Vanecko Case Gets Legs

  • It’s been two weeks now since the Chicago Police Department concluded Mayor Daley’s nephew threw the punch that led to David Koschman’s death but closed its recently reopened investigation without seeking criminal charges.

    The case is closed. And the police aren’t talking. But many questions are still unanswered.

    The police have said only this: No one received special treatment.

Which no one we've met believes for even a moment. Novak and Fusco of "Hired Truck" fame have their teeth in this one and the only thing keeping it from a federal grand jury is pressure from Washington DC.

The only question is how long can Vanecko be protected by the powers that be? Maybe if it gets national media attention something will be done.

At the very least, Vanecko should easily be found liable for Koschmann's death in a civil suit.

A few more questions that an eager investigator may want to ask are?

What are the criteria set by the FBI to have a case closed “exceptionally”? (JFeds old employer and an investigative body that JFed has shown some pull with in his tenure as CPD superintendent.) (i.e. Bill Cozzi)

One of the criteria is the case must have a "known" offender, and that appears to be Vanecko AND some sort of extenuating circumstances as to why the offender is not being charged, usually because he is DEAD. Last I checked, Venecko is not dead...yet.

The FBI also needs to APPROVE all cases that are closed “exceptionally”. (This makes me wonder if JFeds near $1 million salary over 3 years was not more like a $1 million bribe to get in with the FBI to get a bad situation to disappear.)

This case is as dirty as they get and I would just love for John Kass or Ben Javorsky to pick up on it and apply pressure to the right people.

These half ass bosses are destroying any integrity left in this department. How hard is it to read the reports and explain that Darren OBrien rejected charges?

I never read anything more incorrect than the above post. This writer has no idea how a murder case is charged or how it is cleared exceptionally (either cleared closed or cleared open).

This was very likely written by the dumbest person on the CPD. We are all now a little dumber for having read it.

This case is done.

By most accounts there is not really a case, other than the guy being related to Daley.

He probably got away with manslaughter. It happens now and then.

Maybe a civil suit will get some money out of the Daley crime family if there is a competent lawyer willing to risk being found in the river who will take the case.

OTOH, I would not be surprised if some of the people involved in the investigation got some time off. Some very irregular things went on.

I agree (for once) with the reporters questions...this is a b.s. cover-up 100%. And I love Det's saying it was all legit...the ASA didnt approve..Bullshit...they didnt WANT to approve!! AND the investigation was screwed up from the beinning...on purpose no doubt.Called in 2 weeks after for a line-up after changing his appearance? Yeah ok Detective...great job. On this one EVERYONE is to blame...Sad thing is no one would give a flying fuck about this kid if the offender wasnt who he was.

Here's another question the media may want to ask. WHY weren't the original detectives assigned in A/3 given the case to close? Not all of them have retired two are still working there. WHY give it to a detective that was not assigned to A/3 and never on the paper? Does someone not trust that these two detectives in A/3 are competent enough to handle the closer? Fresh eyes you say well what about the detectives filling the spots in the cold case squad? WHY weren't they assigned to re-open and re-investigate this case? Hmmmmmmmmm

There will be no civil suit. The mother has no interest in filing one. And it is long past the date to file one anyway. this is why this has come out now and not sooner. Basically there is nothing anyone can do and this guy got away with murder. and stealing from our pensions.

These reports are exempt from FOIA requests per stattute as well as our own department policy.....

I hope Rory O'Brien had the authorization to release the shit, what is the sense of blocking out his PC # on the bottom of the report in the Scum-Times but keeping his name on the report?

One criteria for exceptionally closing this case would be that the offender is identified.
There are several criteria to be met, I worked homicide as well as many other units and the criteria is spelled out on paper for the detective division. I had to refer to this order several times and the number one was to identify the offender, other wise the others don't matter.

If the offender was identified he would have been charged in any other case like this.

this whole thing was turned over to the feds by a copper who worked that night and knew it would come out as a obstruction of justice under color of law and didnt want to be caught in the middle when it came time to bite him in the butt, his union rep told him to go ahead with it.copper kept all records and case reports concerning the death of the kid and all the bosses involved at the scene that nite.

You guys aren't going to believe this but I was flagged down yesterday by a witness to this incident that they just saw Daleys nephew a block away and that he's killed their friend a few years back.

I toured the area but could not locate Vanecko.

I hope I see him because I will detain him, call the Detectives and have a line up done because the witnesses and victims family want to pursue the matter. I'm sure the Det's (especially their bosses )will call the States Attorney quickly so we can charge Daley's nephew with murder...Right?

I'm sure the States Attorney will take this seriously, becuase Alvarez ran on a anti police platform, so now here chance is here again.

If this was a homicide in a High Crime Area it would have be pursued and charges filed. How come not in these circumstances.

But I bet Vanecko is probably on Vacation with Daley's kid in a non extraditeable country..

All this harping about "why didn't the Police do anything" is for the most part a bullshit distractor designed to middle and dirty up CPD in this madness.

We cannot IMAGINE any detective in their right mind, given the current climate, not wanting to slap the cuffs on Vanecko. More incentive just BECAUSE HE IS a blood member of the Daley Inc. crime family.

This is beyond the power of the Police to address and correct. The Police apparently did what they were supposed to do. Work this investigation to it's conclusion; which is identifying the offender and presenting it to CCSAO for approval of charges, seeing as how moving beforehand would expose those involved to false arrest litigation which WILL be made to hurt REALLY BAD by orders of City Hall.

So how does an Area 5 double merit sergeants name appear in the supervisor approval box for an Area 3 incident? Did merit lieutenant, er, Chief of Detectives TB go "shopping" for someone who supervisors easily influenced to do the wrong thing-upon command-since he's beholden to a thoroughly corrupted system for his own advancement? And where is the Skull? Did he get a phone call as well? Lets see if uber Mic' Fitzgerald will move as swiftly to investigate this cover-up as quickly as he moved to sandbag Cozzi. This one has Chicago written all over it. And with Bill Daley in the White House he'll make sure Eric Holder never allow any federal investgation of this crime. There is time to file a law suit still. Even though this occured seven years ago, the identity of the offender was not discovered until now. The clock starts ticking now, and regardless believe me when I tell you that you can find a judge that will allow a law suit after the time expires anyway. Hard to believe in Crook County I know.

It seems, on it surface, to be a very shoddy investigation into a very serious matter. It does not matter how many murder trials someone has testified in, this investigations just does not look right. It would be interesting to know which of the police officers (beat offcer, his sargent, His Lt. The initial investigators, their Sgt's Lt's and Violent Crimes Commander initially involved in this case were promoted to the next higest rank after the initial investigation in 2004 was closed out.

I did read the UCR handbook and the definition of " exceptionally cleared" is in this handbook. However, that does not state that the feds approve all cases that are in this catagory. They take the word of the reporting agency and all agencies do not have to report to them. The CPD reports to the state of illinois who reports to the feds. There is no " approval" per se. The city can, and does enter what it wants to enter and there is no follow-up by the feds to see if entries are correct.
