No Pension Fix for Judges

  • Legislation intended to curb the rising cost of public pensions in Illinois would reduce the benefits for recipients, except for the judges.

    Judges receive the highest average annual pension of any public employee, yet their benefits would remain untouched, according to legislation introduced by Illinois House Speaker Michael Madigan

    The nearly 1,000 retired judges earn an average annual pension of more than $112,000. The average public employee retiree draws an average annual pension of about $40,000.
We're pretty sure the legislature hasn't touched their pensions either.

OT: The salaries of judges were just raised in Tanzania, Congo, Chile, and North Korea. Those are apparently a direct correlation to Illinois. The writing is on the wall.

Old lawyer nearing retirement. USN 6 years (72-78), afterwards railroad ten years (midnights) while getting through college and law school, while wife worked her butt off to raise 4 kids . . . I ain't gonna see that kind of pension. Shit! I guess I should have thrown ethics out the window and gone Dumbocratic! Have a Dem law school classmate who is a Circus Court of Cook County judge (elected unopposed). . . . and she is an idiot, and should not be on the bench. But . . . I guess I am the idiot.

According to the BGA Website Pension Database;

Over 7800 people get a pension worth over $100,000 a year.

Almost 200 get a pension over $200,000 a year.

MANY have 3% compounded COLAS.

We get shit compared to them but we are the enemies.

It's time to SHUT IT DOWN and stop doing anything for a public that despises us!!

Right, whats good for all of us, should be good for them. If they really want to fix the pension system go and discontinue the pension benefits to all those state reps who collect after one term.

As far as the judges go, go sit in a courtroom sometime. The public would be shocked at the stupidity that dons the black robe. We had one who was changing the speeding tickets of truck drivers to loud muffler convictions so they wouldn't have a moving violation on their CDL. It got so blatant that she ordered all the officers out of the courtroom while she did it.

She really deserves a pension, f-in joke..

While I am sure there is "pay to play" going on city politics, I doubt that this is an example. Did you see this guy's bio? I'm sure he was making more money at Citadel than he will with the City. Part of me thinks its good to have someone who was a success in private sector coming to work on the city's finances.

Eligibility
You may retire:

• At age 55 with 8 years of credited service.


• At age 62 with 4 years of credited service.


Your retirement benefit is paid monthly for your lifetime. However, you must apply for benefits in order to receive them. Contact GARS approximately 30 days before your retirement date. Your pension will start on the day following your withdrawal from service.


Your Retirement Benefit
Contributions made before January 1, 1982 were taxed when you received them. Your contributions after January 1, 1982, were not included in your gross income and therefore are not immediately taxable. However, when you begin receiving benefits, you will be taxed on your contributions accordingly.
Your retirement benefit is based on your salary and credited service on your last day of service using the following formula:
3.0% for the first 4 years of service
3.5% for the next 2 years of service
4.0% for the next 2 years of service
4.5% for the next 4 years of service
5.0% for each year after 12 years
The maximum pension payable to a member of GARS is 85% of their final salary with 20 years of service credit.



Example: Assume a member is age 55, has 20 years of credited service, and a final salary of $57,619:


First 4 years x 3.0% = 12.0%
Next 2 years x 3.5% = 7.0%
Next 2 years x 4.0% = 8.0%
Next 4 years X 4.5% = 18.0%
Next 8 years x 5.0% = 40.0%
TOTAL = 85.0%
85.0% x $57,619 = $48,976.15 annually or $4,081.35 a month.

A member terminating service with four to eight years of service credit is eligible for the following pension rates at age 62:


• 4 Years 12%

• 5 Years 15.5%

• 6 Years 19%

• 7 Years 23%

This table illustrates the percentage of salary that GARS members with 8 to 20 years of GARS service credit will receive at age 55.

Annual Pension Increases
If you retire at age 60 or over, you will receive a 3% pension increase every year on January 1 or July 1 following your first full year of retirement. These annual increases are compounded on your previous year’s annuity. Pension increases are not limited to the 85% maximum.


Example: A member is age 55, has 20 years of credited service, and a final salary of $57,619. The initial retirement annuity is $48,976.15 (85% of final salary). The automatic 3% annual increase (not payable until age 60) would be: 3% x $48,976.15 = $1,469.28 annually or $122.44 per month


Accruals
The 3% increase also accrues each January 1st for GARS members who remain in service after age 55 with 20 years of credited service. These increases are payable on January 1 or July 1 following the first full year of retirement at age 60.


Example:

Using the table above, a member retires at age 60 in December 2001 with 25 years of credited service. On January 1, 2003, the member would receive a pension increase of 18%.


Reversionary Annuity
This option reduces your monthly retirement benefit to provide a lifetime income for your survivors after your death. This election should be filed with GARS at least two years prior to your contemplated date of retirement. This benefit is paid in addition to survivor benefits.

Returning to State Employment
If you return to work for the General Assembly Retirement System after retirement, your annuity will be suspended. It is your responsibility to notify GARS immediately of your reemployment.

When Benefits are Paid to You

• You pay no state income tax.

• You will pay federal tax on most benefits. Specific information will be furnished when benefits are payable.

The best tax treatment for you depends on your individual financial situation. GARS advises all members to check with a qualified tax consultant or financial planner before receiving benefits or refunds.

This is the first that I've heard of it, but then again I don't read the Quincy Journal. Funny that I never saw this article in Sun Times or the Tribune ever. It is an absolute indictment of our bought and paid for major newspapers that this had to be dug up from a small southwestern town in Illinois from 18 months ago. Not to mention it seems to be extremely relevant due to this week's passage of the pension reform bill.

Judges are suppose to be living in the subcircuit that they were elected to per Mark Suplessa's expose on channel 9 news and he found many not doing so. I wonder what addresses they put on their ethics statements? Anyone lying on that should be dumped and disbarred. If a police officer is caught living outside the city he is fired with no appeal.

It's not an effective payoff. If the Illinois Supreme Court upholds the pension fix, the next time around it will apply to them and they will have cut their own throats. They still have an interest in upholding the pension clause in the Ill. Constitution.

In 21st century America, contracts and the rule of law apparently don't mean anything, at least not if the people at the other end are ordinary workers. So, rather than inconvenience all those rich folks at the Chicago Board of Trade or other highly successful businesses with a larger tax bill, the plan is to stiff the firefighters, the schoolteachers, and the people who collected garbage for 30 years.

It may turn out to be the case that the rich and powerful can just rewrite the rules as they go along. But at least the people should know that theft is now in style when it's their property at stake.

Rahm's new comptroller also worked for Citadel. Citadel invests 401k money. Citadel's CEO, Kenneth Griffin,gave money to Rahm and Rauner and is also a Rauner campaign advisor.... Watch for the big push to end our pensions and put them in 401ks.

OT: I have left phone messages and Emails for Sid Davis over the way the vet was handled by Dougherty and then how Moriarty threw his name out at the last FOP meeting. I was told the trustees discussed this in executive session so the vet’s name would not be made public. Sid refuses to return my calls and when I finally got a call back it was from Di Maria. He tried to tell this was a setup from start to finish. He said there would be no apology from Bill Dougherty or Jim Moriarty directly to the vet as this was all water under the bridge at this point and was done with. He’s blaming it all on the guy running for 1st vp with Angelo. Davis has forgot our code and has lost his honor. All the stuff about caring about vets was all for show by Sid Davis for his political advancement in FOP.

No vet should vote any of these guys until they acknowledge they have contacted this guy and made peace with him.

I am going to give a honest review of the Brad Woods Study Group. They fucking suck. Let me elaborate. They fucked things up for the first part. Now for part two, they fucked it up even more. I just sat through their morning session and it was a complete waste of my time. I left early. All they did was reiterate nonsensical gibberish. Nothing related to the actual test. Plus they give you their handouts every week. Also they claim that 40 people got opted out of their email list and somehow it's my fault and not theirs. Go figure. When these fuckers give a test prep for the detectives test, et test or any other future tests, stay the fuck away from them. I have coworkers who took Bernstein. Bernstein is a lot of flash and well put together. But in the end, save your dough and study the materials yourself with a small group. If you have a group of 5 to 8 people, you can easily break down the material and then study it.

Yes, the story was first reported 18 mos. ago, but the judges will now be expected to deliver the goods when the pension lawsuits are filed and brought before the courts. It's news that stays news.

And if you want to totally honest about it, these types of stories get recirculated every several months anyway, only with different players. Because nothing changes in the filth pits of Crook Co. and Illinois.

Listened to Dougherty explain why he bears no responsibility for Shields not sending the letter. He says it's like you and your partner responding to a burglar alarm, your partner gets out of the car and upon his return he says he wrote a ticket. Later the Sgt. Calls you and wants to know why no ticket was written at the burglar alarm. Bills answer, my partner said he wrote the ticket. OK if Shields was told to send the letter, didn't but said he did then why isn't Dougherty bringing Shields up on charges of telling a lie to the Board. If the Board believed he sent the letter then why did Donahue and Aguilar tell him to send the letter? In Doughertys world it know appears his partner on three occasions said he wrote a ticket but didn't. I think anyone would have said I can't work with this guy he lies to his partner. I could be wrong but why didn't Dougherty do something other than shrug his shoulders? But then again I don't live in Doughertys world. I don't get an extra 2G a month to work a beat car.

I remember thinking that won't last because as soon as the seal is broke and the know the coast is clear, they would simply amend their own bill to restore the costliest pensilns for themselves.

OT: I have left phone messages and Emails for Sid Davis over the way the vet was handled by Dougherty and then how Moriarty threw his name out at the last FOP meeting. I was told the trustees discussed this in executive session so the vet’s name would not be made public. Sid refuses to return my calls and when I finally got a call back it was from Di Maria. He tried to tell this was a setup from start to finish. He said there would be no apology from Bill Dougherty or Jim Moriarty directly to the vet as this was all water under the bridge at this point and was done with. He’s blaming it all on the guy running for 1st vp with Angelo. Davis has forgot our code and has lost his honor. All the stuff about caring about vets was all for show by Sid Davis for his political advancement in FOP.

No vet should vote any of these guys until they acknowledge they have contacted this guy and made peace with him.

It is an absolute indictment of our bought and paid for major newspapers that this had to be dug up from a small southwestern town in Illinois from 18 months ago. They are trying to convince the public that the problem is from teachers, firefighters, and police officers. A good portion of the public buys into the hot air the politicians are blowing, because they aren't savvy enough to figure it out on their own, and simply believe the politicians hot air. Yes. Jim Moriarty taped (100% sure of this) and released (can't prove this as easily but someone conspired with him and it got released) on YouTube the contents of a confidential FOP meeting. What he did was CRIMINAL and he needs to be held responsible. He is a disgrace to the membership. Shields may have effed up withe the letter problem, but Moriarty intentionally tried to torpedo the union by his actions. And then he disclosed the name of the Marine embattled with medical issues at a general meeting?!?! For those that don't know, Moriarty The Rat is a member of the contract negotiating committee. Where ever you may stand on pension reform in Illinois, I bet it is unlikely that most if not all citizens of Illinois formed their opinion considering the impact of such reforms would have on all retiring or retired State of Illinois civil servants. So why after failing to address this crisis year after year and being unable to reach a middle ground, did our representatives carve out the Judiciary and exempt them from any fixes?


Perhaps they feel guilty bc this will be the first year that Judges will have to contribute to their healthcare insurance costs. Something nearly all of us have been doing forever on much lower salaries.Up until now the fine citizens of Illinois covered all premium costs for all judges.

Is it just me or have our politicians gotten so bad that they don't even bother to pretend they are looking out for our best interests anymore?

He was lucky enough to retire because ole Mikey Shields was going to pull a Caparelli move on him and get rid of him.

The governor and every state rep have to get sworn in to their office and during that they must state they will uphold the constitution to the best of their ability… We should be running commercials showing their swearing in and then defining what a public employee is which includes judges and the elected officials themselves on how they willingly and knowingly violated the constitution by not including the judges and also by not funding everyone’s pension but their own. They are special you are not. Clear violation of equal protection rights provided to us in the constitution.

O.T. Brad Woods Study Group

I am going to give a honest review of the Brad Woods Study Group. They fucking suck. Let me elaborate. They fucked things up for the first part. Now for part two, they fucked it up even more. I just sat through their morning session and it was a complete waste of my time. I left early. All they did was reiterate nonsensical gibberish. Nothing related to the actual test. Plus they give you their handouts every week. Also they claim that 40 people got opted out of their email list and somehow it's my fault and not theirs. Go figure. When these fuckers give a test prep for the detectives test, et test or any other future tests, stay the fuck away from them. I have coworkers who took Bernstein. Bernstein is a lot of flash and well put together. But in the end, save your dough and study the materials yourself with a small group. If you have a group of 5 to 8 people, you can easily break down the material and then study it.

Are you nuts? Bill may call this blog the bathroom wall but he's here every day. Bill, Aguliar, DiMaria, and Donahue were on this blog every day insulting the Sgt’s union during their contract vote. They laughed at it for months at meetings. That is a fact.

What gall the Citywide guys had coming out to OPLEO. The guy who runs this organization is Jimmy Ade's uncle. They beat up Ade every day on SCC (deservedly too). Shields at least did it in public with interviews. And that’s where Rahm’s hate for Shields comes from.

The Citywide guys were there (OPLEO) looking for votes but not telling the retires how they have a history of trying to get them out of the union. Before Shields knew where FOP was Bill Dougherty 8 years ago talked about how he wanted to triple their dues because of how much per capital was being paid to the state and national lodges. Steve Robbins is Donahue’s neighbor and was his named pick choice for the pension board. After one term Shields beat him. That is where their hate comes from. And this last week the CityWide guys voted in masse to postpone the vote on letting retirees in the union w/o penalty if they missed a year. So they will not be able to vote in this upcoming election.

Maybe you were not around 12 years ago when the CityWide guys attacked Dean Angelo. We did not have SCC back then. But Bill Dougherty and his guys had a sharpies and they WERE writing on the wall in every bathroom in the city against Dean.

Dougherty likes to call this site the bathroom wall so if you use that exact phase I’m guess if you are not Bill you are on his ticket. Bill will never get 50%. In a three or five way race he’s toast. No vet can ever vote for him. No retiree should vote for the CityWide team either. And Dean Angelo will never support Bill nor will Mike Shields so Bill’s a rudderless sinking ship.

You have been mis-informed. Sid was launched from the Field Rep position in the office but retains his elected office of Recording Secretary. Sid then retired from the CPD but is still Recording Secretary of the FOP Chicago Lodge 7. As such he sits on the Board of Directors. He continues to be paid whatever stipend the Recording secretary is paid but it is NOT Captain's pay. Trustee gets $600 a month, I don't know what Recording Secretary is paid.

Just don't ask Sid to stand up if you see him. He likely is already standing up and is sensitive about that.

To the membership demand to find out why Capparelli was really dumped.

Ask why the lawsuits against Donahue's administration were settled for 25 times what the plaintiff asked for. And there are more than one.

Why legal defense was paid out w/o going thru the normal process.

Why most of the core group never met with the city's team for anything of substance.

ASK YOURSELF WHO BENEFITED?

Most of the public seem to care about the pensions of police and fire, although they think the amount is way too generous. And, it seems most of the public also care about the pensions of teachers but complaint that the retirement age is too young. However, no one I have talked to or things I have read agree that other government employees should even have a pension, let alone such an early retirement age. If governments truly want to cut taxes they need to do a work study on all government jobs, their salary and benefits as they compare to the private sector. Now that would be interesting!!

OT: I have left phone messages and Emails for Sid Davis over the way the vet was handled by Dougherty and then how Moriarty threw his name out at the last FOP meeting. I was told the trustees discussed this in executive session so the vet’s name would not be made public. Sid refuses to return my calls and when I finally got a call back it was from Di Maria. He tried to tell this was a setup from start to finish. He said there would be no apology from Bill Dougherty or Jim Moriarty directly to the vet as this was all water under the bridge at this point and was done with. He’s blaming it all on the guy running for 1st vp with Angelo. Davis has forgot our code and has lost his honor. All the stuff about caring about vets was all for show by Sid Davis for his political advancement in FOP.

It was Dean's 1st VP that threw this vet under the bus. Looks to me like the general orders were changed to help this vet. How did Dougherty hurt him? Lets hear from the vet how he was harmed. Sounds like a bunch of political nonsense from the Dean boys.

Listened to Dougherty explain why he bears no responsibility for Shields not sending the letter. He says it's like you and your partner responding to a burglar alarm, your partner gets out of the car and upon his return he says he wrote a ticket. Later the Sgt. Calls you and wants to know why no ticket was written at the burglar alarm. Bills answer, my partner said he wrote the ticket. OK if Shields was told to send the letter, didn't but said he did then why isn't Dougherty bringing Shields up on charges of telling a lie to the Board. If the Board believed he sent the letter then why did Donahue and Aguilar tell him to send the letter? In Doughertys world it know appears his partner on three occasions said he wrote a ticket but didn't. I think anyone would have said I can't work with this guy he lies to his partner. I could be wrong but why didn't Dougherty do something other than shrug his shoulders?

Its sad Rick that you are on the board and you don't know that charges were brought up on Shields. Shields picked his own committee and he was found not guilty. Now the State is looking into why Shields picked his own committee. If you worked as hard looking for Bear as you do posting lies on SCC you would have found Bear. Shields has got to go!

Steve Robbins is Donahue’s neighbor and was his named pick choice for the pension board. After one term Shields beat him. That is where their hate comes from. And this last week the CityWide guys voted in masse to postpone the vote on letting retirees in the union w/o penalty if they missed a year. So they will not be able to vote in this upcoming election.

SCC I will send you a poster from the last election. It was Mike Shields and Rick King that ran on the same ticket as Steve Robbins. You gotta love how these guys try to distance themselves from the truth.

If you guys think Dean is a scam artist then prove it. You had your hack at the pension board in Steve Robbins who went along to get along with the city and OUR money. Did he even look at the annual review of Dean's case for the three years Robbins was on the pension board?

I don't know if Dean is scamming, but you do have to question why he couldn't come back and work limited duty. We come to work everyday shouldn't he. If you can be FOP president and you can work as a professor at Calumet College while on disability then why can't you work limited duty? These are questions that the men and women in blue will have to ask themselves.

This is the first that I've heard of it, but then again I don't read the Quincy Journal. Funny that I never saw this article in Sun Times or the Tribune ever. It is an absolute indictment of our bought and paid for major newspapers that this had to be dug up from a small southwestern town in Illinois from 18 months ago. Not to mention it seems to be extremely relevant due to this week's passage of the pension reform bill.

The bill in question, HB1447 affected just two of the five pension systems covered by the state. The three left out were the Teachers Retirement System, the State Universities Retirement System and the Judges' Retirement System. That particular bill never made it to the Gov's desk. This latest bill, an amended bill formerly known as SB 01, NKA Public Act 98-0599, that was passed and signed into law by Gov Jello covers all five I think (the State Employees' Retirement System of Illinois; the Teachers' Retirement System of the State of Illinois; the State Universities Retirement System; the Judges Retirement System of Illinois; and the General Assembly Retirement System). Seriously, I tried reading the actual bill and I started getting a headache.

Whoever said the judges are included in the bill are WRONG Below is a link to an article about it and why they think the judges were excluded by Madigan

Senate Bill 1 does not include the retirement system for judges, likely in an attempt to improve the legislation’s chances of surviving a court challenge on its constitutionality – the Illinois Constitution states that pension benefits “shall not be diminished or impaired.” When former Gov. Rod Blagojevich tried stripping judges of their 3 percent COLAs, they sued, got to hear their own case, and won.

Did you know that they replaced lab rats with lawyers. Because there are some things that even lab rats won't do.

And now they replaced lawyers with members of the city-wide team.

Because they will do anything to get back in power including throwing a vet under a bus, attacking a disabled officer, and screwing every copper out of 6.1% of raise.

As a former member of the city-wide team it will be fun to see how fast the rats jumps ship when the shit hits the fan.
