Good Read

David J. Robinson is the Chief Deputy Director at the State's Attorneys Appellate Prosecutor's Office in Springfield, Illinois, and he currently serves as the Deputy Director of the Fourth District office. In layman's terms, it means he's not just a lawyer, but a very smart lawyer.

He recently authored a memo that calls into question numerous portions of Putzker's Executive Orders. We're having issues with some of our remote document hosting applications, but here's a direct link to the memo. It runs about four pages, and it brings up many of the issues discussed here and elsewhere.

If you want to be a smarter cop and not rushed into dumb decisions by "merit" hacks who don't know their jobs or the law, read it and understand the nature of the "orders" you're being told to enforce. The foundation is built on quicksand and cops are the ones who are going to drown in it.

OT: is it me or is it insane that we aren’t requiring healthcare workers to have a negative test before returning to work after testing positive. It seems if all the cumbersome and asinine things in all these Pandemic orders that essential workers testing positive would be required to have not one but perhaps two negative tests before returning to work? I remember seeing stories on cruise ship passengers who were still testing positive after two months from first test. They claim this thing is dangerous enough to literally destroy our economy, but then we are sending essential workers back into the workplace without requiring them to test negative. I know it’s true of the CPD medical section.

Anyone enforcing any orders from these merit hacks after reading this deserves everything coming to them in a lawsuit. However you'll still have these two year wonders with their tight jeans, sunglasses, leather gloves and baseball caps turned backwards enforcing these BullShit orders. It's a good memo that clearly states that Fredo's original EO was unconstitutional, and the extending of the EO could not be done because it exceeded the original 30-day window for any EO. It's too bad that he can't get over declaring that the crux of the EO is good and worthy, because those are the very things that are in themselves unconstitutional.

Being a merit hack or not, does not mean you are smart about constitutional law. If these gold stars have not received any legal guidance from the city, then both the gold stars and the city should take the blame. The exempts should demand a legal opinion and the city and Illinois Attorney General should provide it. In my opinion, the lack of any written legal guidance and the very vague language of these " order" and "directives", tells me that the mayor and Governor know what they are doing is a house of cards on a bed of sand. Only the legislative body can write laws and pass them into existence with the signature of the executive branch. The executive branch cannot make up laws on its own, which is what seems to be happening. Any emergency powers acts/laws seem to have passed. Arresting people for congregating, not wearing a mask or walking on the public way, to include parks during normal business hours seems to be an overreach and unconstitutional.

If you took the time to read the memo it says in a nut shell that any problems with enforcing their SUGGESTIONS fall on the person interpreting those suggestions. Simply put that means when the law suit is filed and make no mistake many will be filed the arresting officers name will be the primary defendant. The Governor and Mayor will say him not me, he misunderstood my SUGGESTION and took matters into his own hands. Your reply will be I was ordered to that. Next question will be show me the written orders, oh you don’t have any too bad. Guilty, need an assets inventory ASAP. But honey I was just following my merit hacks orders. No nothing happened to them just us guys on patrol.

Much ado about nothing; standard procedure for attorneys to wargame arguments in the event they have to fight about something in court. Also of interest are: 1) "A cursory review of the EO (and extension) reveal clear - although potentially justified - infringements on the constitutional rights of Illinois citizens." So even this attorney realized right away all this may be legal. Point 2) "Church v. City of Greenville, 4:20-CV-64}" is an out-of-Federal-Court-District case, and in no way binding the 7th Circuit, who may see things totally differently, and 3) Citing the IEMA provisions which clearly spell out the Governor's powers leaves no doubt as to the authority of the Governor to act on his own (there being NO language requiring him to consult the Legislature, or allowing the Legislature to override the Governor, for that matter). This continued propaganda that nobody has authority to tell people what to do or when to do it, or why to do it, is ridiculous. It has happened in other pandemics, it happens in wartime, and it happens every day in the real world.

The IL plan is falling apart because many are ignoring this communist lockdown. Slobernor Pugs knows this and now is adamant about finding and raiding house parties. Unit Competition Quotas are back baby!

Wisconsin legislature took their Governor (govenor in 011) Tony Evers (D) state closure to their conservative Supreme Court. They want people to be allowed to get haircuts and allow kids to return to school. Evers ordered state closure included utilizing his liberal Dept of Health Director as the decider, both whom are not allowed such power. His “order” is open ended much like ours in that it’s open ended with no plan or date of expiration.

JB FullSlab wants the courts cooperation and likely they must comply.
We don’t expect Kwanmie or the Democrat legislative to circumvent JB Hoghead’s and doctor Ezekie’s communist powers.
Anyone notice how quiet IL AG Kwanmie has been, even quieter is the loyal Madigan’s Majority.

Courtrooms are closed right now, for many reasons besides the Covid’s.
How many politicians cases are due up this summer?
Even the delay of the Juicie Swollsette case will keep KmmFxxx2020 out of the news.

When these lockdown raids are ordered, find something else to do.
Once they open the courts first up may be the civil rights violations.

Just read the whole memo. Long story short, you can ask citizens nicely to comply and recommend that they adhere to gov Fats "order", but you cannot enforce one iota of this "order" as it does not hold any legitimate constitutional basis. Fats was very careful to put the responsibility of enforcement on the shoulders of the police as he stated it is "up to local law enforcement" as to the manner in which his orders will be enforced. Chief Deputy Robinson emphasizes the fact that Fats has not taken any real position on the enforcement of his own order; obviously he understands the legal ramifications and political backlash. If your supervisor is too clueless to understand this, then take the spar or suspension and see them in court. Do not allow yourself to be ordered into breaking your own constitutional oath.

It appears what he is saying is much of the executive order relies on voluntary compliance with an implied threat cops will enforce it without actually ordering it. Having read the original order i kind of got that impression.

I also think the 30 days is past, and he has no authority to extend it.

We cannot and must not enforce unconstitutional orders. "I was ordered to..." has never in recent history been a valid defense. History will look at us harshly. Be on the right side of it.

Bailey filed a lawsuit as a citizen challenging the governor issuing rolling executive orders that the governor has said is meant to slow the spread of the novel coronavirus. The order keeps certain businesses closed and limits individuals' travels outside of their homes.

While a ruling in favor of Bailey would only impact Bailey, DeVore said it could send a signal to others.

The lawsuit is scheduled for a hearing on Monday, April 27 at 1:30 P.M. in the Clay County Circuit Court.

The Memo references a "volume of requests from individual State's Attorneys" regarding the viability of enforcement and potential civil liability. Pay attention - Elected State's Attorneys throughout Illinois are concerned about whether Pritzger's stay ay home orders are constitutional or enforceable. The Memo clearly outlines the answers to both questions as being no and no. If you issue dispersal directives or citations, or make an arrest stemming from trying to enforce Pritzger's illegal stay at home orders, you will be opening yourself up to a lawsuit. Don't do it. Stay safe.

Nurses are suing NY & the hospitals for the lack of protective gear.
Years ago there was a great connect between nurses and the police. Somewhere that connect
diminished at the Chicago emergency rooms. No doubt nurses are taking a hit at the moment, I commend you all. After this nightmare settles, I hope the nurses will once again support the police as they are always in the line of fire, short staffed & lacking proper equipment.

While I had made up my mind from the onset of all this overreach that I will NOT do what some law enforcement officers appear to be doing across the country (embarrassing, sad, and ILLEGAL), I am grateful for the wording and grounds on which to state my case for REFUSING to carry out stupid orders.
We swore to uphold laws and enforce laws, for the protection of life and property... we are not "order" enforcers.

A southern Illinois judge delivered a setback to Democratic Gov. J.B. Pritzker on Monday, issuing a temporary injunction allowing Republican state Rep. Darren Bailey to ignore the governor’s stay-at-home order.

The ruling by Clay County Circuit Court Judge Michael McHaney came in a lawsuit filed by Bailey, a Republican from the small town of Xenia, which challenged Pritzker’s authority to issue extended stay-at-home orders under the state’s Emergency Management Act.

In seeking the injunction April 23, Bailey asked the judge to find that the lawmaker was “irreparably harmed each day he is subjected to” Pritzker’s executive order and to enjoin the governor or anyone under his authority “from enforcing the March 20 executive order against Bailey from this date forward.”

I get it. This is a unique situation. We haven't experienced anything like this since the days of the plague, but that doesn't mean you should be on the hook for their bad decisions.

That would mean hospitals would be more understaffed than they already are and one doctor/nurse for many more patients on ventilators= death. If you're ok with a bump in the mortality rate by all means test all medical professionals (if you can find and afford that many tests) and take them out of rotation "until they test negative twice." Vents can probably run themselves. Do the same for the meatpacking industry and you won't see protein on the shelves for months.

Fed and state executives have been doing this for years by enforcing only the laws they want to enforce. See Cook County's state attorney as an example. Now they're just doing it more brazenly.

The city is on the hook for hundreds of millions for false convictions that are in the works. I know the wisdom in cop circles is all these false convictions are so much bunk, but the funds will still have to be paid. It will be decades before anything happening today will be adjudicated.

Being merit does not make you dumb, it just makes you undeserving and selfish for bumping to the head of the line base on clout. I have known merit promotees who actually were qualified and intelligent, but that is not the point. The system is unfair and corrupt. But, I would bet that within one year it will be back under a different form .

You are ignorant. States cannot file for bankruptcy absent the consent of the US Senate and that will not happen. They have the ability to raise taxes and cut expenses. And, the government cannot confiscate your investments, and that included deferred compensation. It is not their money. What will hurt your investments is a world wide depression which will crash the market and then hasten the city bankruptcy and the end of the pensions.

Just a guess that a sizable this donated food was packaged for commercial use/sale,
to restaurants, hotels,schools, mobile food vendors, etc. And could not be sold by retail due to packing, labeling, etc. so this is way for these businesses and or food distributors to "write off " the loss for a good cause, rather than throwing it away and writing it off that that way.

Probably alot of commercially package food around that needs somebody to eat it before it expires and then it cannot usually even be given away.

Sorry, but when you see police arresting a surfer who's alone in the water or a mother being arrested in a park with her kids or a father playing softball with his daughter in a near vacant park...I'm supposed to expect the police to use good judgement? JB Swine is a dope. The laws are written for a reason and he thinks he knows best. I look at how police are reacting in Chicago. Sorry, but your reply is wrong. I'm retired, an Army Veteran also, and it's sad to see what's happening in the USA.
