NRA Wins Attorney Fees

  • Fairfax, VA—Today, the U.S. Seventh Circuit Court of Appeals conclusively and forcefully held, without need for oral argument, that the National Rifle Association has the right to recover attorneys’ fees in its lawsuits against the city of Chicago's and the village of Oak Park’s unconstitutional gun bans. The court held that the NRA was a prevailing party in the case of National Rifle Association v. City of Chicago and Village of Oak Park

    “This is a Second Amendment victory and a civil rights victory. The National Rifle Association and the Second Amendment prevailed against those who sought to deny the right to keep and bear arms in Chicago and Oak Park,” said Chris W. Cox, executive director of NRA’s Institute for Legislative Action. “The attempt to avoid paying the NRA’s attorneys’ fees was rightly found to be unjust by the Court."

    After the U.S. Supreme Court ruled that the Second Amendment guarantees a fundamental right to keep and bear arms for all Americans in the historic McDonald v. Chicago and NRA v. Chicago and Oak Park cases, it remanded them for the purpose of issuing an injunction against Chicago and Oak Park's unconstitutional gun ordinances. Before that injunction was issued, however, those ordinances were repealed. The City and the Village then argued that the NRA was not a prevailing party and should not be allowed to recover attorneys’ fees. The District Court, which originally ruled against the NRA, agreed and denied the fee award.

    Today’s Seventh Circuit decision overturns that ruling, holding instead that the NRA is indeed a prevailing party and is entitled to receive reimbursement for attorneys’ fees. The amount to be recovered will be established by the District Court.
And just how much did Richie Daley cost Chicago taxpayers with his misguided and poorly thought out attack on Second Amendment Rights? Well, the lawyer in the Heller decision is asking for $3.5 million from the District of Columbia, and we believe he assisted in the McDonald v Chicago case. Then there are the other associated costs to be borne by Chicago and Oak Park taxpayers. We figure anywhere between $5-to-$10 million isn't out of the realm of possibility.

From a city that's about as flat broke as it can be. Way to go Daley, you complete and utter asshole! Another pile of money Chicago doesn't have just because you know better than the Founding Fathers and the US Constitution.

At least a couple of the suburbs were smart enough to drop their anti-gun laws; Evanston and Wilmette(?) Winnetka(?)

They saved their taxpayers money, allowing Chicago to take the brunt of the costs, even to the point of coming up with a law that would comply with Heller and McDonald.

But Hell, Daley never cared. It wasn't HIS money and he had no fears of spending it. For example, "he" was fined for destroying Meigs Field, but you and I paid his fine.

It is interesting to see the media blaming him for little things here and there, however.

Just read the story about Daley's son Patrick making lots of $$ for the WiFi deal at O'Hare and Midway. Also cashing in was RJ Vanecko the murderer. Maybe the City Council shopuld pull that expensive body gurad detail. Fatarce could well afford to buy his own security. What a complete corrupt joke!

The Heller lawyer, Alan Gura, did not "assist" in the McDonald case, he was the lead attorney in the SAF and ISRA case, McDonald v Chicago.

Attn: Chicago area Illinois State Reps. of whom almost all voted against the recent concealed carry bill. The barrage of quality lawsuits against Illinois has begun, WE WILL SEE concealed carry. Either get on the train or get run over, it is inevitable. We will win. We will make it perfectly clear in the next election, when we help WHOEVER your opponent may be in explaining to your constituants how fighting this cost over $10 million on a suit known to be a loser for the state and missing the chance to regulate reasonable training.

Gun rights folks and the NRA will not find a friend in McCarthy. He said so in front of the sunday mass crowd at St.Sabina. That means, I believe, that he will not cooperate with retired concealed carry and might do everything he can to block it as currently happens in the city of New York.

Sunday's Tribune's Editorial page ripped the state legislature for not "reforming" "exorbitant" public pension.

First, take a look at the 2009 Pension Annual Report. On page 36 you will see the average Annual benefit paid to a widow in 2009 was 17,159. That hardly qualifies as "exorbitant". To the contrary it qualifies as below the 2009 poverty guidelines for a family of 3. See the 2009 US Dept of Health and Human Services Guidelines.

Second, as numerous legal authorities have concluded, changing pensions for current employees is unconstitutional. Millions will be wasted on attorneys fees defending any new law.

They knew they were going to lose this thing years ago, they were trying to outcost the NRA and hopefully wait for liberal appointees to the supreme court to win this. It didn't work. Just like Sotomayor said she "supports the second amendment" then votes against it within months of saying that. Daley knew it would cost millions, he just never cared when it came to spending or blowing or even stealing taxpayer dollars, as evidenced today with his security detail. Chicago is still fighting the supreme court ruling with gun laws that are nearly an outright ban in itself and guess who's going to pay again when Chicago loses...again

Before we get too happy about the NRA getting fees in this case, let's remember that the fees are awarded here under the same statute that gives fees to the plaintiffs' lawyers in cases against cops.

Like, a $10,000 verdict and $150,000 in fees. The whole thing is CRAZY.

Oh yeah? I bet the NRA has those costs all totaled up already. What will the City do, spend more of our tax money to keep from paying them what they already owe? Daley doesn't care, he gone.

The judge will have to approve any amount. then the City can lay off more employees to pay, or else steal back some parking meters.

Who did you think we were going to get, Jennifer Beals?

It is looking like the best Superintendents were those early in my career, Fred Rice etc. It got steadily worse when Daley got in.

Daley politicized this police department like never before. My own working conditions are better than before but overall, clout is stronger than ever.

I prefer a return to the open drawer policy, if you pay, you get what you want. Very fair and above board. You come up with the scratch, no problem.

It's a long way from over. If memory serves me right, the City is being sued to permit a gun range, it's also getting sued for a burdensome new registration ordinance, and so on. It will add up to quite a bit more before everything is said and done.

Even in retirement Shanks is still screwing the city. He's picking up high paying job after high paying job yet Rahm is allowing the city to foot the bill for Shanks 5 personal assistants ,er I mean bodyguards, and 2 vehicles. Rough annual cost about $700k.
Today's Sun Times mentions Patrick "Batters" Daley made almost three quarter of a million dollars for sale of WiFi at airports. At the time of the deal everyone denied Patrick had any financial interests in the company. Must be magic huh?

Probably will bill the City about the same as the NRA will: $5-10M.

So the City pissed away $10-$20M taxpayer dollars fighting a losing legal position.

I gladly renew my NRA and ISRA memberships every year. These folks are fighting the good fight against the f'n gun grabbers and they deserve any financial support that you can throw their way.

Just like the past few we've had he is a puppet and a engine of politicians. I find myself being "weird" thinking: at least jody gave us rifle, cars, fight law suits but fuck a cop. He was an outsider just like the current puppet but seems like officers are more accepting of the current guy. Why? Because he was a cop? He was just as politically ass wiped like all the brass. Don't kid your selves officers, he is not our savior. He "WILL" make it worse.
