One thing to remember. The employees terminated were at will employees. Any new administration can terminate anyone to bring in their people. This is not anything that is not anything new. What is the difference, is that their are several people who are looking for a bigger exit pay off and did not get it. So whats next in the chicago way, lets get a lawyer and file a lawsuit in crook county. Nothing new folks. Some old (now unemployed) crowd up to their same old tricks who are angry that they no longer are being paid by our union dues. Just ask Plienes (& his buddies) how much he made from separate and extra billing he charged FOP for special projects from Mark and you will now know why? Now lets audit those bills boys and girls at the FOP and see if all the work can accounted for.

I liked Pleines. I'm not happy with what I read about retalitory firings. I've never met Mike Shields and I didn't vote for him, but he comes across as being immature.

Being disabled myself, I wouldn't wish Parkinsons or any other injury or disease on anyone. However, having personally dealt with Mr. Pleines in the past, his representation was mediocre at best. He lost my case before the Pension Board, and then got my appeal mired in delays. Those days were a nightmare...injured, in pain, sick and going broke. Ultimately it took another route to win my case. I had to worry about supporting my family while not being able to work...but I still had to pay him every month. His big break to me was letting me make monthly payments. When I finally was awarded my disablility pension, I mentioned to Tom that I had been praying very hard for that outcome. He looked down on me and said, "You're good."

Anyway, he knows a thing or two about disability and the courts. Too bad Donahue didn't fire Plienes like he promised the disabled officers when he first ran for FOP president.

I'm sorry you are sick, Tom. It's really horrible, isn't it, to be sick and have to worry about income and medical care and a pension. That being said, if some of the allegations in the lawsuit are true, shame on everyone involved.

First of all I would hardly call his negotiation skills "exceptional" as I don't remember ANY favorable outcomes to police officers in the last 2 contact negotiations.

I feel so sorry for that man, to have been treated so maliciously, yes, maliciously by the incoming president and his staff.

Sounds like that lawsuit could bankrupt the FOP. I say good riddance and let's start all over.

I hope those who violated rules and laws and were sexual harassers are held accountable.

Shields was probably thinking, 'what do I need this old fart for'? Wanted a new 'dynamic' team around him, being too young to realize that the older, established employees are EXACTLY what he needs.

This lawsuit justifies Plienes being terminated. It is also an unethical attempt by Plienes to blackmail Shields and the FOP into giving him lifetime employment. Attorneys, even in-house counsel, are "at-will" employees and their services may be terminated at any time for any reason.

If you read the federal lawsuit against me it doesn't paint me in too flattering a light either. I beat it last week. totally, 100%.

It was all lies. Remember, the plaintiff's complaint always describes the incident or conditions in terms most favorable to the plaintiff.

Tom is pissed he was let go. He was an at-will employee with no promise of a job until retirement.

And what are litigators good at? Litigating! He knows where bodies are buried and how to get a nice pot full of cash for retirement.

Pardon me for being facetious here, SCC, but I don't think ANY lawsuit is filed to "paint a flattering picture" of the defendants.

As far as the suit, obviously it is a one-sided discussion. I'm sure the FOP will provide and EQUALLY one-sided response when given the opportunity.

This does bring up an interesting subject though. At what point is it okay to let an employee go? Once an employee is hired, must they be employed until they retire or die?

Is it necessary to try to do a character assassination on someone in order to bring in a new employee with better or broader skills or someone who you feel more comfortable working with? I don't know. Nothing in this suit necessarily convinces me that the "claims" made are absolutely true however.

Before anyone starts with the Shields attacks here, remember that the suit claims this started in 2007 under the old FOP Administration. Enough said. Let the court decide.

After reading this, all I take away is that you can't fire anybody. EEOC is the biggest collection of BS lawsuits going.

First I would like to say that I am sorry to hear about Tom's illness. Second, maybe Mike Shields could have exercised a little more sympathy. With that said, the new administration is definitely entitled to fill these sensitive positions with people that represent their brand of management, and that includes Tom's job. This is not a discrimination case and is so far reaching that it had to dirty up the case by mentioning the case regarding a purported sexual harrassment beef. This is typical lawyer bullshit that is designed to throw egg on the face of your opponent. This is a side show that hopefully does not distract us from the big picture, SAVING OUR PENSION! Mike Shields was definitely entitled to replace Tom and the other people removed. You may disagree from a personal stand point that it was cruel because Tom has his illness. But my feeling is that Tom was going to be removed regardless of his illness and that is it. His illness(and God Bless him)was not the motivating factor for dumping him.

Lets not jump the gun kids - Shields can fire any non-elected FOP employee (unless they have a contract). Tom did not have a contract and thus an at-will employee. who recalls the nurses at the medical section years back at the academy. when they were dumped back to the streets they cried and pouted and threathed to bring a suit against the city. all at once any talk of a suit disappered and they were made sgts, and dicks, coincidence, i think not.

All those speaking highly of Tom Pleines, remember this is the same guy who sent out settlement agreements to all the members who were wrongly placed on the Behavioral Intervention system by the City. The City admitted wrongdoing before the scheduled arbitration and all the officers were removed from said program. About a month later Pleines and the FOP sent out settlement agreement attempting to coax affected members into signing it, promising to not bring civil suit against the City or FOP. On a side note, the officers were removed from program regardless of their signing the agreement. However, Pleines made it sound as if their removal was contingent with signing the agreement. Such was not the case. Pleines certainly did not have the interests of those affected members at hand. He was concerned about saving the City money in the form of damages that should have been paid out to these officers. I'm curious to know if his decision making in this case had any bearing in his firing. I certainly hope so.

Paul geiger has been close friends with dan for at least 13 years that I can think of before mike was even a PO.. Dan years ago recommended him to me for a CR # as the only lawyer who cared and was smart at the FOP years ago while all other flop clowns where singing Roddy's praise. Geiger always did me right. No complaints about him. Very smart man. Danny use to go down to hang with Paul socially. So citywide knew that they where good friends for years. So don't you think perhaps these allegations surfaced after fop got wind that Shields would run as a way to set up Geiger to be fired for being friend with shields brothers. Has anyone even thought of that? No never happens in Chicago. Citywide was pissed that shields even had the gall to run let alone win when they told him not to. They called and told him that it was Bella's time to run. Just ask Bill.

The other staff fired. I don't care. What is Shields suppose to do bring in 2 more secretaries that can help the new team while paying the old ones just because their nice people? You'd all be complaining about how he's hiring too many secretaries. Is that any wiser then terminating AT WILL employees that are not needed. You want job protection pick a job with a union.

Lets remember Fop lawyers have been something that people have complained about for years. Now your going to complain when you vote a new president under the promise to change things and when he does complain. Can we stop acting like school girls please and start acting like police officers?

None of us work in that office. How many times have we heard about how awful a district or watch is to only work them later and find out its not the case. We are peering in from the outside and reading what disgruntled employees are saying as the truth? . Is that wise? Is that how you want to decide how the current administration is working out for us?

Like we say in Chicago lawsuits in cook county have nothing to do with truth and has everything to do with making lawyers more money.

If I recall President Sheilds was going to take down this blog called Second City Cop. He said he was going to win a showdown between him and SCC.

Before we rush to judgement and condemn Mikey Shields and all the others, just remember that this complaint is jut ONE PERSON'S SIDE of the alleged injury.

Wait until it all comes out in court.

...and don't go to the union meetings and ask him any embarrassing questions about this incident as you know he can not answer them.

Just sit back and wait and see how this all plays out. It may be an entirely different set of facts by the time it get to court.

This looks like a big loser for Fop. Especially considering how well people with debilitating illnesses play before a jury if it goes that far. Just put it on the tab along with new furniture, a new spokesperson(Camden), a new lobbyist (Donahue), a new field rep (Farrell). Hey while they are at it why not hire Daley or his kid. Im sure Shields could find a spot for them also.

Thank you John Marshall!! Actually an "at will" employee can be terminated for any reason, EXCEPT any that will violate the Civil Rights Act. Pleines is in a protected class by age and disability and cannot be fired because of that. It becomes a matter of evidence and ultimately proof.

Is it true that 5 of Daley's old security detail members (those not heavy enough to get a spot) are now at the academy to be Re-Tred back to the streets! There are no instructors at the academy so who is doing the instructing?? Are these much needed officers ready for the street? Also is it true that they have filed a grievence to remain in the Sgt. Pay Status that they were in while guarding King Richard & Maggie and not return to their regular pay status, since it would be a financial burden on them & their families. Just asking!

Firstly, everyone here who claims Tom's "at will" employment status as some kind of immunizing factor for the FOP misses the essence of the ADA cause of action. Yes, it is easier to fire an at will employee, but the ADA still provides remedies when termination is the result of discrimination related to disability status.
Secondly, whether his termination was related to the alleged sexual harassment investigation at the FOP offices or not, I cannot say. I can say that the coexistence of this investigation and Tom's cooperation with it and his subsequent termination paints the FOP in a negative light. Not sure what kind of office Shields is running but the whole point of a union, and I come from a union family, is to protect workplace dignity, safety, and stability. If sexual harassment is indeed a practice at the FOP office shame on the FOP. I don't want to subsidize the costs of defending sex harassment suits and if there is credibility to the allegations, the FOP needs to terminate the harasser. I voted for Shields and wish him the best. Hope he is up to the task. From what I've seen thus far, I'm not sure he'll have my vote again.

Sorry, but some white shirts need secretaries, even full duty officers. Look at the specialized units such as the academy. They have their share of full duty secretaries. Can you imagine a full duty officer paid to answer phones and type memos? Gosh, this baffles the mind.

The question that that needs to be asked at the Board Meeting tomorrow, or the General Meeting next week is:

Are we gonna write the three employees a big check soon, or are we gonna pay Mike Shields' attorney friends a whole bunch of money before we settle?

The insurance policy is gone, we lost that when we didn't follow through and make everyone do the sexual harassment training after the first SH suit five years ago,.

Firstly, everyone here who claims Tom's "at will" employment status as some kind of immunizing factor for the FOP misses the essence of the ADA cause of action. Yes, it is easier to fire an at will employee, but the ADA still provides remedies when termination is the result of discrimination related to disability status.
Secondly, whether his termination was related to the alleged sexual harassment investigation at the FOP offices or not, I cannot say. I can say that the coexistence of this investigation and Tom's cooperation with it and his subsequent termination paints the FOP in a negative light. Not sure what kind of office Shields is running but the whole point of a union, and I come from a union family, is to protect workplace dignity, safety, and stability. If sexual harassment is indeed a practice at the FOP office shame on the FOP. I don't want to subsidize the costs of defending sex harassment suits and if there is credibility to the allegations, the FOP needs to terminate the harasser. I voted for Shields and wish him the best. Hope he is up to the task. From what I've seen thus far, I'm not sure he'll have my vote again.

When Donahue was running for president 10 years ago for his first term as president he said Pleines was to be let go. Did Pleines threaten something then? Pleines then got an office in the FOP building instead of paying for his own office space. Pleines also got paid from officers when he said his legal work for them was outside what the FOP paid for.

Thank you John Marshall!! Actually an "at will" employee can be terminated for any reason, EXCEPT any that will violate the Civil Rights Act. Pleines is in a protected class by age and disability and cannot be fired because of that. It becomes a matter of evidence and ultimately proof.

At least Pleines was able to successfully lobby for us in Springfield. We just had Shields, Donahue (back on the payroll) and our lobbyist down there. They spent all their time lobbying for AFSCME (State, City & County bureaucrats and their supervisors and managers - NO POLICE). AFSCME got what they wanted - we couldn't even get a bill out of committee - SHAMEFUL! Nothing on the web site about their failure in Springfield - Pleines is a distraction. Thanks for nothing FOP.

Shields did what Donahue should have done years ago. Shields said for anyone willing to listen months before the election that Pleines was gone if he (Shields) got elected. He did and he was.

Pleines has since proved himself very worthy of that firing.

Mike Shields has done something really strange in Chicago. He has done exactly what he said he was going to do once elected.

And the FOP has insurance for this type of thing. No dues money. The firing was deserved and overdue.

Back in the early 80s. Pleines Sr was a Commander. Young Tom Pleines was an OPS investigator. He recommended 10 days suspension for excessive force for myself and three other P.O.s after a stolen vehicle pursuit. Two squads were damaged and 2 P.O.s were injured. This "brutality" was witnessed by a lawyer (whom I believe became a judge) from TEN STORIES up. The witness could not ID the "offending" officers and the arrestee refused to speak with that fat f--k. Pleines is a spineless POS.

Pleines made a nice buck on his own (not with the FOP) defending potential hirees who were REJECTED for being hired as a recruits. Some of these rejections were applicants that were police fighters and here's Pleines defending them at the Personnel Board. If anything, it was a HUGE conflict of interest, and despite complaints, he continued his little side practice raking in big bucks because he knew the ins and outs of the system.
I'm not feeling sorry or angry at anyone involved here, it is what it is.

Not so. It is not about the firing of Pleines. He should have been shown the door a long time ago. It is about how it was done. Were all the bases covered? Hope so, otherwise, it can result in costly litigation and/or a very costly remedy. We will ultimately learn if all the bases were covered because it will be revealed by the process. As of this moment, no one knows that answer, not even Shields and Pleines.

But remember three things as the process unfolds. Age, disablity and performance reviews. Those three big vicious dawgs might bite somebody in the end. (pun intended)

Hey Dimbulb. Stating a fact is not anywhere near the same thing as making excuses. You see there is a Civil Rights Act that is Federal Law, it carries protections for members of certain groups from discrimination such as unwarranted discipline, lack of promotion, firings and other job actions. These groups contain persons of a certain age, sex, color, sexual pursuasion and those disabled. Pleines is in at least 2 of these groups and therefore has some guarantees by the US Government. He is suing to enforce those guarantees. I don't know how to make the issue any simpler, but somehow I suspect that you, and other dopes of your ilk, will still not understand. Well, at least I tried.

Incidentally, for your further edification: The Civil Rights Act, as I previously stated, is Federal Law, that is U.S. Government law. You could look long and hard in the Circuit Court Clerk's website and you will not find it.

Maybe you could go back to high school and retake a Civics Course.

Just to prevent any stupid statements relative to my previous posts, I am aware that there are several Federal Acts that govern discriminaton in employment as well as in other areas, such as the Americans with Disabilities Act, as well as the Age Discrimnination Employment Act and a few others. I was speaking generally using Title VII, The Civil Rights, generically.
