Assailants' Estates Get Paid?
A federal jury awarded $1.35 million to the family of a man shot to death by an off-duty Chicago Police officer after a confrontation at a Northwest Side bar, an attorney for the family said Thursday.
Officer [...] fatally shot Kenneth Elrod and his friend Demetri Centera on April 7, 2006. Attorney Gregory Kulis represented the family of Elrod in a lawsuit against [...], the city and other officers.
Kulis said a jury awarded Elrod’s family $1.25 million in the shooting and $100,000 in connection with an allegation that another officer used excessive force on Elrod in a bar before the shooting.
Centera’s family dropped out of the lawsuit in 2008, records show.
In 2006, police said [...] helped break up a fight involving Elrod at Magic Touch Club, 5728 W. Belmont. Elrod was thrown out. Later, Elrod and Centera were in a pickup that pulled up to [...]’s Hummer at a stoplight at Belmont and Kilpatrick and pointed guns at [...], police said.
[...] told investigators he shot the men because he feared for his life. At the time, investigators found he followed guidelines for the use of deadly force. Two guns were recovered from the pickup, police said.
And the City is on the hook for $1.35 million?

The verdict was against the officers and the city. You should understand that even when you are off duty the judges and jurors will find as a matter of fact that you were acting in the course and scope of your employment. The federal judges will do everything in their power to ensure that any police shooting results in a verdict against the officers and the city. They will allow in any evidence to show that you violated some minor rule or regulation while keeping out of evidence the fact that the offender had prior convictions. The deck is stacked against law enforcement in federal court. The changes that need to be made are the fee shifting laws that reward attorneys for bringing these cases no matter how weak and the manner of appointment of judges. Most federal judges are anti law enforcement. If this same case had been tried in state court, the verdict would have been not guilty.
Chicago spent $85 million on judgements, settlements and outside litigation. Here's what that money could have provided for the city if Chicago wasn' known as "the city that settles".
I'm not a cop but I do think that another 1200 police officers and almost as many ff's would be a damned handy asset to have available right about now.
Hire 1,239 police officers;
Pay for 1,673 teachers;
Fund the Chicago Alternative Policing Strategy Program (C.A.P.S.) for 17 years;

Resurface 65 miles of Chicago roads;

Once again does anyone care about the officer involved in this. Once you become the police your whole world changes and no matter what you can no longer lead a normal life. I remember when I first started and my FTO asked me if I carry off duty. I was naive and said why I was 27 and never carried a gun before I came on the job and did OK. He let me know that that would change. I doubted it but learned quickly. If you do your job you start arresting thugs who have no regards for life. A few weeks after making one of these arrests while driving from the station where I left my gun in my locker who pulls up next to me with some hard looks. Thank God they did not know that I was not carrying because in their intoxicated and high state they may have taken the next step. Thank God nothing happened and now I carry all the time. My heart goes out for this officer whos life has been dragged through the mud but at least he is alive and only because he was carrying.

I think I will retire from the police department and join a gang. The city respects gang members more than the police and they also have more compasion for these gangsters. If I get arrested in my present capacity as a police officer I will most certainly go to jail and lose my job. The problem in this date and time is a lot of people see the police as the bad guy and gang bangers as the poor misguided person(s) who are down on their luck and trying to turn their lives around. The orders specify that if you know you're going to be drinking, you shouldn't be armed. Maybe the coppers pistol was in his car while he was in the bar or maybe, he wasn't drinking at the bar, just visiting. Or maybe... It was told to me about 30 years ago by a grizzled vet: first thing after a shooting, get an attorney. If someone assaults or batters you, sue them. Most will not fight it, so you get a default judgement. Then if they hit the ghetto lottery, it becomes your money.

The shooting happened several hours after the dead guy left the tavern. He summoned a friend and brought guns. They laid and waited, followed and stalked the copper. They pulled up next to him and upped pistols. He shot them both. I arrived shortly thereafter. 100 0/0 self defense.
