$1.3 Million for Suicide

Someone kills themselves via stupidity and the City can't wait to give them piles of money:
  • A video of Chicago police not getting immediate medical help for a suspect who collapsed after swallowing drugs during an arrest last summer likely will lead to a $1.3 million wrongful death settlement against the city.

    The case involves John Coleman Jr., 39, whom police saw taking part in an apparent drug sale in July 2010 in the 100 block of West Division Street, a city attorney said Wednesday. Coleman ran and, after he was caught, struggled with officers. One used a Taser to subdue him.
We're sure Mr. Coleman had a clean record and a great job. He took care of all his children and visited his ailing mother regularly. He loved dogs and rescued kittens from trees, all while assisting little old ladies across the street in his spare hours.

On the other hand, maybe Mr. Coleman was a dope dealing piece of crap with a record a mile long who never contributed anything to society besides pain, suffering and his gang's brand of poison to addicts that ruined once prosperous neighborhoods.

Either way, $1.3 million in taxpayer money is far more than Mr. Coleman ever would have seen in a legitimate workplace.

There is absolutely no reason for rewarding bad behavior.

If I were these officers I would do everything in my power to sue the city/county/state. Get medical opinions, etc. This is unacceptable and should not be tolerated by us as Police or a decent society.

off topic, but I was surfing around the web tonight and found a story written about cpd back in the early 1990s. Its written about Dave Sneethen who is now retired but a great guy. Its funny how the media has changed. This story is so pro beat cop and shines a heroic light on the every day coppers in this city... Its a shame to see what they are calling reporting these days.. You just dont see articles written like this anymore.. It actually is an interesting read, which is why I use to read the paper...Not anymore with the trash they write now... either way, here is the article below.. enjoy

With the money Rahm will save taking benefits from cops he will be able to cut this deserved check to the "victims" family. I would like to know who the family attorneys are and what their "connection" is with the city law dept.

Mr Coleman had well over one hundred arrests and many of those included bullshit trips to the hospital to delay his processing. He was a POS and won't be missed by the 018th District. The two cops who transported him are stripped at call back for well over a year without allegations. Give me a break, yeah and this department wants us to stick our neck out. It could've been any midnight unit that transported that POS, but it happened to be those two who are being hung out to dry. The POS swallowed a pack of heroin ad one of them burst in his belly before he threw them up and they got caught in his throat. He would've been dead if that happened in the lobby of the hospital. Cause of death was overdose, not suffication. Two good cops are being f*cked and a whole watch is feeling the weight of their f*cking, but we'll be sure to go out and produce. And these know nothings haven't a clue as to why morale is so bad.

On the sun times website there are two stories about Finnigan, a story about the dope swallowing settlement, and the story about medical abusers. The increased negative articles will continue until the next contract is settled and our pensions have disappeared. The media will place their spotlight on the tiny percentage of officers bringing ill fame to the department while ignoring heroic actions exhibited EVERY DAY. This is gonna get exhausting, man! I work with brave men and women who respond to life threatening calls every day without hesitation. I want to stay informed about the city I live in, but reading these negative stories day after day after day after day after day........ Simply put, it just sucks being told on a regular basis that you and yours are ASSHOLES.

thing is...police THINK he put drugs in his mouth. We know he did but lets face it he put small items into his mouth before he ran and fought the police! Do we bring everyone to the hospital we THINK put drugs in his mouth? they dont have to treat him if we dont know for a fact so its a waste of time. Imagine bring a guy to the hospital saying "he put small items into his mouth we THINK was drugs" they will ask him if he wants to be treated and thats that. This is a joke he killed himself

Folks, think!!!! The recording device in your car is capturing audio even when the camera is not. The good folks downtown can pull up a live audio, video or audio and video stream from your vehicle at any time. Currently the app they use for the audio randomly selects a vehicle and some schmuck with our best intrests in mind sits in front of his computer listening. The cameras are there to help us, my ass. Show me one example

The whole story is not being told here on SCC.
Read the Sun Times article. It was a compiling
of poor judgements made by the arresting officers
which caused the City (wisely so in this case) to
offer up a paltry 1.3 mil to the family of the deceased, which they quickly gobbled up.
The offender swallowed drugs. This was put out on the air. A taser was used. The man was combative with several officers. All the signs were there that this offender should have been taken to a hospital for examination/treatment in an ambulance. Dept.
regulations require it. So WHY wasn't this done
immediately? Where was the supervision?
Proper supervision on the scene might have
prevented this situation from resulting in the death
of this man (scum, but still a human life, which
we're all sworn to protect). Looking at all the evidence presented in this case, the City got off
cheap. 1.3 mil for a life that probably wouldn't have
been lost if proper procedures had been followed
is a bargain. Any way you slice it, rules weren't
followed, and a man died because of it. Yes, it
does make us all sick as tax payers, but it doesn't
excuse what was done, or in this case, what wasn't
done PROPERLY. Hopefully, those involved who are
assigned to callback will, if allowed to return to full
duty, will do it better & smarter should that occur.

I have lost count at how many times, while working the wagon, they would call us in because some shit head in the lock up is complaining about chest pains.

CALL FOR AN AMBULANCE!

We are not paramedics. If you have someone in custody and they complain about feeling sick, take them to the closest hospital and get them looked at. Once they have a medical clearance you are good to go. Shithead can complain all he wants after that. If you have that little piece of paper in which the doctor wrote what he did, no problems.

If Rahm gave us all 300 days at the beginning of our careers ,
95 % of us would save them for emergency . The abusers would use them all within 10 years .

Working in the insurance industry as an adjuster, this settlement makes sense financially. Cook county juries are notorious for awarding large settlements. The theory behind the settlement is that the city will spend X amount of dollars in defense costs. The jury will award Y x 10, because most dislike the police and will try to punish them for giving them that speeding ticket 10 years ago. So rather than risk an out of control jury verdict, it's fiscally responsible to reach a settlement with plaintiff counsel prior to trial. Rules were broken, liability is difficult to defend with the video that shows everything. I don't agree with the settlement, but understand why they are doing what they are doing.

Settlement so high? The article says that the predicted jury award if the case went to trial was 5 million. Plus, the whole thing about the guy falling out of the squad car onto the pavement, twice, and then being shoved back into the car would almost guarantee punitive damages awards against the officers.

It doesn't seem fair and everyone knows that the guy was scum, but the reality of it is that juries don't see it that way and the federal judges almost never, ever, let in someone's criminal background and felony arrests into evidence because it "dirties up" the plaintiff too much. All the jury would see in this case is a sanitized version given by the family of a hard working guy who had lost his job and the uncaring police officers who didn't take him to the hospital when he needed to go. Consider the 1.3 million dollars a cheap end to the whole thing.

You guys don't get it, and until you start to hold your fellow officers accountable for the truly stupid stuff they do, this will continue to happen. The video on this is gruesome. This guy died because a) he was an idiot, but also b) because the officers were caught on tape THAT THEY KNEW ABOUT not giving a shit about what he was doing, even after seeing him choking. These officers would have been selling their homes to pay the punitive damages that would have been awarded by an infuriated jury, and the City would have been on the hook for far more than 1.3 mil. It's all about the video. That's why it was settled early. Just once, try to have an objective bone in your body. See what it feels like.

I was an Army Military Policeman back in the 70's stationed in Germany. Occasionally we would find GI's with dope and sometimes they would swallow it like this goof did. We would take the guy to the Army Hospital and the docs would pump their stomach. There was no question whether the guy consented to the procedure or not, the docs simply did it. Every time that happened the druggie would be released back into our custody after the stomach pumping procedure and he would keep saying over and over again, "I'm NEVER going to do that shit again!" Too bad the ER docs don't do that sort of things these days.

simple solution to a simple problem... call an ambulance and dont be lazy so you can get done with your quick cb#. I know nobody likes calling an ambulance because now your gonna have to sit on dude in the hospital but you will cover your ass big time. even if the ambulance gets there and he signs a refusal you did your job and are protected. these guys had this guy in the back and stopped the car half way, got out and this guy was fallin out. they got back into the car and drove the rest of the way to the station without calling the ambulance. The settlement isnt weather this guy is an asshole or a dope fiend...its about the coppers turning a blind eye to this guy when hes in pain screaming for the hospital...all of this was caught by the camera that faces rear into the prisoner compartment..not too smart. i know every scumbag says they need to go to the hospital, but if you tase the guy and you think he swallowed dope, just put your pride aside and call him an ambulance. no need to put yourself in federal court for non sense.

Four or five hours later she goes into convulsions in Area 4 Lockup and now goes to Mt. Sinai in an Ambulance. Now she is admitted.

Was it something she swallowed during the arrest or did she have more dope shoved up her crack? Did she crap out a bag and didn't want to waste it? (Junkies are like that.)

Three well documented trips to the hospital with two refusals. Officers and bosses did everything right. Maybe it‘s only good for a half mil if she has the right lawyer. And remember, she almost certainly votes, as I am sure Mr. Coleman will for years to come.

He may not be a cop but I am and he is right. General orders says to call a ambulance after someone is tasered. And if you know he ingested bags of narcotics which has opened in stomachs and killed people in the past also have him checked out by a doctor to get his release. That way it is documented that you rendered aid, seen by medical professional, and you followed rules and regs that way you are covered.This has nothing to do with catering to "their" whims. It is about covering your ass and following rules so you don't get fired.

After fussing, complaining and criticizing the rules at my job I was given the best piece of advice. "Do what they (rules/management/guidelines)tell you to do. They are always right. It will benefit you in the end." Now, regardless of how stupid, idiotic, senseless and waste of time the task is, I do as I'm told. It's been 5yrs and my stress level is very minimal. My response to every action that stirs the pot, "I was following the rules and did as I was told." Shuts them down every time.

To the officers involved, they were damned if they did, damned if they didn't. The family was going to find a way to file suit even if he had survived. Keep your heads up! This too shall pass.

I was mad in the beginning when things changed and pro-active policing became a no no. Now, I look at it in a whole new perspective, a blessing in disguise you can say. I answer my calls and write paper when necessary. Doing so has removed a lot of stress from my life.

I know change is hard, especially for the police, but as soon as officers accept the fact that things are not as they used to be, they will also have less stress in their lives.

This guy died because a) he was an idiot, but also b) because the officers were caught on tape THAT THEY KNEW ABOUT not giving a shit about what he was doing, even after seeing him choking. These officers would have been selling their homes to pay the punitive damages that would have been awarded by an infuriated jury, and the City would have been on the hook for far more than 1.3 mil. It's all about the video. That's why it was settled early. Just once, try to have an objective bone in your body. See what it feels like.

Not a cop.

It is probably better if that kind of situation is handled as a long term disability case rather than a sick leave type case.

Part of the problem is that the medical policy has mixed together things that are really workman's comp type stuff with the common cold and what most people would see as long term disability issues. Some of that is probably unavoidable due to the nature of the job. Cops are forced to deal with a segment of the population that exposes them to things most of us would not choose to be exposed to, so a more generous than normal sick day policy makes some kind of sense. There is really no way to know if a cop got a cold from his kid or because he was exposed to it on the job.

It is probably in everyone's interest to find some answer that makes more sense than what exists now, and the financial straits the city is in may well lead to a cheaper answer, if not a better one.

It is never helpful to have people gaming the system. But it is something that is almost universal. I suspect the bright light being shined on the abusers at present has more to do with posturing than anything else, but that is part of the game too.

My guess is they are done and will be lucky to escape criminal charges.

Despite the lowlife getting what he deserved, they screwed the pooch bigtime. The city can't just ignore that. This is not a mistake that can be argued away. It was a deliberate action on their part, something they chose to do, in violation of the rules. That is going to be really tough to get past.

I hope they have been smart enough to retain counsel to look after their own interests and are not relying on the city or union attorneys.

Maybe they can make some kind of deal. Claim PTSD or something and get pensioned off. Might even be true. PTSD might save them from criminal charges.

Like the responder to the original post said, there is always at least two sides to every story. Usually, the person's family will indicate, yup...I was an ANGEL (halo appeared above my head, with a chorus playing as I was sweetly talking to the officer). Rarely, is that the truth. OT national average may be 14 days off sick , but most of these workers do not receive pay . That's the difference.

If Rahm gave us all 300 days at the beginning of our careers ,
95 % of us would save them for emergency . The abusers would use them all within 10 years .
I think most officers would approve that medical roll plan .

You must be one of the new hair gel non thinkers. I had cancer which required 2 major surgeries and 8 months of chemo. If I had been given 300 days of medical when I came on 25 yrs ago all of my sick time would be gone. The medical roll is something that our union traded for instead of a wage increase. One serious job related injury, such as a broken limb or bullet wound can have long term repercussions, such as arthritis or nerve damage. WE MUST NOT GIVE UP THE MEDICAL ROLL.

The State should come after the family for repayment of all of the public aid he/they received. After that is all paid back then the lawyer and the family gets paid. Watch these lawsuits drop...

Great Idea, after all we have to pay back the city when we receive any monitary settlements. I agree with this post, the state should make this family pay back a portion of the money that he has received.
