Sanctuary!!!!

  • Ten people — including two Daley family friends and some Chicago police officers — were granted immunity from prosecution after they initially refused to testify before the grand jury investigating the death of David Koschman, which led to a manslaughter charge against former Mayor Richard M. Daley’s nephew, the Chicago Sun-Times has learned.

    The two Daley family friends — Kevin McCarthy and his wife Bridget Higgins McCarthy — were with Daley nephew Richard J. “R.J.” Vanecko at the time he allegedly punched Koschman during a drunken confrontation on April 25, 2004, at Division and Dearborn.

    Vanecko and another companion, Craig Denham, took off in a cab. The police stopped and questioned the McCarthys, who at first denied knowing the two men who fled as Koschman lay in the street with brain injuries.

    Kevin McCarthy repeated that story when detectives showed up at his home a few hours later. His wife eventually identified Vanecko to detectives during an interview on May 13, 2004 — a week after Koschman died.

    Bridget McCarthy, 35, is the daughter of developer Jack Higgins, a longtime friend of the mayor who was chosen to build the city’s police headquarters. He recently was picked by the Illinois Medical District to redevelop part of its West Side campus.

    The McCarthys and an unknown number of police officers testified before the grand jury with a grant of immunity from prosecution after first invoking their Fifth Amendment right against self-incrimination, the Sun-Times has learned.
So could someone explain why anyone needed to invoke the Fifth Amendment and receive a grant of immunity from prosecution if this was just a pair of drunks fighting and the investigation was completely on the up-and-up with absolutely no influence or late night phone calls from high ranking bosses and Shortshanks' people?

Just because we take the fifth it shouldn't assume any guilt. The case is over nine years old. The statute of limitations has has run out. Testifying before a grand jury in a heater case opens you up to perjury or anything the state feels like charging you with. Talking from experience. Use your rights.

Dan Webb was a scumbag when he prosecuted the Marquette 10 and other officers just to make a name for himself. He destroyed families mentally and financially. He along with big Jim Thompson have a special place in hell waiting for them.

That said, Webb has turned the screws tight on Vanecko and his defense team. Its a smart move and you can see the beads of sweat dribbling down that cro-mag forehead of vaneckos.

Sure, be more than happy to share, to wit:

--- In a normal world, aka a jurisdiction not run by The Combine / Daley Machine where the fix is in because *you know somebody* their initial statements to the police would fall under; Hindering A Prosecution. And/or Obstruction of Justice, which last I checked are both are Felonies punishable by Fine & Imprisonment. Not to mention the teeny fact that a Death due to homicide is involved (as now charged) and there's that 'Accessory After The Fact - Aiding and Abetting' and/or possibly on the extreme end since they were involved, Felony Homicide. ---

EVERY police officer would seek immunity in order to testify-including you.

Every word of testimony by the investigators is going to be analyzed and twisted by the prosecutors office, family lawyers and media

Why???? Because prosecutors have made no secret of future charges against officers and you can be damn sure the family already has the lawsuit typed and signed as soon as this trial is over.

Was there an IAD investigation corresponding to invoking the 5th before a Grand Jury? I cannot conceive of an officer taking the 5th in a job related investigation and not being sent to Call Back. Unless that Detective was Wired and Clout Heavy. Are these guys still working for the State's Attorney?

If the statute of limitations has expired the case is done. If you tell the truth under oath you won't commit perjury. A person died by the hand of a human being(homicide),now the investigation will determine if criminal charges are warranted. The groundwork is being laid so only one person will be held accountable: Vanecko. If this was in the ghetto everyone on scene would have been locked up and charged;sitting at the County.

Even if one is completely innocent it is always smart when dealing with police in this kind of situation to lawyer up and say as little as possible. I do not blame them one bit. You are far more likely to get involved in a bad situation if you talk than if you say nothing.

Given the politically charged situation, I do not blame their lawyers for asking and getting immunity. It just means their lawyers are smart enough to do what it takes to protect their clients. Good for them. that is what lawyers are supposed to be doing.

If that's true, why would a cover up even be necessary? The fact that there was a cover up, along with immunity proffered for testimony from police officers, and invocation of 5th Amendment rights by the same, all indicate something is rotten in Denmark (or in this case, Daleymark). Hopefully the Chicago Tribune will do an in-depth investigation with regards to this case, so the public can get a better understanding of how the criminal justice system in Cook County works, or rather, doesn't work.

I have no problem with officers afforded their rights in their entirety according to due process.

I hope this also means a precedent can be cited when good officers look for the same protections AND will also not fear losing their jobs afterward if one day you or I need the same arrangement, or want to plead the fifth when it suits us for the sake of using our own discretion for whatever reason even if it gives the impression we're impeding an investigation or stalling prosecution...

This job is fucking great for those who are connected. It is conplete bullshit that officers with a decent amount of time can't fucking move around. Reverand McCarthy fucked up every level of this organization, cauing added resentment, stress, and anger among the troops. I used to take pride in my activity, now I feel guilty bringing in activity for a department and a chicago machine tgat continually is trying to take from us........I a mm proud of my work in one of the most dangerous areas in the city. 9 years. No statute on murder; there is a statute of limitations on civil suits. Any lawyers know what that would be in this case?

Any police officers that had to take the Fifth in a criminal investigation should be fired. There can be no excuse. The Fifth protects you from self INCRIMINATION. That last word says everything.

Taking the protection of the 5th Amendment protecting you from self incrimination is not in and of itself, incriminating, although many or most members of law enforcement see it that way in much the same way as someone who invokes their right to speak to a lawyer is looked upon as guilty.

I am a retired PO now but I would never sit for questioning without a lawyer, no matter what. I advise family members of the same thing. Get the advice and protection of a lawyer if forced to go in for questioning, whether innocent or guilty. It is a right, exercise that right.

Same with talking to Federal Agents, FBI etc. Invoke your right to a lawyer, cop or civilian, innocent or not.

Testifying before a grand jury in a heater case opens you up to perjury or anything the state feels like charging you with. Talking from experience. Use your rights.

You have to remember the Color of Law being another valid reason for officers needing immunity. For example - If a supervisor ordered a detective to do something unlawful, and the detective complied with that order knowing what he/she was doing was unlawful, and years later tells that story to a prosecutor, that detective could be charged under Color of Law.

I, too, would consult a lawyer if accused of a crime. I would also invoke the 5th if they were asking me a question and the answer would INCRIMINATE me.

The 5th protects a citizen from self incrimination. Thus the belief that you have something to hide (something CRIMINAL) if you invoke it.

Some years ago there was a department rule that you could not take the 5th when called to testify. Officers were fired when they did so. The federal courts struck down this rule. I do recall one police lieutenant who was called before the federal grand jury and did not take the 5th, but testified that he could not recall. He was indicted for perjury and sent to prison for 3 years. If there was a coverup in this case it could also extend the statue of limitations for a civil matter. This is far from over.

Statute of limitations for a wrongful death action, in most cases, is two years. Up to a judge if this can be extended here. Even if a judge allowed it, it would be certain to be appealed.

Don't see how any extension would apply. Mother knew the son was killed. What excuse was there for the delay in filing a civil action? I think mom is out of luck there.

The various parties invoking their 5th Amendment rights aren't accused of homicide. Lying, impeding a police investigation, official misconduct, whatever. You know; things that HAVE a statute of limitations.

One of the problems I see is that the new medical facility will definitely be built with a decided tilt in one direction or another, just like 3510's substandard construction.

Of COURSE the City rewards a substandard job on HQ with yet another huge construction contract.
