Here Come the Clowns.....

  • Dan K. Webb — the special prosecutor who said he was unable to charge Chicago police officers with breaking any state law for botching an investigation into a nephew of former Mayor Richard M. Daley — turned over all of his evidence to the FBI last June, the Chicago Sun-Times has learned.

    Some police officers involved in the case — in which files went missing and the special prosecutor said that a key police finding apparently was fabricated — may be under investigation for similar activities in other cases, according to a sealed court document obtained by the newspaper.

    Webb’s request to a judge for permission to turn over the files to the FBI came as he was wrapping up his investigation into how the Chicago Police Department and the Cook County state’s attorney’s office twice failed to charge Daley nephew Richard J. “R.J.” Vanecko in the 2004 death of David Koschman.

    Webb got permission to give the evidence to four FBI agents “who have experience and expertise with police corruption investigations,” according to the court documents. Those documents are sealed under a court order issued by Cook County Circuit Judge Michael P. Toomin, who appointed Webb to investigate the Koschman case.
As we said, this is going to be used as a regular club to beat the Department with. And unless we're badly mistaken, Walsh is going to be Exhibit A in this disaster - unless he flips for a better seat on the bus. We fully expect someone is already looking to cut a deal on this and when the music stops, several someones might not have chairs.

Any predictions on another wholesale restructuring of the D unit?

If half of what was reported in the grand jury report is true, these guys better try and figure out what they need to do to keep themselves out of the MCC. The media has either been instructed, or decided that due to his history that Walsh was the fall guy.

Either way, all these guys had the opportunity to help out the little guy who didn't have the clout or connections to stand up against the machine. Instead they vilified Koschman, and made him to be the aggressor to make sure the status quo continued uninterrupted. They refused to defend those who were unable to defend themselves. Shame on all of you.

This is the problem with how people are promoted in this department. Those promoted to prime spots, like in the d-unit, narcotics, etc., are promoted with the expectation that they will toe the company line (herein, meaning the Daley Clan line) without question and without being told to do so.

The department is a political fiefdom: do something for Daley, and get promoted. Carrothers was a perfect example. One week after Carrothers the alderman goes to jail on federal charges (without giving up the king, without being a stepping stone up to the top of the throne), Carrothers the sergeant gets promoted to lieutenant in the D-unit, and shortly after that stint, gets promoted to Commander. Not because of his abilities to lead, but most likely because of his brother's silence: because his brother didn't snitch.

And the promotional system has to be fixed from the top, but if the top is corrupt, then the top certainly won't have a system in place that puts people with integrity anywhere near the king or even inside the castle gates. Those with integrity can stand outside and guard the moat.

Back to the vanecko fiasco, if those fools don't get indicted, watch, they will get promoted again.

Chicago is not a democracy: it's still in medieval times.

Just speculating out loud here, but might Deputy Chief of Detectives Constantine G. “Dean” Andrews, Sgt. Samuel J. Cirone III, Cmdr. Joseph P. Salemme, Det. James G. Gilger, Det. Nicholas J. Spanos and Lt. Denis P. Walsh be the "Scandal Six Pack"?

No doubt it was one hell of a cacophony of assholes slamming shut when this news broke. Followed by a switchboard-clogging amount of nervous-as-fuck phone calls to lawyers and coworkers, both active and retired.

I love the irony of Vanecko once again being a free man as these pathetic bastards that sold their souls to the Daley Crime Family are scrambling to hide assets, shelling out small fortunes for lawyers and figuring out the easiest way to tell the [ex]wife[s] and kids that daddy may have to go to jail.

Mrs. Koschman may get the second best Christmas present ever this year.

The detective division should be held responsible for doing there job everyone wants a check but no one wants to work amazing . It is time to change the way detective division unit functions what do they do for the amount of hours they work how many cases do they solve have of them might not even know what the fuck they are doing . Let let to the bottom of this so we can save the embarrassment to this department .
may be if we alternated supervisor from patrol to detective division there might be cases solved for those supervisor who work in the detective division what the hell do you supervise .
now we are face with FBI investigating this issue. oh well no better for whomever though they can get away with this .

Maybe no one ever told you, BUT, that is what a boss is supposed to do, ask what you are doing because they are your supervisor. But if he or she tells you how to rewrite your report, that's another thing and you be the fool to do it. That's when you put that name in a GPR "was told by Sgt. Lt. Cmdr. Etc, etc, etc....

And did anyone forget that all four are teaching classes at Homicide Certification classes. I freaked out when Walsh, Salemme and Cerone each taught a class, what a crock of misrepresentation. Ok FBI, start looking as far back as 2005.
When the first CR number was pulled by family members because Detectives did nothing and when it went infront of wicked boss of IAD, it was closed

Then ask why when it all came back in 2010 and 2011 Jody requested the re-investigation which was closed by Detectives again...and another CR was pulled and closed in one day........by IAD

The exempts all knew it from the 1st week of the criminal investigation but they all buried it.

Area 3 was buring the matter. If you doubt it Ask the ASA handling the sex assault case that happen on major holiday but was never investigated until ASA forced the matter after interviewing the victim........Hey FBI what happen to that CR for detectives not investigating the CSA?

I know some of the detectives involved. Nick Spanos and Jim Gilger are great detectives. They're good guys who work hard, have values and integrity. They wouldn't jeopardize their jobs or families for anything. I'm proud to say they're friends of mine. The Sun-Times is a liberal, anti police rag. It's saddens and sickens me that police officers would hope that fellow police officers lose their jobs, get sued and prosecuted based on what a paper prints. Some of you don't even know these men and you're judging them based on what you read. They're being thrown under the bus. You never know when it can happen to you. If it did, I'm sure the last thing you would want is fellow police officers judging you. Hang in there guys.

I think 90% of the critics here have never been detectives and mother fuck the dics if they don't get felony charges approved everytime.

This case is not a shining example of CPDs best work, but if Webb didn't find anything then I doubt the FBI will either. The FBI likes sure things and I don't see that here at all.

Other than maybe Walsh retiring and a few of the others getting shuffled around I don't see much changing.

I think some of you are putting too much faith in the opinion of the SunTimes and the media. You know the same media that screws us every time a copper breaks wind. You can write a book on how many times the media has lied by ommission or taken information and misrepresented it. Look at how many times they have referred to Manning/Mandell as a former Chicago cop.

On a side note it is nice that you can sit back and wish other Police a trip to the joint. You are what is wrong with this job, not the Detectives. I worked with all of these people and can tell you that the Detectives did nothing wrong here and should not be held accountable for bosses actions. They are two of the best Detectives I know and are so pro police it isn't even funny. But hey lets jump on the media bandwagon and put them in jail.

All I can say it is about time. But all these detectives and commanders did was follow what has been done by others for many years. The culture was established long before their time. Daley made the detective division a patronage heaven overshadowing many fine detective with unqualified merit hacks.The entire process needs to be redone, to include reporting and file indexing, supervision of investigations and assignment of cases. Plus, add more detectives and establish a baseline of qualification for supervisors, not some political hack .

Say what you will about the D unit and I agree that they did in fact err in this investigation but fault lies in the Felony Review Unit if the State's Attorney office. Being a retired guy who spent decades in homicide I have seen FRU act as judge and jury when approving charges. Kevin O'Brien was one one the worse. This is an on going problem. They
completely dismiss probable cause. But that said, while Koschman was still alive the deputy superintendent could have charged with aggravated battery on a public way by overruling the Fru. That would have put the case where it belonged in the judicial system and CPD would have done their job. Why no one asked for an override to protect themselves was pure stupidity.

This is the problem with how people are promoted in this department. Those promoted to prime spots, like in the d-unit, narcotics, etc., are promoted with the expectation that they will toe the company line (herein, meaning the Daley Clan line) without question and without being told to do so.

The department is a political fiefdom: do something for Daley, and get promoted. Carrothers was a perfect example. One week after Carrothers the alderman goes to jail on federal charges (without giving up the king, without being a stepping stone up to the top of the throne), Carrothers the sergeant gets promoted to lieutenant in the D-unit, and shortly after that stint, gets promoted to Commander. Not because of his abilities to lead, but most likely because of his brother's silence: because his brother didn't snitch.

And the promotional system has to be fixed from the top, but if the top is corrupt, then the top certainly won't have a system in place that puts people with integrity anywhere near the king or even inside the castle gates. Those with integrity can stand outside and guard the moat.

Back to the vanecko fiasco, if those fools don't get indicted, watch, they will get promoted again.

Chicago is not a democracy: it's still in medieval times.

I knew Dennis when he was a Patrolman in 015 on Probation, and it was a "Given" that he was connected. I was one of his Sergeants at the time and I never hurt a cop; but I have no sympathy for any of these guys. In the scheme of things, this travesty of justice is smallball to the FBI's bosses -- the DOJ, Eric Holder and POTUS, but to keep the rest of the team in line in a heavily Democrat region like Chiraq -- nothing -- is going to be come of the FBI's posession of the info Webb gave them.

I hope I'm wrong.

Carrothers was not in the D-unit. After being made he was sent to 002 as the Tact Lt.

A simple bit of advice that really has nothing in particular to do with this case but should be followed under any circumstances: If the FBI ever asks you a question, your answer should be, "no comment". Even if the question is, "do you breathe to stay alive? "No comment".

Any detective who ever worked a heater case knows that every single thing you do in that investigation is first decided upon by the big bosses even before you do it. Kline was 100 percent micromanager, which in turn caused every boss directly under him to be even worse with demands and keeping their thumb on every aspect of the investigation. This constant exempt micromanaging infuriated most detectives, because it was insulting and unnecessary.

The problem is that no detective documents every call, every email, every request, every statement, every demand, that these exempts make during and about the investigation. Because the D unit is supposed to be more mature, and no detective wants to be a rat.

If you ever worked closely with the Feds, you would know that every email and every phone call they make during an investigation is documented and subject to discovery. Obviously Dean and Sammy and Denis and the rest of Klines crew were too stupid and arrogant to remember that simple fact.

On the flip side, I still believe Webb deliberately avoided further investigating Daleys bodyguards involvement in the koschman/vanecko case. I know for a fact that Keeting was shitting in his pants when he got the letter from Webb. I wonder why???

The most ironic part about this comment thread is that Walsh, Cirone, Gilger, and Spanos would do anything for another policeman. I know because I've seen it. These are four guys who regularly go out of their way to help officers involved in shootings, officers who are victims, etc. Then their names are smeared by a completely worthless paper in town and countless officers start slinging shit at them on this site. Pathetic. Can Cirone and Walsh be arrogant at times? Yeah, they can. So fucking what!! Does that mean that none of us should care that their careers are getting ruined over some bullshit?! As far as Gilger and Spanos go, it boggles my mind that anybody can say anything bad about either one of those guys. Salemme is another one that has gone to great lengths to protect officers. Just ask the state's attorney's office who pushed and pushed for videotaped witness statements. The only reason he did that was to protect detectives from witnesses who were filing lawsuits that stated that they were being held against their will. It really saddens and disappoints me to see how many people on this job have an attitude of "every man for himself". It's no wonder that our union is in shambles.

I have known Denis and Mike Walsh since they were kids. I don't care what anybody says they are good guys. Anybody that says Denis is arrogant and a bad boss is full of shit. Denis learned how to be a good guy from his dad who was a Captain in SOG A/6 for a long time. He was also a very good boss that took a lot f kidding from certain coppers and he could dish it out also. Who the fuck knows what really happened with this case, but it is what it is. What version of the events the witnesses gave was true? Every witness changed their story at least once. Gilger and Spanos are good guys, I have never scene or heard of Cirone or Walsh trying to hurt a policeman, in fact they go out of their way to help guys. Salemme was CCed on emails, and was not involved in the investigation. Not everybody has to like each other but the cowardly statements being made are truly horrible. I worked with or for all of these guys some I liked some I did not, but I would not wish this which hunt on anybody. For those of you sitting back and passing judgement shame on you.

Two "very good" and respected detectives from Area 5 were originally offered the re-investigation before Andrews went to his best detectives Nick "I Haven't Solved a Homicide Since I became a detective" Spanos and Jim Gilger. The two detectives who told Andrews and Cirone to go pound sand saw right through Andrews's and Cirone's bullshit. And they were the only two, or at least one of them was, that would talk to Andrews and Cirone like that because they were ALWAYS the police and actually solved and charged murders, so they didn't have to get involved in this bullshit because they never played the political game. They are both off the job now, but ask any states attorney or judge about them and you would find they were two very intelligent, honest, hardworking, and knowledgeable detectives.

By the comments posted on here, I know that 90% of you don't know anything about them or this investigation.

These cops are some of the cities hardest working, and toughest men who were put in a case which they had zero control over.

Knowing these types of cops, they knew that there was going to be a media and political shit storm which they would have to sail through; And boy did that ever happen.

They're taking the brunt of this mess, and they didn't kill anyone. They certainly didn't cover for RJ-that's quite apparent in Webb's' finding.

If you have about 2 hours you can read through the probe and see there really isn't a cover up. It's just cops having to deal with good attorney's.

This is a perfect example of why power needs to be taken away from the mayor of Chicago. The mayor appoints every city executive in Chicago. The mayor selects the police superintendent, fire commissioner, head of Board of education, etc.... That way these different agency owe their jobs to the mayor. They police department should be one department that stands alone with no influence from city hall or reverends on how it is run, who gets promoted, and who gets investigated. Finally once and for all put in writing criteria an officer needs to get considered for meritorious promotions.

Unfortunately the ones who will be suffering on this mess will be those with their names on the Sup reports, the Detectives. They are victims here. They get this case as a hand-out with nothing to indicate that it is anything special. Then it becomes known that a member of a Chicago royal family is involved. There is no way that the powers-that-be were going to allow this case to go the way it should. Behind the scenes pressure was exerted, tho nothing was put on paper. Any accusation they make regarding interference or attempts to influence the direction will be denied with the white-shirts saying it was just be a supervisor.

And don't be so naive as to think that the same think would not have happened in any other place where a big pol was involved.

Rahm, like Daley before him, needs to demonize the police while he negotiates the new contract. What better way than to have a couple of CPD detectives or white shirts jailed for some Fed charge like they pulled on Cozzi.

You just keep telling yourself that it's just "media spin"... mark my words, if they want a cop behind bars out of all of this, SOMEBODY will be going to jail. End of story.

I wonder if those trying to defend these bosses and detectives would feel the same way if it was their relative that was killed, and I really doubt it. I don't care if someone is a nice guy or not, that's not what this is about. This case was improperly handled, at best and manipulated by those involved to let Vanecko skate at the worst. Either way, justice was not served for this woman who lost her son and that's a damn shame.

yes, I know the USAO is at 219, crackerjack. the Fb1 are now on Roosevelt Rd . And yes, I understand that the USAO is the charging authority... but the Fb1 SAC would won't touch anything unless its in a pretty little package to drive to the USAO. Also if you don't think that the Public Integrity Squad hasn't already looked at this and others but chose to look the other way to save their careers... then you are the one living in a fantasy land. My post regarding geography was only meant to advise the ones that don't know that the boogie men/women now live on Rosevelt Rd. Oh and I retired from 018 after doing my time in what you hard chargers like to call working districts.. you should try it for your twilight it's stress free and you actually deal with some real victims. it's like a cleansing prior to retiring to the real world.

We'll once the dog runs out of the yard it doesn't matter if you then shut the gate. This case has entered the lives of some well known, heavily connected people. Dan Webb, Judge Toomin, the new AIC of the FBI, the CCSA. Not to mention the rahmster as well. Some of these people are seeking reelection and have further political ambitions at the national level, while others seek to keep a reputation that is very upfront and is critical to their livelihood ie... Their careers. Once their names got attached to it, their reputations got attached to it. If you think all these people of which some who make millions off their reputations in their field are gonna let this go away with their names attached in a perceived cover up of the death of a young man are mistaken. Something will be done, there is no question about it, but what exactly that is, is THE question. Nobody who runs for office on a national level wants any talk of a cover up of a homicide following them around, but if they were the one to eradicate this injustice and weed out this systemic corruption then they can campaign on that , being the reformer of a thoroughly corrupt organization known as the CPD. So basically if this becomes a liability to the named above individuals, then heads will roll ,so to speak, regardless of how much of a " great guy" one is perceived to be. So Saleme has the time to pull the pin and go with a pension. Makes sense to be the first one on the bus, cut a deal, look legit. As for Yamashoria, he's not too bright, but still young and this could affect his future law practice especially if the ARDC gets involved along the way. So it would make sense to "give it up" for your future endeavors, in other words, cut a deal especially if your were privy to some of those secret, private conversations and phone calls discussing very, very sensitive issues with others, you know what I mean, right Gary. Dean Andrews could pull the pin, get immunity and blame it on Walsh and the 2 detectives, saying I was just being kept informed of the investigation. That leaves the Lt. The Sgt. And the 2 Detectives. DW has some real problems in this matter and could stand to lose the most yet with his connection I'm sure he could get a new job with the McPier board. That leaves the 2 hard working detectives. They will bear the brunt of this, and if they are smart they will be making an appointment with the Feds and getting the best deal possible because if they do it, the aforementioned guys will. Remember everyone talks, everyone rats on each other. Why go to the Pen when you can send a friend. Everyone should realize that on this job, all of us, everyone is expendable for political gain and or personal gain of the connected. Remember that when you make a decision to violate your oath for future gain.

Only one thing matters. Koschman's friends could not ID Vanecko. They never stated we picked him out and the police didn't charge him. The case was presented to felony review they said it can't be charged.

Nobody manufactured a statement. Re read the report. Somebody said that Koschman threatened to "kick your ass"

This is Cook County, the police don't charge, the States Attorney does.

Two "very good" and respected detectives from Area 5 were originally offered the re-investigation before Andrews went to his best detectives Nick "I Haven't Solved a Homicide Since I became a detective" Spanos and Jim Gilger. The two detectives who told Andrews and Cirone to go pound sand saw right through Andrews's and Cirone's bullshit. And they were the only two, or at least one of them was, that would talk to Andrews and Cirone like that because they were ALWAYS the police and actually solved and charged murders, so they didn't have to get involved in this bullshit because they never played the political game. They are both off the job now, but ask any states attorney or judge about them and you would find they were two very intelligent, honest, hardworking, and knowledgeable detectives.

That's what I'm talking about. There are officers on this job who had the common sense to tell their supervisors NO. At ant point Gilger and Spanos could have told Andrews and Cirone NO, and they chose not to. That is what the federal charge Color of Law is all about. The officer conducts an action that he knows is wrong, but does it anyway.

Are you trying to bait someone? Let me jump in instead. Where in Yawger’s statement does he say he did an incomplete or incompetent investigation? All he says is he wanted to put the ball in the ASA’s court. How is that illegal? Most detectives have that thought about most cases. In order to “kick the can down the road” and put the onus on the ASA he would need to do his investigation and gather enough evidence to present it. He did present it and when the ASA rejected it he called Thomas Epach for help in trying to convince the ASA to charge. He clearly advocated for the victim in trying to get the case charged…whatever his personal motivation. Personal motivation and intent to be rid of the case by getting it charged is not a crime.
If you want to be pissed at someone, be pissed at O’Brien for rejecting it and then throwing out his felony file proving he rejected it.

Regarding the supposed Jacobs Twin scandal: yes, tax evasion does have a 6 year statute. However, if proof can be shown that there was a coverup then it's another way to make us look bad. On the other hand, 'Tax Fraud' is a Felony the I.R.S. can always go back to if they really want to fuck someone over. They usually won't do it though.
