OPS Stands Alone

  • Mayor Richard Daley today announced plans for a "total restructuring" of the office that investigates police officers, removing it from control of the Chicago Police Department.

    The office would report directly to the mayor and have subpoena power, something the current office does not have, Daley said.
We have a question about this proposal. And it pains us to have to ask it because it will most likely have to be answered by a lawyer - and as a matter of policy, we greatly dislike lawyers and have advocated that they be drowned at birth. Failing that, we recommend drowning upon graduation. Anyway here it goes:
  • If this "new" entity has subpoena powers, at what point do 5th Amendment protections kick in?
Under current Department rules, you can be ordered to answer questions. Being ordered to answer will subject you to administrative discipline, but what you say supposedly cannot be used against you criminally. Being subject to subpoena would seem to negate Department discipline being a factor and even the Department rule compelling you to answer.

Any lawyers not currently learning to breathe underwater care to answer?

Uh oh looks like the area ranges are going to close soon. guys are bailing out of that unit. Or they make the drunk range guys sgt.'s The city is going to install a computer game in each station to simmulate range practice. Just like a playstation game.

I would imagine they will use subpoena power to bring forth witnesses who would normally be uncooperative.

As far as compelling testimony goes. . . one would be entitled to assert a 5th Amendment right against self-incrimination if it is reasonable to believe such testimony can or may be used against in criminal proceedings against that person (ie. testifying before the Grand Jury).

The bottom line is this. . . if you are ever administratively forced to give any sort of statement, that statement cannot be used against you in criminal proceedings. It is similar to a copper being ordered to blow administratively in a DUI. While the results will most certainly be used against him or her in Departmental administrative proceedings, they cannot be admitted as evidence in any criminal proceedings.

The City cannot make any changes in the discplinary process without the approval of the Lodge through collective bargaining.
They have tried in the past and the Lodge has requested arbitration and the arbitrator has always ruled in the Lodge's favor.
I can remember two instances when the City lost big time in efforts to modify the process.
We hold the upper hand.

This is a total load. There's a lot of things that need to change in this city, but OPS is not one of them. Why don't they start looking into why there are so many administrative errors in hiring, contracts, and finance in this city government? What about the officer who was falsely accused by a female citizen for sexual harassment on a traffic stop and had the tape which recorded her saying "if you take me in, I'll say you touched me". She slandered the officer and when they found out she was lying the department refused to press charges against her even though she signed the affidavit, perjuring herself! This whole thing is nauseating.

Damn right. This city doesn't care about the thugs or the few police who try to stop them. As long as the yuppies and gentrified are safe in thier part of town.
