Time Machine - 2003

Remember the last time the CPD followed orders that everyone thought were completely lawful?
  • America's eight-year war in Iraq officially ended in December. It took two additional months for the city of Chicago to end its legal battle with demonstrators arrested for protesting on the first day of the conflict.

    Actually, the litigation still isn't over. On February 8 the city agreed to pay $6.2 million to settle one lawsuit, Vodak v. City of Chicago, filed by more than 700 protesters. A related case involving another 16 demonstrators and bystanders, Beal v. City of Chicago, is expected to be settled soon for $2 million to $3 million.

    In addition, the city spent at least $3.8 million on outside legal help, records show. That brings the total cost of fighting these cases to roughly $12 million.
It was dicey for a while, but not a single officer paid punitive damages.

Does anyone really think that would be the case if it happened today?

Perhaps we missed it working the hours we do, but has Legal Affairs come out with any sort of bulletin about this order by the governor? There are procedures in place for emergencies, but we aren't sure those hurdles have been cleared in the legal sense of the word. Just because Groot and Fat-Ass say something doesn't negate the procedures and legal steps. There are deadlines and limitations and restrictions on what can and cannot be done and no one in the media seems to be asking any of these questions.

You know who asks these questions? Plaintiff lawyers. The ACLU. Federal Judges. And if they're asking, does anyone think that Groot will be sitting at the defense table with you?

OLA did come out with a Legal Bulletin regarding enforcing said Order. I find. It strange they have you enforcing an Order from the State by citing people with a violation of City Ordiances. Why not an ILCS charge?

i was there in 2003 and incompetent bosses chiefs and above ordered the arrest of people going home from work, an idiot could see these people were not demonstrators, then no boss admitted to this but they all retired and left everybody hanging. it was the stupidest thing i ever saw.

How long before there is a video of police actually bothering to try to enforce this illegal "order" and the media and civic groups side with the members of the public who (I believe rightfully) challenge the legality of this much infringement of basic liberties?

how long before the accusation is made that the enforcement of the order disproportionately targeted one group more than others?

and how long before little thing throws you to the wolves and drops the charges AFTER someone in uniform was dumb enough to bother?

Legit question here. When stopping a jogger, walker, cyclist, etc... Wouldn’t this require an ISR at the very least? We would be stopping (detainment) and taking away their freedom of movement, at the very least movement of where they want to get to. My understanding after going to Force Mitigation and Use of Force is this is a 4th Amendment issue.
So all you units out there taking part in the shut it down movement should get some clarification. Me, I plan to do one for every one of them I have to talk to. I work in the area most effected on the lakefront. The place where people would actually pay for these citations. I will spend my first couple of hours giving out verbal warnings and the next 6 after lunch doing ISRs on the John/Jane Doe “violators”.
Also, my message to each one is to “remember this come election time, you healthy people are a risk and the problem but travel on the CTA is not”. I get mostly good responses from each one of them.

If you approach a group of 10 or more and stand there until they move after giving them an order to move.....that's and ISR....Follow the ball.... You observe a crime taking place and you then perform an investigation to determine that an emergency is not taking place which would validate their need to congregate.

Total mess. The Democrats have created a disaster that the police cannot solve due to an ISR and BWC that double documents an officer violating the 1st Amendment to publicly assemble to worship Allah, the Devil, of Je_us Chri_t.

You can read the governor’s executive order online. It’s about 20 pages long and doesn’t lay out any enforcement policy or penalties whatsoever. Obviously they just blindly passed the order and left gaping holes in legal procedures to be filled up by the local municipality’s legal departments later (big mistake and blatantly unconstitutional). Officers...please don’t get sucked in by the governor and mayor’s power-trip, Don’t be a legal guinea pig either. History will not be kind to this unconstitutional executive order.

They asked the Sup about the legality of arresting people and he said something like, "there is a very big law that says stuff." never answered the question. It is not legal because there is no law making a gubernatorial proclamation binding. At some point they will try to pressure you into making an arrest and if you don't, I'm sure they will do bad things to you. Not the best of situations.

Officers do not make arrests for the undeclared Marshall Law. The stress put on you by the lawsuits will result in coronary failures and worse. The people who you will encounter cannot obey the law in the first place. Don't be that officer caught up in the legal switches and potentially give the lawless parasite class a huge payout. Society knows you are doing the right things, but the legal system is so corrupted by attorneys and judges alike who profit from civil disobedience. If you took all the civil litigation resulting from unlawful acts paid for by the taxpayers and its consequences out of the law game, we would once again have an orderly society. Judicial actions and encouragement to challenge an orderly society from "civil rights" minded lawyers ensure the public monies will be diverted into their profitable calculated legal schemes.

Lawyers, greed, social justice themes and lucrative taxpayer funded payouts are a tempting volatile cocktail which encourage anarchy, lawlessness and social unrest in society time and time again. Just remember the areas who voted in democrat candidates. Obviously these voters are not yet ready for the hope and change transformational stuff to keep their communities safe. I remember that night well. Had a gang team and we were on stand by all day. Listened over the City Wide and all the bosses were calling in crowd sizes all over the place. The context is that 1st Deputy JT had recently passed away and all the “bosses” were unsure of their upward mobility or sustainability, keeping their spot so no one wanted to make the call. Fast forward to the wee hours on Michigan Ave with thousands of people, some protesters and some legit. I was with my team about 15 feet away from these gold star clowns and they were like whirling dervishes, literally walking in circles, NOT wanting to make a decision. They literally were afraid to make a call fearing for their potential upward mobility. After a few hours of indecisiveness the call came out, and my team was designated an Arrest team and were ordered to start locking em up. What a fiasco. We did what we were ordered to do and guess what happened? Yep, the lawsuits, the depositions and you know what? Not one, not one boss who ordered us to initiate the arrests was there at the depositions. So let me tell you, DO NOT, DO NOT lock anyone up during this time or you not only will get sued but the city will leave you out to dry. Better yet, never get out of the car.....

What is the exact charge? And don't tell me reckless conduct, city or state. I would think most lawyers would make a case that unless you have been diagnosed with Covid you cannot be reckless to be out on the public way. And if I standing within 6 feet of my wife while taking a walk, what's that charge if we don't space ourselves out? Anyone know?

I see all these opinions from all you legal experts on what not to do with these "unconstitutional orders" So let's hear YOUR plan of action for when an officer is faced with the following situation.(Because it's happening)

A commander drives by a corner, sees 20 dudes hanging out, tells sgt to get a car to give a new "covid dispersal" Sgt calls you over to do it. Now although I disagree with giving the "order", there's really not any damages or individuals restricted, so just grab your event number & move on, some gray area but not thinking much lawsuit chances. Now what happens when that same commander drives by later, sees the same crowd, calls the sgt to get you back there to fine, possibly arrest any/all of the crowd for "violating" the order you gave them earlier? We all understand that the gov/mayor/commander will probably not be sitting at the defense table with you, but How do you online scholars propose the officer proceeds? Are you suggesting the officer tells a commander "No, I refuse to cite/arrest them because I believe the order is unconstitutional" Do we officers have attorneys standing by (like the people we arrest surely will) when we are taken off the street, stripped, possibly/probably fired for "refusing a direct order" however unlawful "WE" believe that order to be? People can wait years of court trials to be paid (or not) for police actions. What are WE supposed to do in the mean time if we refuse direct orders and get stripped for it, while waiting to see how the constitutionality of all this plays out. Seems like you're screwed (later) if you arrest and screwed (now) if you don't. Can some attorneys share their info or get in contact with officers so if I HAVE to refuse an order at least we have a viable threat, with an attorney, of a lawsuit against any boss that orders you to arrest. I hope the bosses are smart enough not to put ANY of us in this situation, but as we can all attest, the best & brightest are NOT usually bosses in CPD.

If it comes down to it Ladies and Gentlemen...

Stick to the Title 8 ordinance. Write the Ticket and tell them to get the F out of the Park.

Do your Best to avoid a "Refused Lawful Order Arrest" and just write That Ticket.

Then help them into the squad and drive them gently to the entrance/exit of the park.

Admonish them with kind words, since the BWC will no doubt be on, and extoll them to avoid the park district propteries until at least May 1st @ 6am or else they are at risk for more ticketing and court dates at such time as the Covid19 pandemic is past.


Or just stay in your squad and watch netflix.


Which ever works best for you all.

There might be protection under federal laws and courts - but this is strictly Cook County where law firms jump over each other for uncontested settlements....and with settlements, there’s donors. We got this frivolity thing and it’s f-cking golden.

He is a fool and way over his capabilities. Saying goofy stuff is for the fear mongering media and in line with what Fatso and Little Boy are selling. Fear works on the dumb and illiterate. Use your head, common sense and approved procedures. Yes human nature being what it is we tend to congregate once we put down the iphones and such. The tough talk compared to the straight talk by Cuomo is striking. Although Cuomo is starting to get whinny again. At least he's not selling fear.

Chicago Pols and media mongrels want to "lock it down" for China Virus but not a word about 30 killings per month city-wide. That's just routine business in Chicago.

How long before there is a video of police actually bothering to try to enforce this illegal "order" and the media and civic groups side with the members of the public who (I believe rightfully) challenge the legality of this much infringement of basic liberties?

how long before the accusation is made that the enforcement of the order disproportionately targeted one group more than others?

and how long before little thing throws you to the wolves and drops the charges AFTER someone in uniform was dumb enough to bother?

Like yesterday’s Chicago Fibune’s subliminal front page photo of all the lawless White folks not practicing social distancing by bike riding, walking, dog walking sitting together on a bench across the 606 trail. Then you continue to story inside-oh, there’s a police officer questioning a black male in Lincoln Park while other people (whites in particular) go about their business...

It bears mention that an attorney friend of ours refers to the mayor as "Larry Leftfoot".
We respectfully submit that SCC consider adopting this nomenclature.
This friend also had face-to-face dealings with the current governor, but I'm afraid that the manners my grandmother ingrained in me will not let me repeat his terms associated with JB.

That whole mess was single handedly caused by Mauer and his huge ego. He turned that into a mess and was wrong all the way in how he handled that. Worst boss ever who fooled way too many people into believing he was great. Just a juiced up clout baby who was never the real police, just told good stories and always had good spots .

They asked the Sup about the legality of arresting people and he said something like, "there is a very big law that says stuff." never answered the question. It is not legal because there is no law making a gubernatorial proclamation binding. At some point they will try to pressure you into making an arrest and if you don't, I'm sure they will do bad things to you. Not the best of situations.

Actually he brought up two sections of the reckless conduct law this would fit under. You obviously did not watch the press conference Thursday. During that same Q and A an asshole female white reporter asked about police/public relations already being bad and how this “harassment” could do more harm. He actually did a good job of sternly correcting her. He explained officers enforcing the law is not harassment dispute certain groups and her thinking so.

OLA did come out with a Legal Bulletin regarding enforcing said Order. I find. It strange they have you enforcing an Order from the State by citing people with a violation of City Ordiances. Why not an ILCS charge?

commander drives by a corner, sees 20 dudes hanging out, tells sgt to get a car to give a new "covid dispersal" Sgt calls you over to do it. Now although I disagree with giving the "order", there's really not any damages or individuals restricted, so just grab your event number & move on, some gray area but not thinking much lawsuit chances. Now what happens when that same commander drives by later, sees the same crowd, calls the sgt to get you back there to fine, possibly arrest any/all of the crowd for "violating" the order you gave them earlier? We all understand that the gov/mayor/commander will probably not
