Cook County "Justice"

This is from two weeks ago and in the suburbs, but it's Cook County and Crimesha Foxxx is keeping true to her (and Prickwrinkle's) promises:
  • The Cook County State’s Attorney has refused to approve felony burglary charges against two men caught by Oak Lawn Police after a three municipality chase and search and a written admission by one of the men that he was entering other cars without the owners’ permission.

    As a result Khadafi Dailey was charged with misdemeanor reckless driving, driving with a suspended license, leaving the scene of an accident and obstructing a police officer. His passenger in the car was charged with only one misdemeanor of obstructing a police officer.

    The chase started on Sunday morning, November 4th at about 3:30 a.m. when Oak Lawn police units responded to a commercial burglar alarm in the vicinity of 96th and Cicero Avenue.
So, a Burglary, with the "required" written admission and Oak Lawn PD gets misdemeanor Obstruction and traffic charges.

Kind of makes you think that all police work is pointless.

Yes during these trying times doing police work is pointless. Things will not get better until they get worse and the public gets sick of it and cries for law and order. Until such time don't get caught in the switches and put your career on coast. It's the safest thing to do.

Removing prosecutorial discretion from political hacks, and restorinng it into the hands of We The People JURIES puts a end to this problem entirely.

Issue arrest warrants, execute them, and THEN TRY THOSE CHARGES... along with any additional ones that come to pass as a result of the warrant serving.

SA and ASA is supposed to do what we the people decide...not what their politician bosses decide.

Powers that be clearly want to deter police work. This attitude will drive down arrests when cops get tired of banging their heads against a wall. Reduce the the arrests and you reduce the chance some crim will resist, get (deservingly) shot, and become a martyr.public safety is sacrificed of course. But the people making these decisions usually don't live in the neighbourhoods that are worst effected.

Kind of? No it is, at least in Chicago. Why anyone would want this job now is beyond me. It used to be all the hair gels, running and gunning, would be the ones that would step on their d**ks. Now all you have to do is just enforce the law as it is written and you can be written up, suspended and/or fired based solely on an accusation.

One of the problems in the State's Attorney's Office is that there are NO ASA who are willing to speak out (i.e. disagree with and tell FOXX that she is wrong). Anyone who had the guts to do so . . . LEFT within FOXX's first year.

I just wonder, is there a pattern of behavior by the States Attorney in regard to the catch and release policy or is "everybody" getting the same treatment? I mean are whites, asians and hispanics being handled the same or is there systemic racial discrimination in action? If there is, why is there "no" concern or action against the States Attorney? People have lost jobs, been ridiculed and ostracized for alluding to a comment that may be construed as racial prejudice, and don't even think about using the "N" word! Members of the community are putting everyone at risk and are not being held accountable! How can this be allowed to go on without being addressed and punishment meted out to responsible parties? Meanwhile the axxholes in the NFL are kneeling for injustice? We should all kneel with them and call attention to the racial injustice that is "obviously" in action in Chicago!

So, Kim Foxx continues the catch and release policy! In another blow to the chaos in the city, Bobby Rush is protesting and boycotting Target for closing "NON PERFORMING STORES" in "HIS" community! Non-performing because more items are going out the back door than are being rung up at the register! Has anyone asked the "very esteemed black panther" I mean congressman, just exactly how or why Target should continue to lose money and yet still stay open in these areas? At the same time just wondering what he is worth and why he didn't give "all" his money to the community??? I mean it's obvious that this is the thinking!!!

Well, I predict that Ms Shit-For-Brains will be in for a rude awakening if she tries this shit with Crime Victims & Police Departments in the farther reaches of the county that do NOT coddle criminals, like say ... Arlington Heights, Barrington Hills, or Inverness.

Those citizens pay a boat-load of County Property Taxes and they rightly expect that their tax money be used so they can remain safe, and any and/or all Criminals arrested get prosecuted according to their 'alleged' crime.

OT. Willie Cochrane withdrew his guilty plea. Usually it's best to wait em out, but pleading guilty to one charge prolly woulda been the smart thing to do. Now the gloves are off and he's facing about 15 charges I believe. Didn't work out so well for Blago going to trial.

I am not an apologist for Foxx, but I see the point of the refusal. There was no specific vehicle identified to tie the recovered merchandise to. I would think that if the link is established in the future, then charges can be upgraded. However, i am and have been against the statue of vehicle burglary, an offense that for many years was theft from auto. It is making felons, unnecessarily, out of young people which is affecting their lives. If you think or any legislator thinks that making an action a felony really deters someone who is a drug addict from doing something, then you are misguided. California has changed their laws and reverted back to a misdemeanor of theft from auto. A good move on their part. At one time in this country the police used to be able to shoot the driver of a stolen vehicle who was eluding the police. That never worked either and the law was changed.

It just frosts me that it’s just how Cook County does reformative criminal justice...AND gets away with it.
The voting public cast +/- 800,000 votes in 2016/2018 for Prickwrinkle-KmmFxxx and now JB Toilets.

Contrasting identity prosecution and detainment.
Does anyone recall that homeless person of an altered state, the frequent trespassing Ohare stowaway, Marylin Hartman(?), she was sent for a few months last year in Dart Jail awaiting...get this: A Trial, after a couple arrests for what amounted to trespassing and theft of services (and for wanting to get out of this shithole city).

Probation, affordable bonds, ankle monitors, plea deals and excuses.
It’s how Cook Co levels the playing field.

Shame on you for doing anything more than a case report for the benefit of Team Special Ed.

It's been burglary since at least the middle 80s. There's never been a specific offense of "theft from auto". Case report, yes. Offense, no. And the statute isn't vehicle burglary, it's just burglary. Nice try.

And you are exactly what's wrong with America. Nothing "makes felons out of young people." Young people committing crimes makes them felons. Guess what people who steal from cars also like to do? That's right! They like to steal from houses and people too. Guess what happens when they break into your house to steal things and your child or other family member surprises them? Maybe they get scared and run away. Maybe they get violent and your child gets injured or killed. Guess what happens when committing these crimes over and over results in worthless misdemeanor charges or no charges? It doesn't make them suddenly realize they need to straighten up and stop committing crimes. You're absolutely clueless and will never realize it. But you'll keep voting for people like Foxx, Obama, Hillary, etc., in hopes that they will help the "young people" to become productive members of society, through social programs, handouts, corruption, and free passes to commit crimes. You seem to be missing the fact that fleeing the scene of an accident, while leading the police on a car chase, while driving on a suspended license, should be eligible for a few felonies, regardless of where the stolen goods came from. Any burglary or theft charge is impossible? With a written confession? That's interesting. Have you heard of theft of lost or mislaid property?

Arrest unless involving death or great bodily harm (none in this case) driving on a suspended DL also a class A misdemeanor. The car chase if presented correctly will be charged every time so either they (oak lawn) didn’t try for that or their chase didn’t meet the criteria. Without a victim there is no case other than Misdemeanors.

The car chase if presented correctly will be charged every time so either they (oak lawn) didn’t try for that or their chase didn’t meet the criteria. Without a victim there is no case other than Misdemeanors.

    (625 ILCS 5/11-204.1) (from Ch. 95 1/2, par. 11-204.1) 
    Sec. 11-204.1. Aggravated fleeing or attempting to elude a peace officer.
    (a) The offense of aggravated fleeing or attempting to elude a peace officer is committed by any driver or operator of a motor vehicle who flees or attempts to elude a peace officer, after being given a visual or audible signal by a peace officer in the manner prescribed in subsection (a) of Section 11-204 of this Code, and such flight or attempt to elude: 
        (1) is at a rate of speed at least 21 miles per hour over the legal speed limit;

        (2) causes bodily injury to any individual; 
        (3) causes damage in excess of $300 to property; 
        (4) involves disobedience of 2 or more official traffic control devices; or

        (5) involves the concealing or altering of the vehicle's registration plate.

    (b) Any person convicted of a first violation of this Section shall be guilty of a Class 4 felony. Upon notice of such a conviction the Secretary of State shall forthwith revoke the driver's license of the person so convicted, as provided in Section 6-205 of this Code. Any person convicted of a second or subsequent violation of this Section shall be guilty of a Class 3 felony, and upon notice of such a conviction the Secretary of State shall forthwith revoke the driver's license of the person convicted, as provided in Section 6-205 of the Code. 
    (c) The motor vehicle used in a violation of this Section is subject to seizure and forfeiture as provided in Sections 36-1 and 36-2 of the Criminal Code of 2012.

And depending on the circumstances of the suspended license, that could easily be a felony. Depending on the value of the stolen property, that could be a felony. In short, you don't need an identified victim of the thefts, or a specific vehicle for a theft charge to be brought, which is what I was responding to. As for your "the car chase will be charged every time if presented correctly" nonsense, I actually laughed out loud. You've clearly never spoken to Cook County ASAs.
