FOP Wins A Round

  • An administrative law judge says the Chicago Police Department violated state labor law when it failed to negotiate expansion of its body camera program with the city’s largest police union, according to court documents.

    Administrative Law Judge Anna Hamburg-Gal found the city failed to bargain with the Chicago Fraternal Order of Police when it expanded use of body-worn cameras to 14 police districts in 2017. In a recommendation order handed down this week, Hamburg-Gal advised the city to begin a dialogue, as required by state law, on safety and disciplinary matters surrounding the 2017 body camera expansion.
The no-so-good news - the city can still drag their feet:
  • The recommendation won’t have teeth unless adopted by the state Labor Relations Board, and does not stop police officers in those districts from using body cameras issued in last year’s expansion. Nor does it reverse any disciplinary action against officers based on footage obtained from the cameras, the ruling says. It does overturn any discipline meted out as a result of misuse or loss of cameras, and it halts any future disciplinary action until the city and the police union complete the bargaining process.
Hopefully the FOP doesn't squander this opportunity.

Fellow officers, I am writing this to you all to let you know that the moment has come in whether we show solidarity with each other or turn our backs on each other and cower away! No one wants to be that person called upon to go against the tide. Most of us want to live our lives as simple as we can and do what’s best for ourselves and our loved ones. But on Friday 29 Dec 2017, the city showed its intent when it comes to us, that is to persecute us! It has unleashed a beast that will not stop until it has made a name for itself as a persecutor of “bad cops”. Most officers have taken the fetal mentality. Has much as I hate that way of policing it has become an appropriate method in order to avoid this beast called COPA.

The problem is that being fetal will not ensure your safety when it comes to complaints, persecution, and termination. You still have a job to do and by policy and law you must respond to your calls accordingly. This officer did just that when he responded to a mental/domestic call. He took appropriate action that was well within policy and the law! Yet, here we are two years later and this officer may now face termination and possibly being charged! So, how long until you’re the next officer being called to COPA to answer for your actions? How long until your face is plastered all over Chicago media and your home address is shared live on TV? This is not about salary, healthcare, pension, or whatever! It’s about the quality of life, our dignity, and honor! We cannot rely on the FOP or anyone else! We must rely on each other! Regardless of your skin color, gender, religion, and sexuality, we all are blue! We are blue when we put on that uniform and star!

So, I am asking all of you who are reading this, if things continue to decline then it will be time to show a sign of solidarity. We will show solidarity by applying the blue flu method! Or any other method deemed appropriate. Right now would not be the right moment. But I say let us choose Memorial Day weekend 2018! Whether you’re a PPO or about to retire Veteran, we must stick together! We can make a difference if we stick together! This department had a legendary reputation, but we are now the laughing stock of the nation! Enough with the petty bitterness that divides us and let us come together! I am a blue shirt in a management spot, and I am more than willing to do what it takes to defend my brothers and sisters in blue. Pass it on!

Much ado about nothing. Officers are still going to be wearing them, and they can still be disciplined for wrongful acts committed (and captured) while wearing them. The cameras aren't going anywhere, regardless of how the now mandated/'suggested' negotiations go between the City and the FOP. And the city WILL drag its feet on that one, rest assured.
It's just too bad that bodycams aren't mandated on all of our city and state elected officials.

So does that mean that if something happens quickly, meaning it escalated so fast that you don’t remember to turn your camera on immediately because you are more focused on shithead trying to hurt you or someone else, that we won’t get sparred or in trouble? Because there are officers getting sparred left and right for this exact reason. Even though the cameras did get turned on at some point, like after offenders were placed into custody or even some time during an incident, the bosses are still sparring us. Most of the time we remember, if we have lead time to think, but often times shit “hits the fan” fast. These punishments should be reversed.

WTF? What kind of comments are these? Gents, keep in mind it was the FOP that filed this with the Labor Board. It didn’t just magically fall into their laps. Why would they back off on it now?

And by the way, the last time I checked, every benefit listed in our contract was fought for and earned by the FOP. The City didn’t just give us these benefits because we are so well-loved. Every mayor, with the exception of Jane Byrne, couldn’t give two shits about any of us.

And while I can certainly appreciate the opening poster’s hatred for COPA, abusing the medical to make a point isn’t the way to go. First, the reality is that there likely wouldn’t be enough of a showing to make a point. Secondly, just for shits and giggles, let’s say enough people did participate. We would be giving the City fodder to try to eliminate one of the best benefits we enjoy. A blatant misuse department wide might just convince an arbitrator a change is necessary. Every copper that I’ve ever spoken to outside of the city would kill for our medical. How about waiting to see what FOP has up it’s sleeve? They have already mentioned legal action against COPA.

December 19, 2017 – Last week, a Fitch Ratings report determined that Illinois is the worst in the nation when it comes to pensions as a share of residents’ personal income. Under Fitch’s calculation, Illinois’ total debt – defined as net tax-supported debt and net pension liability – amounted to more than 28 percent of Illinois residents’ personal income. The average in other states is 3 percent. State Representative Jeanne Ives, a Republican Candidate for Governor, released the following statement:

“After his election, Benedict Rauner was quick to abandon us in the fight for pension reform. While some in Springfield chose to ignore his betrayal, it did not go unnoticed by the ratings agencies. And once the junk ratings come, it will be too late to reverse course without an enormous amount of pain to taxpayers, state retirees, and the state’s most vulnerable citizens.

“These three items must happen simultaneously:

· Pass a constitutional amendment to change the pension protection clause in Article VIII, Section 5 of the Constitution of the State of Illinois, which states that pensions cannot be diminished or impaired. This change will ensure taxpayers are not on the hook for pension obligations on services not yet rendered.

· Require all new hires to enter a 401K-stlye self-managed plan. This provides the flexibility and ownership of assets that is prevalent in our private sector and relevant for our modernized employment system where job mobility is important to workers. As well, the US Military is shifting to this plan for all military personnel.

· Re-negotiate pension obligations with current workers and retirees. Many of these plans will either be insolvent or require confiscatory taxes that cannot be paid. We must have an honest conversation, as Rhode Island politicians had with their pensioners, in order to solve this problem once and for all.

“The plan I am proposing ultimately restores fiscal order to the state by eliminating unsustainable pensions and unfunded liabilities. This paves the way for the economy to flourish, fostering an environment where businesses can thrive and create the jobs Illinoisans need.”

I like Prieb, but I have to admit that he did a very foolish and stupid thing. People seem to forget that what you send out to cyberspace can hang around forever and can, under the right circumstances, be exposed. Just ask Hillary and Rahm about that. Be very careful and respectful about what you email or what you post in social media. I am a private investigator and I have found out how easy it is to search for your posts, even the ones that you try to erase. It is done by your telephone number or your email address and software can search dozens of social media sites.

Does it make any difference in Contract negotiations...(?) but it would be fair to say that sworn members should be prepared for Rotten Rahm to be demanding a complete revamp of Disciplinary Investigations and perhaps Grievances prior primary election season when all Candidates are filed with the Election Board.
Our Contract will be the last to ratify.

In the meantime, there’s plenty already in the Contract already for COPA’s overreach to disregard and that go beyond the politically beneficial release of bwc/dash video images.
Rotten Rahm is willing to wait it out and keep it out of the media.
He could hype up the Discipline issue as a campaign talking point, offer a paltry 7% for 5 years and blame the greedy, disrespectful FOP membership or wait and see how the his campaign is trending before saying anything more.
He gets no money from FOP so we are expendable at every level and he could always take side with the right to work lobby, and to try circumvent law with home rule to get FOP membership to stop paying fair share dues.

So if you’re still going out there with a pro-active agenda...good luck with that decision.

My thing is, this is all great the FOP won a suit and it places the blame on the city. But this reminds me of the CR files and the city retained them for past the 7 years in the contract. What did we get from that? We got from the city "well yeah you guys are right" didnt change shit, and aclu has all the CRs and the rules got changed where the city retains all of them anyway. So what do we get out of this? An admission by the city saying "oops our bad" and thats it?

If this is true then it is a disaster waiting to happen. If an officer has a job of importance like a shooting, then fine. If an officer is getting a lot of complaints, beefs, c.r.s from citizens then understandable. Commanders or Captains or whomever should not have the right to constantly be looking at video footage of officers when there is no reason for it just because an exempt has a hard on ( figuratively or literally) for some p.o. Next you will have some creep commander like Henny Penny constantly monitoring a p.o. they are obsessed with

I didn't know some of our members have decided to follow suit with the bullshit newspapers that cover this city and focus on THAT as an issue. If he falters in other ways, and doesn't live up to the expectations of his constituency, then use your vote to have him removed. It's kinda cheap and petty to highlight an old email. Martin Preib is the media person at the FOP. He attends most everything that effects all of our members . He works countless hours putting together what we need to address all the issues involved . There are members of our union who lost in the last election who do not like Marty . Marty is a threat to them monetarily . He has made a difference and speaks the truth . Is he too far off with the movement that’s anti - police that’s been going on with the People’s Law Office . Marty is a perfectionist and is working for all the men in blue . It’s easy to complain but another thing to do something constructive . When Marty and Pat Murray attended the finance committee and he spoke calling out everyone who voted for the settlement for the Englewood Four it shook up many members who are Alderman . Marty should focus completely on what he does . He is doing a great job and the “ haters “ who are in our union know it . Good job Marty and please keep it up !

Careful what you say or text to your friends and fellow officers. The Department has promoted merit, clout hacks with sensitive feelings. The new T/S from 011 who cried to the Chief until they put him in Narcotics, got a CR # on an officer because he didn't like what they put in a group text. There was a reason this was added to the constitution. Because they knew the politicians could not be trusted with maintaining the pensions. how many programs were paid for with money intended for the pensions. Just like the federal gov stealing from the SS fund, illinois gov just stole the money for the pensions. If she wants to start this she should start by taking the pensions and health care for her part time constituents. YEAH, DIDN T THINK SO.

Marty Prieb is a good guy and works his ass off for the membership. He's not perfect but it's clear that he really cares and he doesn't do his job for all the perks that come with his job. Perks that the vast majority of our prior leadership abused for years. If there are things he's failing at I'm sure he's willing to listen to whatever issues people have.

Rahm would love us to wait until Memorial Day to do something. By then this will have all been forgotten and the next issue will have presented itself. The mayor loves how we delay our actions for the purpose of solidarity. He just laughs at us and knows we do not have the courage to stand up for our convictions. We are just the idiots that he blames all of Chicago’s problems on.
Keep up the good work brothers and sisters, we the Police are going to guarantee the mayor another term which will then make him “mayor for life”.

WTF? What kind of comments are these? Gents, keep in mind it was the FOP that filed this with the Labor Board. It didn’t just magically fall into their laps. Why would they back off on it now?

And by the way, the last time I checked, every benefit listed in our contract was fought for and earned by the FOP. The City didn’t just give us these benefits because we are so well-loved. Every mayor, with the exception of Jane Byrne, couldn’t give two shits about any of us.

And while I can certainly appreciate the opening poster’s hatred for COPA, abusing the medical to make a point isn’t the way to go. First, the reality is that there likely wouldn’t be enough of a showing to make a point. Secondly, just for shits and giggles, let’s say enough people did participate. We would be giving the City fodder to try to eliminate one of the best benefits we enjoy. A blatant misuse department wide might just convince an arbitrator a change is necessary. Every copper that I’ve ever spoken to outside of the city would kill for our medical. How about waiting to see what FOP has up it’s sleeve? They have already mentioned legal action against COPA.

Turn them on all the time just leave them on. Taking lunch leave it on. Taking a shit leave it on after a year or so when you need to review it for one incident you know that COPA will go back and review all your incidents and surprise. Wouldn’t that be the shit

activity or misconduct to the Chicago IG Office!

They are hand picked by the mayor and can & will make suggestions per
his approval.

They can’t not get anyone fired, only suggest termination.

Basically they are a guard dog with no teeth.
