Did Dean Just Detroy the Pensions?

We got this in an e-mail:
  • To all CPD,

    The following excerpt is taken from Senate Bill 777 that just passed and is headed to Gov. Rauner for approval. The governor's approval or veto is meaningless as this bill passed with veto proof majorities. This is the bill that reduced by several hundred million dollars the City of Chicago's Actuarily Required Contribution (ARC) to the pension fund. What I am showing you here is new language that was quietly inserted into the bill. THIS LANGUAGE IS VITALLY IMPORTANT AND POTENTIALLY RENDERS THE CITY FREE FROM EVER PROPERLY FUNDING OUR PENSION!

    Any payments required to be made by the city pursuant to this Section are expressly subordinated to the payment of the principal, interest, premium, if any, and other payments on or related to any bonded debt obligation of the city, either currently outstanding or to be issued, for which the source of repayment or security thereon is derived directly or indirectly from any funds collected or received by the city. Payments on such bonded obligations include any statutory fund transfers or other prefunding mechanisms or formulas set forth, now or hereafter, in State law, city ordinance, or bond indentures, into debt service funds or accounts of the city related to such bonded obligations, consistent with the payment schedules associated with such obligations. [emphasis added - SCC]

    It appears that this new language lets the City of Chicago off the hook from any court ordered payments to our pension fund. It clearly states that any payments to the pension fund are "SUBORDINATED" to payments for any bonded obligation debt outstanding or to be issued. In essence, the City will pay any other outstanding debts before it pays any court ordered pension payments due to failure to comply with the new payment schedule contained in this new law!

    Senator Pamela Althoff (R - McHenry) questioned the co-sponsor Senator Cullerton regarding this new section. Senator Cullerton then did something curious. Senator Cullerton asked to pull the bill for a private discussion with Senator Althoff regarding this issue. A short time later, Senator Cullerton brought the bill back for debate. The bill was debated along party lines but this issue was never mentioned again. The bill was summarily voted on and passed along party lines. Several times during the debate, Senator Cullerton stated that this bill was crafted with police and fire union representatives.
We will confess to being less than perfectly informed about certain issues and not up on all the legal jargon that accompanies the legislative process. But at first glance, this looks very bad. At second glance, it looks even worse and it isn't getting any better. Did the heads of the CPD and CFD unions just let Rahm off the hook for funding? Someone commented that the PBPA reps didn't, but their websites aren't very helpful, though we did find this link from Bloomberg:
  • Chicago bonds rose after the Illinois legislature cut more than $200 million from the city’s required 2016 payment into the police and fire retirement systems, a move to provide a partial reprieve from its pension burden.

    Illinois’s General Assembly gave final approval Sunday to a bill that would reduce Chicago’s pension payments over the next five years. The average price of a general-obligation bond maturing in 2040 climbed 1.5 percent Monday to 91.7 cents on the dollar. That pushed the yield to 5.6 percent, the lowest since May 12, before Moody’s Investors Service announced that it cut the city’s credit rating to junk.

    “It alleviates an immediate fiscal pressure,” said Gary Pollack, who manages $6 billion of munis as head of fixed-income trading at Deutsche Bank AG’s private-wealth management unit in New York. “That’s obviously positive for Chicago, which means it’s positive for the bondholder.”
It would appear that the market is already assuming the Bill has been signed by Rauner...and Rahm is off the hook at no cost and without a casino in existence. Sorry, but the FOP is doing a piss-poor job of keeping anyone informed.

The next FOP meeting is 16 June at 1900 hours. We'd expect every single retiree to be in attendance to find out exactly what is going on along with everyone even close to retiring and anyone currently hoping to get a pension - pretty much everyone.

The city doesnt have to file bankruptcy they simply pay other bonds and avoid pension payments while continuing in the great tradition of ripping off the public. For rahm and the others to slip this in and pass it was the kiss of death for the fund. If you are young run from the city and if you are older pray a lot.

This would mean that until every single penny of city bond debt is paid off, these payments to the pension will not be made.

And Cullerton, "Friend of the Working Man", tried slipping that through? Outrageous.

Even if Chicago paid off every penny of debt tomorrow, we all know Rahm would borrow some more money via bonds to build anything else before he put that money into the pension. This is unacceptable.

Senator Cullerton pulled the bill at the end of the session for a motion to reconsider the vote. I'm not sure why he did that. It may have something to do with eliminating this escape clause. I urge all coppers to contact Senator Cullerton's office and ask him for clarification.

Another 'BS state law VERSUS the Illinois Constitution' fight already?
Do they doubt the outcome, or is this a way to put off payment until they declare bankruptcy? Losing this legal battle will add tens of millions of dollars more to Chicago's more than half billion dollar pension payment.
I suppose we could find out who the city will be hiring to defend them by looking through the political donation rolls since they may as well grease some (more) palms on the the taxpayers backs.

I am an active Sgt paying an annual FOP membership. I am appalled by the lack of communication from the FOP leadership regarding their opposition to the out right neglect by Madigan (pompous, selfish jerk that he is) and Rahm regarding the city's payment obligation to our pensions. Truthfully all the blame is not at the doorstep of Rahm but most of it is the fault of our Royal Mayor, Little Richie Daley. And when you come to think about it more closely, the blame extends to pretty much all the aldermen, and ILL House Reps & Senators because they were allowed by our unions to just kick the can down the road. Perhaps it is OUR fault because we didn't put a stop to the can kicking. When was the last time you saw a genuine concerted effort to unseat one of these politicians? All you hear is, "GIVE ME MINE FIRST" and the heck with everyone else.

The message I get here is that police lives don't matter and all involved in pushing this legislation could give a rats ass about me or my brother officers and our families. The next move will be to reduce the pensions on our backs. They already believe we can survive with 125% above the poverty level. I wonder what their pensions look like?

Pension is gone in exchange for future promises that won't come to fruition. Count on working as a security guard at the Casino for 10$ hr to make ends when you are 63.

This is incentive for the City to borrow as much money as possible and then piss it away. Sorry, no money for pensions because we are obligated to pay the bond holders back first. You get the crumbs. If restrictions were put on borrowing, I could go along with this but Rham will continue to borrow to pay operating expenses. This is bad.

If the city does not pay the arc we intercept 22 million. No language to go to court. Thanks Mark. This Bill forces the city to find the pension not forgiving one cent. Dean's Board unanimously voted and approved to draft a casino bill. That did not happen. Instead, Dean went around the unanimous vote and went to Springfield where he told lawmakers that police are "neutral" on putting off the payment.

Unfucking believable - what the hell is the FOP doing??? The court mandated that payment, so they just decide to make a law to override the original court decision. Is there any legal recourse for this? They are actively trying to bankrupt the pensions -- and this is blatant proof. This is absolute bullshit and I know everyone has had it to the gills with all these asshole kleptocratic politicians. Watch, this just allows the city to continue to spend more money on other unnecessary and frivolous projects that serve nothing else than to enrich the connected friends and donors of the elected. Time to sharpen the guillotines people.

I would like to know what pension fund handles the pensions of alderman and state legislators? What is it called? How well funded is it? I am going to call my alderman's office and I will ask them that question. If their pension benefits are funded better than ours and I suspect it is, then we should do something about it. If they are going to force us to live poor because the city is broke then they should live poor too.

Finance guy from fop came to roll call in 24 and explained that changes made to lower initial pmt to $380m then make necessary pmts over time. This raises bond rating to borrow to build casino. On surface sounds reasonable but with politicians, lawyers, and money involved God only knows what really is going to happen. They can't get out of paying pension. Can't reduce benefits. Can't declare BK, to much revenue and if they go BK have to give up control. And we know they never going to loose control of Chicago inc. They loose the skim.

FOP, get some busses lined up. Save the money from the golf outing, the fishing contest or even the picnic and pay for busses and signs. What this means that all bond holders will be made whole before money is paid into the pension fund. They will default on pension payments before they default on any bond. But don't forget, you will still be guaranteed 125 percent poverty level payments, so you will never be left with nothing.

Again let me repeat. Madigan was voted in and no one ran against him. Rahm won in a landslide, the media and almost everyone says only Rahm had a plan. Was Garcia really that bad where he would just not pay into the pension and say fuck you? What is worse at this point? Sad day for Chicago for this situation to be staring us all in the damn face. Just for SANITY'S sake I'm curious if there's Any way that The City made a priority of having the ability to borrow. It's Credit Rating has to be top 10 in worst Big Cities to lend too. Our credit is SHIT. Wouldn't loan Chicago a nickel that I found on the street.

The FOP is going down the same road that the CTU has gone down; and look how its worked for them: the teachers' pension plan is 3/4ths of a billion behind where it should be. The city always uses the same tactic: when pension fund payments are due, they threaten there will be drastic budget cuts and lay offs if they are forced to make the required payments. The union, leadership, not wanting lay offs, relents. Well, FOP, you arent doing anyone any favors. Unless the incremental payments are made as scheduled, there will be massive layoffs when the city can no longer push back the payments and the balloon payment comes due. If the mayor, council and Springfield wont increase revenues now to cover the smaller payments, what makes you think they will approve a giant tax increase to cover the balloon payment? They wont. In case of bankruptcy the following should be considered:

Cities in Illinois cannot, as yet, declare bankruptcy. That law is not yet law.

In case of an actual bankruptcy filing by the City of Chicago any law that subordinates pension payments to bond payments doesn't matter one iota. A bankruptcy judge decides where and for what any funds are spent, not state law. If a judge says "Pay the pensions" then that is it. If a judge decides bondholders get 50 cents on a dollar then that is that. Whatever Madigan and Cullerton (Capone and Nitti) conspire to do doesn't matter in case of bankruptcy.

It is, however, imperative to get Dean Angelo Sr out of office as soon as possible. Mike Shields never did as much harm to the membership as Dean Angelo has already done. This guy has to go and quickly.

I admit I don't completely understand this but, can the city simply craft a bill that says they don't have to make court ordered payments to the pension? Seems to mean that the courts ruling has no real meaning. Break this down for me/us.

The bill appears to clarify that revenues designated for bond repayments have to be used for that purpose. I am not sure why such a clause would need to be added unless there is no such requirement elsewhere, which would make government bonds issued by the state or it's localities a whole lot more expensive.

In other words, if you sell bonds by claiming they will be repaid from a specific revenue stream, the bond repayments have to be made from that revenue stream before they are used for something else, like pension funding, or building more parks to name after wives of former mayors.

If this is what is being done, it is a completely rational thing to do.

consistent with the payment schedules associated with such obligations.

it does not appear that bonds can be prepaid under this clause. just that the bonds payments come first. that is pretty standard for bonds. they are very high in the food chain of debt.

I would just like to know that if a Court orders specific payments to be made to pensions funds (or any fund) can a state legislature just pass a law to circumvent that court order?

And, can the FOP negotiate or bargain an individual employee's pensions benefits?

As a retiree, I came on the job when there was no FOP/union. I was automatically (as are all city employee's) placed into a pension fund. I (as are all city employee's) not given any other option than the city pension fund.
How can the FOP or any other union bargain the pension benefits?

Can someone who is knowledgeable about these things in Springfield and with the FOP please respond?

Just spoke with the senators office. Unfortunately what is stated is correct the Bill was passed to give priority to "more important" city debt. What this allows is for the city to make a small payment to the pension fund this fiscal year and not the ordered 600 mil.because they would of used that money to pay other debt. By making a small payment and showing good faith in the states eyes the city will eventually catch up and our pensions will not be diminished as stated... Yes the can is getting kicked down the road.The senators office did not know if the police and fire unions where on board with the 777 bill. The senators office stated they expect to pass another Bill to clarify this one if the governor does files it. Please call senators cullerton office and ask your questions. Caitlin was the person who I spoke with and was very helpfull. Call the Springfield office the number was provided in the comments section. Our future depends on it

A few years back I stated that the city would never pay. Had a few comments about state law and the rest of that nonsense. Basically, the city kicked the can down the road a bit. The pension fund will get more money and be solvent for a little while longer. In 2008 I guessed the fund would be belly up by 2020. With the additional revenue, 2024 or so would seem reasonable barring another catastrophe. It is amazing though, that next contract time, all the posts will concern themselves with the retro money, just like the last contracts.

On May 31, the General Assembly passed a bill (SB 777) that changes the City's contribution to the Chicago Police Pension Fund. The bill is now being held by Senate President John Cullerton. This bill, that was NOT supported by the PB&PA organizations, was to be part of a greater plan to solidify our pension fund. The legislative efforts to stabilize the fund was explained at a May 20 meeting of the Chicago Public Safety Coalition (FOP Lodge 7, IAFF Local 2, and the three PB&PA Units). The plan called for legislation that would grant the City of Chicago their own casino where the profits of this casino would be contributed to the police and fire pension funds. This commitment was estimated to be in the area of 350-500M per year until the respective pension funds reached a 90% funding level. The trade-off for the city's dedication of casino revenue funding the pensions was that the public safety unions support a re-amortization and ramp bill that turned out to be SB 777. On May 21, the CPSA Board of Directors agreed to support the casino bill for the dedicated revenue stream to fund our pensions. The re-amortization bill would only be supported contingent upon the casino bill being passed. We felt that we could not support that legislation without the dedicated funding source already being in place. Without the support of the PB&PA unions, SB 777 was introduced last Friday and passed on Sunday. As the bill is being held by President Cullerton, this gives our legislative liaison and lobbyists time to raise our concerns and suggest solutions to some of the troublesome language contained in SB 777. With the General Assembly still in session, anything can happen.
Below are some of the changes as compiled by the Center for Tax and Budget Accountability:

In analyzing the changes that SB 777 makes, it is important to remember what the bill does not do:
· The bill DOES NOT reduce any pension benefits either currently earned or in the future.
· The bill DOES NOT change the total amount the City owes to the Chicago Police Pension Fund.
· The bill DOES NOT change the employee contribution to the Fund.
SB 777 makes three major changes to the payments the City is required to make to the Chicago Police Pension Fund. As noted above, the total liability of the fund is unchanged by SB 777. However, the bill does extend the time that the Fund will be severely underfunded. The legislation specifically does the following:
· Delays determining the City’s annual contribution based on benefits earned and unfunded liabilities from tax year 2015 to tax year 2019. The City’s contributions for tax years 2015-2019 are specified in SB 777 and are NOT determined by actuaries each year;
· Extends the time to reach 90% funding from 2040 to 2055; and
· Provides the Chicago Police Pension Fund the right to sue the City if it fails to make the contributions required under the bill.

I am an outsider to this process so I do not gain or lose regardless of how it turns out. So... what irks me the most is the abandonment of the rule of law. Wisely or otherwise, they promised you guys the money and if they are not going to pay up the city of Chicago should have to go through bankruptcy proceedings. Instead this is an attempt to weasel out of it painlessly. What it really is at core is the loss of the rule of law. Things become what ever the potentate at the moment want them to be. No binding rules.

Perhaps I am overly pessimistic, but as for you coppers, what I would hope for is getting most of the pension. It would seem that it is progressively less likely that you will got all of it.

And while we are at it, just whose side are these union guys on? Why the (blankity blank) are they not acting as agents of your interest? Are they paid off? Do they need voting out?

However since the election not once has there been any elected representative out to the district roll calls like you insisted would happen. Why?
While you are a affable man, you certainly aren't a police officer of integrity. You have lost your honor, since you have recieved a check for a disability from the pension fund that is so underfunded. Essentially all the contributions you made to the pension as an active duty officer you have taken out, then you took other officers contributions to the fund out claiming disability which is not true. Your not disabled. Your an able bodied, maybe limited, but certainly able to work and contribute. Ironically your a well paid welfare recipient, only the membership has been making your monthly welfare payment to you.
Since Ive been on this job there has not been one decent FOP president that hasn't sold the members out in some way they have all sucked and thats been 25 years now.

IL Sup. Ct. just ruled that "pension benefits may not be diminished or impaired" means just that.

So they can subordinate the payments to the pension fund all they want - but the simple fact of the matter is that unless, and until, there's an Amendment to the IL Constitution changing the language of the pension obligations, that no matter what the Legislature says, does, or passes, that it's all UNCONSTITUTIONAL.

By subordinating the pension debt to other debts, and continuing to not fund it, doesn't relieve them of the obligation of PAYING the pensioners what they're due. If they can't pay because the money isn't there, then that's a diminishment or impairment of the benefit and they're going to have to fork over the cash to the pension fund to make people whole, and you don't need a law degree to realize this.

Typical IL/Shitcago Dumbocratic bullshit tactic to try and wiggle out of an obligation. You guys need to get your FOP on the legal case - as soon as it's signed, file an immediate motion for injunction with the Court because this is against the recent IL Sup. Ct. ruling. And if your FOP doesn't get their shit together and do it, then FORM A NEW FRATERNITY, vote to decertify the previous frat, and certify to recognize the new Frat.

You guys hold all the power in this matter - exercise it. Stop letting a bunch of connected shitheads run roughshod over you. You're CHICAGO POLICE for crying out loud - stop acting like pussies, and act like the Police. No nonsense - all business. Put an end to it.

Two weeks ago I post this message on a pension story on this blog. I stated that while watching a local television news talk show there was a very well know Chicago Labor Attorney who stated that a pension could be changed by one of two way. One way if there was a bankruptcy and the other if a union WOULD GO ALONG with the changes. I sited the International Brotherhood of Electrical Workers #9 and the City of Chicago. Local #9 agreed to give up benefits. This was done without the consent of it's membership. There were two very nasty replies to my postings. It appeared that the replies came from person(s)affiliated with the FOP. If what this current posting is saying is correct, then what I posted was correct. I don't know if this agreement can stand a legal challenge. I do know that retiree's of Local #9 were part of the law suite that challenged the reduction of retiree's benefits. I do know that if the current President of the FOP agreed to a reduction of benefits or did not object to the current Illinois bill #777 then he should be removed from Office. It is a dam shame that a person elected to represent the men and woman of the CPD is so blatantly selling the membership out. If this is true then he got to go. If this is true then the Attorneys who work for the FOP and negotiated with the City should also go. If this is true, then how can he trusted in further negotiation with the city. Love her or hate her, THE FOP NEEDS A LEADER IN THE KAREN LEWIS MOLD. It is going get interesting in several weeks when Rahm does not make the payment to bail our the Board of Education. What he does with the BOE will give us a preview of what he will do with us. Remember, the BOE can strike, we can not. This is all the more reason to force Angelo out of Office.

Fyi, this bill (SB777) was never voted on by the fop board.
Dean and only dean was in springfield and was neutral on SB777. What that board did vote on was a casino bill (unanimously) but that bill never got submitted in Springfield. Dean should be brought up on charges for failure to represent the best interests of the members.

Here is the problem....they are putting off the payment UNTIL time comes to make that constitutional amendment. It can happen every 20 years. When the time does come to bring that issue back to the polls, the pension crisis will be worse than now and they will be all over the media telling the sheeple we need to have a convention to reform the pension system. Then they can do whatever they want.

After reading the above comment I think that the poster really needs a law degree. If the funds run out of money the city does not have an obligation to fund them any more then the law requires. The funds will become a pay as you go fund and would mean substantial cuts to pensions. Uninformed people with thinking as above will allow the law makers to slid out from under. Our pension fund is in real trouble and only a tax increase and a reduction in benefits will save it. People don't care if you are thrown out on the streets.

listen folks police officers deserve pensions , we work weekends , shifts for straight time . yes we know that's the job we signed up for , but it also includes the pension we signed up for. Com Ed , ATT , Peoples Gas , guess what we are all paying their pensions , no complaints . It's a scam , $$$$ wasted by politicians .
city tradesman receive union and city pensions , that is the abuse of patronage , cops pass a test and are not preceint captain workers that are forced to buy tables of tickets for fund raisers to keep their jobs .

Rauner has stated several times that he doesn't like the bill and, when asked, said he doesn't know that he will sign it. Now's the time to let Rauner know how weand our voting families feel about that bill.

How did this goof get elected? Dean has been a scammer his whole career. He injured his knee playing softball and turned it into an IOD with the help of Bill Nolan. Nolan and Dean gave away our health insurance back in 2001.Then he gets elected and now he is going to give away our pensions. We are stupid and get what we deserve.

There are many good, informative comments on this thread. I asked an individual in the know about SB 777 and he related that there is no conflict with the Constitution. One deals with benefit levels, the other a funding mechanism. They are exclusive to each other. (Kind of like the scene in Goodfellas. Got a problem? To bad, pay me).
As for the folks who have dissected the minutiae of the language of the bill, my only observation is to look at the Supreme Court case regarding subsidies for Obummercare. The law is black and white; except when politicians ignore said law, and language.

Finally, to the poster who said that historically regimes go after the weakest link, and old, white retired folks will bitch and moan, but not do anything more, remember. When you give people nothing to live for, they act like they have nothing to live for.

As a side note, check out Matt Bracken, "What I saw at the Coup". A good, short read. The politicians and lawyers get theirs in the end.

So I googled the 2015 Federal poverty level and discovered 125% is about $15,000 a year. Some please tell me I'm missing something. I don't don't trust these guys one bit. Why is that language needed. That would seem to diminish our benefit quite a bit.

If a judge says "Pay the pensions" then that is it. If a judge decides bondholders get 50 cents on a dollar then that is that.

The judge does not get to make it up as he goes though. The bankruptcy laws don't allow unsecured creditors to be paid before secured creditors. And bonds are about as secured of a debt as there is.

It is pretty common in bankruptcy cases for unsecured creditors to get nothing because there is nothing left after the secured creditors are paid off.

I don't know how it is with government pension plans, but IIRC, private company pension plan liabilities are unsecured debt.

Compare Sections 15-112, 15-154, and 15-157 side by side, OLD next to the NEW.
You will notice the slight changes in language. Notice any new DEFINITIONS also.

For example, a "Calendar" year is different from a "Fiscal" Year, which is different from an "Academic" year....Which changes the actuary math.


Find a loophole.

Start a new credit union that offers some decent investments.

Create a Tax-Exempt Retirement home/non-profit corporation.
