Walgreens Sued

Not sure how much of case he'll have, but this guy might have a chance of changing the corporate group-think that pollutes so much of society's thinking:
  • Lawyers for a Walgreen's pharmacist in Michigan who lost his job after using his own gun to thwart an armed robbery attempt last May released surveillance video Wednesday that documents the event in chilling detail.

    Jeremy Hoven, who was hailed as a hero by gun rights activists after the incident, sued the retail giant in federal court for wrongful termination last month. Deerfield-based Walgreen Co. has denied the charge and is contesting the suit in U.S. District Court in Grand Rapids, MI.

    Hoven gained national attention last May after he brandished his own Smith & Wesson 357 Magnum revolver to prevent an apparent armed robbery at an all-night Walgreen's store in Benton Harbor, MI. Shortly afterward, Walgreen fired him for violating company policy.
Walgreens has a right to set policy and fire you if you don't follow it. You have no "right" to work at Walgreens if their rules violate your beliefs.

Here's where the change might happen though:
  • Hoven's court papers say he had a permit to carry a concealed weapon and only used it to protect himself and other store staff when two masked gunmen burst into the store at 4:30 am on May 8. The suit claims Hoven "had a right to defend himself and others" when he fired his pistol at the robbery suspects and had a "right to carry a concealed weapon" during the incident.

    But Walgreen contends Hoven's actions violated store policy, which specifically bars employees from carrying weapons and instructs employees to avoid confrontation in the event of a robbery.

    "Store employees receive comprehensive training on our company's robbery procedures," a spokesperson said in an emailed statement. "Compliance is safer than confrontation. Through this practice, we have been able to maintain an exemplary record of safety."
"Compliance is safer than confrontation?" Since when? That sure worked well at Brown's Chicken. Or Lane Bryant. Or a few dozen post offices we could name. Or in law offices across the country. Or schools.

There's a study out, post-Columbine, that changed the way Departments across the nation responded to school/workplace shootings involving one of two shooters. Quick confrontation saves lives. It doesn't matter how you respond, simply responding saves lives, either by catching the shooter unaware, evacuating potential victims from areas they might be slaughtered, or provoking the gunman into a suicide. We're sure one or more of our readers has seen or read the same thing - post a link if you can locate it.

Walgreens might be liable in another way though:
  • The company contests Hoven's claims that it neglected safety after the 2007 robbery.

    "We've made significant investments in security technology in recent years, including increasing the number of digital surveillance cameras at our stores," the company said. "We continue to invest in state-of-the-art security measures and high-definition surveillance equipment and hope that the apprehension of robbery suspects in the Benton Harbor area will prevent future crimes."
None of which prevented two assholes with guns from attempting to rob and possibly murder three of their workers in the store. And a security policy based on "hop[ing]...the apprehension of robbery suspects...prevent[s] future crimes"? Walgreens is fucking dreaming.

Surprisingly, the agency most involved in developing these concepts has been the US Secret Service. After President Reagan was shot they got heavily into psychology and predictive modeling. You would think it would be the FBI, but I guess they're too busy writing press releases.

Walgreen's may have a legal case, but they will not wish to put the question before a jury. Sounds like they are just trying to 'jaw' the settlement number down a bit. A jury, seeing the video, won't take long to award the plaintiff a hefty sum. Walgreen's knows it, the plaintiff's attorneys know it. That's why they sued!

As for me--I avoid Walgreen's stores like the plague. Who wants to be caught in one of their locations after they've announced to the world that armed robbers are free to enter and won't be confronted?

A shooting at Orland Square Mall tonight, a white woman shot in the parking lot by a black woman in an attempted robbery. This is just what the citizens of Orland Park have been fearing. Our mall has been taken over. Once the weekend comes, whites are definitely in the minority. I guess Lincoln Mall, Ford City and Evergreen Plaza aren't enough for them. Now we can't even feel safe in our own neighborhood. This is why we don't want a movie theater in downtown Tinley or that "luxury" apt complex proposed for Orland.How far can we run?

No one can demand that you stand helpless at the business end of a potential murderer’s gun as a condition of employment. Self-defense is a human right – not just granted by law but by our Creator.

It would logically follow if you have a right to life granted by God – your Creator - that so too would you have a right to defend your life. No employment contract can strip you of an unalienable right; it is foolish to argue otherwise. That story policy was never enforcable from the start.

The folks who run corporations like Walgreens live in luxuary gated communities and have plenty of secuirty around them all day. The poor folks who work in the trenches everyday are at the mercy of animals prowling our neighborhoods. If this employee had a legit permit to carry a weapon then he should be getting a medal instead of being fired. Walgreens is taking some heat for this incident so look for them to pay this guy off to shut him up.

Walgreen's is slow to change their policies regarding robberies. I personally recall working Tac on an armed robbery pattern in which a 3 to 4 man crew were hitting Walgreen's on the southside. At that time Walgreen's always located their safes near the front window/entrance of the store and their were liquor departments situated just inside the entrance at a right angle.

On this occasion we pulled up to a Walgreen's about 0700 hrs waiting to position ourselves inside, hoping to thwart the crew if they were to attempt to rob that store. We noticed that the front window was obstructed with advertising but otherwise noticed nothing unusual. We decided to drive down the street two blocks to get some coffee before returning and staking the store out, but as we were just getting the coffee the Zone came out with a robbery in progress at the Walgreen's we had just left. We literally dropped our coffee on the ground, jumped in the car and drove light/sirens back down the street, covering the 2 blocks in record time. We learned from the manager that the offenders were already in the store, saw us pull up and then leave. He stated that they were hiding tactically in the store near the entrance, storeroom and liquor department to catch us in a crossfire ambush if we had come inside. Although the offenders were able to make good their escape, they were apprehended a few weeks later using the same MO. Walgreen's still did not change their practice of putting the safe in the front of the store, their store layout, nor did they properly advise their managers/employees about dealing with robberies until years later.

Several years ago Walgreen's decided that security guards working in their stores should not be armed. This was due to a number of cases in which security guards shot robbers and the robbers subsequently sued the corporation and, because of our weak judges and liberal juries, won large verdicts. So now, instead of trying to protect their employees or customers, Walgreen's has retreated into surrender mode and orders "compliance" with the will of the robbers which leaves its employees and customers to the whims of the criminals. I would never set foot in a Walgreen's again.

When I retired from CPD, I went to work as an armed bank guard. I lasted about 3 months. The bank told me that I could not wear a safety vest, I could not confront any stick-up men either inside the bank or follow them outside. I could not fire my weapon under any circumstances and the final straw: The bank manager wanted me to sit with my back to the front door watching the teller cages. That is when i quit. They are more concerned about law suits in which some customer is injured then in the ass of any employee. Bank robberies will continue until the US banks start protecting their employees instead of wanting to look customer friendly with open banks. The same goes for a pharmacy that is open all night without protection ( guards and bullet resistent glass).

Oh, by the way, Walgreens , after 31 december, will no longer fill prescriptions for retired veterans of the US Armed Forces. I was just informed that I have to find other pharmacies and should go to Osco or to the Veterans hospital.Walgreens will no longer honor Tri-care, the insurance of the retired soldiers.

If I was a walgreens employee I would follow their policy and beyond. I would leave all the cash right on the counter. That way any would be robber would not even have to make any threatening gestures! Utmost compliance....

It's a liabilty thing. Most businesses have the same policy. Guess who gets sued if the employee shoots and sets off a fire fight and a customer gets shot. The approach with the least amount of legal exposue to the business is to comply (avoid confrontation) and call the cops.

Amen!! My daughter has worked for Walgreens since she was 16 - and while they maintain her hours at 30-35 per week to avoid benefits, her salary is a whopping $10.30 an hour. They treat their employees like garbage!

Employee: A person who is hired to provide services to a company or organization on a regular basis in exchange for compensation.

You have to understand what that word means. We are all hired to work unless we own a business or are given a position of authority in government. Companies and organizations do not make jobs to help people get employment. They create jobs to fulfill their assignment carried out for political, religious, or commercial purposes. It doesn't matter if it's some capitalist fat cat or progressive politician, they're the boss and we're their workers.

We will always find the the unfairness of it all, but then again, who ever said that life is fair?

I used to work at a place that installed security windows for the counter and neglected the drive thru window. It was a huge window. I asked our security head about the gaping hole in the security of a restaurant that had a history of robberies and he said there wasn't enough money for both.

This security survey that the lawsuit refers to just might get this guy paid and I hope it does. Fuckin' shame you can't defend yourself anymore.

You actually believe an entire segment of the United States population is "emboldened" to commit crimes just because the First African American President was elected? Whites, as a whole, also feel the same way. Blacks have been "migrating", moving into and patronizing businesses in suburban commnities for decades. So what's different? The suburbs are feeling those affects moreso now during these hard economic times.

When they make rules that violate the US Constitution and the peoples' right to keep and BEAR arms, they are wrong.

If they make rules that violate the right to free speech, they are wrong.

If they think that cameras will protect people, they are wrong. The proper tool for protection is not a camera, it's a firearm. The proper tool to document a crime is a camera, if you can get the right angle. The camera won't prevent a crime, only a firearm in properly trained hands will.

Loud indoors, huh? -- you mighta had three dead Walgreens employees face down in the back room, done execution-style, police dusting for prints and scratching their heads...

Too many of these killings. Robbery busted up by discharge of one round, idiots wet their pants and fall all over themselves getting back out the door, no one injured, life goes on.

South side? Elmwood Park police and auxiliary officers constantly in the 24-hour Walgreens at North and Harlem. Don't like stopping there in that atmosphere. It's not the officers, it's the apparent need for them.

Time for random drug testing both for pharmacists and the new know-nothing, unqualified "aides." I have seen some really crazy people behind those counters; some of the old guys were the farthest gone -- raving, accusing, hands visibly shaking...
