How Do These Files Exist?

These files date back forty-eight years AND they were the subject of numerous Contractual Agreements that prescribed destruction seven years after they were closed, especially the ones that cleared officers:
  • A Cook County judge is giving the Chicago Police Department until the end of the year to turn over nearly five decades’ worth of previously unreleased files related to allegations of misconduct by officers.

    The order was issued Friday in a Freedom of Information Act lawsuit filed against the city by Charles Green, who served more than two decades in prison after being convicted in a quadruple murder on the West Side in the 198[0's]

    In 2015, six years after his release, Green filed a FOIA request with the city asking for copies of any and all closed complaint register files from 1967 to 2015. The request was made, Green’s attorney said, “in order to help him discover evidence of his innocence and to preserve and disseminate evidence of innocence to others wrongfully convicted.”
The number of officers that had contact with this guy can't number more than a dozen or two - tops. But now, thousands of retired cops (and many hundreds of deceased ones), not to mention three-quarters of the current force, are going to be fodder for a data-mining effort to smear reputations and legacies.

So what penalties is the FOP pushing for? The City has consistently and repeatedly violated the Contract - a Contract that carries the force of law because it was passed by the full City Council. What sanctions against the City does the membership have to look forward to? Surely there must be something on the table.

Records keepers at police department and city bureaucracies tend to be hoarders. They throw out NOTHING.

The FOP was asleep on this from the day one.

Ok, you come as the new bargaining agent and there are a lot of things to do. But it should have been a priority issue. It's too late now.

I talked to the FOP about this just recently. Rich Aguilar at FOP filed a grievance in 2011 about the non-destruction of files when an IAD investigator made a faux pas at an arbitration hearing and testified that she was ordered not to destroy any files. The grievance went to hearing and the arbitrator ruled in January 2016 that the Department was supposed to negotiate a destruction plan with FOP. Not too surprisingly Disability Dean’s crew did absolutely nothing about it. The matter is now being handled by the FOP labor attorneys. Next time you see Dean or any of his crew, give a big thank you. On second thought a FUCK YOU might be more appropriate.

FYI Ray Ray Casiano who was Dean’s 1st VP is now running for President and Kevin Kilmer who was the Grievance Chairman in 2016 is running for a Trustee spot in the upcoming FOP election. The two have got balls bigger than King Kong. If either one of these guys gets more than a couple of hundred votes all of you coppers are nuts!

It will only get worse with electronic records and cheap storage.

Going forward. Maybe add a requirement that the custodian of the records signs a statement under penalty of perjury every year that the records have been destroyed in accordance with the FOP contract and records retention policies, Things like "Penalty of Perjury" tend to make people sometimes actually do their job. It would be hard for the City to object, since the cost for the City is minimal.

Time to sue the city, and get this to the Supreme Court. And I don't mean the IL Supreme Court. I know this is a stretch but we are talking about a major city of this country. Labor Contracts were violated at will by the city for years. A pattern has been established by the city that can clearly be documented. Patterns and practice, sound familiar. Violated by the pols that tout labor as a priority, and yet screw all city unions and their members constantly, regardless of the profession.

My father retired 10 years before I was hired, I am now retired. I went to be cleared from an IOD. As I sat in the room waiting for the nurse I picked up what I believed was my file, all paper back then. I was dumb founded when I realized I was looking at my father's file, at this point he was retired better than 15 years. That was the day Dad's file was destroyed.

I’m going to look into finding an attorney or law firm that specializes in contract law that would be willing to represent us. Two things: If I can find one to represent, would everyone be on board with not only signing on, but committed to contributing to the costs the for law suit, it will get expensive fighting the city. Two: What repercussions do I/we face with FOP being our legal representation?

Another problem will be finding a firm/attorney not associated with the Chicago Democratic Swamp, but I’m willing to try. I’ll keep you all posted, I’ve just had enough of this BS.

The executive board of our FOP doesn't give two shits about the members, especially considering the fact they are giving a letter of recommendation to Senator Rob Martwick. Martwick is a John Arena buddy and cheered him on when her went after dozens of our members with false complaints. We can't even get the FOP to back our members when a 2 year investigation by COPA proved that these officers were unlawfully monitored. Why isn't Arena being held accountable for filing false complaints? Yea, we know Mark Donahue and his followers care more about their buddies in Springfield, more than our actual members. This legal stunt is not about subpoena and deposition of aged retired from the ‘70’s.
It does make for a quick restorative and social justice settlement when the City can’t locate actual 40 year old paper copies or microfiche likely are long gone when HQ moved out of 11th & State and still, ain’t nobody got time to do no search.
That’s the only reason this frivolous nonsense is being brought up and Groot and her nasty council caucus is going to gladly pay.

I think 10 dollars an allegation is a fair price to any officer whose rights were violated by the city for not following a lawful contract agreed on by the city council and mayor. And i mean each allegation since the IAD/COPA clowns seem to love adding shit to BEEFS.

I asked IAD records years ago why the files weren’t destroyed. Supposedly a federal judge ordered the files to be retained. As far as I know the order is still in effect.

the FOIA statute says if you don’t deny a request as unduly burdensome within 10 days of getting it, you waive the right to deny it as unduly burdensome and must give all the records. The judge made the right call. Her hands were tied. It was the CPD FOIA unit that made this problem.m

Isn’t the police union there to look after the best interests of its members? I keep hearing you all have been working without a new contract for a few years now. How can this be? Is the police union just another corrupt, insider slush-fund that makes people with connections rich and does little for its members (like most labor unions)? The first 50 pages for any FOIA request are free. After that it's 10 cents a page. Had FOIA figured out the expense to provide these records prior to letting the response time run out, the requester would of never paid the price. Since FOIA sat on this request and let it expire, the request needs to be provided for free as per FOIA law. Imagine how much paper will be needed to process this and at the tax payers expense.

Rich Aguilar at FOP filed a grievance in 2011 about the non-destruction of files when an IAD investigator made a faux pas at an arbitration hearing and testified that she was ordered not to destroy any files. The grievance went to hearing and the arbitrator ruled in January 2016 that the Department was supposed to negotiate a destruction plan with FOP. Not too surprisingly Disability Dean’s crew did absolutely nothing about it. The matter is now being handled by the FOP labor attorneys. Next time you see Dean or any of his crew, give a big thank you. On second thought a FUCK YOU might be more appropriate.

FYI Ray Ray Casiano who was Dean’s 1st VP is now running for President and Kevin Kilmer who was the Grievance Chairman in 2016 is running for a Trustee spot in the upcoming FOP election. The two have got balls bigger than King Kong. If either one of these guys gets more than a couple of hundred votes all of you coppers are nuts.


Grievance was settled in 2016 and Kevin Graham was elected in 2017 and brought retired Rich Aguilar into the office at 136,000 a year of dues money,the question is what did Aguilar And Graham do in the last three years to make sure the files were destroyed????

FOP has a contract in place to see these files destroyed, the FOP ought to show up EVERY YEAR and witness the destruction of said files. Hell, have the FOP contract with a shredding company, let that company bring a shredding truck to the location of the files, and witness the files being destroyed; save for any under a valid "legal hold" issued by a Judge. Mark those boxes, put them in a special location of the place marked as such with a copy of the Judge's Order. Take note of the date the Order expires, and schedule the truck to show up on THAT DAY, and toss that box into the shredder.

That takes care of the paper. For Digital Files, FOP needs to have a rep go up to the System Administrator/Database Administrators with a copy of the Contract and tell the Admins to DELETE those files, and scrub any/all backups. Watch them do it.

You know you can't trust the scheisters at the City, so you guys need to get it done yourselves. Stop bitching about this everytime it comes up, START DOING SOMETHING.

2020 is the 40th anniversary of the CFD strike.....and while this is not an option for us maybe we can take a lesson from their solidarity. My kid was lucky enough to get hired and I couldn’t believe all the perks they get over our recruits. Everything is provided for them including their turnout gear and full dress blues down to their shoes! What do our recruits pay out these days when they come on upwards of 7k? When they test for promotional exams 30% of their final score is based on seniority. Extra points based on years on the job which gives you a maximum number of points at about 9-10 years. I’m retired and know that we have never really come together in the past, but if there is anything that these kids hope to salvage of this once proud profession we need to organize and act. Police work as we knew it is dead, but these kids are patrolling the same beats we once did and their situation has to improve to deal with the madness of current politics and public resentment.

This should have been addressed in every level of the courts until the contract was honored. Certain people are touting their efforts to bring in the best and brightest attorneys. I'm seriously beginning to question that theory. 3 years they had to make this right. Almost as long to address the storage of bodycam footage past the 90day guidelines. They want you to believe they have great plans ahead and the will make a complete turnaround because they were on the 'rightside" of consent decree intervention. They couldn't stop that. They couldnt stopthis. I doubt they could stop a corpse from violating our contract. They have done practically ZERO but divide this Lodge further.

Before proceeding, one needs to know the following: (A) what documents/ information has ever been shared with other City/ State /Federal Agencies ? Do any of these agencies still have the documents? (B) what hard copy/ paper documents have been opticallly scanned and placed into digital format AND if this is accessible to any other agency? (C) is there off site/ back up/ disaster recovery storage of any documents// information?

Categorize as follows: CPD DEAD/ No cases pending: DESTROY. CPD RETIRED/ No cases pending: DESTROY. And so forth depending on status of any CPD AND whether information is currently pertinent or discoverable to any on going or pending criminal or civil cases

Little Danny Trevino's son got appointed to a judgeship opening by the democratic party. Now the kid has to run for the office to keep it. FOP endorsed Trevino's son for judge, but will not endorse a copper because Donahue takes his orders from Madigan? Dougherty has to protect his political appointment as a US Marshal. Mike Underwood, Ken Hauser, Sergio Escobedo, Carlos Salazar, and Frank Quinn all voted with Donahue because they are all on his ticket. Keep that democratic machine working for the select few.



Furthermore, Danny Trevino stood in front of the room talking about his dad being on the FOP board and coming from a "blue" family blah blah blah.
He went pale face when I informed him that he might want to not work that angle since his dad and friends didnt endorse Danny OToole.
We will be urging all voters in the 016th district tomorrow to ignore the boards ridiculous vote and vote for O'Toole.

Preib did the police a solid in calling out the media , especially the Sun Slimes, for their complicity in forwarding their anti-police agenda. It's no secret that money is being passed under the table by certain attorneys to certain media outlets ( Sun Times, Tribune, WBEZ, Reader) to slander and excoriate the police, so these self same attorneys can sue and bully the city into hefty settlements and or judgments.

Yep, this crew from FOP voted to endorse Martwick over Sgt. Danny Otoole. Donahue and Underwood we’re behind this fucked up move. Bottom line their endorsement of this POS Martwick over a Copper shot on a search warrant and a Marine is beyond belief. They took so much heat on this move that they removed Martwicks endorsement and decided to give Martwick and Otoole a letter saying they are both highly qualified. Any existing IA / COPA record that hasn't reached the 7 year threshold for destruction is perfectly responsive to FOIA, and that means if anyone, ANYONE, ANY citizen / journalist / blogger / activist / attorney submits a FOIA, those records will ALWAYS be out here. There is no law, for instance, that says bloggers and journalists have to destroy their copies of those records or that they ever have to be removed.

The same holds true for all case reports, arrest reports, and investigative files

The files are already out in cyberspace. Do a google search of your name and see what comes up if you ever had a complaint filed against you. The judge that allowed the release should be sued for violating our contract and allowing the violation to continue! Because he’s a madigan appointment doesn’t put him above the law.
