Deadline? What Deadline?

What is it with the police labor organizations and deadlines? Here's another one missed:
  • SCC, the Sergeants Union messes up big time. So the Sergeants filed a grievance under the “Me-Too” clause regarding wages. This is what was sent to all the Sergeants earlier this week:

    This afternoon I received the Arbitrator award from our attorney regarding our grievance and arbitration award for the the Me-Too Wage Increase. The Arbitrator award reads as such, "Grievance is barred by the Perkovich award. None of the grievances was timely filed. All are procedurally inarbitrable and dismissed on that basis." The arbitrator dismissed the grievances of the Captains, Lieutenants, and Sergeants as they were all argued in the same arbitration. The arbitrator further stated "Given the obvious desire of all parties to maintain wage parity, I expect the matter will be addressed in the apparently ongoing contract negotiations."

    To say that this award is disappointing would be a major understatement. This arbitrator failed to follow past practice of applying one award granted to all unions. I cannot express to you my displeasure at this time. Like all of you I had expected that we would prevail in this arbitration. This award allows the city breathing room for issuing wage increases which will now have to be done retroactively at the conclusion of contract negotiations. I do apologize for the outcome of this matter. Please, rest assured we will continue to fight for our contractual rights. The battle is not yet over. Thank you for all that you do, be safe, and remember, take care of each other.


    So they lost because they didn’t file in time. What great leadership... Rumor is that next weeks meeting will be well attended and a resignation demand will be motioned. If they refuse to resign members have enough signatures to go forward with impeachment procedures. Stay tuned!!!
Anyone know what this grievance was about? And how filing deadlines are missed? Is Shields running the PBPA now?

I noticed Vallas had a statement up about that on his page, but nothing more than politicking. Someone left a comment asking about lifting residency but no one from his campaign staff has replied back on that question. Some of the comments by posters are interesting though.

Missed out on a guaranteed 3% raise for one year . That would compound over the course of your career and is pensionable. In other words something like 150 grand in a lifetime . Ooops sorry procrastinated and filed too late.

Why has the PB&PA not filed for arbitration regarding the expired contract? The Sgts., Lts. and Capts. contracts expired a year before FOPs.

Has to do with a 3% wage increase that Fop got so under the Me-Too clause the Sergeants should receive it also. Because of the unions mistake now they never will. So they would have received a retro check around $3000-$4000. But in reality it’s worth more than that because now it’s 3% less then they would be making year after year so it’s a big loss and a big screwup. Someone should have to pay for it, but we will see what happens.

RETRO HAS NOT been given up or lost!
This was only to get the Raises NOW, instead of waiting till the contract is settled. This had NOTHING TO DO with receiving pay raises Retroactive to when the contract starts ( July 1st. 2016).
This HAS BEEN DISCUSSED during the general meetings for a the Six months that the grievance has been going on.
Had you attended you would know this.
These Company men, as you put it, get paid the same as you. Unlike the FOP, the members of the board MAKE SERGEANTS PAY, not a higher ranks pay. The president does NOT get a car.

To 3:24 AM. You should research before you make a fool out of yourself.
The Fop received a 2% raise on July 1st 2016, then an additional 1 % on January 1 2017.
The grievance was to obtain that now.
When the contract is settled we WILL get no less than that because this “Me Too” clause timer would start over once the contract is settled.

From a 20 year Sergeant ( time in rank not time on job) who has been through this may times before.

Want to get screwed? Throw out the board in the middle of contact negotiations. The city would love that!
There is not enough people who have attended enough meetings to qualify to replace them.

Considering the average sgt's union meeting has about 25 attendee's and half of them are retiree's I doubt that it is going to be that much of a hue and cry, nor is there going to be impeachment etc. The board followed past procedures and filed as soon as damage was done which was the past practice and standard. The arbitrator made a political decision.

If you attended meetings you would know
This was asked and answered at a previous meeting
This does not effect Retoactive pay at all.
This was filed since the Lt’s won the 2% the FOP got in July 16.
It was seen as a attempt to not have to wait till the contract is settled.
You should note the Lt’s also lost getting the 1% from Jan 17 & the Capt.’s lost getting both early like the Sergeants did.
The result being have to wait till the contract is settled when you will get your Retro Money for ALL the raises that are in the contract.
So put down the Car/Boat/Motorcycle brochure for a little longer.

Sergeants and some Officers missed out on a grievance years back for back pay regarding housing special employment. Both the FOP and PBPA said that we would not be grieved until they paid the grievances. They did , we filed, arbitrator said too late. No brain trust at either FOP or PBPA. I personally lost out on about 30 thousand dollars. Both unions would better serve us if they had less staff and retained real expert attorneys in union matters and arbitration.

That's all well and good, but how does the affect the golf outing?

This one is directly on the board as well as the cut rate attorneys. Pleines just doesn't have it and the new on is the attorney equivalent of a PPO. When are we going to get smart and hire a real labor law firm to protect our interests? Just like the rest of the city, we do it on the cheap. Disgusting

If you read the award, it states that the arbitrator expects it to be addressed in the current negotiations with the city. All it means is you will get paid later rather than now.

This is my understanding...it was regarding a raise fop got. We, like the Lts, have Me Too clause. Lts filed first, so Sgts said we'll just wait to see how the Lts' grievance goes so as to not waste time or money if the Lts' aren't successful, since we have Me Too. Lts' grievance is successful and they receive their raise. Since we have Me Too and Lts were successful, Sgts file their grievance. Arbitrator says we should have filed earlier, even though I don't believe there was a deadline, just an arbitrary time frame set by the arbitrator. The way it was explained to me is that during contract negotiations we should still get it because of Me Too, along with retro. We just aren't getting it now like the Lts are.

@ 0324, Simply not true. 1) when sgt contract expired fop still had 1.5 years in place, and 2 pay raises. 2)Lt.s and capt.’s were in the same boat. 3)lt.s filed a grievance for me too. And the sgt.s and capt.s waited for results because we are all in the same boat and past practice was to apply the finding to all unions. When they won, the sgt.s and capts were handed a shit sandwich at which point they filed their own grievance. Arb ruled that the grievance was too late for “me too”. 3) when the sgt. And capt contract get settled the city will give the sgt.s the same pay raise they gave fop and the lt.s. This is an entirely different scenario from Shields not filing contract negotion letter on time. This was to compel the city to pay NOW instead of waiting for a new contract. End result is the same, except for loss of interest on 3k.

Now for the dumbass sgt.s who do not know how email works...there is a difference between reply all and reply to the original sender. Emailing 1100 sgt.s “REMOVE” doesnt do anything except make you look pathetically stupid. This is @ the 25 or so sgt.s that will probably make merit LT. It will be interesting to see.

It was for me to on the last 2 raises that FOP got on the last contract. I believe the Lt's got the first 2% the Sgt's did not. This was all where the FOP contract expired later that the Sgt/Lt. The Sgt belief was those raises would automatically kick in under the new contract. After the Lt's filed on the first 2% the Sgt begrudgingly filed. The arbitrator ruled they filed late and said go negotiate with the city.

Boy after reading the 50 or so emails the Sgt association needs to set up 2 email groups. One for all the merit morons and those that have never been to a meeting and another for the rest. Some of the emails looked like they were written by a CPS 4th grader. But seriously it looks like the association got some bad advise. They should have known better.

It is a raise that FOP revived because they had a 5 year contract and PBPA had a 4 year contract.
The raise will be received when contracts are resolved, and could possibly be a higher raise than the FOP received.
This loss of arbitration is only a delay in the retro to be received. The amount of outrage is over blown.

The 3% raise will be take affect after next contract is signed off on. It was either get the raise now or wait til contract either way the sgts will still get it. Captains and lts lost greivance also.

Anyway, as for Shields, he has just 4 months to FINALLY hold Rahm’s feet to the fire.
But at least we eventually got that overtime back pay...less hefty attorney fees of course.

Many would argue that by now FOP, PBPA et al. would have their acts together on union style business, negotiations and contract law.
Too many part timers, loudmouth showboats, school book smarties and not enough real world sharks.
It’s not easy work by any means. True dedication doesn’t end at 5:00 pm M-F.
We always (and it never fails), pander and dance to the mayor and his vast team of cutthroats, insiders and loyalists and wind up giving up more than we get back when they present some onetime shiny bag of trinkets.

And in the end, the ShortShanksRahm and successors thereof, eventually go and circumvent or ignore contract obligations to appease a disgruntled deadbeat community and likely electorate.

So from what I gather it’s the unions position that the 3% will automatically added to whatever wage increase is agreed on come contract time. Does anyone really believe the city will do this?? Especially when they know they won this grievance already?? Something with this argument just doesn’t make sense. Then why did we grieve it to begin with??? Why waste all the time and money on something we were going to automatically get anyway? And why would the city use all the resources fighting something they were going to give up anyway?? I hope Biolotta and Pettis will be explaining this on Thursday.

Calm down Einstein, and get your facts straight. You will get your raise, pensionable and retroactive, when the contract is settled. This was merely an attempt to get the raise while the city is dragging their feet on contract. There was no "Shields-type" deadline missed. You aren't going to lose out on 150 grand, Henny Penny.

As many of the more intelligent Sergeants have noted, this money will be granted. After the Lt.'s received their award they still waited 8 months for the city to pay them. The Sgt.'s, Lt.s, & Capt.'s unions all filed upon learning that the arbitrator from the Lt.s grievance did not honor past practice of giving to all the unions. Upon filing immediately after the Lt.s award this arbitrator agreed with the city argument that the filing was late. Of course the city will argue that so they can pay us later. This is typical police hue and cry without gathering any facts. Go ahead, ask these guys to leave, buy be very careful what you ask for. New team, new contract negotiations, you won't see your money for 5-6 more years. The city would love to see PBPA walk away because of a few idiot Sgt.'s with their loud mouths.

You guys are trying to blame the current group. This all started and was done on someone else's watch. And he's gone now. He retired in June. JA was the guy making the decisions. Nobody in this group had the authority when this was filed. The current guys were just doing what they were told by Jimmy.

It seems to be a case of a lot of misinformation. That falls on the leadership. For months we have been told “don’t worry it’s an automatic win” and then this. Also Vice President Pettis himself is telling members that a mistake was made and now in order to get the 3% we will have to give something up at the table during negotiations. That’s from his mouth himself. So naturally when people hear this there will be this reaction. Plus I just don’t trust the city at all that they are going to agree to give it to us. And for those that do I hope you are right because if it comes to be that we don’t get it for sure I will FULLY support new leadership.

Sgt’s Membership should contemplate:
1. President P.B. is running the Union alone, because
2. Vice President C.P. Is not in the Union offices assuming his role but still in HR Unit 123, because...
a. He can’t give up the OT in Unit 123 (but STILL collects the VP stipend from the Union);
b. He likes the unauthorized “take home car” from Enterprise w M-Plates;
c. To curry favor by helping all the exempts kids (even the dirty ones) get on the job before they leave;
d. and of course, in hopes of making Merit Lt. Chief BW put him in but he’s in personal concerns now for losing his gun a 3rd time plus some additional harassment CR’s - so, no Merit for him);
3. PBPA attorney Tom Pleinas has Alzheimer’s and can not handle the workload anymore;
4. The Union did not prepare for a smooth transition when Jim Ade left nor did they anticipate how worthless the new VP would be in the day-to-day responsibilities.

The Sgt’s Union is not like the FOP. The PBPA only is slotted 2 officers (Pres & VP) assigned the Sgt’s Union offices. Those two carry the workload. In this current PBPA administration, one man is doing the job of two. Unlike the past administration of J.A. and P.B. who had a good working relationship this administration is overwhelmed and truly not capable.

These points are often discussed in OLA & MLAS (openly) amongst the City’s negotiating group.

That is an absolute lie. The current President was the Vice President, he followed JA around for a year and a half and sat in on every meeting and phone call because they (JA and PB) knew that JA was retiring. PB and the rest missed this one and it’s a big deal. Don’t let them say oh well get it back not without concessions.

So all of the supervisors union bosses had a “Mike Shields moment”....we don’t know why Mike did what he did but maybe the bosses unions can explain? Will they dilute their seniority rights and produce a shit contract for its members like Dean did so they can recoup the pay they rightfully deserved but were denied??
