Resentencing

Cops needed to show up in court:
  • The murderer of PO Brian Strouse 15806 (012th District; EOW 30 June 2001) was originally convicted of 1st Degree Murder of a Chicago Police Officer and sentenced to life without parole in 2003. Changes in the law due to the murderers age at the time of the offense bring him back to court to be re sentenced. The murderer is being re sentenced on 4 November 2019 at 1330 hrs 26th & California Room 504 before Judge Flood. I'm asking that a strong Police presence attend court that afternoon and support the family of PO Strouse showing the Judge that we WILL NEVER FORGET!
Let's get a decent showing today.

Why don’t they just open the prison doors and let them ALL out? Or is that the plan?

It's time like these that not only to remember the slain officer but also the result of the judiciary and their resolution of this offender regardless of age. Murders should be held accountable for their actions and the judiciary should ensure the integrity of the sentence.

So around 13 left. I know its unbelievable but I was there today and it fucking happened. My heart breaks for the Strouse family."

There was a good representation of our members at the hearing.
Thanks to all those that were able to attend.
Collectively, we were most impressed by Brian’s sister Kathy (CPD) who gave a very heartfelt, moving and sincere closing impact statement on behalf of her brother, Brian. You did your family proud.
To the Strouse family, on behalf of your CPD FAMILY, we hold true to our promise that we ‘Will Never Forget’ the service and sacrifice of ‘our’ brother, Brian.

Judge L. Flood sentenced the defendant Salgado to the maximum, allowed by law commensurate with the recent US & Illinois Supreme Court ruling as it relates to juveniles in accordance with the Eighth Amendment of the US Constitution to the maximum of...
Forty (40) years.

In closing, I leave with words of President Calvin Coolidge our (30th) President...
“No one is ever honored for what they receive.
Honor is the reward for what is given.”
Our brother Brian gave his ALL... the ultimate sacrifice.
May he Rest In Peace.

🌟CPD Brother (Ret)

The way the law works is because of a 2012 Supreme Court ruling in Miller V. Alabama. The “Justices” ruled that it is a violation of the 8th amendment to sentence a juvenile defendant to life without parole. They stated that 40 years is the MINIMUM an offender can serve. There are also extenuating circumstances. The Illinois State Supreme Court ruled that a day over 40 years would be equivalent to a “life” sentence. So 40 is the minimum federally, but 40 is the max in Illinois. His sentence is was changed due to the decision that all cases will be retroactive to this ruling. He will be released June 30th, 2041 (or within a day or two of that). This lies solely on the hands of the “Justices” of the Illinois Supreme Court. This will now be the norm for all juvenile defenders of murder. Including those of officers. So please be careful out there, the target that you wear is now bigger, and brighter than before. PJS

May God be with his family, including CPD officers. I lost a few in my tenure and it’s something that’s always with me. God helps us to keep our sanity in check, and i thank Him for that.

I live in a county of about 200,000. Our southern border is El Paso, Tx and several miles of Mexico. Today we experienced two separate officer involved shootings and both suspects were shot dead. One was a Border Patrol Officer checking a group of individuals for illegally entering the US. One suspect opened fire, the Border Patrol agent returned fire.

The other one was in the City of Las Cruces. Officers and US Marshall’s attempted a high risk arrest of a wanted, violent felon. He opened fire on officers and was killed by officers. That was about 5pm on Monday.

50 miles to the East, NM State Police pulled a speeder over for doing 106 mph in a 60 mile zone. When the officer went back to his vehicle, the suspect charged the officer with a knife, stabbing him until the officer shot him dead. This was yesterday about 6 am.

Thank God these officers were not killed. Our area seems to be getting more violent.

Guys and gals, I pray that we all go home to our families. Sadly your department leaders and city politicians are doing their best to disarm you. Whatever you do, never-ever let your guard down. Make sure you get to go home.

You guys are going to have to stick together and fight.

Anybody tell me if he was charged and tried as an adult?
Sounds like he was tried and sentenced as a juvenile. I retired in 2001, dealt with adults and juveniles in another agency.
If he had been charged and tried as an
adult, the judge could have increased the sentence.
Juvenile criminal statutes in Illinois were affected by Jane Adams, going back to the early part of the 20th century.

There is a provision where a juvenile could be sentenced as an adult. I don't remember what they were. Sorry about that.

God Bless and watch over his family.
Is there a go fund me site?

Judge flood did everything he could, giving the shirtbird the maximum he could. It’s just outrageous. He will still be in prison for awhile longer, thank you judge flood for keeping him in as long as you could, because we know a lot of other judges wouldn’t have done so. Most of his life will have been spent in prison, and let’s hope he gets gunned down at his welcome home party.

All I can say is it’s unbelievable. From the FOP KNOWING it was going to be this sentence, and NOT informing you, to the complete lack of news coverage. Thank you for those officers that did show, and those that have ALWAYS been there. What was heard most over those first few days was, we’ll never forget, we’ll always be here. Maybe those that didn’t show, The Top Commander, and any officials that claims they back the Police, should STOP saying that to the victims family. Aside from the repulsive words spoken by the public defenders, those are some of the lies that those who loved Brian will remember most. And THEY will NEVER forget that it was just lip service. If you wear a badge, and you’re not doing all you can to support a fallen officers family, with something other than words, then take the time to stop, and DO Something about that.

One big difference. Folks (law abiding citizens) in Oklahoma can legally own and carry firearms if they so choose. Plenty of them carry and not afraid to use them. In fact, Oklahoma just recently eased the carry laws.

Take it you are not CPD or familiar with serving a sentence. If 40 yrs is his sentence, with good behavior he will be out in 20 years at about 36

The great majority of inmates whose sentences were commuted in Oklahoma were low level drug users, mostly marijuana. With medical marijuana shops proliferating in the state and a recent change in Oklahoma's laws on marijuana by state question last election day, it didn't make sense to keep them in prison. They weren't pardoned; their sentences were commuted.

This sucks. Even if the truth in sentencing were applied he would have to serve 85% or 34 years and still be out at 50.
