lampreys of Society. The produce nothing and they suck.
You gotta love it!!!!
Like you said, now they have to work for their money, which in turn means they wont jump to take ol boys BS, frivilous lawsuit, sight unseen.
Are these F'n lawyers serious?! The city is going too far in fighting their frivolous lawsuits?! These lawyers are no better then the mutts they are representing. They are just pissed because their own entitlement program (free money from the city because they went to law school) is slowly coming to an end. I hope the free be dries up entirely and these mutts go bankrupt. Ha...ha!!!
SCC: NEW TOPIC
Last night on the 3rd Watch,
two individuals came in from IAD and stripped 2 officers of their police powers.
As it turns out it is over this incident:

"But some plaintiffs and their attorneys complain the city is going too far."
Defending yourself to the best of your ability in a court of law against false or exaggerated claims of wrongdoing is "going too far"?
Half of these complaints against the police and their actions are phony anyway, predicated on the lawyerly belief that if the bad guys beef on the police that THEY are somehow LESS guilty!
Good riddance to bad lawyers!
I wish for nothing more than the bottom feeding parasites like Loevey and Loevey to suffer, but the fact is that many of these pieces of shit have already made millions from the city filing bullshit lawsuits that the city just simply broke out the checkbook for.
The class of people filing these suits are often garbage felons looking to hit the "ghetto lottery" because they are being advised by assholes like Loevey to sue for anything!
I realize the public wants to pretend that these suits don't affect policework and the class of polieman being put out there to protect them, but the fact is many coppers with enough time on the job are smart enough to fear the almighty lawsuit.
Of course all the liberal fucks and media type will reply--"If you do your job the right way , you won't be sued" Unfortunately that is absolutely not true. Most aggressive coppers will eventually be sued for some bullshit by some jagoff offender that "beat" his case at 26th st. The simple reason is that if these jagoffs are found not guilty they will sue for no other reason than that.
I am extremely happy to see a bit of resistance from the city in regards to these suits, but why not take it a step further and prosecute or at least punish some of these offenders and piece of shit lawyers who bring on the frivolous suits or won't sign the affadavits and are found to be lying. None of these lawyers are even able to be found accountable for their actions or that of their felon clients.
The City has a responsibility, not ONLY to it's citizens to run the city in a fiscally sensible manner (aka stop settling merit-less, frivolous lawsuits), but also to its police officers to uphold the reality of their quest to uphold the law and pursue truth, justice and the American way...!
Too dramatic? ... Sorry I got carried away, but point being that its a lot harder to do our job when the public perception is that we are a bunch of Neanderthal knuckle draggers looking for the next innocent victim to pound the shit out of because thats what we take pleasure in and thats the only way we know how to get a conviction, by beating people into confessing or using some kind of secret 'black box'!
I have a lawsuit that is currently going as we speak. It was first alleged that we planted a gun on a fatal police shooting. But after the plaintiff sent the gun for DNA testing in Texas and the dead guys DNA was found on the magazine and bullets the charges were changed to excessive force. 5 years ago the city would have paid out. Today this case goes to trial and we win.
It will appear that the city will protect us now, even though it really means that its a win situation financially for them. Be pro-active. Our ultimate safety is at stake.
Check out Jack Higgins cartoons for the 17 and 23 March
The best part is the lawyer for Reid states "police should of terminated the chase, where (offender) going to go with a stolen police car" answer pull someone over, kill someone, rape some women. Go sue the offender who stole the police car, and tell chris Reid to pull to the right when you hear sirens.
The problem with this accident is fleet, not CPD. Theye were offered a device that is used by most suburbs. The car keeps running, but when the officer steps out with the key, the car will not go into gear.
Fleet saved a few bucks and things went downhill from there.
I wondered after considering how the feds investigated the Cook County Court system for Operation Greylord how they felt about leaving the rotten apples they didn't arrest in play.
The only reason more arrests weren't made is that it would have completely shut down the court system here.
When we complain about the lack of justice that comes out of the ASA's office, how much corruption is there to be found there reminiscent of the old days and ways of doing things.
How is it, exactly, that so many repeat offenders get let out with just a slap on the wrist? Are bribes and favors being passed again? One would be a fool to think otherwise.
All of the corrupt politicians who made the assignments to courts in order to protect themselves bears looking into. Why not focus on that instead of Cozzi?
Any chance that the courts will begin sanctioning attorneys who file these meritless suits?
How is it that the city is "going too far" when it wins? It would be one thing if they city were litigating the hell out of these cases and losing, but it is not.
Sorry fellow lawyers, you need to either have better cases, or get a new practice area.
A big fuck you to all you scumbag lawyers and your shitbird clients. Now go get your fucking shinebox!!!!
I do think the city should fight lawsuits aggressively, but if basics of the Reis story are true the city should be held liable for his injuries. A police car stolen because the keys are left in the ignition is a bit different than the normal BS lawsuit.
Now I don't know if the 4 million was justifed, probably not, but paying his medical bills etc doesn't seem out of line.
Just picture yourself or a family member being injured because of those circumstances. We have relatively good insurance and expenses like that could bankrupt an individual.

and some more!
Let the guy sue the person who HIT him.
This is like suing the manufacturer of the car. After all, if the car hadn't been manufactured at all, there wouldn't have been an accident. Stupid.
How about suing the A-hole suspect that actually hit you! Oh wait he doesn't have anything, how about you get a portion of his link card and SSI income, yeah I know it is still the govt. money but at least it would cut back on the p.o.s's living expense on the amount of crack rock and flaming hot cheetos he can afford. Or when/IF the p.o.s. goes to jail you get any money he made or a number amount of honeybuns he stold!! About freaking time, to bad it is going to take along time to right what was wronged in the past.
No more ghetto lottery ! About f****n time.
Now go try to get hired by a real law firm, J/O's.
This is great news SCC. I am sick of these Loevy types making more money from the city on one case than those of us who have worked day in and day out for 20 plus years
Don't be late on your water bill, the City will shut it off and assign late fees and such. (Which seems to go up $40 every 6 months regardless)
But sue the City for bull shit and here's a few thousand to make it go away?
About time it changed.

Agree with you 100% brother. Ever heard of Brendan Shiller? Him and his mother are a perfect pair, she destroys neighborhoods, he destroys the careers of cops.
With the amount of shit regular people have to put up with living in the city, its a shame cops don't have a free ticket to be as hard as you need to be. Criminals know the laws are WAY to soft and beyond that all these liberal lawyers are waiting to back them up once they get caught doing something. Bullshit. Wish you guys could really crack some heads....
I feel sorry for Ries, he is the victim, but the PD is not the bad guy, The city is not the bad guy. The bad guy is the one who stole the squad. The other bad guy is Rie's lawyer for taking the easy way out (for him) and giving the victim false hope.......The bad guy doesn't have insurance? Of course not. Too bad you can't sue someone and if they don't have money they get put away....

I'm not sure how long this has been going on, but I heard a radio commercial today slamming public employee pension programs. The Illinois is Broke group has started airing radio ads in an effort to make the public pension programs seem extravagant. I realize that the union leadership is in a transition stage, but our leadership needs to get our own informational campaign started. With other organizations speaking out against us, we needed our campaign to have started YESTERDAY.

Venson, meanwhile, is back in jail in a separate case, records show.
Best line in the story.
Kind of ironic.....maybe the plantiffs and their attorneys have gone too far, for many many years....the corp counsel prize van has been awaiting r-service, I sure hope they don't fix it like they did my squad car....

The fat contingencies on quickly settled, bullshit lawsuits against The Police appear to have dried up like piss on a Vegas sidewalk.
Justice is seeing these bastards huddled around a small fire on the banks of the Sanitary and Ship Canal waiting for the pork 'n beans to get done...
Viva Hate.
The slum-times article today was really fair and balanced. All we read about was how the city lawyers are cheating and they should have settled (all from plantiffs' attorneys). No interview with the city hired guns or the POs as to what BS the suits were in the first place. Hope the slum-times and the plantiffs lawyers all go down in flames.
Try suing an automaker sometime. Most lawyers won't bother even when their is good evidence.
And for then chasing the suspect.

You remember how the city was going to be getting all kinds of advertising revenue from those French bus shelters (with hardly space to sit down) they put in?
Half or more of the "advertising" I see is city-printed posters pushing the Olympics, the fire department, "Safe Summer," or some other city project. They have got to be losing their a** on this, have to put something in the empty ad space no one's buying.
More expense to print the posters -- undoubtedly some "connected" firm gets the contract. News story?
Anyway, I just saw a bus shelter with a poster advertising that you should volunteer, sign up to have one of the new water meters put in.

To the Trooper: Please accept the apologies of every other officer in 011. We can't express the depths of our embarrassment. So true. Which is why after being sued twice, I've pretty much given up "aggressive" policing. These days, I answer my radio calls and that's it. If it doesn't happen right in front of me, I don't go looking for it. Just aint worth it anymore.

Kids set off homemade explosives in Gurnee man’s yard
By Megan Craig TribLocal reporter Today at 6:07 p.m.
"Six kids used three small homemade bombs to blow up part of a Gurnee man’s trampoline, according to a police report.
"Police officers called to a home in the 800 block of Belle Plaine Avenue on March 21 found a partially melted plastic bottle with a white, foamy liquid around the bottle and partially melted tin-foil. A chemical reaction inside the bottle had apparently caused an explosion on a trampoline in the man’s backyard, said Gurnee Police Cmdr. Jay Patrick.
"The homeowner told police he heard a loud explosion in his yard, and when he went to investigate, he saw several boys with skateboards there..."

Oh, boy. Whatever the discussion might be, I could never lay that down as Truth.
All YOU have to do is get rear-ended at a light, or pick something up a little bit the wrong way when you're in a hurry, or miss a step on the stairs moving back when someone swings on you -- you won't be singing that song when you're laying down afraid of going through what it takes to get up, asking someone else to bring you the Robaxin and a glass of water...
Stay safe and God bless -- I hope it never happens to you.

Depending on where the kid ended up, get ready for a 30 day suspension or 30 pending.
WTF! They KNEW there was a camera there!
Hopefully there's a good explanation.
I don't know how anyone can say that Reis didn't deserve payment from the City for his proven injuries. Those injuries must have been substantial or the 4M judgment wouldn't have been awarded in the first place. The negligence exhibited by the officers in leaving their keys in the ignition of a car that they have put a prisoner/suspect into is indefensible and is certainly the proximate cause of Reis' injuries. It's entirely foreseeable that an arrestee would seize the opportunity to escape by stealing the squad car and might be involved in a personal injury accident or other such incident.
I dare say that if this were to happen to one of your family members that you too would be demanding that the City pay up or settle the case.
Bad news tonight for the police. 9 oclock news on both wgn and fox showed Streamwood copper found guilty for doing his job (I wish he didn't stop that car in the first place) and they showed the terrible CPD allowing the crowd to view the arrestee in the back of the Tahoe. Doing this job BLOWS!
Do nothing and be happy! If not happy at least take solace in the fact that you are employed and not going to jail. Be careful.
Important fact --
"The [Illinois Supreme] Court, in its 18-page opinion filed Feb. 25, said the appellate court correctly determined that the city was immune from liability in the incident pursuant to the Local Governmental and Governmental Employees Tort Immunity Act.
"The act immunizes local public entities and their employees from liability for injuries inflicted by escaping prisoners.
"The plaintiffs in the case, Christopher Ries and Michael Martinez, were injured when Demario Lowe stole the police vehicle and proceeded to crash into their car.
"Both Ries and Martinez sued Officer Sergio Oliva of the Chicago Police Department and the City of Chicago in Cook County Circuit Court.
"The case ultimately went to the jury against the city only, and the jury entered a verdict for the plaintiffs."

All those exempts that JFled made had their 3 and a day on 15 March but they have to make up unpaid furlough days - 12 for 2009, 24 for 2010 and 24-52 for 2011, best case senario 12 + 24 + 24 = 60 / 5 = 12 weeks which brings us to -at the earliest- mid - June, worse case scenario, 82 days / 5 = 16 weeks. Sorry Sue,
It didn't pass the smell test. The proximate cause of the injuries lies with the offender who made the conscientious choice to steal the vehicle, not with anyone else; your reasoning is akin to blaming Ford for making cars that have the ability to go fast and could be used to flee the polife and be involved in a personal injury accident or other such incident.

None at all. Some are now called judges.
Anyone remember Judge James "No-Time" Epstein? Former defense attorney. Former public defender. Wife/judge Joan Corboy got killed, he gets appointed to his wife's judgeship through Corboy clout. Funny that Joan Corboy never was known as Joan Epstein, kept that Corboy name.
Ed Burke and John Daley slate him for the Appellate Court, he runs unopposed. Watch for Epstein to end up on the IL Supreme Court next time. He will owe the usual suspects. It's all legit, all fair.

What happened with assigning percentage of liability? If shithead was 90% liable for stealing the car and city 10% then the payout could have gone like that, city pays 10%, dirtbag pays the rest out of his LINK card.
As it is, city pays nothing. City won. That's how it is when you win.
This reminds me of Albert Brooks trying to ask for his money back when his wife lost it all in a casino. It's called gambling, you gamble going to trial, you win or lose. Nothing is certain but the expense.
keep fightin'em boys...this shit might turn around after all. Next thing we gotta get passed is useless, liberal judges not being held accountable for exercising their fucked up, biased beliefs...
Okay, so obviously you're the ppo he tried to sandbag. And this has exactly WHAT to do with his wife?
----------
It means both the husband and wife are to stupid to know when there is a camera filming you:
DON'T FUCK UP.
Now they both can work at Wal-Mart for $9.00 an hour while us taxpayers pay the lawsuits for their stupidity.
Okay, so obviously you're the ppo he tried to sandbag. And this has exactly WHAT to do with his wife?
===========
I think it means BOTH wife and husband are going to be fired for doing something STUPID on camera even though they KNEW THEY WERE BEING FILMED.
The 1st Deputy's are getting their powers back now that Masters is gone. Hillard stated the dept is going back to the chain of command before he left, per the Sun-Times. Inquiring minds want to know. I was surprised it wasn't posted here first.

Seriously, learn the Department Organization, chain of command and rank structure...idiot.
that cop in 019, writes anybody he can, police, police family, firemen, anyone! be careful this guy has no friends, no outside life, and no future. Big jagoff and no conscious.
No professional courtesy, hope he never needs a break...
"What about the 019 dist Copper who wrote the off duty cop a DUI. Unbelieavable

Exactly. What was the off-duty copper thinking driving drunk? Take a taxi.

To the moron 2nd watch officer in 011, who wrote the State Trooper, even AFTER he told you he's a Trooper and showed you his credentials: What is your major malfunction? You made the entire district look bad. Idiot!
Hopefully, the W.C. ripped you a new asshole when he called you to his office and closed the door.
To the Trooper: Please accept the apologies of every other officer in 011. We can't express the depths of our embarrassment. Hopefully, the actions of 1 idiot won't damage the great working relationship Troopers and the 011 district have always enjoyed. None of us, and I do mean NONE of us support what this officer did.

This is the same bitch that tried to cover for her gangbanging son, after he murdered someone a few years back. She is carried on management on 2nd watch, and has never worked another watch. She belongs in prison, not on CPD. She is hated by everyone, except the bosses, who repeatedly take care of her.
Fuck you AC! Just wait until you fuck up just a little bit.
So their easy payday lawsuit's are being challenged and they are pissed about it, suck eggs scum.
"All those exempts that JFled made had their 3 and a day on 15 March but they have to make up unpaid furlough days - 12 for 2009, 24 for 2010 and 24-52 for 2011, best case senario 12 + 24 + 24 = 60 / 5 = 12 weeks which brings us to -at the earliest- mid - June, worse case scenario, 82 days / 5 = 16 weeks. Either way - Rahm has plenty of time!"
The pension is based on the most money made us the best four of the last ten years. There is no magic date for a gold braid pension. Even if they don't make three and a day if they retire at the right time their pension will still be significantly higher than if they were just a lt. Enough with the counting days already.
Correct me if I'm wrong but in a federal lawsuit, the prevailing party can collect court costs from the losing party. Perhaps a reform can be made to hold the losing law firms responsible for the costs. Maybe that would REALLY cut down on the B.S. lawsuit that get filed on us just for doing our job....correctly I might add.
Paraphrasis --
"The negligence exhibited by the officers in leaving their keys in the door of a cell that they have put a prisoner/suspect into is indefensible and is certainly the proximate cause of [the plaintiff's] injuries. It's entirely foreseeable that an arrestee would seize the opportunity to escape by leaving the cell and might [cause injury.]"
"Sorry Sue,
"It didn't pass the smell test. The proximate cause of the injuries lies with the offender who made the conscientious choice to leave the cell, not with anyone else; your reasoning is akin to blaming Master for making locks that can be opened, as this might allow a prisoner to escape and cause injury or other such incident."

I know the officer and he is a complete professional. By professional I mean he treats all people fairly and professionally and with courtesy.
Being a PO does not give one the right to unlawfully drive under the influence of alcohol.
I am glad there are officers who hold everyone accountable. Me or one of my family members might not have to be killed by a drunk driver who happens to work as a police officer.
Minor traffic violations, he gives as many breaks as the next cop, act courteous and professional and he will treat you just the same.
Drive drunk and you are risking your livelihood and drivers license and freedom. Do we really need a rehash of all the police officers who have gone to trial for killing people while drunk?
We have a guy in 019 who is waiting for his day in court. He is using every legal remedy at his disposal to get off, as is his right. All he had to do was to call a taxi. Now he is fighting to stay out of prison.
Don't drive drunk. So simple.
Yeah and that same attorney took the case out of the kindness of his heart and plans to donate his 33.3% to Rainbow Push or some widows and orphans. Bravo. Go fuck yourself you spineless dweeb
