Once Again, It's Over

Corp Counsel was never really your friend. We've been there many times and their first responsibility was ALWAYS to the City. Fine, we understood that going in. But now they are actively looking to stick it to cops:
  • I'm at Corp Council, been here a few hours. No stranger to how things operate there, unfortunately. Been going there for many years.

    So, imagine my great surprise when the lawyer handed me a document, specifically, asking me if I WANTED them to represent me. And, I was also given the option to hire my own attorney, at my expense. Then, she goes on to explain that Corp Council, is NOW divided into 2 parts: 1 group of lawyers represent US, the Police and another group of lawyers, specifically and purposely represents the City ONLY, on the same case. Wow, what a shocker.

    It gets worse.

    You can't even talk to a City lawyer, on the same case, without your assigned lawyer present. So, what does this mean? It now seems, as soon as the City lawyers, can get the City off the hook for a case, they will throw us under the bus. It appears, this is a legal move to make it easier for juries and judges, to punish Officers with punitive damages and other penalties. Wow, I'm glad I'm leaving soon. This is NOT good. Pass this along, to your troops and forewarn them. Damn.
Between this and the post directly below, if you stop anyone proactively, you are taking your continued financial well-doing into your own hands. We don't care if you follow the new rule book to the letter. If you give a lawyer enough money, they will sue anyone for anything, including cops doing everything by the book:
  • We repeat - you are taking your continued financial well-doing into your own hands

It has always been that way.They just never informed you of the 2 separate City Attorneys.The initial speech was always informing you of the option to hire your own attorney and the listing of your assets for potential Punitive Damages and their expectation of your full cooperation and testifying in the way that they wanted you to if it came down to a trial.Was down there often enough to catch on that the Corporation Council and the Private Attorneys that were filing the law suits were very friendly with each other socially and in many cases attended the same Law Schools.Being single and renting/leasing everything enabled me to be direct and to the point with these wonderful people.Listened to their threatening speech exactly 1 time.Informed the Corporation Council very politely that you will be my Attorneys until you inform me that the case is going to trial.At that point you are fired and i will be represented by my own attorney.Over 34 years on the job and lots of law suits never had to obtain my own attorney.Of course it was a much different Police Department during my years.SCC advice is obviously right on the money and should be followed.

Reign in the horses cowboy. Yes, city will bring in attorneys to represent the city. Corp Con represents you. Both entities want to know their liability in whatever matter is being questioned. Doesn’t mean the city is hanging you out to dry. That being said Corp Con “should” work only on our behalf, doesn’t mean they always don’t look out for their our best interest. Get it.

It does not change anything. The city cannot escape liability for actions of its employees taken within the scope of their employment. It makes no difference how many city lawyers are involved.

As for punitive damages, an employee cant escape them by not having a city attorney who is looking out solely for the interests of the employee.

This new policy will be more incentive for greedy lawyers (People's Law Office, Loevy & Loevy, et. al) to routinely sue officers hoping to garner more funds. This is an issue that FOP should address during contract negotiations.

Sure sounds like a conflict of interest having lawyers in the Corporation Counsel having opposing goals. Furthermore if you retain a Corporation Counsel to represent you how can you trust them when their co-counsels will be working against you. Trust no one, do nothing to place yourself in this position.

Someone needs to get off the ledge. The City has had separate lawyers for YEARS. If you are accused of wrongdoing the City may also be sued based on the policies of the City. A Monell claim it’s called. The City, by law, cannot pay punitive damages levied against you. It must however, and again by law, pay any compensatory award against you.

As to throwing people under the bus you must understand that generally it’s to the benefit of the City to stand behind you and contend that your conduct didn’t violate Muttley’s rights. Why you ask? Because the City cannot be held liable under a Monell policy claim unless it is first established that you committed a constitutional violation.

It sounds like they’re just tightening up some procedures that already should have been in place. Yes you can hire your own lawyer at your own expense and you shouldn’t be talking to other lawyers without your lawyer present. Nothing to see here.

To say its over is an understatement. I just found out that the Officer living in the 16th District that took police action a few years back and tried to apprehend the catalytic converter thieves, was just handed a 180 day suspension. They don't want you protecting the neighborhood anymore. I live in the neighborhood and know that the Officer was run over by the fleeing vehicle and sustained injuries. He had an accidental discharge when he was struck, and fired a few rounds at the fleeing vehicle. I know there were no converter thefts for about a month after that. They want to give that guy 180 days? I think they should give him a medal. 180 days is way overboard for no one being hit and no complainant.

As a lawyer who handles Public Entity Liability insurance coverage issues, take my advice: never consider your employer's lawyer to be your lawyer. Sometimes, when your interests align, they will do a good job for you. But as soon as there's a conflict, they're working against you.

Years ago when I was a patrolman I had a case in traffic court with a prominent Chicagoan where he caused an accident resulting in an injury to me and damage to the squad car. Prior to the trial call I advised the sitting Traffic Court Corp. Counsel of the facts. So when the case was called he conveniently stepped out of the court room and the lawyer for the defendant was standing next to his client. The judge asked are we ready, and I said no because the Corp. Counsel just stepped out. The judge said we will proceed. I gave my testimony the other side said nothing and the judge said, not guilty. So I watched after my case the Corp. Counsel returned for other cases. You can’t beat the Democrats in this city they have everything fixed. Never trust the Corp. Counsel or the judge they are all on the same side, their side!

Wow. This is huge. So as police, we are no longer agents/representatives of the city? This is why I come in with zeros. It amazes me how with all the changes over the last few years, some coppers are out there doing proactive work.

SCC, could you please do a review of all the changes that have taken place in the last few years that scream to police officers to DON'T do proactive police work? And put it all on one post. We need more coppers to wake up.

Begin keeping your own detailed records of everything.
The training, or lack there of should be documented.
How often are videos turned on and everyone leaves, or not turned on at all.
Weapons inspection, use of force etc.

Call the Sgt for Everything.
Unsafe vehicle, down it. Mold in station, report it.
You have a cold, medical.

Zero pro-active policing. High visibility patrol is active-policing.
Speed limit to everything (other than 10-1).

Couple that with they are being paid by the city to let you collect a lot of money from their employer. Do I have that right? If I have that right all I can say is Good Luck because your screwed. It should not surprise you all in the future when the City completely cuts you off. Then you WILL have to get your own attorney at your own expense.

I have always believed that it was wrong to have Corp Counsel represent officers because it was a conflict of interest. Their primary goal is to protect the City and not the officer. Additionally, Corp Counsel has been bleeding lawyers from their office for several years now. You are getting represented by lawyers that have limited experience. They have limited knowledge of our general orders and the Use of Force. When you have to explain to your Corp Counsel lawyers several times why it was a lawful stop and why a certain use of force was applied, you are doomed.

Where have you all been hiding under a rock? Officers responded to a call from another Officers call for help bad guy is charged etc. The bad guy sued and everyone pays punitive damages and the city allows it. So be carful responding to an officers 10-1 that could cost you $$$

Guy was trying to do the right thing and CPD should have supported him. That being said times are changing and if you fire at a fleeing car, things are not going to turn out good

From not a LEO, just a city worker:
Hire your own attorney. It will cost you less in the long run. From my experience with the corporation counsel, they will try to get you to admit fault or blame a co worker to exonerate the City. Then you will be sued and bankrupted.
They tried to get me to admit fault or
pin it on another cityworker why the streetlights were out. I calmly reminded them the city bosses took bribes and bought defective streetlights. I was dropped from the witness list. The city does not you as a witness. It wants to shift blame onto you and make you the defendant.

Guess it would be too much to ask what specifically gets one in for a deposition at CC these days. Unlawful Arrest has been the mainstay for at least 15 years now, as excessive force for 25.
“ Wow, I'm glad I'm leaving soon.” is a clear example of someone having done something, too much and too late for a rotten sanctuary City and a corrupt merit-run Department.
Just trudging through rush hour traffic and paying for parking to a CC lawyers office should be enough to keep ones pro-activity desires in check.

Corp Council has apparently went the way of HMO like health groups did for insurance companies.
CC was never filled with the best and like CCSAO, it’s filled with lots of beginners usually until they gain enough props to go private.
You may even find yourself ‘splaining your case to a paralegal beforehand without even knowing it.
Expectations of professional ethics from a Groot Administration???

Police work and attempts to interact positively in ghetto affairs can be expensive.
No multi-merit boss man is ethics worthy so therefore No CB# is worth a car payment, a mortgage payment or a month of tuition.

This is great info and all but quite frankly the city is the one with deep pockets not an individual officer. City can afford millions in damages no officer will ever be found to have to pay more then 30k in punitive because it’s just absurd for one person to have that. Disagree with me ok, if the court finds me liable and I have to pay a million I am “judgement proof” which means the plaintiff gets ZERO.

About 7yrs ago I had frivolous litigation (my opinion) brought against me as a Patrolman.

I, along with the city, were defended by the following Corp. Council Attorneys.

Brian Kolb
Jessica Griff
Mary Ann Spillane

These people were fantastic, they were honest, and they trusted me.

I believed they were truly on my side and I developed an admiration and friendship with them which I will honor for the rest of my days. I cant always say this about my fellow Officers, especially when you are being sued. You find out who your friends are real fast.

There is good and bad in every profession, some more so than others. Sometimes this job can make you feel like nobody, other than your co-workers and family, are on your side.

Remember this Officers, we dont like getting painted with a broad brush either.

It has been this way for 30 years. The first time that I went down there, my city attorney said that they had just passed the bar and this was their first case with the city and that they would representing me and my partner. Then two older gentlemen in thousand dollar suits came in said that they were representing the city in the case. That's a big pucker factor right there. Luckily everything turned out OK. After that, I put everything in my wife's name or in a trust. The city has never had your back. Try to hang on and retire and move to another state. Let Chicago and Illinois tax themselves to death.

let the community rot in their own stew. Slow roll to all calls no light or sirens ever. Never chase in car or especially on foot. If they don't want them caught you shouldn't either. Try that for the next six months and see what the outcome is. Community policing is DEAD over and done with. Fetal is the standing order of the day. If you get jammed up it will be your own fault for not listening and NOONE will have your back, city, FOP or fellow officers. So stay off the limbs with a saw. You have been duly warned. Poster 11/2/19 444AM is correct, this has been going on a some time now. I was sued for 24 million dollars 10 years ago and was told that I three CC were representing me and that there were going to be separate CC's representing the city in case I was found guilty of any of the charges filed against me. If my memory is correct every time I went down for a conference there were always several attorneys present. This stopped when the City hired outside attorneys to represent me and my partner.

I have 20 years on and my first time going to corp counsel I had maybe 2yrs. Older coppers told me back then that the city lawyers were never on our side no matter how they would try to paint it. I was always told to be careful with any attorney who wasn't specifically and exclusively representing me. That's how you should all act. Be careful on the streets and the courts

All those words to say the City now offers you an attorney? I guess the implication is that the city-offered attorney is not really representing you, but it representing the city. No example given about how the city threw this copper under the bus though. Sorry, just being overly critical of the post. How about an example of how the city threw this copper under the bus?

And just an aside. If that City-appointed attorney throws you under the bus they can have big problems with the whole attorney-client privilege thing. I know, the sarcasm will reign supreme in the following posts but that lawyer jeopardizes their law license now on each and every case for what? $80k per year? Ya, sorry, I'm calling BS.

This is really nothing new. Each party involved gets an attorney. The city, you, the other POs involved. There have always been separate attorneys assigned. And the form is to waive the conflict of interest in having the CC represent you while their office is also representing the city.

If not, you along with the help of legal counsel from FOP can sue city-corp, counsel for malpractice!!!!!!! Like others have said this is old news. This has always been the City policy. Separate interests = separate lawyers. Years ago I was part of a settlement agreement over a lawsuit where a partner was involved in misconduct. I being his partner was told I was equally accountable for his actions because I didn’t report said conduct. The City began extorting money from me not as punitive damages but as part of the settlement. I withstood my ground as long as I could as my CC continued to badger me into handing over money to avoid greater monetary damages. When I requested to speak with City lawyer and told him I don’t buy the BS they would not still settle the case without my contribution he looked me in the eye and said he’d do one better. He would settle on behalf of the City and let my case play out in front of a jury and “good luck paying the 6 figure punitive damage amount”. Ultimately I caved and paid the $1000 if only to avoid the added stress. But yes this is how the City operates and protects its interests.

I would also like to add something very dangerous going on. I was in court last week and a lawyer who represents the City and Officers I’m various lawsuits said that the States Attorney's office isn’t even contesting certificate of innocence from Not Guilty verdicts. So now, anyone who is found not guilty is suing and the States Attorneys office is helping by giving these people certificates. Not guilty , doesn’t mean innocent. The States Attrorney is very dangerous.

I know the officer personally from that incident in 16, and I know he is an honest man who would help anyone. That is why he tried to stop the thieves. I know he does not like being in the spotlight, and after the news coverage of this incident, and all the attention he got, and then the “COPA investigation” that kept him in limbo for 3 1/2 years, it caused him and his family a lot of stress. His family moved out of state 4 years ago and was waiting for him to retire in April and move out there with them. Unfortunately now, COPA has turned 6 lives upside down, because his retirement is on hold until all this is taken care of. If it took 3 1/2 yrs to decide on the suspension, how long is it going to take to fight it? Absolutely disgusting. He should have received a commendation, instead he’s made to look like a criminal. He could use all the support he can get right now from his brothers in blue.

In the 1980s, when I worked as an Assistant Corporation Counsel under Nicholas Trovato representing police officers exclusively, the ACCs who represented the City of Chicago occupied offices on a separate floor from us. We were forbidden from discussing the theories of our defense with the City's attorneys and vice-versa. We kept the confidences of our clients' as Mr. Trovato ran a tight ship when it came to conflicts of interests. We did not engage in the crap that is being suggested by so many commentators. If we did, we'd lose our jobs.

And, by the way, we took on the People's Law Office (PLO) and the Loevys' of that day, took cases to trial, and won most of them. When we settled, we did so for nuisance value or those that were dead-bang losers, thus saving our clients from possible punitive damage recoveries.

This is going on with CFD. They have this Petrillo doctrine. Any law suits against the city where our crews are witness’s they can not speak to them regarding the case. They send our people notices to appear, they are not subpoenas. Our medics are getting pissed off. We try to explain to the city that we have CBA’s to abide by. We provide them with dates to appear for our guys. Then they turn around and say we can use them on these dates. They are not giving subpoenas. Start requesting subpoenas by the city.

The city stuck it to the medics in the LeGeier case. Our medics hired their own attorneys.

Not a lawyer, Not CPD family is 4th generation CPD.
Here is a plan for SCC and FOP to push:
Effective immediately the city should not settle complaints against first responders.
All must go to trial. This will result in a huge reduction of frivolous complaints against city and first responders. The current backlog of for a civil lawsuit to go to trial is probably 8-10 years. Adding these cases to the backlog will increase it considerably. The community and their respective lawyers will not pursue the cases because they wont get the quick payoff. The cases will be heard in open court for the world to see vs fast settlements/quick payouts behind the curtain. An additional step would be to REDUCE staff and lawyers in Corp Counsels office. Fewer lawyers means less time available time for motions, depositions etc and also lengthens time to trial because all the necessary investigations cant be completed in a timely manner, If the community wishes to file suit- so be it, The Courthouse and Clerks office is on Dearborn, the line will stretch to Western Ave. The multi million dollar settlements for silence would stop immediately. No. All an umbrella policy does is increase the amount of financial coverage on the policy you have. If you policy doesn’t cover the claim or if it is a punitive damage your umbrella doesn’t cover it.

Van Dyke hasn’t filed an appeal yet These are a few paragraphs from an article after the Supreme Court ruling.

“She had the same concerns that we had, she’s just relieved,” Herbert said. “She wants this case over and I think probably everyone wants to move on from this case.”

Van Dyke filed a notice of his intent to appeal his convictions, but he only did so in response to the mandamus request and the possibility of a longer sentence.

A couple of hundred a month for the next couple of years does not mean much compared to a couple of thousand now to these people. However it is now (financialization) possible to sell structured settlements for lump sum cash. If a lawyer puts in the work to get a judgement against the city then adding a settlement against the individual is not much extra work. It is what it is. Getting a personal liability insurance policy will get another lawyer working your side. Adding a personal lawyer to an insurance lawyer to the union lawyer (if your union provides such) to the corporate provided one makes the payoff for the case much more problematic. Contingency lawyers want the most money for the least work. Judges want the least time spent per case. Walking in with a herd of lawyers against a single shylock gets a suit dropped in the sending letters phase a lot of times. A SWAT team is much more intimidating than a single guy with a badge.

Don't foot chase, don't car chase, dont stop anyone, and don't point your firearm. Don't do any ISR's for the ACLU. Arrest on signed complaints only,court sergeant to handle. Just answer your radio and go to your calls. Be safe and God Bless!
