Statute of Limitations?

Isn't there a deadline for a reason?
  • Two Chicago police officers are being sued more than seven years after a car they were pursuing crashed into a brick wall, killing a 19-year-old man.

    The family of Luis Vazquez said Officers [...] “wantonly and recklessly” contributed to Vazquez’s death by speeding excessively, failing to discontinue their pursuit of the vehicle, and failing to use their Mars lights among other claims in the lawsuit, which was filed Tuesday in Cook County Circuit Court.
Seven years? What a joke.

For failure to stop? And the police shouldn't persue? How about mounting a laws rocket on the light bar slaved to a laser that's lockable on target. How about Anita filing suit against the two that begat this mistake and let him loose on the public?

The owner of the wall, this piece of shit struck, should sue the family for the damage and for letting this piece of shit get behind the wheel of the car in the first place. Chances are the family knew this piece of shit was a danger to the community. This piece of shit did the world a favor the moment he struck the wall and ceased to live.

Too bad cook county is again immune from US Supreme Court case law which has wrote an opinion: that fleeing from the police in a vehicle is considered a dangerous & violent crime with the bearing laying solely upon the driver of the fleeing vehicle due to avoiding capture. I bet corp council won't even cite Sykes vs United States.

There are exceptions to the seven year limitation. For example, a lady on The People's Court had an expensive watch cleaned at a shop, when she had the watch appraised approx seven or eight years later, she was told the watch was a fake.she sued and won even though the statute of limitations had run out, because she did not become aware that a fake had been substituted for her watch until seven or eight years later. She then had six years to sue, which she did and won. This is why lawyers are hated, they know this and refuse to file suits (not against the police) and lie its too late to recoup your losses.

Hopefully corporation counsel won't have to cite anything except the statute of limitations. Unless I'm missing something, this thing should be tossed out- statute of limitations for state law claims is 1 year and federal law claims is 2 years.

Relax, it will be dismissed. For the officers being sued contact an attorney and sue the attorney who filed the lawsuit. It is an easy winner all day. Also have your attorney file a complaint with ARDC, it won't go away.

7?!! Thats nothing, some co-workers and I were sued 14 years after the alleged incident AND were found liable!! The blind mice on the so-called jury even handed out Punitive damages. It makes me sick to talk about it...

Call Dick Durbin's office & ask him to sponsor legislation for a "Brick Wall Ban" that would limit all walls to a certain density and thickness. All existing brick walls would be retrofitted with mattresses and all new construction would have to consist of Government approved foam rubber.

read the "Scott vs. Harris" case that was decided by the US Supreme court. Tha oficers in-car camera save him and the kid who crashed and became a quad lost his case. No 4th admendent was violated.

Definitely worth following this one. I've heard there's a two year (?) statute on commencing a civil suit against a government entity. Not sure about the individual officers in a civil case. I DO know that the statute of limitations against a government official in CRIMINAL matters is tolled by their employment. IOW, you're fair game until 3 yrs out of the job. Watch yourselves.

Its not that easy, if the lawsuit was filed too late, the judge will dismiss the lawsuit. Thats all that will happen. The officers have no lawsuit as they have no loss and dont waste your time on my character, deflamation, what will my co workers think of me, you have no damages or monitary loss

Why would you even bother chasing anyone unless it's something serious against the police? Hot car, victim usually doesn't want to press charges. Agg bat, see last comment. Traffic, gimme a break. Homicide, he will get picked soon enough. There's not really a reason unless you are to young enough to know. Be safe.
