City Pushing Too Hard?

  • Christopher Ries thought he’d finally won.

    A jury awarded him $4 million for neck and back injuries he suffered after he was hit by a stolen Chicago Police squad car in 2002. Jurors faulted the police for leaving the suspect alone in the back of the squad with the keys in the ignition — and for then chasing the suspect.

    But the city appealed, claiming the officers should receive immunity. And last month, the city won in the Illinois Supreme Court, canceling out Ries’ award.

    Chicago is getting more aggressive in fighting lawsuits against police officers — a strategy that’s winning approval from the rank-and-file who believe the city settled too easily in the past.

    But some plaintiffs and their attorneys complain the city is going too far.

Boo-fucking-hoo. So a bunch of law school hacks who couldn't cut it in the real world, aside from quick payouts from an overly generous Corp Counsel, are going to have to work for their money. Maybe they'll stop taking the frivolous suits and actually work at making a living for once. We can't say we'd cry if a few hundred lawyers went out of business

There is no such thing as "going to far" in the law. If an attorney aggressively defends his client at trial or through appeal he is doing exactly what he is supposed to do. Bravo

Defending yourself to the best of your ability in a court of law against false or exaggerated claims of wrongdoing is "going too far"?

Half of these complaints against the police and their actions are phony anyway, predicated on the lawyerly belief that if the bad guys beef on the police that THEY are somehow LESS guilty!

I wish for nothing more than the bottom feeding parasites like Loevey and Loevey to suffer, but the fact is that many of these pieces of shit have already made millions from the city filing bullshit lawsuits that the city just simply broke out the checkbook for.
The class of people filing these suits are often garbage felons looking to hit the "ghetto lottery" because they are being advised by assholes like Loevey to sue for anything!
I realize the public wants to pretend that these suits don't affect policework and the class of polieman being put out there to protect them, but the fact is many coppers with enough time on the job are smart enough to fear the almighty lawsuit.
Of course all the liberal fucks and media type will reply--"If you do your job the right way , you won't be sued" Unfortunately that is absolutely not true. Most aggressive coppers will eventually be sued for some bullshit by some jagoff offender that "beat" his case at 26th st. The simple reason is that if these jagoffs are found not guilty they will sue for no other reason than that.
I am extremely happy to see a bit of resistance from the city in regards to these suits, but why not take it a step further and prosecute or at least punish some of these offenders and piece of shit lawyers who bring on the frivolous suits or won't sign the affadavits and are found to be lying. None of these lawyers are even able to be found accountable for their actions or that of their felon clients.

The City has a responsibility, not ONLY to it's citizens to run the city in a fiscally sensible manner (aka stop settling merit-less, frivolous lawsuits), but also to its police officers to uphold the reality of their quest to uphold the law and pursue truth, justice and the American way...!

Too dramatic? ... Sorry I got carried away, but point being that its a lot harder to do our job when the public perception is that we are a bunch of Neanderthal knuckle draggers looking for the next innocent victim to pound the shit out of because thats what we take pleasure in and thats the only way we know how to get a conviction, by beating people into confessing or using some kind of secret 'black box'!

I have a lawsuit that is currently going as we speak. It was first alleged that we planted a gun on a fatal police shooting. But after the plaintiff sent the gun for DNA testing in Texas and the dead guys DNA was found on the magazine and bullets the charges were changed to excessive force. 5 years ago the city would have paid out. Today this case goes to trial and we win.

The problem with this accident is fleet, not CPD. Theye were offered a device that is used by most suburbs. The car keeps running, but when the officer steps out with the key, the car will not go into gear.
Fleet saved a few bucks and things went downhill from there.

I wondered after considering how the feds investigated the Cook County Court system for Operation Greylord how they felt about leaving the rotten apples they didn't arrest in play.

The only reason more arrests weren't made is that it would have completely shut down the court system here.

When we complain about the lack of justice that comes out of the ASA's office, how much corruption is there to be found there reminiscent of the old days and ways of doing things.

How is it, exactly, that so many repeat offenders get let out with just a slap on the wrist? Are bribes and favors being passed again? One would be a fool to think otherwise.

All of the corrupt politicians who made the assignments to courts in order to protect themselves bears looking into. Why not focus on that instead of Cozzi?

I do think the city should fight lawsuits aggressively, but if basics of the Reis story are true the city should be held liable for his injuries. A police car stolen because the keys are left in the ignition is a bit different than the normal BS lawsuit.

Now I don't know if the 4 million was justifed, probably not, but paying his medical bills etc doesn't seem out of line.

Just picture yourself or a family member being injured because of those circumstances. We have relatively good insurance and expenses like that could bankrupt an individual.

The Illinois is Broke group has started airing radio ads in an effort to make the public pension programs seem extravagant. I realize that the union leadership is in a transition stage, but our leadership needs to get our own informational campaign started. 2 agents from IAD came to the 014th District police station on the 3rd watch and relieved them of their police powers.

You remember how the city was going to be getting all kinds of advertising revenue from those French bus shelters (with hardly space to sit down) they put in?

Half or more of the "advertising" I see is city-printed posters pushing the Olympics, the fire department, "Safe Summer," or some other city project. They have got to be losing their a** on this, have to put something in the empty ad space no one's buying.

More expense to print the posters -- undoubtedly some "connected" firm gets the contract. News story?

Anyway, I just saw a bus shelter with a poster advertising that you should volunteer, sign up to have one of the new water meters put in.

I don't know how anyone can say that Reis didn't deserve payment from the City for his proven injuries. Those injuries must have been substantial or the 4M judgment wouldn't have been awarded in the first place. The negligence exhibited by the officers in leaving their keys in the ignition of a car that they have put a prisoner/suspect into is indefensible and is certainly the proximate cause of Reis' injuries. It's entirely foreseeable that an arrestee would seize the opportunity to escape by stealing the squad car and might be involved in a personal injury accident or other such incident.

I dare say that if this were to happen to one of your family members that you too would be demanding that the City pay up or settle the case.

Bad news tonight for the police. 9 oclock news on both wgn and fox showed Streamwood copper found guilty for doing his job (I wish he didn't stop that car in the first place) and they showed the terrible CPD allowing the crowd to view the arrestee in the back of the Tahoe. Doing this job BLOWS!

"The [Illinois Supreme] Court, in its 18-page opinion filed Feb. 25, said the appellate court correctly determined that the city was immune from liability in the incident pursuant to the Local Governmental and Governmental Employees Tort Immunity Act.

"The act immunizes local public entities and their employees from liability for injuries inflicted by escaping prisoners.

"The plaintiffs in the case, Christopher Ries and Michael Martinez, were injured when Demario Lowe stole the police vehicle and proceeded to crash into their car.

All those exempts that JFled made had their 3 and a day on 15 March but they have to make up unpaid furlough days - 12 for 2009, 24 for 2010 and 24-52 for 2011, best case senario 12 + 24 + 24 = 60 / 5 = 12 weeks which brings us to -at the earliest- mid - June, worse case scenario, 82 days / 5 = 16 weeks. Either way - Rahm has plenty of time!

Just watched 10 news channel 2 lead off with coppers and some gang banger getting yelled at by other gang bangers! 2 young coppers YOUNG COPPERS take this from a KMA veteran never trust a gang banging punk and his friends! Ghetto mama tells scum savini that she was "scared" to exit her car even after being lawfully ordered out by police! savini says after 1 hour 45 minutes a ticket for speeding was issued, then a month later the same ghetto bitch was arrested for interfering with police but both cases were thrown out! I do think the city should fight lawsuits aggressively, but if basics of the Reis story are true the city should be held liable for his injuries. A police car stolen because the keys are left in the ignition is a bit different than the normal BS lawsuit.

Now I don't know if the 4 million was justifed, probably not, but paying his medical bills etc doesn't seem out of line.

Just picture yourself or a family member being injured because of those circumstances. We have relatively good insurance and expenses like that could bankrupt an individual.

Whether someone leaves the keys in the car or not, the offender is an adult and he knows the car is not his. His criminal act of stealing the car brought upon his injuries, not the keys.

It's entirely foreseeable that an arrestee would seize the opportunity to escape by stealing the squad car and might be involved in a personal injury accident or other such incident.

It didn't pass the smell test. The proximate cause of the injuries lies with the offender who made the conscientious choice to steal the vehicle, not with anyone else; your reasoning is akin to blaming Ford for making cars that have the ability to go fast and could be used to flee the polife and be involved in a personal injury accident or other such incident.

When you sue and go to trial you get your fair shot under the law to prove your case before a jury.

They guy lost in his shot in court. That is it. He had his trial, he lost. Next please.

Those crying civilians now posting should have been on that jury so they could have given away the treasury. The trial is over. Send him a donation if you feel bad. Write out a check. Feel better now?

Anyone remember Judge James "No-Time" Epstein? Former defense attorney. Former public defender. Wife/judge Joan Corboy got killed, he gets appointed to his wife's judgeship through Corboy clout. Funny that Joan Corboy never was known as Joan Epstein, kept that Corboy name.

Ed Burke and John Daley slate him for the Appellate Court, he runs unopposed. Watch for Epstein to end up on the IL Supreme Court next time. He will owe the usual suspects. It's all legit, all fair.

What happened with assigning percentage of liability? If shithead was 90% liable for stealing the car and city 10% then the payout could have gone like that, city pays 10%, dirtbag pays the rest out of his LINK card.

The pension is based on the most money made us the best four of the last ten years. There is no magic date for a gold braid pension. Even if they don't make three and a day if they retire at the right time their pension will still be significantly higher than if they were just a lt. Enough with the counting days already.

Correct me if I'm wrong but in a federal lawsuit, the prevailing party can collect court costs from the losing party. Perhaps a reform can be made to hold the losing law firms responsible for the costs. Maybe that would REALLY cut down on the B.S. lawsuit that get filed on us just for doing our job....correctly I might add.

I know the officer and he is a complete professional. By professional I mean he treats all people fairly and professionally and with courtesy.

Being a PO does not give one the right to unlawfully drive under the influence of alcohol.

I am glad there are officers who hold everyone accountable. Me or one of my family members might not have to be killed by a drunk driver who happens to work as a police officer.

Minor traffic violations, he gives as many breaks as the next cop, act courteous and professional and he will treat you just the same.

Drive drunk and you are risking your livelihood and drivers license and freedom. Do we really need a rehash of all the police officers who have gone to trial for killing people while drunk?

We have a guy in 019 who is waiting for his day in court. He is using every legal remedy at his disposal to get off, as is his right. All he had to do was to call a taxi. Now he is fighting to stay out of prison.

Don't drive drunk. So simple.
