Beat Up the Geezers

  • The state's lawmakers had passed a pension bill for all of about ten minutes—socking it to little old retirees from Cairo to Waukegan—when Mayor Emanuel issued a statement to the press.

    "The pension crisis is not truly solved until relief is brought to Chicago and all of the other local governments across our state that are standing on the brink of a fiscal cliff because of our pension liabilities," the mayor said in his statement released yesterday.

    Translation: Let's beat up some geezers!

    The geezers in question are Chicago's retired public school teachers and most likely its retired firefighters and cops, whose pensions are in debt largely because our last mayor—a man named Daley—didn't fund them adequately.

    Instead, Mayor Daley took the money that was supposed to go to the pensions and spent it on other things. For which everyone in our larger civic community, Rahm Emanuel included, hailed him as a fiduciary wizard who deserved to be reelected.

    Now these same people are saying, Sorry, seniors, but you're going to have to pay the price.

    Because messing with geezers is what passes for reform in our great city.
The entire article is a take-down of Rahm's supposed accomplishments that are actually Rahm directing millions to his friends instead of Daley's friends.

He closes with a call to action:
  • Just in case, my advice to the police and the firefighters is to counterpunch.

    For instance, I'd like to see a big demonstration of cops and firefighters at the corner of Michigan and Cermak>, where the mayor's gearing up to waste at least $92 million in TIF dollars on a basketball arena for DePaul and a hotel for Marriott.

    C'mon, fellers: if the teachers can fight back, so can you.
We would - if we had leaders ourselves. But we don't seem to at the moment.

even a round the clock silent vigil til we get this resolved fairly would make international news.

We get a sign up going to schedule turns like for a sick friend on his death bed awaiting a miraculous recovery to keep even just a small amount of coppers, firefighters, our family and friends and anybody who wants to stand (or sit-in)with us always keeping a small torch burning to call attention to the thousands of lives (and votes) at stake.

I bet the small crowd at times at all hours would see a swell, catching on til we're uncomfortably persistent to not go away...even if there's not a huge demonstration. No yelling, no marching, no big rally or speeches...just persistence, determination, and silence. But we don't move and we don't go away til our pension and our contract and the manpower issue is brought to light.
We respectfully state our case for each when asked.

When I read the title of this thread I first thought it was about FOP. From Steve Robbins to the entrenched members of FOP executive board which have had a anti retiree bias for about 10 years now. There was a motion this week to allow retirees who have let their membership lapse for some reason to rejoin. They would have had a 90 day grace period to rejoin. That motion was passed on so in effect they could not vote in the upcoming election. The Park District retirees just got a royal screwing from Rahm because they do not get to vote in their elections.

For you younger guys retirees are not a threat to you. They would be allowed to vote in elections but not on contracts. So you younger guys are and always be in control of your own destiny. What they are is a asset in that many of them can get on a bus and go to Springfield or City Hall to picket without worrying about retribution.

Would someone who was at the Board of Directors meeting Tuesday please post the names of the officers who voted to keep retirees out of their limited roll as members of FOP?

2. once the tax increase is in place and as long as the taxpayers are not in the streets with pitchforks and torches then you can disregard the pension contracts and steal that pension money too by wiping out the commitment on that pension debt

3. after cheating the evil pensions and while everyone has become accustomed to the sixty-six percent temporary tax increase who's primary purpose was to fix the pensions in the first place but was spent everywhere else instead....well why not just make that temporary tax increase a permanent tax increase instead. there's no longer a pension crisis and you can enrich all your campaign donating friends with private/public partnership deals.

it's everyman for themselves. public servants my ass.

if you can't trust the powers to honor their commitments and contracts why would anyone let the same people act as controlling custodians of what is in the pension accounts today.

they can't be trusted.

how about demanding one-hundred percent payout and then transfer that money to one of the game changing crypto currencies, bitcoin for example,

look, since 2000 in spite of the dept. of labor lies cost of living has gone up about 39 percent. who's wages have risen by that amount.

how ya think that pension is gonna look 10..15..20 years out. inflation is gonna put us in poverty.

look around.. is education cost only rising three percent a year. how about health care is that rising only three percent a year..energy and what about that sixty-six percent state income tax increase. no, that's not in the cola cpi calc.

According to the people at Nationwide, your deferred account is an account between you and them, the city has no part of it. Once that money is deposited, it's the same as being sent to your bank, means the city has no legal claim to it. Or for those who think the city can reach into your bank accounts and take your money, it's like cashing your check and putting the money under your bed, the city has no access to the money.

Deferred compensation is just that, YOUR legal compensation for indentured service that cannot be taken back for work performed. Putting it into deferred comp is YOUR choice, an investment choice, whereby the contract is between you and Nationwide. The city is not a partner or custodian of your compensation or your investments. There's no possible way the city can claim ownership of your compensation, you've already earned it and it belongs to you, what you do with it after that is your choice.

The only thing the city has control over is whether or not they're going to put up with the "hassle" of having a computer deposit it in your account for you, for which they get a very small fee for.

So no, the city will never have any legal authority, either vested or given to them by the SCOIL, to take compensation for work performed back from you once it's earned.

Not ever will they get that authority.

I was listening to the anti pension John Kass show on the radio the other day. I couldn't get in with my call. He and his anti pension/private sector comparing partner said a lot of things that were just wrong and piss you off. He stated that every day that the ex mayor wakes up, he is $500.00 richer thanks to all his pensions! If that doesn't piss you off you deserve to be treated just like the asshole you probably are!

What about the 5900 retirees that have maintained their membership and have always paid their dues on time? How about everyone pays the same? detroit just got the go ahead to continue with it's bankruptcy from a judge--- they want to give 15 percent of what's owed to everyone on a pension--- for example, a 5,000 dollar a month annuity just turned into 750 dollars--- that's a bitter pill to swallow for someone who doesn't qualify for social security because they paid into a pension fund--- why can't the federal government step in and borrow them some money just like they did for gm and all the mortgage bankers....

If we truly want to send a message, for one month, lets not do any VRI, let them see we want more police paying into our pension, and not just creating a band aid for the problem. I know theres a lot of bust outs on this job that will refuse, because of their pee brain thinking of the "money" but if we can stand united, its a big step.

In bankruptcy your deferred comp money would be a debt owed to you by the city just as they owe anyone else. So you would get in line with vendors etc. to get paid. In short, yes, the city could "take" your deferred comp money. However, despite posts to the contrary, Chicago is not going bankrupt nor will it do so anytime soon.

Not a cop, but have been a reader and am definitely a police officers friend. I cant understand why you folks dont organize and really put some pressure on this rotten bag of crap called Rahm. They go on TV and make a big splash about spending billions on CTA, Parks etc which fills their back pockets with money but in the next breath they say we have to fix a pension problem. But I never see anything from the media on how pensioners both current and future are in an uproar over this crap. These crooked pols HATE bad publicity. Its time to give them some and keep it up until they get run out of this state.

The city is not going to declare bankruptcy. There was a discussion about this a few years ago on here and your deferred comp is not as safe as people think it is. The money isn't held in some protected account waiting for you, so much as you're lending it to the city to use until you ask for it.

Regarding deffered comp, I did some research in 1983, when the talks were about laying us off and the city not paying bills...to cut to the chase under the provisions of 453b (I think that's the correct federal act site) Deffered Comp technically remains the asset of the governmental agency to which the Deffered comp participant belongs. I was told then that that is the way to avoid taxes, etc. I was told then that if that situation took place in which the city took possession of the funds a participant would be one of the first in line as a creditor. The governmental entity would owe that to you ,along with owed salary pension etc. Now when everyone starts telling me I'm full of crap, I would urge you to ask the Deffered comp reps. They will start out telling you it's your money, when you push them hard they, if honest, will tell you that legally the funds remain an asset of the city, until you leave the department.

Ladies and Gentlemen,
This should be viewed as all out war by us. Current, retired, young guns and old guns and families of all must be in this. We need tens of thousands at a rally and hundreds keeping a 24/7 persence. We need to get CFD and the other unions to join us. If not we all will be eating cat food at some point.. We need to inform the public about our side of this issue, all they hear is the city's side. FOP and PBBA should suspend all unnecessary spending and direct those monies to media spending to get out message out. Let's pickett the movie locations too... We to pull out all stops on this. All hands on deck!

The only people complaining about the proposed amnesty for retirees, is the city wide team, led by JIm, the taper, Moriarity and Billy boy. The retirees don't have a problem with it, so why do upon? Don't start with the I'm a retiree, and I was at he meeting. The ir was only one retiree present when the vote was taken and, Vic doesn't have a computer.

Just did a little research on the internet. Rahm's net worth is only 14 million dollars. Also, I think he will qualify for a 52K pension at age 62. Why doesn't the FOP and other unions broadcast this? After all, he wants to cut off our pensions.

Tip: Deferred comp (457 plans) accounts are portable. This means that if you leave your job you can move your deferred comp into another similar account.

So, if you're leaving your job in the near future and have a lot invested in deferred comp, take your money out of your city account and move it into a similarly designated account at a a broker or investment firm. This effectively takes your nut out of the claws of thieving gov't rodents.

Another advantage to deferred comp is that by Illinois law, timely withdrawals will not be subject to state tax. Good way to avoid state taxes on lump sum payouts at retirement that can be thrown into deferred comp accounts.

SCC, maybe a thread on former Mayor Richard M. Daley's various pension incomes would be in order right about now? With appropriate details on how he weaseled his way into GETTING those various pension payouts. The former mayor is doing QUITE well for himself at the public trough, and that's BEFORE you factor in his made up jobs at the U of C, the soda pop company board and the law firm that brokered the parking meter deal.

That meant that, at his age 49, he could have retired at age 55 with a pension benefit of $97,750 a year, far higher than the $20,686 he would have received if he hadn’t rejoined GARS.

He went on, however, to win five more terms as mayor and now receives a pension of $183,778 per year — $15,314 a month — which is about $50,000 more each year than he otherwise would have received had he not made the jump into, and out of, GARS back in 1991.

Daley was able to take advantage of another sweet deal built into the pension bill that he helped pass: He was able to “purchase” years of benefits from his legislative days to add to his pension benefits, which would normally have cost him about $540,000, just by transferring his GARS credits of $128,000 over to his own pension plan, neatly saving him over $400,000.

Today GARS is only 21 percent funded with unfunded liabilities of $235 million. The only way that shortfall can be made up is by taxing Chicago residents."

The deferred comp question. It is the City's money otherwise it would not be deferred. There was a case in Ohio years ago where a city wanted to use it as collateral and a judge intervened and say no. As for bankruptcy, not being a lawyer, I would image it would become part of the bankruptcy hearing. After all, it is the city's money as it was tax deferred as a 401 K.

Taxpayer here. I agree you need to start organizing with the other city unions and inform the public of what's going on. March on city hall along with other locations, get some bill boards going and get your side in the papers and on Tv. Keep the pressure on constantly. If your union officials won't help organize then do it yourselves. But you need to rally all the rank and file to be a success.

Not all citizens are in the dark when it comes to Rahm. A lot of folks don't like him or his policies. And he seems to have a bottomless bucket of money available when he needs it for other things. I'm tired of his dog and pony show. He sets off all my alarm bells.

Take a stand and don't let him get the upper hand in this fight.

Not time and a half, Money wasn't an option, If you went to court for 30 minutes that's what you got , 30 minutes on the books. There was no opportunity to make any money in overtime the only way you increased your income was by working a side job, or secondary employment as it was called back then. Up to 20 hours a week I think. But of course that was only if your Watch Commander "approved" your secondary employment request.If he didn't approve it and you got caught working a side job on your own time, you could get fired or at least get time or they took time from you. So you better have enough movers and parkers or you don't work. we worked on election day for no additional pay because "it was our Civic duty, that was usually an 18 hour day for no additional pay. There are many other abuses but this post is getting too long. Just remember when you want to ban
those guys that fought the boss's and the city to get the benefits you now tell us YOU protect, because they forgot to pay their
union dues out of their "$23,000
a year pension, and you don't want to let them rejoin and start paying dues again stop to think about just who it is you are trying to Fuck.

Another advantage to deferred comp is that by Illinois law, timely withdrawals will not be subject to state tax. Good way to avoid state taxes on lump sum payouts at retirement that can be thrown into deferred comp accounts.

Dont understand about timely withdrawals. No taxes on payouts at retirement is true, but no state taxes on withdrawals. Where does it say that?

I am a retiree. I paid my $40.00 For what? I can buy a FOP book for what, $3.00 and a new sticker for a buck or two. What the fuck do I get for $40.00? A newsletter mailed? So fucking what. I read it online for free before it comes in the mail anyway. If I get in a shooting I am on my own.

I am retired and in a bit of a rut…I have a comfortable-amount of dough in the city's Deferred Comp…..it's going on 1 month since I called and asked the procedure to withdraw a partial amount…this in itself was no easy thing, as it took several calls to speak to a human…once I got through, she told me she couldn't help me and would have to take a message and have someone call me back, which no-one did…the next day I called and had to speak to several different people, ALL of which put me on hold. Finally some resolve, as this person said that she would e-mail me an application to fill out…she did, but there appeared to be so many superfluous fill-in boxes and titles of positions and codes etc. that I found myself calling back, again getting the run around…I was told that IF I'm retired, I need a letter to that effect, with a dept. letterhead and an official CPD,authorized person signing it…well the obvious response ensued, in that I AM retired and had deposited this money from a CPD payroll check, etc. etc…..to no avail!.. So AHA! I thought, I'd just call back and get a supervisor…nope, none available, leave a message…2 days later, I did get a call back from a lady, that told me, it's no big deal, she'll send me the appl. with the required info. highlighted in yellow!…WOW, great! except I've received nothing in past 2 weeks….So, I'm passing my story on in hopes that someone has an anecdote…Monday, I'm making a trip into city,and personally request my money, in any form available!..ie, bullion, cashiers check, money order, direct deposit?…I'll keep ya posted…remember, this is only for a small withdrawal AND I was told, there will be a 20% tax on ANY amount I withdraw…sorry for the lengthy rant, but it helped me vent…ALL of my $ is going to be invested elsewhere, after speaking to a financial advisor. UNLESS people have had much less hassle than I, I would advise ya'll do the same!

So instead of taking your payout of CU time, V-Days etc, port that money over to deferred comp and then take it out or whatever you are going to do with it. You save 5% off the top for doing that. Pension Board will explain if it is your retirement time. Take the check direct from the City and you are on the hook for 5% Illinois Income Tax.

Call your accountant before you take the money out. There's a twist in the IRS code that allows first responders to draw their pension after age 50, instead of being hit with a tax penalty and there may be an out for you, too, because you're officially retired and, presumably, over 50.

I retired a couple of years ago and the IRS tried to penalize me an additional 10% in taxes, plus penalties, for taking my PENSION at age 56! My tax attorney photocopied the pertinent tax code and sent it to the author of the IRS demand-letter and we got a release within two weeks. Don't let them steal your money.

Speed camera on Peterson, between Jersey and Lincoln, west side of bridge. NO SIGNS warning motorists of it's presence. The only indication that it's there is the strobe light going off like you were at an '80s dance party.

I have it and it works great! I use it every day when I'm in the car. With the audio warning feature it helps to remind you that you are coming up to a red light or speed camera, especially useful if you get distracted and forget it's there.

You can't touch your deferred account until you retire. When you turn in your papers you select what to do with the money the City owes you, CU, V-Days etc. Hopefully you haven't already maxed out on contributions so you put in as much as possible to your deferred account. Then after the effective date of your retirement, do what you will, let it sit or take a withdrawal. No 5% Illinois Income Tax since it is then considered retirement income.

Same as your pension checks. No Illinois Income Tax due on pension checks, it is retirement income. Call pension board to confirm. It saves you 5%.

The election is not until February 2014. How many retirees are we even talking about? This is such a non-issue. The real issue is that Shields forgot to send in the "letter." We are not getting retro and our pensions will be based on a lower salary because of this blunder.

What is this error/omission really costing the members? Secondly, will Mike go to arbitration or appeal the Labor Board's second dismissal of the FOP's ULP. Lastly, will Billy D. retain Paul Geigher, if he wins the election? These are the questions that should be answered by FOP and the candidates.
