UUW Charges?

  • A University of Illinois at Chicago staffer has been placed on administrative leave after she brought a legally purchased handgun to work because she didn't want to leave it at home while her house was being renovated, a UIC spokesman said.

    A judge set bail at $25,000 Wednesday for Kathleen Loviscek, 55, according to the Cook County sheriff's office. She is expected in court again on Feb. 19.

    Loviscek, of Westmont, was charged with unlawful use of a weapon, a felony, said UIC spokesman Bill Burton.

    “There was no apparent intent or threat,’’ Burton said. “It was never brandished nor was it loaded.’’
So a legally purchased weapon, cased and unloaded, is grounds for a felony charge now?

Follow the rules, be a good citizen, practice at the range and then put your stuff in a case in your trunk. Then you drop off your friends in Chicago and some asshole cops stop you and make a criminal out of you because you didn't realize that you were no longer in America, but in a dictatorship run by a strongman who violates the Constitution.

Anyone else get denied to sit with the panel writing the new police exam? They're looking for police to provide advise on questions to be asked on the exam. They came to roll call asking for volunteers, so I signed up. A few days later i received a letter stating I was not needed because I am "white"! They are only looking for minority input on the test. Their's got to be others. Can anyone scan the letter and post it?

The lady was charged with UUW because after a coworker entered her office to tell her that she could not have the gun in her office (on school grounds) she uncased the weapon, held it in her hand, and told her coworker she knew her rights and could carry the gun with her.

How did the coworker know she had the gun? She told several coworkers a week ago (before purchasing the gun) that she planned on buying a gun and brining it to work. She then told several coworkers when she actually brought it with her.

We need law enforcement officers (both Chicago Police and UIC Police) to start respecting and enforcing the Supreme Law of the Land, the 2nd Amendment, and STOP arresting good citizens for transporting UNLOADED, lawfully owned firearms when it is obvious that there is no criminal intent involved.

If I had encountered such a citizen, I would never have made that arrest, and if a supervisor gave me a direct order to make the arrest, I would refuse to be listed as an "arresting officer" of any kind on the report (the sergeant would be sole arresting), and I would have documented my professional opinion in the narrative that there was no probable cause to make an arrest.

WE as officers have the ability to determine if "probable cause" exists in a given situation.

JUST SAY "YES" to the 2nd Amendment, and REFUSE to enforce Illinois UUW statutes that have already been ruled as un-Constitutional.

INTERESTING ... last year we all got training on citizens' 1st Amendment rights, and we were all told that if we violate others' 1st Amendment rights, we will be left by the Department to hang out and dry. WHY doesn't the Department have the same training on the 2nd Amendment? Because we have a gun-hating Governor, Attorney General, Cook County State's Attorney, Mayor, City Council, and multiple members of the CPD Command Staff, that ALL DESPISE the 2nd Amendment gun rights that are guaranteed by the U.S. Constitution, and upheld by recent court rulings.

How the fuck is having an unloaded rifle in your trunk, provided you have a FOID card, illegal?

I'm serious. I have lot's of people ask me how to legally transport weapons and I've alwys told them as long as the weapon is unloaded and otherwise legal you can transport it in the trunk of your car. If it's an SUV you need to break it down or lock the mechanism open to render it inoperable but in the fucking trunk?

What's the actual law? I honestly don't know I guess?

Typical for the UIC Police. The department has been run into the ground by the political hack John Richardson and his cronies. Patrol has been gutted, there is no equipment, broken cars, hiring of friends kids who are an empty uniform, all the while granting the top brass raises and take home cars. The department has turned into a joke. There are Breeds running around ABLA with guns but those cops are told to turn a blind eye, but then turn around and arrest this woman.
From what I hear, the decision to arrest was COMMANDED by the Chief himself. Probably because she was white. After all, don't want to look like UIC Police harass only blacks.
You could probably make a whole blog like this for UIC Police, from all the stories I hear from my buds who are cops there. It's like a case study in cronyism and political corruption. Do a little digging, and you'll find that UIC and UC are two of the most fucked up police departments in the state, run by egotistical failures from CPD.

What in the hell is wrong with these police officers? A year ago a man who resided in a right to carry state approached me and said he wanted to bring his family to visit downtown Chicago for the weekend. He asked if he'd get in trouble if he carried his weapon. He was nervous because of all the ghetto wildings downtown. My response was that he has a right to protect his family. I told him if he's a law abiding, decent citizen, carry the weapon so he can be ready if shithead attacks him and his family. Some officers may disagree with me but I don't care. Decent people shouldn't have to be prey to the "honor students" who roam the streets. If I stopped someone with a weapon in their car who had no record, is from a right to carry state, who is a decent, law abiding citizen, I'm not locking them up. I don't blame good people for wanting protection in this shit city.

Some outside unit visiting 003 last week locked up a M/2 from Lindenhurst who was returning from the range with an unloaded and cased carbine in his trunk. The charge was MCC un-registerable firearm.

How is that possible? A person can't drive through Chicago if their guns aren't registered in Chicago?

There may be more to this story then we know, how did they know she had the gun with her? What is her mental state?

Most of us know many a civilian who carry a loaded gun as they work in some of the shit neighborhoods as long as they're decent folks with an FOID we turn a blind eye. If they have an out of state concealed card I figure at least they had a background check which makes them cleaner then the politicians running this asylum.

This is the problem with our department. We criticize the media daily and then assume they're 100% accurate when they talk about us.

In my experience the CCSAO denies anything that isn't a guaranteed conviction so there has to be more. If the gun was never brandished, how did UIC police or anyone else get involved?

WTF Great reporting of news. The lady had it unloaded and in a case. How in the hell did they get felony charges approved? Or did they?

We stop a shithead with a loaded gun in the car with the serial numbers filed off. Says he is a security guard and on his way home. Ask when did you get off he says 2000hrs. Its now 0230. We bring him in tried to get felony charges because the serial numbers were filed off. Guess what, ASA said no unless he says he admits he took numbers off, and it didn't matter he has X amount of time to get home from work. Being in possession of a weapon with the serial numbers filed off didn't matter I guess.

Whole city is backwards and county is worse. Cant wait to leave, only have 4 years left.

The news reporter was given bad information. The lady was charged with UUW because after a coworker entered her office to tell her that she could not have the gun in her office (on school grounds) she uncased the weapon, held it in her hand, and told her coworker she knew her rights and could carry the gun with her.

How did the coworker know she had the gun? She told several coworkers a week ago (before purchasing the gun) that she planned on buying a gun and brining it to work. She then told several coworkers when she actually brought it with her.

OK and compare those statements to what Pokie says when ou find that un-loaded or loaded Glock

What was his probable cause for the stop and search of the mans vehicle? As we all know unless they are going thru a red light or stop sign which are only traffic violations and NO cause for a search of the vehicle. What DWB, DWM, was he a gang banger, I can see this Officer paying heavy punitive damages for his actions. Hope you documented your actions and cause because I been to federal court and the city's attorneys are finest and cheapest they can find to defend you, and when and I mean when they settle with out telling you officer you are still liable for punitive damages out of your pocket and the FOP will NOT represent you as you were on duty and covered by corporation council!

This trend has gone on for a very long time. They want to "socially engineer a specific end result". If a white or Asian is caught in legal trouble and if felony charges are applicable then 100% of the time they are going to charge that person with a felony. The reason is they want to throw those to under represented groups into the criminal justice system so the statistical data is more equal. You gotta love liberalism; if you don't like the current results then socially engineer the end result to your liking. Equality rocks!

The problem is that there are higher laws which supersede MCC charges. One of them being the Costitution. Another being your personal honor. You dont jam up a good person on a MCC gun charge because that violates both.

I love it when police officers trash another police department without knowing the entire story. The UIC arrest was legit, lady brought the gun to a state school brandished it, after being told not to by her coworkers.

UIC police department are all full time, not part-time off duty Chicago, that was U of C, but they also got rid of all Chicago Police part timers and command.
The only problem with UIC Police Department is our idiot command staff who are all retired Chicago Police and we are also in the process of getting rid of them.

This blog does nothing but talk a ton of crap about the poor quality of CPD and CPD bosses, doesn't say much about the system you guys come from and when every other department in and around the city are trying to get rid of CPD retired bosses, you shouldn't throw rocks in a glass house.

It's unfortunate because over the years I've worked with some great CPD coppers, which make me think if I was a criminal I would not want them on my case, but I don't know what happens after they get promoted.

Yes, you misunderstood my entry. No individual UIC officers EVER gave CPD a hard time about carrying a weapon while a student. The threat came from you chief and this was a few years ago before your chief was a retired chicago guy. I have never heard of this being enforced. I have always gotten along great with UIC officers and they are professionals in every sense of the word.Pardon me if I was misunderstood. This case will get tossed out but the inconvenience and cost to the person arrested will still be there. There was an Illinois Supreme court ruling some years ago that a person who is not a resident of Chicago and who is passing through or in the case of a non resident private detective or security officer, cannot be required to register their weapons in the city. That law applies only to residents.The dummy cops did not know the law and the dummy watch commander who approved the charges also did not know the law.

The 016 PO who arrested the man returning from the range would make a killing at Ohare. Many passengers are traveling with checked firearms for hunting and competition purposes. (assuming that he didnt know about travel exemptions) How easy is it to get his firearm returned to him? We will find out.

Secondly, any person who knowingly brings a firearm on state property and inside a university building is an idiot. Dont they watch the news? Virginia Tech?

Agreed. Lots of armchair quarterbacking join going on. Just like all the medical opinions about P.O's on the medical/IOD. I.E. "that guy's just milking it". Sure seems to be plenty of doctors on the CPD. All willing to share their medical opinions.

I expect that the arresting officer(s) will be actually questioned, as to the reason(s) for their actions in this case, by the arrestee's attorney(s).

And, as I recall the law wants you to go direct from the range to your home with the weapon cased and unloaded. It does not have to be in the trunk, but you cannot drive around all day with the weapon.

and what truly is an act that, Constitutionally speaking, qualifies as being an 'unlawful use of'?

because it appears that some commenters consider the Constitutionality of any law to be irrelevant to the enforcement of same.

which, if given even a minimum of thought, is not the actual duty of sworn law enforcement officers.

just because the criminal justice system here has been turned into a travesty by the political beast called the illinois democratic party, doesn't mean that those sworn to uphold the Constitution should act as lackeys of the beast.
