Privatization

  • The homeowners associations responsible for managing subdivisions across the state have the power to enforce their own traffic rules through a private security force, the Illinois Supreme Court ruled Friday, overturning a lower-court ruling that found they could be unlawful.

    Former DuPage County prosecutor Ken Poris sued LaSalle County's Lake Holiday Property Owners Association after he was pulled over for speeding in 2008 by a vehicle with flashing lights.

    A uniformed officer wearing a badge and duty belt took his driver's license and Lake Holiday membership card back to his squad car and wrote him a $50 speeding ticket. The man wasn't a police officer but a homeowners association employee with little police training and no state certification.

    Last year, an appeals court found that the association could not stop and detain drivers for violating homeowners association rules. The court found that Lake Holiday could be found liable for Poris' false imprisonment claim and that the association's use of amber-colored flashing lights on its squad cars was unlawful.

    But the Illinois Supreme Court on Friday reversed each of those findings, ruling that Lake Holiday was allowed to enforce its bylaws against residents and that courts "generally do not interfere with the internal affairs of a voluntary association."
We imagine Rahm would have to surrender control of city streets and allow fenced-in communities to pop up all over the place, but that would eliminate street repairs, garbage pick-up, a whole slew of union and City Hall jobs.

Of source, gated communities would have to have their own neighborhood watches and we all know what that leads to - Trayvon Martin versus George Zimmerman.

And what's the difference between a private association issuing tickets with a human officer and these Revenue Runts and their little machines or the private Red Light Cameras.

This has already been going on. If you haven't seen the Special Service Patrol in you district, trying to be the police, then I guess your a house mouse.
These asshole security guards think they are the police and respond to police jobs, via scanners, and act all official and shit. Fuck them.
Any copper that speaks with the, cooperates with them, and GOD FUCKING FORBID allows them to take part in their arrest, is a fucking idiot. Yes, that includes transporting in an arrest. Don't take for granted the powers you have as the police. You can't just detain somebody and send them in the station in some assholes car. Yes, this shit has happened and continues to happen. Let some hack do your job for you then ask for a raise and more new hires, you fucking idiots.


This could go on and on, but end of the day don't think a security guard is the police.

This decision is a bit of a head-scratcher. What's to stop these association employees from walking onto or entering your property in an effort to see if your garbage cans are too close to the street, or if you cleaned all of your grass clippings?

This is going to play out ugly. In the court case the plaintiff was an attorney who thought he could win in court. In the future the plaintiff is going to be some mutt displaced from a demolished project. That plaintiff already has a history of challenging uniformed real police. Rest assured he "knows his rights and lefts" and will not hesitate to physically challenge the Rent-a-cop. Once again the court have set the stage for what is sure to be many death scenarios.

This is commonly known as a "cluster fuck" If rham broke up the city for this purpose say MT. Greenwood, Beverley Uptown etc. each would have it's own enforcement rules and employe it's own police&fire dept's.as well as all city services. Wouldn't that mean Chicago would cease to be a city but a bunch of townships or private gated residences?This would eliminate himas mayor, and no aldercreatures? sounds good.

WOW-- Everyone reads to much into this. The CPD couldn't ticket for the most part on private property- shopping malls and such (very limited) and this allows them to "fine" people that LIVE there. A guest, they could do nothing against. The ticket would be a worthless piece of paper if you don't own there. It's an agreement within the association to pay these fines, or not put a certain color on the house or signs or a thousand other rules these associations have. Moral: Do NOT live in as Association, unless you want to live by the rules it sets. From Retired CPD in middle of nowhere.

When I was a young trainee for a van service that catered to northern Illinois and NW Indiana, there were two housing complexes that we were explicitly warned about driving into that had private security doing speed patrols around their complexes, Mission Hills in Northbrook (which uses Levy Security for their patrols) and Lakes of the Four Seasons, which crosses over the Lake/Porter County borders. I flat out told the trainer that I didn't care; I wasn't giving my drivers license to private security officers who asked for it; they are NOT police officers, and God only knows what they would do with the information (read: identity theft.)

I'm not a cop but I have friends and family who are, and I have lots of respect for police officers and the VERY hard job you do.

As I have stated before the goal of PROGRESSIVES is to discredit the POLICE department (not just in IL either)..and go around the system to hire OBAMA'S new militia..making the real police not relevant.. As for me I moved OUT of CHICAGO on my list of things I wanted the TOP one was NO HOME OWNERS ASSOCIATION .. many people are seeking homes in subdivisions WITHOUT them ... Is it just me or does anyone else see a problem with laws within laws../??

Hey why not? We already have guys who leave the job, never having done shit while they were actually employed,then become the "neighborhood cop" flying about solving all sorts of crimes. And then, now wait for it...then, they find a stolen toaster or similar item at a neighborhood flea market or garage sale, and want to lock up the seller for a major theft. But wait...theres more for all you at home viewers! Not content to have single handedly solved a major crime pattern of toaster stealers, our hero then gets himself press time for his achievement and in so doing giving our own guys a demerit.

These are the kinda guys we want patrolling our communities! Ex do nothings looking to get noticed by the new regime.

If some how there isn't one in your ghetto palace, then lucky you asshole. They are private security guards trying to take our jobs, and some police are making that much easier by working with them. Looks like it was just pointing out that these "security patrols" are everywhere, you might even see them off duty near your house. They are currently trying to institute this crap in Mt. Greenwood, a big tax for everyone, so some boot leg security guards can roam 111th st.. Since you sound like you need a pat on the back, Atta Boy for your hard work on the West Side!!

The private patrols are generally within a guard gated community. We have tons of them here in Las Vegas. Before you're allowed on property they take down your DL info and license plate along with the name and address of who you're there to visit. Then you're checked against a preapproved visitor's list for that address or they call the homeowner to grant you permission to enter.

If you get caught speeding, blowing stop signs, etc their security just logs your vehicle info and the HOMEOWNER gets fined for your violation. Since you're an invitee of the homeowner, they take responsibility for their guest's actions and the association will hold them responsible.

In those cases I don't want a friend to get a fine from their HOA for my behavior so I either avoid meeting them at home or behave myself when I go over there.

If a private security guard attempted to detain or stop me I would keep driving, gun in my lap and on the phone with 911 reporting a police impersonator attempting to falsely imprison me.

bunch of ass hats commenting on this issue all over the place. Its a private community. Criminally nothing can be done by the rent a cop if you chose not to stop. Bear in mind, if they get your plate and you are a member, they will know who you are and go after your membership benefits. If you don't live there then you are trespassing and subject to arrest when they call the "real" police. If you don't like the rules then stay out of the private community.

Thats how it is in Vegas in the gated communities. If a guest gets a ticket or parks illegally and gets a ticket and doesnt pay it, they charge the homeowner because when you pass thru the gate they get your information and the name of the person you are visiting. If you dont pay the ticket, they bill the homeowner and he is responsible. They add it to his monthly assessment and he pays. In extreme cases where the homeowner wont pay, they get a lien on the property for not paying the assessment. That is not a good thing because if you want to sell, the lien has to be taken off first. Can stop or at the least delay a deal and if anyone has dealt with removing a lien it os not easy and takes time

As police officers, we should always seek out all facts before making a judgement call. I don't beleive all those commenting know the facts. Everyone should read the court's decision and learn the facts before making stupid statements. This incident occurred of a privately owned road, not a public roadway, between an employee of the owner of the property and a member of the association who is obliged to comply with the association's rules and regulations.

The same people on here complaining about obeying a uniformed security guard hired by the homeowners association are the very ones saying Trayvon Martin should have stopped to answer Zimmerman's questions. Remember,you're not doing anything wrong. Stop your vehicle and answer the questions.

You must be state certified to have police powers.Anyone who detains someone and transports or issues citations is violating the law.you can have security people but to make a long story short they must call police in their juristriction when any contact is made.Correct me if I'm wrong but any municipality over 100,000 must maintain a regular police dept.
