Shortshanks Reads SCC!

  • Emanuel talked about the possibility of compensating Michael Tillman and other victims of police torture, even as he defended his decision to provide a legal defense for former Mayor Richard M. Daley for his role in the case.

    Daley has received notice to appear for a Sept. 8 deposition, now that U.S. District Judge Rebecca Pallmeyer has ruled that the former mayor can be sued as a defendant.

  • Sources close to Daley have argued that the former mayor’s deposition is “not a done deal” because attorneys representing the former mayor have filed a motion to reconsider.

    They’re trying to block the deposition on grounds that Daley’s involvement in the case stems from his tenure as state’s attorneys and that prosecutors have “absolute immunity.”

So Daley and his lawyers are saying he has "absolute immunity" because he was state's attorney for the time frame in question. We and others have argued that since he was state's attorney, why is Chicago footing the bill instead of Cook County. We seem to be in agreement, don't we?

As soon as ya heard the word deposition in the same sentence as Daley, ya knew there was going to be a payout... and so did Flint Taylor.

And once again Rahm shows that he is nothing but a sawed-off puppet for the Daley Crime Family!

Daley should be required to submit to a deposition prior to any settlement talks. The citizens deserve to know what he knew.

And just in case the "prosecutorial immunity" argument doesn't fly. Rahm will head them off at the pass (on shortshit, er, shanks behalf) by settling the cases.

It would be the highest form of entertainment to see King Daley having to answer questions from those he allowed to be tortured. The thought of Daley in all of his arrogance having to answer questions from these POS is something we Daley Haters have wanted for 30 yrs. But the New Mayor, is afraid of the power of the Daleys, including Obama's Chief of Staff, so once again we will pay tens of millions of dollars in a settlement. If they had been able to drag Daley in years ago, Burge would not be in jail. He might not have even been fired!

If you tied Daley up to a chair and made him give a deposition he would plead the 5th. This rat would never talk. But please believe it won't get that far by a long shot. Rahm will sell off the entire city to save his Godfather. This whole mess just stinks to high heaven. And we are paying for it.

This settlement was pre-ordained when Daley announced he wasn't going to run again, actually much before that. Remember that phony baloney statement by Rahm, "Gee, I'd like to be mayor, if Daley should ever decide he doesn't want it any more, like in 6 months."

Yes, you may be in agreement him that the city shouldn't have to pay, SCC, but Daley is right. He has absolute immunity (with very limited , specific exceptions) for his conduct and knowledge as State's Attorney. That's why the Plaintiffs' Attorney's are attacking him as Mayor and not SA.

I'm a Chicago cop and a lawyer. Daley does have immunity in a case such as this due to his intimate role in the legal process as a States attorney. That being said he was employed by the State of Illinois and as such his indemnification from suit ought to be paid out by his employer at the time. The municipality of Chicago paying for his defense is in my opinion inconsistent with current 42 USC 1983 jurisprudence- that is the statute that a citizen can sue an individual for a violation of their constitutional rights under. Is there another attorney who reads this who can verify that? If it is so then legal action ought to be taken to prevent it.

The asshats posting on this blog need to decide which side they are on. Do you really think Flint Taylor is your friend? I know that we all hate shortshanks, but that doesn't mean Taylor and all of his savage clients were tortured.
If an innocent man went to prison because of a coerced confession, he deserves to be compensated. If a guilty, brutal criminal is set free because of the myths of Area 2, then we all lose.

The everyday citizens need to stand up WITH their police and DEMAND that prosecutors and those under their auspices in whatever capacity have their "absolute immunity" taken from them. No person should be above the law simply because of a title and position.
