Motion Denied

  • The foot pursuit that culminated in the daylight slaying of Chicago police Cmdr. Paul Bauer began with a relatively minor infraction: Bauer’s accused killer was approached moments before the shooting for urinating in public, court hearings this week revealed.

    That was enough, though, to justify officers giving chase, a Cook County judge ruled Friday, setting the stage for [scumbag], 46, to stand trial for first-degree murder later this winter.

    In a series of recent hearings before Judge Erica Reddick, officers recounted the moments leading up to Bauer’s February 2018 death and [scumbag]’s arrest, including the initial approach by officers who noticed [scumbag] appearing to relieve himself on Lower Wacker Drive.

    [scumbag] took off running after police tried to stop him, sparking a downtown pursuit that Bauer ultimately joined. Bauer followed [scumbag] to a stairwell outside the Thompson Center, where [scumbag] allegedly shot the veteran officer six times.

    In an effort to block prosecutors from introducing the gun, drugs and body armor found on [scumbag] as evidence at the upcoming trial, his attorney, Scott Kamin, had argued that officers didn’t have legal justification to try to question [scumbag], let alone chase after him, for what amounted to an ordinance violation.

    But Reddick disagreed, finding that the officer was justified to try to question [scumbag] because he "reasonably believed he was urinating or about to urinate in a public setting.”

Good ruling. The stop should be legal even if the police just wanted to ask him if he liked the fit of the sneakers he wore, or where he got his haircut.

Has Chicago joined the devolution parade and made public urination a non-crime?

Judge Reddick is a very good, fair judge. She used to be a public defender and the only one I ever personally dealt with who had any integrity.

A few judges know their game, but overall most Cook County judges are the laughing stock of the US.

I gathered this from having had the opportunity to socialize with two separate state supreme court judges, one form a southern state and one from an east coast state. Really eye opening.

It's a good decision, but I am still concerned with the judge in this one. Reddick has a history of making some shitty rulings and going against us. I'd love to see this motherfucker hang for what he did, but one ruling isn't going to get us there. Watch this judge and this case closely. Don't be surprised if she changes her opinion or does something to agree with the defense no matter how dumb.

But that extra word is an important one. You have to be able to explain your reasonableness.
And you have to put that in writing (typing). That is tough for a lot of our people.

Don't take it personally. These are standard motions made before the actual trial. Challenge the arrest, challenge the evidence, and challenge the ID and the statements. It costs nothing and there may be some benefit.

At the time of this encounter tact and others were being assigned to lower Wacker bc of an unusually high number of robberies and shootings down there right where the pos was hanging out with everyone pulling mission numbers and event numbers.

(R) Reasonable (A) Articulable (S) Suspicion

All it means is that the A/O be able to document the probable cause for the stop/arrest. Unfortunately, many of these millennials cannot do that. Retired last year with 39 years on the job, spent the last 20 in the detective division and seeing the report writing in the last ten years, just glad I'm gone!

I understand what you are saying, but, when a P.O. is on scene, he or she may feel that they are being clear enough. We have all made that mistake. When reports were in paper, and you could read everyone's report , I think that was a big help, at least to me, when I was new. But we do not have that anymore.

Not that I’m defending millennials, but who approves these reports? I can’t tell you how many times after writing a
nicely articulated report I was told “why you wrote soo much”, “you give them too much information”, “who’s going to read all this”. Like me I don’t give a sh.. you read this. But new guys, they shit their pants, and guess what’s going to happened with the next report? They will cut corners cause they do t want to hear 2 year wonder seargant wining.
