UUW Charges?

  • A University of Illinois at Chicago staffer has been placed on administrative leave after she brought a legally purchased handgun to work because she didn't want to leave it at home while her house was being renovated, a UIC spokesman said.

A judge set bail at $25,000 Wednesday for Kathleen Loviscek, 55, according to the Cook County sheriff's office. She is expected in court again on Feb. 19.

Loviscek, of Westmont, was charged with unlawful use of a weapon, a felony, said UIC spokesman Bill Burton.

“There was no apparent intent or threat,’’ Burton said. “It was never brandished nor was it loaded.’’
So a legally purchased weapon, cased and unloaded, is grounds for a felony charge now?

And this popped up in the comment section:
  •  016th District warrior locked up a guy after returning from gun range for having an unloaded carbine in his trunk. Legal, but not in Chicago. Way to go, soldiers of Rahm.
Unloaded and inaccessible to the driver - another UUW charge? Not to mention a seeming violation of at least one Constitutional Amendment.

CrimeFile covers the UIC incident over at his blog. We'll entertain a civil discourse over here.

For believers of the Second Amendment, why would you lock up a law-abiding citizen with an unloaded gun? did they actually get felony approval? And the admission ??

That's thirsty for a pinch.

Hopefully some national organization with the resources will take this to the SCOTUS, and they rule against the arrest.

In a city where the dictator in charge can tear up a runway in the middle of the night and risk the lives of any pilot coming in to land, where a handgun ban clearly violating the Second Amendment stood for a quarter of a century, and where a citizen can follow the laws of the state and get arrested and have his property stolen by the city, the people have a RIGHT to revolt.

Let's see here. The British came to the colonies and wanted to take the guns from Americans, kick in their doors to go through their private property and tax the citizens unfairly. Those Americans revolted at the risk of everything they owned and their own lives.

In Chicago, the midget mayors steal, lie, ban guns in violation of the Constitution, tax the citizens into the poor house, send their goons out to arrest innocent Americans exercising their Constitutional rights and...the citizens re-elect them.

The news reporter was given bad information. The lady was charged with UUW because after a coworker entered her office to tell her that she could not have the gun in her office (on school grounds) she uncased the weapon, held it in her hand, and told her coworker she knew her rights and could carry the gun with her.

How did the coworker know she had the gun? She told several coworkers a week ago (before purchasing the gun) that she planned on buying a gun and brining it to work. She then told several coworkers when she actually brought it with her.

The first thing they'll do is get the guns away from the cops. They'll tell you that you can't carry except at work. We need law enforcement officers (both Chicago Police and UIC Police) to start respecting and enforcing the Supreme Law of the Land, the 2nd Amendment, and STOP arresting good citizens for transporting UNLOADED, lawfully owned firearms when it is obvious that there is no criminal intent involved.

If I had encountered such a citizen, I would never have made that arrest, and if a supervisor gave me a direct order to make the arrest, I would refuse to be listed as an "arresting officer" of any kind on the report (the sergeant would be sole arresting), and I would have documented my professional opinion in the narrative that there was no probable cause to make an arrest.

WE as officers have the ability to determine if "probable cause" exists in a given situation.

JUST SAY "YES" to the 2nd Amendment, and REFUSE to enforce Illinois UUW statutes that have already been ruled as un-Constitutional.

INTERESTING ... last year we all got training on citizens' 1st Amendment rights, and we were all told that if we violate others' 1st Amendment rights, we will be left by the Department to hang out and dry. WHY doesn't the Department have the same training on the 2nd Amendment? Because we have a gun-hating Governor, Attorney General, Cook County State's Attorney, Mayor, City Council, and multiple members of the CPD Command Staff, that ALL DESPISE the 2nd Amendment gun rights that are guaranteed by the U.S. Constitution, and upheld by recent court rulings.

So according to Feinstein, Bloomberg, and the others who want destroy America, (and exempt themselves from the law they legislate). Guns are "bad" and for the children (of course its always about the children) we must give up our guaranteed right to bear arms. Do these people think that carry laws means every shitbird will suddenly legally buy a gun$$$, with a valid FOID and purchase a carry permit$$$, pay for classes$$$, then pass the classes, simply to rob one 711? OR will the criminal continue his predictable nature of burglarizing homes untill he finds a gun to do the same crime. HMMM lets think about this, power junkies. The violent criminal, intending on committing a violent crime will very very likely commit lesser crimes to reach his goal. Normal people dont do this. Normal people have that silly thing instilled by Christianity, family structure, responsibility, called a CONSCIENCE! Power junkies, do you find it coincidental that the programs that YOU create, destroy religion, family structure, and responsibility? When those are gone, no conscience = thoughtless crime. You created these monsters, and now its convenient to blame the gun, not only because it gives you just that much more power, it also paints gun owners as those ignorant ones who "cling to guns and religion". And why do you exempt yourself from the very gun bans you create? Is that for the children too?

Typical for the UIC Police. The department has been run into the ground by the political hack John Richardson and his cronies. Patrol has been gutted, there is no equipment, broken cars, hiring of friends kids who are an empty uniform, all the while granting the top brass raises and take home cars. The department has turned into a joke. There are Breeds running around ABLA with guns but those cops are told to turn a blind eye, but then turn around and arrest this woman.
From what I hear, the decision to arrest was COMMANDED by the Chief himself. Probably because she was white. After all, don't want to look like UIC Police harass only blacks.
You could probably make a whole blog like this for UIC Police, from all the stories I hear from my buds who are cops there. It's like a case study in cronyism and political corruption. Do a little digging, and you'll find that UIC and UC are two of the most fucked up police departments in the state, run by egotistical failures from CPD.

What in the hell is wrong with these police officers? A year ago a man who resided in a right to carry state approached me and said he wanted to bring his family to visit downtown Chicago for the weekend. He asked if he'd get in trouble if he carried his weapon. He was nervous because of all the ghetto wildings downtown. My response was that he has a right to protect his family. I told him if he's a law abiding, decent citizen, carry the weapon so he can be ready if shithead attacks him and his family. Some officers may disagree with me but I don't care. Decent people shouldn't have to be prey to the "honor students" who roam the streets. If I stopped someone with a weapon in their car who had no record, is from a right to carry state, who is a decent, law abiding citizen, I'm not locking them up. This is the problem with our department. We criticize the media daily and then assume they're 100% accurate when they talk about us.

In my experience the CCSAO denies anything that isn't a guaranteed conviction so there has to be more. If the gun was never brandished, how did UIC police or anyone else get involved?

I want to see where this one goes.

Did you guys read the whole story. The media was spreading rumors that the lady barricaded herself in an office or part of the building and there was a standoff with the police. WTF Great reporting of news. The lady had it unloaded and in a case. How in the hell did they get felony charges approved? Or did they?

We stop a shithead with a loaded gun in the car with the serial numbers filed off. Says he is a security guard and on his way home. Ask when did you get off he says 2000hrs. Its now 0230. We bring him in tried to get felony charges because the serial numbers were filed off. Guess what, ASA said no unless he says he admits he took numbers off, and it didn't matter he has X amount of time to get home from work. Being in possession of a weapon with the serial numbers filed off didn't matter I guess.

Whole city is backwards and county is worse. Cant wait to leave, only have 4 years left.

1st ammendment infringes on gang enforcement if you are pos.

so the city dumped gang crimes, intel, disbanded, and stop and frisk laws. further warning pos NOT to infringe with gang rights to assemble, even on corners, parks, etc. HAnds off. The 1st ammendment GO. is near a quarter of an inch thick.

thus gangs flourish and killings soar.

2nd ammendment is an easier target.
that's the one the city chooses to violate because the guns can't talk.
Ironically the guns can't shoot themselves either.

go figure.

This trend has gone on for a very long time. They want to "socially engineer a specific end result". If a white or Asian is caught in legal trouble and if felony charges are applicable then 100% of the time they are going to charge that person with a felony. The reason is they want to throw those to under represented groups into the criminal justice system so the statistical data is more equal. You gotta love liberalism; if you don't like the current results then socially engineer the end result to your liking. Equality rocks!

If there was a gun range in the city limits and I was legally transporting my weapon (in a locked case, with trigger lock) unloaded, I'd still feel like I'd be harassed for deviating from the path from range to the home. I love it when police officers trash another police department without knowing the entire story. The UIC arrest was legit, lady brought the gun to a state school brandished it, after being told not to by her coworkers.

UIC police department are all full time, not part-time off duty Chicago, that was U of C, but they also got rid of all Chicago Police part timers and command.
The only problem with UIC Police Department is our idiot command staff who are all retired Chicago Police and we are also in the process of getting rid of them.

This blog does nothing but talk a ton of crap about the poor quality of CPD and CPD bosses, doesn't say much about the system you guys come from and when every other department in and around the city are trying to get rid of CPD retired bosses, you shouldn't throw rocks in a glass house.

Yeah that's exactly what I meant moron. Listen dipshit, if she went to work with an unloaded , legally purchased handgun, because she couldn't leave it at home that day..and the police were called. Then there should be some discretion given and therefore no arrest. But let me ask you Detective? Why were the Police called? Was she showing it to co-workers? Not explaining it was unloaded? Did the people who maybe saw it and called Police know it was legally purchased, and why she brought it to work? Doesn't sound like responsible gun ownership to me? If the Police were called then don't ya think there was a reason? Otherwise the gun would of stayed in her fuckin purse or desk drawer and no one would have even known she had it. All I'm saying is the public assumes we go out and lock people up for no reason, maybe the benefit of the doubt is due to the coppers? Cause I doubt they thought...hmmm let me lock up a cancer researcher and get a gun pinch while violating her 2nd amendment right, yea i wont catch shit for this and get laughed out of court. re: 2/17/2013 02:13:00 AM

1. a) "Why were the Police called?"

because some person, or persons, being convinced that guns are 'dangerous' and that their own 'fears' are always the most important decision making factor, as well as that obeying the 'rules' of the employer are always much more important than exercising and enjoying our God Given, and Constitutionally affirmed, Rights, decided it was their 'duty' to cry wolf.

b) "Was she showing it to co-workers?"

if she was, she committed a practical error in trusting a person, or persons, who were unworthy of that trust. and, if she was, was there anything, beyond misjudging the trustworthiness of the unworthy, that you deem wrong?

c) "Not explaining it was unloaded?"

loaded or unloaded is irrelevant. those who chose to act based on their righteous sense of 'fear' will react the same either way. this same reaction would be expected if you, in plain clothes, were to expose your weapon to the view of their scared little eyeballs.

d) "Did the people who maybe saw it and called Police know it was legally purchased, and why she brought it to work?"

again, it wouldn't matter to them, as they live in a world where their fears rule their actions.

e) "Doesn't sound like responsible gun ownership to me?"

it sounds exactly like responsible gun ownership, if you haven't swallowed, hook, line and sinker, the full belief in your right to fear anything and act on your fear. or, rather, have someone else act on your fear as you want them to, ie. 'arrest that person, she scares me!'

2. "...the gun would of stayed in her fuckin purse or desk drawer and no one would have even known she had it."

a sound piece of short term practical advice, given the reality of our current rabbit infested environment. however, unless you are satisfied living amongst rabbits, who, as you may know, multiple exponentially, if not inhibited by predators, hiding the enjoyment of your God Given Rights from the sight of all these poor, scared little rabbits only increases their false confidence in their glorious rabbit natures.

3. "All I'm saying is the public assumes we go out and lock people up for no reason, maybe the benefit of the doubt is due to the coppers?"

not true. only the imposition of unconstitutional, and thus invalid, 'laws' give the public the impression of which you speak. as far as the arresting officer(s) are concerned, they were 'just following orders', right? (actung....)

4. "Cause I doubt they thought...hmmm let me lock up a cancer researcher and get a gun pinch while violating her 2nd amendment right, yea i wont catch shit for this and get laughed out of court. But hey continue to point your finger, hopefully nobody ever misreads into what you did."

no need for me to point a finger, you did a fine job doing that yourself.

our God Given Rights, affirmed in our Constitution, are inviolate.

as long as we allow the scared rabbits amongst us to continue to loudly cry wolf, as if their fear trumps our God Given Rights, we will continue to submit ourselves to the consequences of their rabbit madness.

if you haven't guessed by now, i am that consequence.

This case will get tossed out but the inconvenience and cost to the person arrested will still be there. There was an Illinois Supreme court ruling some years ago that a person who is not a resident of Chicago and who is passing through or in the case of a non resident private detective or security officer, cannot be required to register their weapons in the city. That law applies only to residents. The dummy cops did not know the law and the dummy watch commander who approved the charges also did not know the law.

The 016 PO who arrested the man returning from the range would make a killing at Ohare. Many passengers are traveling with checked firearms for hunting and competition purposes. (assuming that he didnt know about travel exemptions) How easy is it to get his firearm returned to him? We will find out.

Secondly, any person who knowingly brings a firearm on state property and inside a university building is an idiot. Dont they watch the news? Virginia Tech?

Lastly, even if its unloaded, we all know that felons have their lacky hold on to the ammo and keep it separate from the gun they stash until they are about to whack someone. That way they can always say "what gun?" "I never no way shoot no one. No bullets."

Why is a m/2 from Lindenhurst passing through 003 after leaving range?

2/17/2013 09:18:00 PM

i don't know, comrade, as, until that male, white, actually commits a true criminal act, witnessed by myself, or another reliable pair of eyes, and confesses to same, with full disclosure as to his motive(s), his 'passing through' a geographical area traditionally occupied by, presumably, mostly male and female black skinned men, women and children, is none of my business.

perhaps when our glorious leaders mandate that we all wear audio/video monitoring devices bolted to either our foreheads or our temples, with a direct cable connection, capable of reading, and recording, our very thoughts, inserted into the base of our skulls, you will then be privy to the answer(s) to your query.

until that time, Eustis, until that time......

I don't know. Maybe because it's a free country, or used to be, and you can't have the gestapo stop him for no reason, ask for his papers and take his property and liberty from him? Wake the fuck up, stooge. It's no one's fucking business what he's doing. He's a free man in a free country. He can go where he wants to.

"Be very afraid, people; Rahm is about to realize he can never have the White House..."

2/15/2013 04:40:00 AM

This was on TV last night, "if Hilary (!) ran she would beat Rahm, and Rahm isn't loyal to many but he's loyal to the Clintons."

"...so Rahm will set his sights on 'mayor for life'."

Maybe he will run for Governor which is really scary.

If you don't know then don't question the arresting officers.

Agreed. Lots of armchair quarterbacking join going on. Just like all the medical opinions about P.O's on the medical/IOD. I.E. "that guy's just milking it". Sure seems to be plenty of doctors on the CPD. All willing to share their medical opinions.

Thanks for the reference from Soldier in the Rain.

Here's another by Steve McQueen- "You never had a dog".

The question posed by 2/17/2013 09:18:00 PM was:

'Why is a m/2 from Lindenhurst passing through 003 after leaving range?'

My response to the question posed was:

'i don't know, comrade, as, until that male, white, actually commits a true criminal act, witnessed by myself, or another reliable pair of eyes, and confesses to same, with full disclosure as to his motive(s), his 'passing through' a geographical area traditionally occupied by, presumably, mostly male and female black skinned men, women and children, is none of my business.

I expect that the arresting officer(s) will be actually questioned, as to the reason(s) for their actions in this case, by the arrestee's attorney(s).

until that time.....

And, as I recall the law wants you to go direct from the range to your home with the weapon cased and unloaded. It does not have to be in the trunk, but you cannot drive around all day with the weapon.

hmmmmm, 'so much deference'?

do you mean to say that UUW arrests do not require much more than minimal 'deference'?

and what truly is an act that, Constitutionally speaking, qualifies as being an 'unlawful use of'?

because it appears that some commenters consider the Constitutionality of any law to be irrelevant to the enforcement of same.

which, if given even a minimum of thought, is not the actual duty of sworn law enforcement officers.

just because the criminal justice system here has been turned into a travesty by the political beast called the illinois democratic party, doesn't mean that those sworn to uphold the Constitution should act as lackeys of the beast.

You said absolutely nothing. The legislature of this state writes legislation and sends that bill to the governor for his signature. Once the governor signs that bill it becomes law. Is George Ryan a democrat? How about Jim Edgar,or James Thompson? The next traffic or street stop you conduct in the "ghetto", you just make sure you don't violate their constitutional rights!

you understood absolutely nothing, other than what you wanted to 'understand', which was practically nothing.

typical ghetto logic.
